OSHAAcceptsOurHAZWOPERHands-onSimulator®(ThisOSHAletterisamilestoneletter-reflectingacceptanceofanonlinesystem.NootherHAZWOPERtrainingproviderhasreceivedacceptanceforanyHAZWOPERtrainingcomponent.Theonlinetrainingindustryconsidersourlettermonumental.Ourcompanyhasledthewayindevelopingnotonlyeffectivehealthandsafetysolutionsbutalsoregulatorycompliantprograms.)OurexclusiveHAZWOPERHands-onSimulator®providesarealisticandstunningpresentationofdonninganddoffingPersonalProtectiveEquipment(PPE),andadecontaminationsequenceforeachPPElevelofprotection(LevelA,LevelBandLevelC).Thesimulatoruseshighdefinition3DgraphicsalongwithahighlyintuitivenavigationsystemthatguidesastudentthroughtheprocessofusingPPE.Thesimulatorprovidesanengaging,gorgeousfullscreenpresentationwithprofessionalvoiceoversandisavailableinSpanishandEnglish.DidYouKnow?Manyclientselecttousethesimulatorduringthesite-specifichands-ontrainingsession.(OSHArequiressite-specifichands-ontrainingontheactualequipmentanemployeewillbeusingataparticularjobsite).Withtheuseofoursimulator,aqualifiedandproperlytrainedsitesupervisorguidesanemployeethroughsite-specifichands-ontrainingontheactualPPE.Anemployeeisabletodon,doff,andmanipulatetheactualPPEusedataparticularjobsitewhileusingoursimulatorasaguide.ThissatisfiestheOSHArequirementthatemployeesreceivesite-specifichands-ontrainingontheactualequipmenttheemployeewillbeusing.ThesimulatorhasgreatlyreducedcostformanyleadingcompanieswhileprovidingOSHAcomplianttraining.Thisisawin-winsituationforcompaniesandisoneofthereasonswhywearetheleadingproviderofHAZWOPERtrainingtoday.Note:ThesimulatorcoversPPEonlyandnotanyadditionalsite-specificequipmentuniquetoaparticularsite.InaninterpretationletterdatedFebruary4,2009OSHAstatedthatourexclusiveHAZWOPERHands-onSimulator®isacceptablewhenusedinconjunctionwithsite-specifictraining.Site-specifichands-ontrainingontheactualequipmentanemployeewillbeusingisrequiredforbothonlinetrainingandpublicseminar(openenrollment)classroomtraining.(IfyouthoughtyoumettheOSHArequirementsbysendingyouremployeesoffsitetoapublicseminartrainingclass,pleasereadthedetailedexplanationbelow).Employerscannowtraintheiremployeesonlinewithoursimulatorforthe40or24hourHAZWOPERcoursesandthenconductsitespecifichands-ontrainingontheactualequipmentanemployeewillbeusingintheirjob.



SinceJuly11,2008we'vehadcommunication(severalphonecallsandinterpretationletter)withtheU.S.OSHADirectorateofEnforcementPrograms(DEP)inWashington,D.C.,regardingHAZWOPERtraining.Thediscussioncenteredonhands-ontrainingforthe40hourHAZWOPERCourse.Theyarespecificintheirexpectationofwhatistobeusedinthetrainingandhowitisconducted.OSHAregulation29CFR1910.120AppendixE(Non-MandatoryGuidelines)statesthathands-ontrainingshouldbeusedinconjunctionwiththe40hourcourse.AlthoughtheAppendixEhands-ontrainingrequirementwasnotpromulgatedinthemandatoryregulations,theyhaveaspecificexpectationofwhatisacceptable.Also,anumberofinterpretationletterswereissuedovertheyears.Manypeoplefoundsomelanguagetobeina"greyarea".TheexpectationbeingconveyedtothefieldenforcementofficesisthatindividualsmustbetrainedontheactualmodelandtypeofPPEthattheywillbeusingintheirjob.Itwasalsoconveyedtousthatclassroom/seminartrainingonarespiratoringeneraldoesnotmeettheirexpectation.Inaclasswithstudentsfromadozendifferentemployers,whatisthechancetheinstructorwillhavetheactualandexactPPEyourworkerusesonthejob?TheindividualmustbetrainedusingtheactualequipmentandPPEthattheywillbeutilizinginthefield.Therefore,thisexpectationisnotmetintheclassroomnoruseofasimulatorbutcanonlybefulfilledbytheemployerconductingsite-specifichands-ontrainingontheactualequipmenttheemployeewillbeusing.TheactualHAZWOPERtrainingcertificationcomesfromboththeinstructorandtheemployer-ithasalwaysbeenajointresponsibility.Sincetheemployerisresponsiblefortheiremployee'shealthandsafety,andtheemployerknowsthespecifictasksthattheemployeewillbeperformingandhasdirectknowledgeofthesiteconditions,itmakessensethatOSHAexpectstheemployertoconductthehands-on/PPEcomponentofthetraining.Whatdoesthismeanfortheemployer?Actually,itisnodifferentthanwhataprudentemployerhasbeendoingallalongastheHAZWOPERtrainingstandardisperformancebased.Wecontinuetooffertheacademicportionofthetrainingonline,andtheemployerwilltrainonthespecificmakeandmodel-theactualequipment-thatwillbeutilizedbytheemployee.Likely,thisiswhatyouhavealreadybeendoing.Thereisadifferencebetweengenerichands-ontraining(publicseminar)andsite-specifichands-ontraining.Ifyouhavebeensendingyouremployeestoapublic40HourHAZWOPERtrainingseminar/classandreliedsolelyonthistrainingforhands-on(assuminghands-ontrainingwasconducted),thenyouarenotmeetingtheOSHAstandard.Site-specifichands-ontrainingmustbeperformed.Werealizethismightcomeasasurprisetoyouassomeclassroomprovidersofthistrainingwilltellyoutheyconducthands-ontrainingandthis



mightmakeyouthinkyouhavemettheOSHArequirements.Well,theymightconducthands-ontraining,buttheycannotperformsite-specifichands-ontraininginaseminaropentoanyone.Pleasedoyourduediligenceandcheckthemoutfirst.Thedealis,youaretheonewiththemostatstake.OSHAholdstheemployerliablenotthetrainerprovider.Don'triskit;it'snotworthit!ThiswillhelpyouavoidanypotentialOSHAHAZWOPERviolation/fine.WeareproudtoworkwithsomeofthemostdiligentHealthandSafetymanagersintheindustry,andknowthatforemostintheirmindsisthesafetyoftheirworkers.Wefeelveryfortunatethatmanycompaniesandindividualshavecometousfortheirtrainingneeds.Thesafetyandwellbeingofallisourutmostpriority.Wearealsothankfulthereisclarificationtothequestionofhands-ontraining.Whatifmycurrenttrainingprovidertellsmetheirpublicseminarhands-ontrainingisallthatisneededormakesmebelievethisisallthatisneeded?TalkwithyourcurrentproviderandstresstothemtheOSHArequirementforsite-specifichands-ontrainingandthattrainingonPPEingeneraldoesnotfullymeettheOSHArequirements.Yourtrainingprovidershouldalreadyknowthiskeyfact.Site-specifictrainingontheactualequipmentanemployeewillbeusingistheOSHArequirement.Unfortunately,therearesomewebsitesthatwilltellyoutheyofferOSHArequiredhands-ontrainingandthismightmakeyouthinkyouhavemettheOSHArequirements.Iftheydonotprovidesite-specifichands-ontrainingwiththeactualequipment,thenyouhavenotfullymettheOSHArequirementsandmaybesubjecttofinesandpenalties.YourbestmoveinprotectingyouremployeesandyourcompanyistocalltheU.S.OSHADirectorateofEnforcementPrograms(DEP)inWashington,D.C.,at202.693.2190andaskthemanyquestionsyoumayhave.Whatifmyprospectivetrainingprovidertellsmethatarespiratorfittestcanbedoneatapublicseminarcourseopentoeveryone?Iwillhavemyactualrespiratorforthefittest.Thereismoretrainingrequiredforarespiratorthanjustafittest.Eventhoughyoumayhavetheactualrespiratoryouwillbeusing,thetrainercannotprovidesite-specifictrainingforyouinanopenenrollmentorpublicseminar.YouwouldnotmeettheOSHArequirements.AddedAssuranceofOSHAComplianceWeoffertheaddedassurancethatour40HourHAZWOPERcoursecomplieswiththeOSHAregulations.NootheronlinecompanyhassuchaletterfromOSHA.So,foralmostthesamepriceasothercompaniesthatprovidenoassurance,youalsoreceiveaddedassurancefromusthatyouareincompliancewithOSHA.WearetheonlyHAZWOPERtrainingproviderwithaninterpretationletteracceptinganycomponentforHAZWOPERtraining.Wethankyouinadvanceforselectingusasyourtrainingprovider.
