Safety - WSDOT installation of a median on Fourth Plain - Several City intersections failing concurrency standards

Block Sizes and Perimeters

- Exceedance of the 800’ block length and 3200’ block perimeter standards for urban circulation

Cross Circulation The DKS study commissioned by Clark County does not show that the future Kerr Road alternative route would relieve pressure from NE Fourth Plain Boulevard. The letter levels of service do not change between the 2035 No-Build and 2035 Build (Kerr Road Extension) scenarios for the A.M. peak hour as shown in Table 1. In fact, to discern any difference in levels of service, the v/c ratio needs to be compared. Of the four NE Fourth Plain Boulevard intersections studied, one intersection (NE Fourth Plain Boulevard.NE 117th Avenue/SR 500) has the same v/c ratio. Two intersections (NE Fourth Plain Boulevard/NE 121st Avenue and NE Fourth Plain Boulevard/NE 131st Avenue) show slight improvement in the v/c ratios. One intersection (NE Fourth Plain Boulevard/NE 137th Avenue) shows a slight decline in the v/c ratio. These results do not show that the Kerr Road extension would relieve pressure along NE Fourth Plain Boulevard. The P.M peak hour DKS analysis more strongly supports the conclusion that the Kerr Road extension would not relieve pressure along NE Fourth Plain Boulevard. Of the four NE Fourth Plain Boulevard intersections studied, all of the intersections worsen slightly with the assumption that Kerr Road is built. Safety The safety issue referred to was specifically at the NE Fourth Plain Boulevard/NE 124th Avenue intersection. WSDOT installed a median to restrict movements to right in, right out at this intersection. To mitigate the restrictions at the NE Fourth Plain Boulevard/NE 124th Avenue intersection, WSDOT bought right-of-way to extend NE 65th Street eastward to NE 124th Avenue. This future connection allows any properties fronting NE 124th Avenue to have future signalized access to the NE Fourth Plain Boulevard/NE 121st Avenue and NE 117th Avenue (SR 503)/NE 65th Street signals. These WSDOT improvements solved a specific safety problem and were standalone. This WSDOT action was not reliant on any action by the City of Vancouver or Clark County. The issue that several City of Vancouver intersections are currently failing concurrency standards along the NE Fourth Plain Boulevard corridor is an odd finding because Clark County is not responsible for City of Vancouver intersections and the two jurisdictions do not have any interlocal agreement allowing Clark County to plan for the City of Vancouver along its NE Fourth Plain Boulevard corridor. It is not Clark County’s responsibility to mitigate concurrency problems for the City of Vancouver. Also, this finding is not entirely accurate because the City

For corridors that are built to their ultimate capacity for through movements, such as the NE Fourth Plain Boulevard corridor, the City of Vancouver evaluates those corridors against the level of service standard in their adopted Corridor Management Plan. The adopted corridor LOS is based on the average P.M. peak hour speed set for the corridor which is 10 mph for the NE Fourth Plain Boulevard corridor. In 2010-2011, the measured average P.M. peak hour speed was 21 mph for NE Fourth Plain Boulevard between I-205 and NE 162nd Avenue. With the actual average P.M. peak hour corridor speed well above the adopted standard, the corridor LOS is met and no mitigation is being required of development projects having traffic impacts along the corridor. A review of the 2017-2022 City of Vancouver Transportation Improvement Program (TIP), June 2016 revealed that the City of Vancouver does not have any transportation improvement projects identified along the NE Fourth Plain Boulevard corridor study area. This corroborates that the City of Vancouver has accepted that the NE Fourth Plain Boulevard is built to its ultimate capacity and that the adopted Corridor Management Plan regulates the concurrency requirements. Block Sizes and Perimeters The block size and perimeter justification for the extension of Kerr Road is not relevant for a variety of reasons. First, the Arterial Atlas is considered part of Clark County’s Comprehensive Plan and the intent is not to plan for local streets but arterials/collectors. The 800 foot block spacing and 3,200 foot block perimeter standards are local street standards contained in CCC 40.350.030.B.2.c. for development projects and are not intended for long range comprehensive planning or arterial block spacing. The DKS traffic study commissioned by Clark County correctly identifies the relevant arterial spacing goals. On Page 10 of that document, DKS quotes: “The street connectivity guidelines typically recommend a network of…collector streets

at ¼ to ½ mile spacing. Figure 3 illustrates desired spacing for an arterial and collector street network.”

In applying DKS’s Figure 3, the major arterial is interpreted to be NE Fourth Plain Boulevard. Then, Kerr Road would be the collector. The DKS street connectivity guidelines calls out the spacing between the arterial and collector to be ¼ to ½ mile which correlates to 1,320 to 2,640 feet. The existing spacing of the future Kerr Road alignment to NE Fourth Plain Boulevard only ranges from approximately 320 to 420 feet. The street spacing proposed by Clark County does not meet the guidelines identified by DKS and as a collector, the short spacing to NE Fourth Plain Boulevard is not advisable. The block size and perimeter standards being exceeded for an undeveloped parcel or parcels are not relevant to this discussion because at the time of development, the applicant must address this issue. Either the developer must comply with these standards or have an adequate justification to vary these standards through a road modification process. Also, the block size and perimeter standards are a local access issue which have no bearing on the Arterial Atlas which addresses arterials and collectors.

Kerr Road Arterial Atlas Proposed Changes September 19, 2017 Page 4 of 15 COMPREHENSIVE PLAN GOALS AND POLICIES A variety of Comprehensive Plan goals and policies do not support the Kerr Road extension which is contrary to the Staff Report provided by Clark County staff. The discussion below explains which Comprehensive Plan goals and policies do no support the Kerr Road extension. Clark County Comprehensive Plan Policy 5.0.4 The state, MPO/RTPO, county and the municipalities shall strive, through transportation system management strategies, to optimize the use of and maintain existing roads to minimize the construction costs and impact associated with roadway facility expansion. Pages 144 and 145 of the 2015-2035 Clark County Comprehensive Plan defines the term “transportation system management (TSM).” Per the Clark County Comprehensive Plan, TSM strategies tend to “have low or no capital cost but address impediments to efficient operation of the transportation system.” The Kerr Road extension cannot be considered a TSM strategy since roadway construction has a high capital cost. Because the future Kerr Road extension has limited utility as a collector as shown in the DKS study and the existing vacant lands along the proposed alignment already have multiple access options Policy 5.04 is violated. Figure 1 shows the access options available to the undeveloped properties along the future Kerr Road extension between NE 124th Avenue and NE 131st Avenue. Clark County Comprehensive Plan Goal: Develop a regionally-coordinated transportation system that supports and is consistent with the adopted land use plan. Policy 5.1 System Development Policies 5.1.1 The capital facilities plans, within each UGA should be jointly undertaken with

the city and reviewed for regional consistency by the Southwest Washington Regional Transportation Council.

5.1.2 County Road Projects and transportation improvements are proposed through

development shall be consistent with the current adopted Clark County Road Standards, Arterial Atlas, 2010 Clark County Bicycle and Pedestrian Master Plan, Concurrency Management System, RTC’s Regional Transportation Plan and the Washington Transportation Plan.

Clark County recently went through a Comprehensive Plan update associated with it Growth Management Act (GMA) compliance and did not update its 2010 Clark County Bicycle and Pedestrian Master Plan. Likewise, the City of Vancouver’s latest Bicycle Plan was adopted on May 3, 2004. In addition, Clark County’s Regional Trails and Bikeways System Plan, 2006 is an additional Comprehensive Plan document relevant to trails and bikeways. These plans are the most up to date bicycle plans from Clark County and the City of Vancouver and reflect the most recent regional coordination between agencies.

Kerr Road Arterial Atlas Proposed Changes September 19, 2017 Page 5 of 15 A review of all of the relevant bicycle facility planning documents did not reveal any proposed bicycle facility improvement projects along the NE Fourth Plain Boulevard corridor or nearby parallel arterial corridors. Because both Clark County and the City of Vancouver have not identified any bicycle improvements along the NE Fourth Plain Boulevard corridor or nearby arterial corridor within its Bicycle Plan/Master Plan documents, it is a safe conclusion that the NE Fourth Plain Boulevard and nearby east-west arterial corridors are not strategically important for the development of bicycle facilities. Also, it should be noted that the 2010 Clark County Bicycle and Pedestrian Master Plan did consider school locations and again no bicycle projects were identified relating the NE Fourth Plain Boulevard or any other nearby arterial corridors. Clark County Comprehensive Plan Goal: Optimize and preserve the investment in the transportation system. Policy 5.3 System Preservation Policies 5.3.1 Development projects shall adhere to minimum access driveway spacing

standards along arterial and collector streets to preserve the capacity of the transportation system. The county shall also work with Washington State Department of Transportation to ensure that minimum access spacing standards for state highways are maintained.

5.3.5 The local street system shall be interconnected to eliminate the need to use

collector or arterial streets for internal local traffic. Minimum driveway spacing standards already exist that implement Policy 5.3.1 within the CCC. Additional consideration for local access is not needed. All vacant properties along the proposed Kerr Road extension between NE 124th Avenue and NE 131st Avenue already have access onto a local roadway. To build a new collector roadway to provide additional local assess is not necessary and conflicts with Policy 5.0.4 which requires minimizing construction costs and impacts associated with roadway facility expansion. This also conflicts with Policy 5.3.5 which requires local streets to be interconnected with each other rather than using collector or arterial streets for internal local traffic. If the proposed Kerr Road extension was built, Tax Lot 158341-00 would be triple fronted with roadways. Tax Lots 158586-000, 158665-000, 158637-000, and 158638-000 are all owned by one landowner and again these properties would be triple fronted if the Kerr Road extension was built. More than adequate access already exists for the vacant parcels with the existing local streets. It makes no sense to build a collector for additional access and triple front lots as well as utilize it to connect local roadways when these roadways already have direct connections to the existing arterial system. Clark County Comprehensive Plan Goal: Ensure mobility throughout the transportation system. Policy 5.4 System Mobility Policies 5.4.1 The county arterial system shall be planned in general conformance with

nationally accepted arterial spacing standards.

Kerr Road Arterial Atlas Proposed Changes September 19, 2017 Page 6 of 15 As previously discussed above in the “Block Sizes and Perimeters” section, the proposed Kerr Road extension does not meet the nationally accepted arterial spacing standard identified in the DKS study. Because nationally accepted standards are not met, the proposed Kerr Road extension does not meet Comprehensive Plan Policy 5.4.1. DKS TRAFFIC STUDY In the introductory section of the Kerr Road Extension Existing and Future Transportation Analysis, August 2017 conducted by DKS, the following study purposes were defined:

Provide a parallel alternative to NE Fourth Plain Boulevard for local trips Provide new access options for land uses on the north side of Fourth Plain Boulevard Create a new, lower stress connection for people walking and biking

The “provide a parallel alternative to NE Fourth Plain Boulevard for local trips” purpose is not entirely accurate as a purpose for the study. The reason in seeking a parallel alternative to NE Fourth Plain Boulevard is to reduce congestion along NE Fourth Plain Boulevard. As previously discussed in the Cross Circulation section above, the level of service and v/c ratio analyses do not show a clear improvement along NE Fourth Plain Boulevard. Rather the opposite is true. The forecasted conditions along NE Fourth Plain Boulevard actually decline with the Kerr Road extension. Also, without a specific interlocal agreement, Clark County staff should not be planning for the improvement of City of Vancouver arterials such as NE Fourth Plain Boulevard or expending resources in planning for the benefit of a non-county roadway through a parallel facility. The second purpose for the study to “provide new access options for land uses on the north side of Fourth Plain Boulevard” is not necessary and should not be within the scope of comprehensive planning. The proposed Kerr Road extension is not needed for local access. All the remaining vacant parcels already have access to local streets as well as other arterial/collector roadways. Adding an additional collector for local access to vacant properties is not necessary and actually adds a proportionality problem due to double and triple fronting of roadways. It does not make sense to build a new collector for local access when access to multiple roadways already exist and one of the existing roadways is a local access roadway. The priority for access always defaults to the lowest classification roadway. Local access planning is not part of the Comprehensive Planning process. The Comprehensive Planning process involving analyses is typically limited to arterial and collector roadways. The third purpose for the study to “create a new, lower stress connection for people walking and biking” is an odd purpose when you consider that all new developments are required to install frontage improvements and urban arterial/collectors typically include both bike lanes and sidewalks. On its own, this purpose is not needed because of the existing block spacing and block perimeter standards already address non-motorized accessibility for localized access. As for regional non-motorized needs, they are already defined in the following three documents:

Clark County’s Regional Trails and Bikeways System Plan, 2006 Nowhere in the above three documents is a project need identified for a NE Fourth Plain Boulevard, Kerr Road, or NE 76th Street regional trail, bikeway, or sidewalks. The 2010 Clark County Bicycle and Pedestrian Master Plan also includes the consideration of school locations and does not identify any additional needs created by Covington Middle School or Heritage High School. If regional non-motorized needs were the primary consideration for the proposed Kerr Road extension, then the planning should have been addressed in the recent 2016 Comprehensive Plan update and an update should have been made to the 2010 Clark County Bicycle and Pedestrian Master Plan. The DKS study has three subsections within the Access and Safety Benefits section of its report. These sections are “Reduction in the Number of Driveways,” “Removal of Access Conflicts near Intersections,” and “Service Roads.” None of these subsections adequately address the real issues related to these topics. The first relevant point regarding the “Reduction in Number of Driveways” as it relates to Access and Safety Benefits is that NE Fourth Plain Boulevard is under the jurisdiction of the City of Vancouver and Clark County does not have any jurisdiction or control over this roadway. Clark County does not have any regulatory authority over the access management standards when it comes to driveway spacing along NE Fourth Plain Boulevard. Second, there are only two vacant property owners along the north side of NE Fourth Plain Boulevard between NE 124th Avenue and NE 131st Avenue. These vacant properties also have frontage along local side streets where local access can be obtained to minimize additional driveways onto NE Fourth Plain Boulevard. Another parallel roadway does little to further reduce the number of driveways along NE Fourth Plain Boulevard. Third, the DKS study does not show a collision analysis documenting any safety problems along NE Fourth Plain Boulevard triggering the need for safety improvements. Fourth, any access management code encouraging consolidation of existing driveways is the most practical recommendation that should have come out of the DKS report but is under the City of Vancouver’s jurisdiction and not Clark County’s. Fifth, the DKS study saying that existing driveways along NE Fourth Plain Boulevard could relocate along the proposed Kerr Road alignment is a misunderstanding of how Kerr Road would develop and a misunderstanding of the existing conditions. There is only one opportunity to relocate an existing driveway along NE Fourth Plain Boulevard to Kerr Road west of NE 124th Avenue. Tax lot 158385-000 could relocate its access from NE Fourth Plain Boulevard to Kerr Road when the right of way is built out with a roadway but the property owner is under no obligation to do so as an existing business. Building a new collector for the local access is not practical and a poor allocation of resources. The “Removal of Access Conflicts” section may be a relevant issue in the discussion of the Kerr Road extension but seems to be very incomplete. The study does not identify any areas it is suggesting the removal of access conflicts near major intersections. Queuing information, while available in the Synchro level of service output, was not provided in the appendix of the study. The queuing information is one of the most significant analytical information used to determine whether there are conflicts between major intersections and local access driveways. In addition, accident/crash rate information is also useful in assessing safety issues regarding arterials and local accesses which is also missing. Another significant issue regarding queuing is the Kerr

Kerr Road Arterial Atlas Proposed Changes September 19, 2017 Page 8 of 15 Road spacing to the existing intersections along NE Fourth Plain Boulevard which are at NE 121st Avenue, NE 124th Avenue, and NE 131st Avenue. The existing spacing of the future Kerr Road alignment to NE Fourth Plain Boulevard only ranges from approximately 320 to 420 feet. This limited spacing does not meet nationally recognized standards quoted by the DKS study of ¼ to ½ mile spacing. The “Service Roads” section is an oddity to try to justify Kerr Road as a collector. As discussed above, there is a very limited value of the Kerr Road extension as an access roadway because all of the existing properties already have significant levels of existing access. There is no need in “accommodating a large number of access points” as stated by DKS. This statement is contrary to CCC 40.350.030.A.5.b. which defines collectors with “direct access to adjacent land uses, however, is still subordinate to traffic movement.” It is clear from the analysis provided above that the Kerr Road extension has almost no value for local access and no value as an improvement to lessen the congestion along NE Fourth Plain Boulevard. If there was any value to NE Fourth Plain Boulevard, the DKS study would have shown the level of traffic volume diversion onto the Kerr Road extension. The omission of this information is further proof of the lack of value the Kerr Road extension is to the traffic operations along NE Fourth Plain Boulevard. If there was an actual benefit to build the Kerr Road extension, then the collector would be on both the City of Vancouver’s and Clark County’s Transportation Improvement Program (TIP) rather than trying to get a “freebie” from development activity. The DKS study concludes that “the connectivity and circulation potential created by construction of the extension allows for better implementation of the following best practices.” This generalization is not accurate. In fact, the Kerr Road extension does not follow anything close to “best practices.” The collector to arterial spacing should be ¼ to ½ mile as a best practice. Limited spacing to NE Fourth Plain Boulevard from approximately 320 to 420 feet is far from the ¼ (1,320 feet) to ½ (2,640 feet) mile spacing best practice. In conjunction, no through volume and little to no need for local access further shows that best practice standards are not met for the development of collector roadways. Again as raised previously several times, DKS applying the use of the block spacing and block perimeter development standards for local roadways is another clear misunderstanding and misdirection to justify the Kerr Road extension. The analysis of the NE Fourth Plain Boulevard/NE 124th Avenue intersection was omitted in the DKS study. Because this intersection provides access to a significant portion of the vacant lands fronting NE Fourth Plain Boulevard between NE 121st Avenue and NE 131st Avenue, it should have been included in the analysis. Even as a limited access intersection (right in, right out) it will be impacted by new development because of its direct proximity to vacant lands. The omission of significant pieces of analysis and lack of the public to access details of the analysis is a clear violation Comprehensive Plan Policy 5.1.4 which states: “The county shall provide opportunity for full and fair participation by all communities in

Kerr Road Arterial Atlas Proposed Changes September 19, 2017 Page 9 of 15 Specifically, DKS should have analyzed an intersection in the middle of the study area (NE Fourth Plain Boulevard/NE 124th Avenue). The lack of this information significantly compromises the DKS study. At the Open House, staff let the public know that there was no more budget to ask DKS to do anything and only what was previously produced is available for public review. Other documentation omitted by the DKS study are queuing analyses, accident/crash data, and traffic volume figures. DKS makes an important point regarding conflicts near intersections but fails to make any analyses. These analyses could have been simply printing out the queuing worksheet within the levels of service analyses already calculated. Since safety was brought up by DKS, and accident/crash analysis should have been conducted. The traffic volumes for all the future analyses were produced by DKS but not summarized in a figure to show diversions from NE Fourth Plain Boulevard to the proposed Kerr Road extension. This information is critical in helping the public understand the value of the proposal. This information already exists and would take very little time and budget for DKS to provide to the public. For DKS to expend all the budget and Clark County staff not reserving a portion of the budget to address the public’s comment is not within following Comprehensive Plan Policy 5.1.4. The question was asked at the Open House where all the trips came from to impact the proposed Kerr Road extension. Staff’s answer was that it came from the residential neighborhood east of NE 131st Avenue. The answer to that question is not believable for the following reasons. First, most residentially generated trips are work trips which would be destined to and from the arterial system. Most of the trips are destined to and from the south to NE Fourth Plain Boulevard which utilize one of three existing full accesses at NE 131st Avenue, NE 134th Avenue, and NE 137th Avenue. It is highly unlikely that these trips would take a less direct travel path to NE Fourth Plain Boulevard. With direct access onto NE Fourth Plain Boulevard, NE 137th Avenue, and NE 76th Street, another arterial/collector is simply not needed to serve these trips. To build another collector for trips serving this neighborhood is a violation of Comprehensive Plan Policy 5.04 where costs are to be minimized with roadway expansion. The DKS study did not even estimate the ADT utilized by the Kerr Road extension. For it to be a collector, it would need to have traffic volumes above the neighborhood collector maximum of 3,000 (see CCC Table 40.350.030-3). H. Lee & Associates, PLLC (HLA) estimate is 1,400 to 1,750 daily trips which is documented in the next section. The daily volume estimate is far below the minimum needed to justify a collector roadway. STAFF REPORT – KERR ROAD, CPZ-2017-00018 Criteria A The staff report did not find that Criteria A was met to support the deletion of the Kerr Road extension between NE 124th Avenue and NE 131st Avenue. Criteria A is met when there is a need for the proposed change. Staff is clearly incorrect in its assessment that there is not a need for the proposed change. First, as discussed above, all of the reasons for the 2011 BOCC decision is no longer relevant. The DKS study shows that the alternative route, the Kerr Road extension, does not relieve pressure on NE Fourth Plain Boulevard. As for safety issues, WSDOT’s improvements were specific to

Kerr Road Arterial Atlas Proposed Changes September 19, 2017 Page 10 of 15 the issues at the NE Fourth Plain Boulevard/NE 124th Avenue intersection including the purchase of the Kerr Road right-of-way to extend the roadway to NE 124th Avenue. These WSDOT improvements solved a specific safety problem and were standalone. This WSDOT action was not reliant on any action by the City of Vancouver or Clark County. There is no public documentation that requires the City of Vancouver or Clark County to take any action. There are no City of Vancouver concurrency issues along NE Fourth Plain Boulevard as previously explained. Because NE Fourth Plain Boulevard is considered a built out corridor, the city evaluates the corridor against the level of service standard in their adopted Corridor Management Plan and not individual intersections levels of service. Related to this issue is that Clark County should not be planning within the City of Vancouver jurisdiction without a specific interlocal agreement. The staff report indicates that there is no interlocal agreement. The block size and perimeter standards being exceeded for an undeveloped parcel or parcels are not relevant to this discussion because at the time of development, the applicant must address this issue. Either the developer must comply with these standards or have an adequate justification to vary these standards through a road modification process. Also, the block size and perimeter standards are a local access issue which have no bearing on the Arterial Atlas which addresses arterial and collector spacing. Furthermore, Comprehensive Plan Policy 5.3.5 gives guidance that “the local street system shall be interconnected to eliminate the need to use collector or arterial streets for internal local traffic.” The proposed Kerr Road extension clearly violates this policy by trying to utilize a collector to connect local roadways for internal local traffic. The second reason that there is a need for the change to remove the proposed Kerr Road extension from the Arterial Atlas is that several Comprehensive Plan polices are violated by the proposed roadway. Specifically, Comprehensive Plan Policies 5.04, 5.1.2, 5.3.5, and 5.4.1. are violated as previously discussed. The third reason for removing the proposed Kerr Road extension from the Arterial Atlas is the simple fact is that the proposed Kerr Road extension does not meet the intent of a collector roadway and is in actuality a local roadway that cannot be planned in the same manner as arterials and collectors. The DKS study did not disclose the projected traffic volumes because the projected traffic volumes are too low to justify a collector classification. The neighborhood circulator is the next lowest classification from the collector and the CCC defines its planning capacity to be 3,000 daily trips (see CCC Table 40.350.030-3). So, for a collector to be designated, it should have at least 3,000 daily trips which is equivalent to approximately 240 to 300 P.M. peak hour trips (8 to 10 percent of daily). The DKS study did not include the future NE 124th Avenue/Kerr Road intersection in its study so the only intersection that can be used to determine the future Kerr Road P.M. peak hour traffic volumes between NE 124th Avenue and NE 131st Avenue is the NE 131st Avenue/Kerr Road intersection. In the 2035 Build P.M. peak hour condition, the DKS study shows only 140 P.M. peak hour trips on Kerr Road west of NE 131st Avenue. This translates to a build out daily traffic volume of only 1,400 to 1,750 which indicates it should only be a local roadway. The fourth reason for removing the proposed Kerr Road extension from the Arterial Atlas is that staff’s comments about better meeting the CCC 40.350.030 (block length and block perimeter) standards is not the function of the Arterial Atlas. CCC 40.350.030 is only about local streets and not relevant to the discussion. As discussed above, the limited number of vacant lots in the study area already have ample local access options.

Kerr Road Arterial Atlas Proposed Changes September 19, 2017 Page 11 of 15 The staff report mentions that the Kerr Road extension improves traffic operations along NE 76th Street. In actuality, there is so little difference between the 2035 No Build and 2035 Build analysis that practically there is no difference between the two analysis scenarios. In fact, in the A.M. peak hour, there are several NE 76th Avenue intersections that have worse results in the Build scenario. In the P.M. peak hour, several intersections have the exact same result. The letter levels of service (A, B, C, D, E, and F) do not change between the 2035 No Build and 2035 Build analyses. A more accurate interpretation of the results of the DKS analysis is that it does not conclusively show adequate improvement in the 2035 Build scenario to justify its construction. Also, the purpose of the Kerr Road extension is to improve the traffic operations along NE Fourth Plain Boulevard and not NE 76th Street. Criteria B Meeting Criteria B is about being compliant with the Growth Management Act. The removal of the Kerr Road extension is justified because as previously established in this memorandum, the Kerr Road extension is a local roadway and local roadways are not within the scope of GMA and the County’s Comprehensive Plan. So, staff’s assertion that Goals 3 and 12 are met is in error. Goal 3 states “Transportation. Encourage efficient multimodal transportation systems that are based on regional priorities and coordinated with county and city comprehensive plans.” As a roadway with a projected daily volume between 1,400 and 1,750, the future Kerr Road extension is not a collector and is not regionally significant. Even from a local circulation perspective, which is not within the scope of arterial and collector planning, the existing vacant parcels adjacent to the future Kerr Road extension do not need any additional local roadways for adequate access. Adding non-essential roadways is not an efficient multimodal transportation system. As for bike facilities, none of the City of Vancouver and Clark County bike plans show the need for any bike facilities relating or paralleling the NE Fourth Plain Boulevard corridor. Goal 12 states “Public Facility and Services. Ensure that those public facilities and services necessary to support development shall be adequate to serve development at the time the development is available for occupancy and use without decreasing current service levels below locally established minimum standards. Goal 12 is known as the concurrency standard. This goal is already implemented through the existing development standard contained within the Clark County Code (CCC). The future Kerr Road extension does not have anything to do with whether concurrent infrastructure is built with new development because the county already implements this standard. So Goal 12 is met regardless of what happens to the future Kerr Road extension. Criteria C Criteria C is about being consistent with all of the elements considered part of Clark County’s Comprehensive Plan. Staff’s assertion is that Criteria C is not met with the deletion of the future Kerr Road extension. In fact, the opposite is true. The deletion of the future Kerr Road extension from the Arterial Atlas is consistent with the Comprehensive Plan because the Kerr Road extension violates several Comprehensive Plan policies as previously discussed. The

Kerr Road Arterial Atlas Proposed Changes September 19, 2017 Page 12 of 15 elimination of the future Kerr Road extension from the Arterial Atlas eliminates the previously described contradictions to Comprehensive Plan Policies 5.04, 5.1.2, 5.3.5, and 5.4.1. The most disturbing contradictions to the Comprehensive Plan relates to Policies 5.3.5 and 5.4.1. Policy 5.3.5 requires local streets to be connected to each other rather than using collectors or arterials for internal local traffic. The future Kerr Road extension utilizes a collector to interconnect local roadways (NE 124th Avenue and NE 131st Avenue) to facilitate the movement of internal local traffic. This type of connection is in direct violation with Policy 5.3.5. In addition, Policy 5.04 is violated by proposing an unnecessary collector which does not minimize construction costs and impacts with roadway expansion. Further supporting this point is that the adjacent developable properties already have multiple access options. It is highly inefficient to build excessive redundancy for local access. The most egregious error in the future Kerr Road extension is the lack of nationally accepted spacing between a collector and an arterial. The DKS study identifies this spacing to be ¼ to ½ mile spacing. The available spacing between the future Kerr Road extension (collector) and NE Fourth Plain Boulevard (arterial) is only between approximately 320 and 420 feet which is far from the acceptable standard of ¼ (1,320 feet) to ½ (2,640) feet) mile spacing. This lack of spacing is clearly contrary to Policy 5.4.1 which requires Clark County to follow nationally accepted standards for arterial spacing. The staff report finds that “the removal of the future roadway would increase the number of access locations, along with the potential for collisions associated with turn movements on Fourth Plain Boulevard…” As stated numerous times in this memorandum, Clark County does not have jurisdiction along NE Fourth Plain Boulevard. NE Fourth Plain Boulevard is the jurisdiction of the City of Vancouver and the city has its own standards. Also, there is no interlocal agreement between Clark County and the City of Vancouver to allow Clark County to plan for the City of Vancouver. No crash/accident information has been provided to quantify the potential for crash reduction. Almost all of staff’s rationale to justify the future Kerr Road extension has to do with local street connectivity which has nothing to do with the Comprehensive Plan and arterial/collector development. Criteria D As stated by Clark County staff, there is no current interlocal agreements that directly apply to the future Kerr Road extension. This is problematic because a significant portion of staff’s argument to keep the future Kerr Road extension involves issues along NE Fourth Plain Boulevard which is owned by the City of Vancouver. Without an interlocal agreement, it is improper for cross jurisdictional planning or any deal making. It should be noted that the 2005 purchase of right-of-way by WSDOT and its median improvements along NE Fourth Plain Boulevard had nothing to do with the current future Kerr Road extension.

Kerr Road Arterial Atlas Proposed Changes September 19, 2017 Page 13 of 15 Criteria E Criteria E is that the proposed change does not conflict with the Metropolitan Transportation Plan. Staff is correct that Kerr Road is not identified in the MTP so its deletion will not conflict with it. Another way to look at Criteria E is that the future Kerr Road extension, Arterial Atlas, and the Clark County Comprehensive Plan should not conflict with the MTP either. Both side of the coin should be consistent. There are inconsistencies between the MTP and Arterial Road Atlas. The MTP includes both existing and future arterial/collector classified streets. The MTP does not include NE 116th Avenue/NE 65th Street from NE Rosewood Avenue to NE 117th Avenue (SR 503) and NE Kerr Road from NE 121st Avenue to NE 131st Avenue as a collector. The existing Arterial Atlas is not consistent with the current MTP. It is our contention that the Arterial Atlas be consistent with the regionally coordinated MTP that is federally required. By removing the future Kerr Road extension, the Arterial Atlas can be made consistent with the MTP. EVERGREEN SCHOOL DISTRCT COMMENT LETTER The Evergreen School District sent in a comment letter dated September 15, 2017 in support of retaining the extension of Kerr Road from NE 124th Avenue to NE 131st Avenue. The letter stated the following four reasons to support the future roadway extension:

1. A two-lane collector with bike lanes would provide safe east/west access to connect the Sifton and Covington attendance areas (Fourth Plain Boulevard does not have bike lanes)

2. The segment of NE 65th Street/Kerr Road between NE 124th Avenue and NE 131st Avenue would further improve safety and ease congestion on NE Fourth Plain Boulevard.

3. The extension is in the Heritage High School Walking area with sidewalks in place to allow safer access for students.

4. The extension would improve our existing bus service to Golden West and Sunrise Acres mobile home parks on NE 131st Avenue.

The Evergreen School District letter does not address any decision criteria outlined in the Staff Report and does not provide specific information backing its reasons to support the future Kerr Road extension. Reason #1 does not provide a safe east/west connection because the bicycle lanes are not continuous through the attendance areas. There are no existing east/west bicycle lanes along any east/west roadways (NE Rosewood Avenue, NE 16th Avenue, and NE 65th Avenue) to Covington Middle School. Sections of sidewalks are also missing on all of these roadways. By constructing the future Kerr Road extension, the existing pedestrian and bicycle deficiencies still exist. The Evergreen School District buses the students in the future Kerr Road extension vicinity as can be referenced in their web site (http://evergreenps.org/Bus-Schedules) because of the existing deficiencies. Bus Route 208 picks up students along NE 124th Avenue. The busing situation will not change with the Kerr Road extension.

Kerr Road Arterial Atlas Proposed Changes September 19, 2017 Page 14 of 15 Reason #2 of improving safety and easing congestion along NE Fourth Plain Boulevard may be the perception of the Evergreen School District but the DKS study does not show any significant traffic operations improvements along NE Fourth Plain Boulevard. As for safety improvements, it is doubtful that there will be any significant improvements in safety because there are only a few opportunities to reduce the number of driveways and the DKS study did not include any safety/accident data relating to existing driveways. While the future Kerr Road extension may be within the Heritage High School Walking area as commented in Reason #3, there is no reason for students to utilize this section of roadway to and from school because there are no residential uses along the future Kerr Road extension. As for walking to lunch, any existing service oriented business fronts NE Fourth Plain Boulevard and sidewalks already exist along NE Fourth Plain Boulevard. Reason #4 of improving bus service at two mobile home parks along NE 131st Avenue is hardly a reason to build a collector roadway costing between $500,000 and $1,000,000 (roughly $150 to $300 per lineal feet x 3000 feet of roadway plus design costs). The future Kerr Road extension is only approximately 0.75 miles from NE 121st Avenue to NE 131st Avenue and it is doubtful that there will be any significant savings in travel time. HLA obtained Evergreen School Districts safe walking route maps from their web pages (http://evergreenps.org/Portals/0/Docs/District/Boundary%20maps/Covington.B.pdf and http://evergreenps.org/Portals/0/Docs/District/Boundary%20maps/Heritage.B.pdf) and are attached to this memorandum for reference. As can be seen from the maps for Covington Middle School, the safe walking routes as denoted by red do not extend east of NE 117th Avenue. So any additional connectivity does not change the fact that middle school students are not encouraged to walk or bike across SR 503 (NE 117th Avenue). The Heritage High School safe walking route map is also very telling. As previously discussed, the southern walking boundary is NE Fourth Plain Boulevard and the future Kerr Road extension does not affect the red safe walking routes. Because there are no residential uses along the future Kerr Road extension, its utility to high school students would be very limited. CONCLUSION The Kerr Road extension between NE 124th Avenue and NE 131st Avenue should be removed from the Arterial Atlas for the following significant reasons:

The Kerr Road extension does not significantly improve traffic operations along NE Fourth Plain Boulevard.

The Kerr Road extension is not necessary for local access. Existing vacant lots already have multiple access options.

All of the 2011 BOCC reasons to add the Kerr Road extension to the Arterial Atlas are no longer valid.

There are several Comprehensive Plan policies that are clearly violated and not met by the Kerr Road extension proposal.

The DKS study is deficient in many areas and does not support the Kerr Road extension as a collector.

The justification of the proposed Kerr Road extension because of bicycle and sidewalk needs is unfounded. None of the City of Vancouver and Clark County comprehensive planning documents (2010 Clark County Bicycle and Pedestrian Master Plan, City of Vancouver Bicycle Plan, May 3, 2004, Clark County’s Regional Trails and Bikeways System Plan, 2006) show this need. Local needs are addressed in the development code and not in comprehensive planning.

For no ability to get supplemental information from DKS is clearly not the intent of Comprehensive Plan Policy 5.1.4 which guides the public participation portion of the transportation decision-making process.

Almost all of the staff report findings are in error. The Arterial Atlas is not consistent with the MTP. The Arterial Atlas should be made

consistent with the MTP which involves removing the future Kerr Road extension. The Evergreen School District letter does not add any additional relevant issues to the

discussion.
