In 2007, Congress adopted a law that spared homeowners from being taxed on the amount of

the loan that was written off. But that tax break expired in December, and now that kind of

relief can be counted as inc ome by the Internal Revenue Service.

"Thats why the Department secured a commitment from Bank of America to pay a portion

of the settlement over $490 million to defray some of this tax liability," U.S. Attorney

General Eric Holder said. "And our settlement requires the bank to notify all consumers of

the potential tax liability."

Holder went on to warn that unless Congress acts, "the hundreds of thousands of c onsumers

we have sought to help through our settlements with JPMorgan Chase, Citigroup, and now

Bank of America, may see a significant tax bill just as they are beginning to see the light at the

end of a dark financial tunnel.

Why shouldn't theybe taxed on it? Seems that in many - not all - cases these

folks walked into trouble by overextending. How about those that didn't? Those

that stayed current? Arewe rewarding poor financial behavior?

Idon't have it handy but read an article that the recidivism rate for delinquencies

was running around 70%...fool me once, shame on me. In the meantime, many

other struggling ownersjus keep plugging along with no help.

Sometimes the chit has to hit the fan....

Nothing wrong with taxing them unless it requires one lump sum. If

you're struggling, and have been for a long time, it's not likely you can

afford to pay all at once. It should be done over time, incrementally, and

withminimal interest.

Are you kidding? Paying over time, incrementally and withminimal interest sounds exactly like the loan they did not pay.

The amount forgiven is added to the borrowers income and the

appropriate tax rate is applied. The amount of tax is due by the

15th of April or you enter into a repayment plan at 18% interest.

Oh, and by the way, the IRS will get their money.

Keep in mind, all of y our cries for principal reduction will be

handled the same way. And the IRS is really good at garnishing.
