Whereas the above named complainant, a person with 65% locomotor disability has filed acomplaint dated 27.05.2011 before Chief Commissioner for Persons with Disabilities under thePersons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act,1995, hereinafter referred to as the Act, stating that ESIC has not provided 3% reservation topersons with disabilities in the posts of Professor and Associate Professor;

'- " "T 0 f;. c "~-".,. - - 4 - And whereas Section 59 of the Act mandates the Chief Commissioner for Persons with

Disabilities to look into complaints or take action on his own motion, inter-alia, with respect tomatters relating to deprivation of rights of persons with disabilities;

2. And whereas as per Ministry of Social Justice and Empowerment's Notification No. 16-70/2004-00-111 dated 18.01.2007, the posts of Professor have been identified as suitable forpersons with disabilities (OA & OL) category;

3. And whereas Section 33 of the Act provides as under:-

"Every appropriate Government shall appoint in every establishment such percentage ofvacancies not less than three per cent. for persons or class of persons with disability ofwhich one per cent. each shall be reserved for persons suffering from-

(i) Blindness or low vision; (ii) Hearing impairment; (iii) Loco motor disability or cerebralpalsy, in the posts identified for each disability:

Provided that the appropriate Government may, having regard to the type of work carriedon in any department or establishment, by notification subject to such conditions, ifany, as may be specified in such notification, exempt any establishment from theprovisions of this section".

5. And therefore notice is hereby given to the respondent to submit his/her version as to whythe ESIC should not reserve at least 3% of the vacancies in the post of Professor for persons withdisabilities in accordance with Section 33 of the Act. The information in respect of number ofvacancies filled since 01.01.1996 in Group 'A', 'B', 'C' & '0' in the enclosed format may also besubmitted.
