DEFENCE REGULATIONS MADE UNDER ARTICLE 3 O F T H E EMERGENCY POWERS (COLONIAL DEFENCE) ORDER IN COUNCIL, 1939, AND THE EMER- GENCY POWERS (DEFENCE) ACT, 1939. IN EXERCISE of the powers vested in him by Article 3 of the Emergency Powers (Colonial Defence) Order in Council, 1939, and the Emergency Powers {Defence) Act, 1939, the High Commissioner has made the following Defence Regulations: — 1. These Regulations may be cited as the Defence (Amendment of the Citation. Civil Trial of Members of the Forces Ordinance) Regulations, 1943. 2. In these Regulations Interpretation. "Member of the Forces" has the same meaning as that assigned to that term in section 2 of the principal Ordinance; "Principal Ordinance" means the Civil Trial of Members of the Cap. 19. Forces Ordinance; . "Scheduled* Member" means a person specified in the Schedule to these Regulations. 3. Notwithstanding anything contained in section 3 of the principal Application of Ordinance, in the event of a scheduled member being charged with section 3 of the having committed any of the offences mentioned in that section, it principal Ordin- shall be lawful for either a British magistrate or any other magistrate ance restricted, to hold the preliminary investigation. 4. Notwithstanding the provisions of section 5 of the principal Ordin- Application of ance, in the event of a scheduled member being charged with having section 5 of the committed any offence other than those mentioned in section 3 of the principal Ordin- principal Ordinance, it shall not be necessary that the civil court for ance restricted, the hearing of such charge shall consist solely of a British judge or judges or a British magistrate or magistrates. 5. Notwithstanding the provisions of section 10 of the principal Application of Ordinance, in the event of a scheduled member being a party to a civil section 10 of the action brought for hearing before a civil court, it shall not be necessary principal that the court shall consist of a British judge or a British magistrate Ordinance. or, British judges. 2. I n these Regulat ions— I n t e r p r e t a t i o n . "Member of the Forces" has the same meaning as that assigned to

4. 1. This Order may be cited as the Defence (Contro l of B a n a n a Waste) Order, 1943 .

2. I n this Order, unless the context otherwise requires — " B a n a n a waste" means any fibre, stalk, pu lp , p i t h or reed or any

other part of the banana shrub, but does not include the banana f r u i t .

" C o n t r o l l e r " means the Control ler of Salvage. " Inspector" means any inspector or officer appointed under any

Order made under Regulat ion 46 of the Defence Regulations, 1 9 3 9 , for the purposes of such Order.

"Licensee" means any person hold ing a v a l i d licence granted to h i m by or on behalf of the Control ler under paragraph 3 of this Order .

3. Save under the authority of a licence or permit granted to h i m ,by or on behalf of the Control ler , no person shal l , or shall offer to,

collect, store, purchase or otherwise acquire, or sell or otherwise dis ­pose of, or use any banana waste.

4. — ( « ) A n y person having i n his possession or under his control any quant i ty of banana waste exceeding 5 0 0 kilogrammes i n weight shall w i t h i n 14 days from the commencement of this Order furnish the Contro l ler w i th a re turn i n w r i t i n g , signed by h im. g i v i n g part i cu lars of the quantities of banana waste i n his possession or under his control .

( b ) A n y person who, on or after the commencement of this Order , becomes i n possession or control of any quant i ty of banana waste exceeding 5 0 0 kilogrammes i n weight shal l , w i t h i n 14 days of his becoming i n possession or control of such quant i ty of banana waste, furn ish the Contro l ler w i t h a re turn i n w r i t i n g , signed by h im, containing part i cu lars of the banana waste i n his possession or under his control .

5. Whenever the max imum price at which any person may sell, offer to sell , purchase or offer to purchase any banana waste is specified i n a notice issued by the Contro l ler and published i n the G a z e t t e , no

6. The holder of a licence granted under this Order shal l comply w i t h any conditions contained or incorporated i n the licence.

7. — ( 1 ) Notwi thstand ing anyth ing contained i n this Order , or i n any licence issued under this Order, every person shal l comply w i t h any special or general direct ion which may from time to time be given by or on behalf of the Contro l ler as to the appl i cat ion , treatment, keep­i n g , storage, movement, transport , d i s t r ibut ion , disposal, acquisit ion, use or consumption of banana waste.

( 2 ) A n y direct ion given by the Contro l ler under this paragraph may be published i n the G a z e t t e , and upon its being so published, every person to whom i t applies shall be deemed to have notice thereof and sha l l comply therewith.

8. Notwi thstand ing anything contained i n this Order — ( a ) the Contro l ler , i f i t is proved to his satisfaction that special

circumstances exist, may, by a special or general d irect ion issued by h i m under this Order, authorise any person to do or not to do any act which would otherwise be prohibited or required under this O r d e r ;

( b ) the Contro l ler , or any person authorised by the Contro l ler , i f i t is proved to his satisfaction that special circumstances exist, may, by a special permit granted by h i m under this Order, authorise any person to do or not to do any act which would otherwise be prohibited or required under this Order . I

9. E v e r y licensee shal l keep books which shal l contain complete p a r ­t i cu lars , as required by the Contro l ler , re la t ing to a l l purchases, sales, transfers, movements, manufacture, use or treatment of a l l banana waste which has come into his possession or under his control , and shal l on demand produce such books for inspection by the Contro l ler or any inspector.

10 . E v e r y licensee shal l , whenever requested by the Contro l ler to do so, furn ish the Contro l ler w i th a re turn i n w r i t i n g , signed by h i m , g i v i n g any part i cu lars required by the Contro l ler re la t ing to any purchases, sales)' transfers, movements, manufacture, use or treatment of any banana waste which has come into his possession or under his control .

1 1 . Wherever under any provisions of this Order any person is re­qu ired to obtain a licence or permit granted by or on behalf of the Contro l ler , such person shal l on demand made i n that behalf by any police constable or any inspector produce for inspection such licence or permit to the person m a k i n g the demand.

12 . I f any police constable, or inspector, has reasonable grounds for bel ieving that a contravention of the provisions of this Order has been committed i n respect of any banana waste, he may seize and detain such banana waste w i t h a view to the ins t i tu t i on of proceedings i n respect of such contravention. , 1 3 . A n y licence or permit granted h y or on behalf of the Contro l ler under the provisions of this Order may at any time be revoked or sus­pended and the conditions thereof may at any time be changed by or on behalf of the Contro l ler ,

1. These rules may be cited as the P u b l i c H e a l t h (S tandard of Foodstuffs) (Amendment) Rules, 1 9 4 3 , and shal l be read as one w i t h the P u b l i c H e a l t h (Standard of Foodstuffs) Rules , 1 9 3 5 , hereinafter re­ferred to as "the p r i n c i p a l ru les " .

( b ) F o r the purpose of this rule , the j e l l i f y i n g power or "the degree" of a pectin means the number of parts of sugar by the add i t i on of which one part of pectin produces a f irm je l ly upon the c a r r y i n g out of the test prescribed i n the F o u r t h Schedule to these rules, or any m o d i ­fication of such test which may be approved by the Director of M e d i c a l Services.

(c) Save w i t h the approval of the Director of M e d ­i ca l Services, the j e l l i f y i n g power of d ry pectin or pectin mixtures shall not be less than 6 0 "de­grees" and that of l i q u i d pectin solution not less than 6 "degrees".

( 3 ) (a) Pec t in may be sold either i n the form of a dry powder or i n the form of a l i q u i d solution.

(6) Pec t in shal l be sold without the admixture of other substances except such substances as may be approved by the Director of M e d i c a l Services.

( 4 ) There shal l be wr i t ten on a label attached to every package conta in ing pectin, i n cap i ta l letters of not less than four mil l imetres i n height, the word " P E C T I N " and, i n cap i ta l letters of the same size, the words " J E L L I F Y I N G P O W E R N O T L E S S T H A N X D E G R E E S " , ind i ca t ing i n the place W " X " the number of degrees as determined i n the manner provided for i n paragraph 2(a) of this rule.

( 5 ) The word " p e c t i n " or expressions which i n ­clude or resemble the word " p e c t i n " shal l not be used on any package containing any substance which i s not genuine pectin according to the standards pre­scribed by or under the foregoing provisions of this

4. The fo l lowing Schedule shal l be added immediately after the T h i r d Schedule to the p r i n c i p a l rules : —

1. D r y P e c t i n . 3 0 grammes of sucrose are boiled i n a smal l beaker w i t h 2 5 grammes of

d i s t i l l ed water u n t i l a clear solution is obtained. The quant i ty of d ry pectin required for the test, as specified below, is added and dissolved by gently heating while s t i r r i n g wel l . The solution is then boiled u n t i l i t has obtained a weight of 4 9 grammes, and then 1 c.c. of a 2 5 per cent, solution of c i t r i c acid, or 1 c.c. of a 1 2 . 5 per cent, solution of lactic ac id , is added, and the solution is thoroughly s t i rred . A f t e r standing for 2 4 hours at a temperature of 15° C . a f irm je l ly shal l have been formed which after removal from the beaker can be cut into cubes wi th sharp edges, which reta in their shape. 2. P e c t i n S o l u t i o n .

The quant i ty of pectin solution required for the test, as specified be­low, has to be taken. The procedure is the same as for d r y pectin, but the weight of the pect in solution has to be deducted from the weight of d i s t i l l ed water used for the preparat ion of the o r i g i n a l solution. 3.
