We started this business over a decade ago--we purchase material and

supplies for fo?·eign governments. We are familiar with the j;roblems of

equipment desired, especially aircyaft, maYine equipment and annaments

and know where things can be found in different parts o the world. We

have expe?'iise in dealing with the U.S. Government, in obtaining licenses

for expo1'i, in complying with the ·requirements for registmtion at the

Justice Department, with the regulations of the TYeasu1·y DePartment and

the myriad Customs and Immigration requirements. We have cooperated

closely with the sensitive departments and of course the Defense Department.

I cannot say we cooperated closely with the State Department, mainly becauseIthe departments with which we were cooperating were at waY with the State

Department and the American Ambassador Knox was not 1·esponsive to mw

Yequests.

This attitude has carried over to our pres eM problem. Even though

mrr counsel had more than a dozen contacts with the B ·r esk, with

attorneys in AID and State and others after our trouble started and even

though we supplied copies of the pleadings in our New York law suit and

ofje?'ed to supply any other information they wanted, we were never told of

'the assertions made by§aymon4 /Jzich are so clearly wrong. This even

though our counsel was told of a request by 1Haiti to advise the New York

Cmrrt of the doctrine of sove?'eign immunity and the further request for an

opportunity to a·rgue this before the State -Depm-tment 's lawyers. When this

request was withdrawn, we-ce?'tainly were not told AID would be ?'elying on'

assertions made in support of the request as constituting the position of the

In every instance save one the payment terms on all the Haitian

negotiated in Director Antonio Andre's office of the Banque Nationale de la

Repztblique D'Haiti. Only after M r Andre gone ('iS commitment and the

drawn and executed. Had ·we not ?'eceived the Banque's aPProval and P?'Omise

of payments, we would not have agreed to fulfilling the contracts or the

purchase orders.

We had Mr. Andre's personal Promise on various monthly payments

on behalf of the Banque for various contracts: Contract No.1 $'66, 000. 00

per month, Pier Contract $30, 000. 00 per month, Open Account $'100, 000. 00

per month which covered comme·rcial items and pen;onal items for the

President.

Despite this Haiti was characte1·istically late in meeting payment

schedules and !sent cable after cable, request afte?' request to get payments.

In Febnzm-y and March of 1973, our suspicions were confirmed as to

the Haitian Government's lac!< of responsibility in honoring contracts and

commitments and promises made by President Duvalier and !VIr. Antonio

Anche (Di?-ectm- of the National Bank of Haiti). It was at that time, that1111·.

And1·e advised me personally in his office that he had no money to pay us.

I then, had a meeting with the President at the Palace in March of 1973, when

again I was told that the Government had no more money with which to jmy us.

Aerotrade received its last payment in July for a deliquent monthly

payment. This payment was made 'by Mr. Antonio Andre upon direct

O?'ders from Madame Simone Dtivalier, ·as she was fully cognizant of the

situation.
