Legislative and Regulatory Update

Natalia Mazina, Kelly, Hockel & Klein, PCThis session will provide a broad overview of California pharmacy law, as applicable to non-pharmacy clients, and will discuss the role of federal agencies in regulating the dispensing and compounding of pharmaceutical products. The speaker will identify some of the hot topics in pharmacy law, such as compliance with Federal Drug Quality and Security Act (Compounding Quality Act and Drug Supply Chain Security Act), legal issues with specialty pharmaceuticals, dispensing medications through TeleHealth channels, state regulations pertaining to pharmaceutical waste, updates to the controlled-substance dispensing, and office-use compounding. Attendees will also learn about recent FDA enforcement actions based on dispensing and compounding, as well as DEA’s and OIG’s investigations pertaining to dispensing of pharmaceutical products.   

Overview of Pharmacy Law and Its Application to Non-Pharmacy Clients

Join us for an hour of exploring how personal and professional blind spots impact our practice as attorneys. This program will include a presentation, acted scenarios, and interactive exercises that will teach us to recognize some of our biases and help us become leaders instead of contributing to the problem of bias in the legal profession. This presentation provides one hour MCLE credit for Recognition and Elimination of Bias in the Legal Profession and Society.

Lawyers and Bias – Are We Diversity Leaders or Part of the Problem? (Recognition and Elimination of Bias in the Legal Profession and Society)

Tara Cowell, St. Joseph Health System and Travis Jackson, Polsinelli LLPThis session will examine state and national affiliation trends to identify options for integrating hospitals, health insurers and physician practices, including hospital mergers and acquisitions, health insurer consolidations, public-private partnerships, physician alignment activities and public and private payor clinically integrated network development. The speakers will identify regulatory concerns that these affiliations may present and discuss enforcement actions with the goal of determining how best to structure and document these affiliations.

Payors often "lease" their network of providers to other payors, including out-of-state plans, ERISA plans, and others. This presentation will discuss state and federal laws governing the rights and obligations of providers, leased network PPOs, and other payors. Topics covered will include when state Insurance Code and Knox-Keene Act payment requirements apply, federal preemption, and contractual obligations. In particular, this presentation will discuss recent cases including UFCW & Employers Benefit Trust v. Sutter Health and best practices for contracting in light of recent case law developments.

Leased Network PPOs, Other Payors, and ERISA Plans – Legal Issues When Plans Sell Their Networks

Depending on the nature of the hospital’s problems, these situations can present attractive acquisition opportunities. This presentation will discuss some of the issues that a buyer may encounter in its due diligence review and whether the problems can be dealt with either in or outside of a bankruptcy case.

Buying a Troubled Hospital: What You Can Fix and What You Can't

Craig Garner, Garner Health Law CorporationThis presentation explains the regulatory challenges facing mental health providers in California, ranging from individual practitioners to acute psychiatric hospitals to rehabilitation clinics. The federal government and California have increased spending for mental health services at never-before-seen levels. However, at the same time, payers and government agencies are challenging the business model of mental health care. Often ignored in this picture are the 3.1% of American adults who have presented with serious psychological distress within the past 30 days, and the 1.5 million hospital inpatients discharged with psychosis as the primary diagnosis, the average length of stay for whom was 7.2 days. To represent mental health providers, attorneys must understand some history, the amount of money at issue, and the regulatory and payor challenges along the way. Our speaker will focus on the various mental health and chemical dependency coverage requirements and provide an overview of California's regulatory infrastructure for rehabilitation centers and acute psychiatric hospitals, ranging from licensure to reimbursement. Finally, the presentation will cover recent friction between payers and providers in mental health, as well as the regulatory audits pending throughout California.
