Plaintif FC WP Building LC (Plaintif') has assered a groundless nuisance
claim against Headington Realty that has no basis under Texas aw. Indeed the egal princiles
that preclude Plaintiff's nuisance claim have been established law in Texas since 1860! In
addition Plainti does not have a good faith argument for the extension modication or
reversal of that longstanding Texas law Headington Realty thereore respectlly requests that
the Court grant its special exceptions and dismiss this lawsuit for failure to state a claim uon
which relief can be granted
