Legal No. 17311 LEGAL NOTICE: USDA - Forest Service Scoping Notice / Opportuni- ty to Comment and Notice of Intent to Sign a Decision Memo for a Cat- egorical Exclusion. The Arizona Game and Fish Department (AZG&FD) has requested permis- sion to construct 260 yards of new fence to create a 10 - acre holding area at the Hose Rock Wildlife Area (HRWA) headquarters. The North Kaibab Ranger District (NKRD) of the Kaibab National Forest (KNF) in working with the AZG&FD, agrees that these improvements are nec- essary as part of the operations and management associated with man- agement of the buffalo ranch / HRWA headquarters. The existing facilities / buffalo ranch and new fenceline are located on the NKRD within Geographic Area number 16, within Coconino County, Arizona; a general legal description of the lo- cation of the new fenceline is as fol- lows: [SW1/4 of Section 34, T. 36 N., R. 4 E., of the Gila & Salt River Baseline & Meridian.] A preliminary assessment of the proposed action (i.e., construction of a new fenceline to create 10 acres of additional holding area) indicates that it is cat- egorically excluded from further analysis and documentation in an environmental impact statement (EIS) or an environmental assess- ment (EA), in that there are no ex- traordinary circumstances related to the proposed action. The categori- cal exclusion (CE) is listed per 36 CFR 220.6(e)(15) and FSH 1909.15 - 32.2(15) as follows: "The issuance of a new Special Use Authorization (SUA) for a new term to replace an existing or expired SUA when the only changes are administrative, and there are not changes to the authorized facilities or increases in the scope or intensity of authorized activities, and the applicant or hold- er is in full compliance with the terms and conditions of the SUA." This category of action is applicable because the activity will amend an existing special use permit (NKR1011, 215 Pasture); this is the second amendment to the 1951 SUP. The original SUA or Special Use Permit (SUP) between the KNF and Arizona Game and Fish Com- mission was signed on July 30, 1951. The original 1951 SUP cov- ers 655 acres and includes the ex- isting 15 acre buffalo holding corral within Section 34, T. 36 N., R. 4 E. Amendment number 1 (dated Octo- ber 25, 2000) to the 1951 SUP cov- ered four additional acres and vari- ous land improvements, such as a barn and tack building, water tanks, and various out buildings. This sec- ond amendment will add a 10-acre fenced corral within the SW ¼ of Section 34, directly adjacent to the original 15 acre corral. This im- provement is necessary to help manage buffalo (up to 100 head) as a temporary holding corral/facility. The proposed action has been eval- uated internally by a team of re- source specialists, and the review identified no extraordinary circum- stances that would preclude use of the CE. Additional information of activities covered under the CE can be obtained from, and/or comments (written or oral) can be submitted to: Angela Gatto, Wildlife Biologist, USDA Forest Service - Kaibab Na- tional Forest, P.O. Box 248 / 430 S. Main Street, Fredonia, AZ 86022; or via email to [email protected]. Or a copy of the proposed action is also available for review at the KNF website: [ http://fs.usda.gov/goto/kaibab/proje cts ]. In light of a recent court ruling (Sequoia ForestKeeper v. Tidwell, 11-cv-00679-LJO-DLB (E.D. Cal.)), the Forest Service is providing pub- lic notice, comment, and opportuni- ty for administrative appeal for proj- ects and activities documented with a "Decision Memo" (36 CFR 220.6(e)) until new instructions are issued by the Washington Office, or the Agency issues regulations ad- dressing the Court’s ruling. With this notice we are combining our scoping effort required by 36 CFR 220.4(e)(1) and the Notice and Comment requirement required by 36 CFR 215. The purpose of this comment period is to allow the pub- lic early and meaningful participa- tion on a proposed action imple- menting the land and resource management plan prior to a deci- sion being made by the Responsi- ble Official. The comment period ends 30 days following the date of publication of this legal notice in the Flagstaff, Arizona - Arizona Daily Sun. This publication date is the ex- clusive means for calculating the time to submit comments on the proposed action. Those wishing to comment on this proposal should not rely upon dates or timeframes provided by any other source. Since the proposed project is covered un- der the application of an existing CE and requires a DM, the project is currently subject to appeal proce- dures set out in 36 CFR 215. The District Ranger for the North Kaibab Ranger District will be the Respon- sible Official authorizing the deci- sion. Only those who provide com- ment or otherwise express interest in the proposed action during the comment period will be eligible as appellants. Interest expressed or comments provided on this project prior to or after the close of this comment period will not constitute standing for appeal purposes. To be eligible for appeal, each individu- al or representative from each or- ganization submitting substantive comments must either sign the comments or verify identity upon re- quest. Comments must meet the re- quirements of 36 CFR 215.6. Com- ments may be submitted by email in word (.doc), rich text format (.rtf), text (.txt), and hypertext markup language (.html) to [ comments- southwestern-kaibab-north- [email protected] ]. Please include "AZG&FD SUP Amendment No. 2; House Rock - Fenceline Construc- tion CE" in the subject line of corre- spondence sent as a comment. Comments may also be hand deliv- ered weekdays 8:00 am - 4:30 pm at the above stated address. All comments received and the names and addresses of those who com- ment will be placed in the project file and become a matter of public record. The U.S. Department of Ag- riculture is an equal opportunity pro- vider and employer. PUB: Sept, 21, 2013 17311 Legal No. 17309 Legal Notice: Opportunity to Object the Final Environmental Assess- ment, Finding of No Significant Im- pact (FONSI), and Draft Decision Notice (DN) for the Kane Ranch Al- lotment Management Plan. Randall Walker (District Ranger) of the Kai- bab National Forest (KNF), North Kaibab Ranger District (NKRD), has prepared a final environmental as- sessment (EA), a finding of no sig- nificant impact (FONSI) and draft Decision Notice (DN) for the Kane Ranch Allotment Management Plan. Under the DN to this allotment management plan, the USDA For- est Service, KNF - NKRD will re- authorizing cattle grazing on the Central Winter, Central Summer, and Kane Allotments. These three allotments are commonly referred to as the Kane Ranch Allotments. A fourth allotment called the Kanab Creek Allotment would remain closed to livestock grazing. The purpose of this project is to re- authorize cattle grazing on the Kane Ranch Allotments in a man- ner that is consistent with the goals, objectives, standards and guide- lines of the Forest Plan (1988), as amended, as well as provide logi- cal, flexible, and adaptive grazing rotations. The Kane Ranch Allotments cover approximately 435,000 Forest Service acres, lo- cated in Coconino County, Arizona. The legal description of the allotments includes all or the majori- ty of the sections within the follow- ing townships of the Gila and Salt River Baseline and Meridian: Town- ship 34 North, Range 1 East to 4 East, Township 35 North, Range 2 West to 3 East, Township 36 North, Range 3 West to 4 East, Township 37 North, Range 3 West to 4 East, Township 38 North, Range 3 West to 3 East, and Township 39 North, Range 2 East to 3 East. The Final EA, FONSI and Draft DN for the Kane Ranch Allotment Manage- ment Plan are available on-line at: http://www.fs.usda.gov/projects/kaib ab/landmanagement/projects. These documents are also availa- ble for review at the KNF - NKRD office, 430 S. Main Street, Fredonia, Arizona, 86022. For addi- tional information you may contact: David Vincelette / NEPA Planner, Phone: (928) 643-8143; e-mail ad- dress: [email protected]. The Kane Ranch Allotment Manage- ment Plan is an activity implement- ing a land management plan and not authorized under the Health Forest Restoration Act of 2003 and is subject to 36 CFR 218 Subparts A and B. Legal No. 17311LEGAL NOTICE: USDA - ForestService Scoping Notice / Opportuni-ty to Comment and Notice of Intentto Sign a Decision Memo for a Cat-egorical Exclusion. The ArizonaGame and Fish Department(AZG&FD) has requested permis-sion to construct 260 yards of newfence to create a 10 - acre holdingarea at the Hose Rock Wildlife Area(HRWA) headquarters. The NorthKaibab Ranger District (NKRD) ofthe Kaibab National Forest (KNF) inworking with the AZG&FD, agreesthat these improvements are nec-essary as part of the operations andmanagement associated with man-agement of the buffalo ranch /HRWA headquarters. The existingfacilities / buffalo ranch and newfenceline are located on the NKRDwithin Geographic Area number 16,within Coconino County, Arizona; ageneral legal description of the lo-cation of the new fenceline is as fol-lows: [SW1/4 of Section 34, T. 36N., R. 4 E., of the Gila & Salt RiverBaseline & Meridian.] A preliminaryassessment of the proposed action(i.e., construction of a new fencelineto create 10 acres of additionalholding area) indicates that it is cat-egorically excluded from furtheranalysis and documentation in anenvironmental impact statement(EIS) or an environmental assess-ment (EA), in that there are no ex-traordinary circumstances related tothe proposed action. The categori-cal exclusion (CE) is listed per 36CFR 220.6(e)(15) and FSH 1909.15- 32.2(15) as follows: "The issuanceof a new Special Use Authorization(SUA) for a new term to replace anexisting or expired SUA when theonly changes are administrative, and there are not changes to theauthorized facilities or increases inthe scope or intensity of authorizedactivities, and the applicant or hold-er is in full compliance with theterms and conditions of the SUA."This category of action is applicablebecause the activity will amend anexisting special use permit(NKR1011, 215 Pasture); this is thesecond amendment to the 1951SUP. The original SUA or SpecialUse Permit (SUP) between the KNFand Arizona Game and Fish Com-mission was signed on July 30,1951. The original 1951 SUP cov-ers 655 acres and includes the ex-isting 15 acre buffalo holding corralwithin Section 34, T. 36 N., R. 4 E.Amendment number 1 (dated Octo-ber 25, 2000) to the 1951 SUP cov-ered four additional acres and vari-ous land improvements, such as abarn and tack building, water tanks, and various out buildings. This sec-ond amendment will add a 10-acrefenced corral within the SW ¼ ofSection 34, directly adjacent to theoriginal 15 acre corral. This im-provement is necessary to helpmanage buffalo (up to 100 head) asa temporary holding corral/facility.The proposed action has been eval-uated internally by a team of re-source specialists, and the reviewidentified no extraordinary circum-stances that would preclude use ofthe CE.
