From Director General’s Desk The Issue of Jal Vikas, which is the In-house Bulletin of NWDA of January, 2017 contains a recap of works accomblished by NWDA during the period starting from January 2016 to December 2016. The main activities of NWDA carried out in the year 2016 covered briefly under the heading “The

Highlights”. The functions of NWDA were amended and approved during the year and is entrusted with two more tasks relating to implementations of ILR and PMKSY projects and to act as a repository of borrowed funds. The other features added in the issue are a technical article on “Significance of Cauvery Dispute for NWDA” contributed by Shri M.K.Sinha, Senior Consultant, Special Committee for Interlinking of Rivers (SCILR); brief detailing of main activities carried out by NWDA during the year 2016 such as India Water Week 2016 (IWW 2016) held during 4-8 April, 2016 with the main theme “Water for All: Striving Together”. It was a prestigious event for the MoWR,RD & GR, NWDA and to mention that there were more than 1500 delegates including foreign delegates participated in the event and issues relating to the main theme were deliberated under related topics in 33 Technical Sessions comprising of 8 Seminars, 7 Panel Discussions, 6 Brainstorming Sessions, 6 Case Studies, 5 Side Events and one Special Session. Israel was associated as Partner Country while the States of Gujarat, Karnataka, Maharashtra, Rajasthan and Telengana acted as partner States while organisation the IWW-2016 event cum Water-Expo-2016.

During the reporting period NWDA also held its 30th Annual General Meeting (AGM) on June 22, 2016 under the Chairmanship of Sushri Uma Bharti, Hon‟ble Minister for Water Resources, RD & GR; 62nd and 63rd meetings of Governing Body (GB), which were held respectively on January 27 and June 13, 2016 under the Chairmanship of Shri Shashi Shekhar, Secretary, MoWR, RD & GR. In addition to this NWDA also held its 42nd Technical Advisory Committee (TAC) meeting on May 23, 2016 under the Chairmanship of Shri G.S. Jha, Chairman, Central Water Commission. Senior Officers of MoWR, RD & GR along with the august gatherings of Principal Secretaries/Engineer-in-Chief of Various State Governments; and Senior Officers of Various Central and State Government Departments participated in these meetings.

Hope this issue would enlight our readers about the activities of NWDA and its role in planning and development of water resources of various river basins of India. We look forward to receiving your valuable suggestions and support for NWDA objectives and improving the value of Jal Vikas magazine.

Highlights of NWDA Activities Held in 2016

The 62nd and 63rd Governing Body meetings of NWDA were respectively held on 27.01.2016 and 13.06.2016, under the Chairmanship of Secretary, MoWR, RD & GR at New Delhi.

Hon‟ble Minister of the WR, RD & GR along with NWDA Officers held meeting with Hon‟ble Chief Minister, Government of Odisha regarding Mahanadi-Godavari Link Project on 03.02.2016 at Bhubaneswar.

The SCILR, which was constituted based on the Supreme Court, Government of India judgement dated 27.02.2012, held its 8th, 9th and 10th meetings respectively on 08.02.2016, 29.04.2016 and 26.07.2016 under the Chairmanship of Sushri Uma Bharati, Hon‟ble Minister, MoWR, RD & GR and 11th meeting on 09.11.2016 under the Chairmanship of Shri Vijay Goel, Hon‟ble Minister of State for MoWR, RD & GR and Hon'ble Minister of State (Independent Charge) for the Ministry of Youth Affairs and Sports at Vigyan Bhawan, New Delhi.

The work of organizing Jal Manthan-2 was entrusted to NWDA by the MoWR,RD&GR and was convened during 22-23 February, 2016 at Vigyan Bhavan, New Delhi.

The work of organizing India Water Week-2016 (IWW-2016) is entrusted to NWDA by the MoWR,RD&GR and the 4th IWW-2016 was convened from 4th-8th April, 2016 at New Delhi.

The Task Force constituted by the MoWR,RD&GR vide OM dated 13.04.2015 for Interlinking of Rivers held its 3rd, 4th and 5th meetings under the Chairmanship of Shri B.N. Navalawala, Chief Adviser to the MoWR, RD & GR respectively on 28.04.2016, 15.06.2016 and 25.10.2016 at New Delhi.

The Environmental Appraisal Committee (EAC) of the Ministry of Environment and Forests & Climate Change (MoEF & CC) recommended Lower Orr Dam Project proposed as a part of Ken-Betwa Link Project (Phase-II) for grant of Environmental Clearance (EC) in its 93rd meeting held on 02.05.2016.

As per the decision taken in the first meeting of the SCILR held on 17.10.2014, a Sub-Committee on System Studies for identification of most appropriate alternative plan was constituted and its 8th and 9th meetings were held respectively on 13.05.2016 and 30.08.2016 under the Chairmanship of Prof.P.B.S.Sarma at CWC, New Delhi.

The 42nd TAC meeting of NWDA was held on 23.05.2016 at CWC, New Delhi under the Chairmanship of Shri G.C.Jha, Chairman, CWC, New Delhi.

As per the decision of SCILR, Shri M. Gopalakrishnan, Chairman of the Sub-Committee on Restructuring of NWDA made a presentation on Restructuring of NWDA on 30.05.2016 in a meeting headed by Hon‟ble Minister, WR, RD &GR.

The 1st meeting of the Joint Committee, pertaining to Mahanadi-Godavari Link Project was held on 02.06.2016 at New Delhi under the Chairmanship of Special Secretary, MoWR, RD

&GR in presence of its Members of Secretary/Principal Secretary of concerned State Governments and Chairman, CWC and D.G, NWDA as Member-Secretary.

The 1st, 2nd, 3rd, 4th and 5th meetings of the Group on Legal Aspects were respectively held on 19.08.2016, 15.09.2016, 28.10.2016, 04.11.2016, and 02.12.2016 under the Chairmanship of Shri A. D. Mohile, Former Chairman, CWC at CWC, New Delhi.

The 5th Special General Meeting followed by 30th Annual General Meeting of NWDA was held on 22.06.2016 at Vigyan Bhawan, New Delhi under the Chairmanship of Sushri Uma Bharati, Hon‟ble Minister, MoWR, RD & GR.

A Presentation by the Special Secretary, MoWR, RD & GR was made to Shri Nitin Jairam Gadkari,Hon‟ble Minister of Road Transport and Highways on Mahanadi-Godavari and Sankosh-Mahanadi Link Systems on 06.07.2016.

The Techno-Economic Clearance of Ken-Betwa Link Project (Phase-I) had been accorded by the Advisory Committee chaired by Secretary,MoWR, RD&GR in its meeting held on

08.07.2016.

Advisory Committee of the MoWR, RD&GR in its meeting held on 08.07.2016 had also accorded the Techno-Economic Clearance of Damanganga-Pinjal (D-P) and Kosi-Mechi (Intra-State) Link Projects subjected with certain conditions.

The 7th meeting of the Sub-Committee for “Comprehensive Evaluation of Reports Vailable on the Issue of ILR” was held on 26.07.2016 under the Chairmanship of Shri B.N. Navalawala, Chief Advisor, MoWR, RD & GR at Vigyan Bhawan, New Delhi.

Hindi Pakhwada was organised in NWDA during 01.09.2016 to 14.09.2016 and all the officials of NWDA attended and participated with full enthusiasms and the Awardees were felicitated with cash awards and certificates.

Signing of Memorandum of Agreement (MoA) between National Bank for Agriculture and Rural Development (NABARD) & NWDA, MoWR, RD & GR was held on 06.09.2016 at India Habitat Centre, New Delhi.

A programme had been arranged by NABARD for handing over the cheque for sanction and disbursement of First Loan under Long Term Irrigation Fund (LTIF) to DG, NWDA on 21.10.2016 at North Block, New Delhi.

NWDA participated in 36th IITF-2016 held during 14-17 November, 2016.

A meeting of the Hon‟ble Minister WR, RD&GR with Hon‟ble Finance Minister regarding funding pattern of Ken-Betwa Link Project under PMKSY was held on 09.12.2016 at North Block, New Delhi.

The MoWR, RD&GR team led by Secretary (WR, RD&GR) met Hon‟ble Chief Minister of Gujarat on 31.12.2016 at Gandhinagar and made presentation on Par-Tapi-Narmada Link Project.

Significance of Cauvery Dispute for NWDA Shri M.K.Sinha*

1.0 Background

For the two months, namely September and October 2016, Cauvery river basin issue has remained in limelight for the whole nation. There has been unprecedented violence in the State of Karnataka when the Hon‟ble Supreme Court gave its first direction to the State Government of Karnataka to release 15,000 cusecs of water to the State Government of Tamil Nadu. Curfew and Section-144 were imposed in many parts of Karnataka, where farmers were agitating and protesting against the direction of Supreme Court regarding release of water. Hon‟ble Court reduced the quantum of water to be released in its subsequent decisions. But, the intensity of protests was not coming down. There was tension in Tamil Nadu also, particularly on Tamil Nadu-Karnataka border areas. It was war like situation between the two States over the issue of water. Now let us examine how this issue got so magnified in spite of clear cut allocation of water by Cauvery Tribunal among the Cauvery Basin States and is of importance and significance for NWDA. 1.2 Cauvery Water Dispute Tribunal Award

The Cauvery Water Dispute Tribunal (CWDT) that gave its report in the year 2007 by allocating the waters of the Cauvery basin among the co-basin States of Karnataka, Tamil Nadu, Kerala and the Union Territory of Puduchery based on the yield of the river assessed at 50% dependability. The Tribunal, in a unanimous decision in 2007, determined the total availability of water in the Cauvery basin as 740 thousand million cubic feet (TMC) at the Lower Coleroon Anicut site, including 14 TMC for environmental protection and seepage into the sea. The final award makes an annual allocation of 419 TMC to Tamil Nadu in the entire Cauvery basin, 270 TMC to Karnataka, 30 TMC to Kerala and 7 TMC to Puducherry. Further, as per award, in a normal year, Karnataka has to release 192 TMC to Tamil Nadu at Billigundulu in monthly deliveries as per the details given below:

This comprises 192 TMC from the allocated share of Tamil Nadu, including 10 TMC

The Tribunal had recommended for setting up of a Cauvery Management

Board/Authority on the lines of Bhakra Beas Management Board for implementation of the order. The Board would in turn constitute a Cauvery Water Regulation Committee for assistance. The award authorises the Board/Authority to monitor the monthly releases with the help of the States concerned and the CWC, MoWR for five years. Thereafter, if any modification/adjustment is needed in the schedule, it may be worked out in consultation with the party-States with the help of the CWC “without changing the annual allocation among the parties”. However Cauvery Management Board/Authority is yet to be set up.

1.3 How Cauvery Crisis Got Magnified

1. On 22nd August, 2016, Tamil Nadu approached the Supreme Court seeking direction to Karnataka to release 50 TMC of Cauvery water from its reservoirs for its third samba cultivation, as mandated in the final order of the CWDT 2007. Then Karnataka cited distress situation, as Karnataka felt there was only water enough for drinking purposes and declined to release water to Tamil Nadu. 2. On 5th September, 2016, the Supreme Court ordered Karnataka to release 15,000 cusecs per day to Tamil Nadu for next 10 days till 16 September 2016. 3. On 9th September, 2016, the State of Karnataka observed a bandh and protested against the release of water to Tamil Nadu. The Supreme Court was approached by Karnataka citing public unrest, seeking modification of the earlier order. 4. On 12th September, 2016, the Supreme Court modified the 5th September order, directing Karnataka to release 12,000 cusecs of water till 20th September 2016. This decision by the Supreme Court led to further unrest among the people of Karnataka as the water release limit was increased by extending the number of days. As a result the violence spread more severly and broke out in Bangalore, Mysore, Mandya and other parts of the State. 5. On 20th September, 2016, the Supreme Court directed Karnataka to further release 6,000 cusecs of water from 21st September 2016 to 27th September 2016 and directed the Central Government to set up the Cauvery Management Board in order to provide a permanent solution for the dispute. However, in a Special Session of the Karnataka Legislative Assembly held on 23rd September 2016, a resolution was passed not to release water to Tamil Nadu, by defying the Supreme Court's order. 6. On 27th September 2016, the Supreme Court ordered Karnataka to give 6000 cusecs of water to Tamil Nadu for 3 days, which was again not carried out. 7. On 30th September 2016, the Supreme Court gave Karnataka a "last chance" and ordered 6,000 cusecs of water to be released during the first 6 days of October. On 1st October 2016, Karnataka filed for review petition over the Supreme Court's latest order of releasing 6,000 cusecs of Cauvery water from October 1 to 6 and also held a Special Session of the State Legislature. In an another Special Legislature Session held on 3rd

October 2016, the State Government of Karnataka decided to release water for agricultural purposes, but it was not specified whether water would be released to farmers of Karnataka or Tamil Nadu. The Supreme Court on October 4 2016 directed Karnataka to release 2,000 cusecs of Cauvery water per day to Tamil Nadu from October 7 to 18. The hearing of the case is then adjourned to October 18.

1.4 Reasons for 2016 Cauvery Dispute

1. As mentioned earlier, there is no Cauvery Management Board / Authority in existence right now, which can monitor the release of water from Karnataka dams to Tamil Nadu. 2. Hon‟ble Supreme Court in their first judgement directed Karnataka to release 15,000 cusecs of water per day in early September. However Karnataka did not release water to Tamil Nadu on the plea that they do not have adequate storage in their reservoirs in Cauvery basin and water available is only enough to meet their drinking water requirements in the adjoining area till next monsoon. 3. Karnataka‟s plea was that drinking water has been accorded highest priority as per National Water Policy of the Government of India. Priority of irrigation comes only after drinking water. 4. Tamil Nadu has advantage of having two monsoons in their State, i.e., south-west monsoon and north-east monsoon whereas Karnataka has only south-west monsoon.

In order to defer the release of water to Tamil Nadu as per the order of the Supreme Court, Karnataka Government convened special one day Assembly Session to discuss Court Order and pass necessary resolution.

Former Prime Minister Sri H. D. Deve Gowda went to the extent that he sat on

hunger strike for indefinite period to make pressure on the State Government for not releasing water to Tamil Nadu. Later on, based on the requests of his senior colleagues, he broke his hunger strike.

The Supreme Court in its subsequent orders reduced the quantum of water to be released to Tamil Nadu to 12.000 cusecs, 6,000 cusecs and 2,000 cusecs respectively. Later, Karnataka Government again called assembly session to discuss the situation arising out from the Supreme Court order and agreed to release water to Tamil Nadu on the plea that storage situation in their reservoirs have improved due to occurance of rains in upper catchment. Thanks to Karnataka Government for honouring the decision of apex court. However, tension is still prevailed among the farmers of Cauvery Command in Karnataka. 2.0 Constitution of High Level Team and Association of Director General, NWDA

The Hon‟ble Supreme Court appointed a High Level Technical Team headed by Shri G.S. Jha, Chairman, CWC. The team consisted of Shri Syed Masood Hussain, Member (WP&P), CWC & DG, NWDA and Dr.R.K.Gupta, Chief Engineer, CWC. The Team visited Karnataka and Tamilnadu regions to take stock of the ground realities and to submit its

report to the Supreme Court on or before 17th October, 2016 as per direction so that the same can be taken into consideration during the next proposed hearing of the Court on 18th October 2016. 3.0 Supreme Court Judgement dated 18.10.2016

The Hon‟ble Supreme Court asked Karnataka to keep releasing 2000 cusecs of water to Tamil Nadu on daily basis till further order and directed both the States, i.e., Karnataka and Tamil Nadu to take measures to control public agitation on water dispute and maintain law and order. This is still interim order. However, the Supreme Court reserved its order on maintainability of appeals filed by Karnataka, Tamil Nadu and Kerala against the 2007 award of the CWDT. A bench of Justices Dipak Misra, Amitava Roy and A M Khanwilkar asked the parties to file their written submissions by October 24 and said it would pass the order thereafter.

The Centre, through Attorney General, had raised a preliminary objection claiming that the CWDT award amounted to a final decree in the dispute and the apex court had no jurisdiction to hear appeals against the award of the tribunal. Continuing its argument, Karnataka said that appeals filed by the State against the award of the tribunal were maintainable. Senior advocate Fali S Nariman, appearing for Karnataka, said that the Supreme Court had the jurisdiction to adjudicate the appeals filed by the State against the award of Tribunal. Senior advocate Shekhar Naphade, appearing for Tamil Nadu, also contended that the appeals were maintainable and no statute can take away the powers of the apex court. "Section 6(2) of Inter-State Water Disputes Act, 1956 cannot oust Supreme Court's constitutional appellate powers given under Article 136 of the Constitution,"Naphade said. Similarly, Kerala also supported the stand of Karnataka and said that the appeals were maintainable. 3.1 Unusual Development

Convening of Special one day Assembly Session by Karnataka Government to defer implementation of the Supreme Court Order was an incorrect precedence set by the State of Karnataka. As a result, the Senior Advocate, Shri Fali S. Nariman, State Counsel of Karnataka on Cauvery issue threatened to withdraw from the case. However, later on persuasion by the Hon‟ble Irrigation Minister, Government of Karnataka Shri Nariman agreed to defend the case in the Supreme Court.

Further, eruption of large scale violence on the judgement of Supreme Court on Cauvery water is also undesirable for both the States because many persons working in Banglore live in Hosur and adjoining area in Tamil Nadu. For Banglore, being most important IT City of the Country and having cosmopolitan character, such incident is most unfortunate. As per one of the estimates, 10.5 lakh Kannada speaking population live in Tamil Nadu whereas 18.9 lakh Tamil speaking population live Karnataka out of which 9.11 lakh Tamil speaking population live in Banglore alone.

Again, Tourist Taxi Operator‟s Association has also assessed the losses due to the

water agitation as Rs.300 crores while Karnataka State Road Transport Corporation (KSRTC) is reported to have assessed their losses as Rs 37 crores as per Times of India Report dated 6.10.2016.

4.0 Conclusion 1. Allocation of water to basin States on the basis of 50% dependable flow by CWDT has direct impact on NWDA‟s ILR programme. Now Telengana is pressing hard in different meetings of NWDA, SCILR and Sub Committees of SCILR to change the existing criteria of working out surplus water based on 75% dependable flow to 50% dependable flow. 2. Arguments in the Supreme Court by different State Counsels, as reported in the newspapers, show that there is difference of opinion in Judiciary and Executive over the award given by CWDT. Things will be more clear when final judgement of the Supreme Court in this case will be known. It may be historic decision for the water sector. 3. At one stage, for expeditious implementation of ILR programme, there were thinkings to seek intervention of the Hon‟ble Supreme Court. However, seeing the legal implications in the matter, Task Force on ILR constituted a Group on Legal Aspects, headed by Shri A. D. Mohile, Former Chairman, CWC to look into the matter and suggest action required to be taken in this regard. The Group has held four meetings so far. The Report of the Group is yet to be submitted to the Task Force for consideration. 4. Irrespective of the recommendation of the Group and its acceptance by the Task Force, SCILR and Ministry of Water Resources, it is not certain that whether the Donor State will agree to share the surplus water (as worked out by NWDA) to Donee State or will follow the path of Karnataka to register their protest. 5. The Government of India will have to take into consideration of the like situation arised out from Cauvery Dispute, while taking any decision for expeditious completion of ILR programme in various river basins of India.

I Feasibility Studies for Inter Basin Transfer of Water Projects IA. Peninsular Rivers Development Component

The Surveys & Investigations and preparation of Feasibility Reports (FRs) of all 16

Inter Basin Transfer of Water (IBWT) links under Peninsular Rivers Development Component have been completed except two minor links viz. Bedti–Varda and Netravati–Hemavati for which concurrence of the Government of Karnataka is awaited. IA.1. Bedti-Varada Link: Although the Government of Karnataka has given their concurrence for the preparation of Feasibility Report, the Survey and Investigation work could not be carried out due to opposition from the local people/NGO of the region, who demanded EIA studies for the concerned area. Subsequently, the Bedti-Varada link proposal has been discussed in the meeting of the Sub-Committee for Consensus Building held on 30.10.2015. In the 62nd Governing Body meeting of NWDA held on 27.01.2016, the representative of the Government of Karnataka informed that the EIA studies of Bedti-Varada link have been entrusted to a consultant by the Government of Karnataka as per the ToR prepared by NWDA for this purpose. IA.2 Netravati-Hemavati Link: The Government of Karnataka categorically stated that since the river Netravati is an Intra-State river, its waters are vested with the State of Karnataka vide reference to the Entry 17 of the State list of 7th Schedule to the Constitution and hence it is entirely the prerogative of Karnataka to decide on the manner of utilization of Netravati water. Accordingly, the Government of Karnataka is planning to utilize Netravati river water to meet the drinking requirement for Bengaluru City and other drought prone districts and mentioned that after meeting these requirements, surplus if any, available in Netravati will be informed to NWDA. If permission for carrying out Surveys and Investigation is received from Karnataka, NWDA will start the work of preparation of the FR for this link. The efforts are continuously being made by NWDA for getting the concurrence.

The Government of Karnataka vide letter dated 19.12.2015 has provided a copy of the DPR of Yettinhole project envisaging transfer of Netravati water to Kolar, Chikkaballapur, Ramnagar, Bangalore, Hassan, Tumkur and Chikkamagaluru has been submitted to NWDA in December, 2015. The report has been examined by NWDA and the comments of NWDA have been sent to the Government of Karnataka vide offce letter dated 11.11.2016.

IA.3 Alternative Studies on Mahanadi-Godavari Link for DPR Preparation

As decided during the weekly review meeting taken by the Hon‟ble Minister for Water Resources, RD & GR held on December 3, 2014, NWDA has examined the feasibility of Mahanadi–Godavari link to address the concerns of the Government of Odisha due to the considerable submergence involved in the proposed Manibhadra Dam site, which is

considered as the diversion point for the water transfer through Mahanadi–Godavari link project.

As an alternate proposal of Mahanadi (Manibhadra)-Godavari (Prakasam Barrage at Dowlaiswaram) with reduced submergence, namely Mahanadi (Baramul)-Rushikulya-Godavari (Dowlaiswaram) link has been prepared. The alternate proposal was also presented to the Hon‟ble Chief Minister of Odisha on 29.05.2015. The representative of Odisha Government mentioned that the proposal presented before the Hon‟ble Chief Minister was preliminary in nature and lacked sufficient details. He also mentioned that Water Resources Department (WRD), Odisha has also not agreed to the Water Balance Studies of Mahanadi basin carried out by NWDA. The Director General, NWDA mentioned that the water diversion to Godavari and further down to South is not only depended on this link but also on the proposed Manas-Sankosh-Tista-Ganga (M-S-T-G) link coming under the Himalayan Component. The proposed M-S-T-G link is expected to provide large quantity of water for diversion to Mahanadi and water deficit regions.

The issue of water balance study of Mahanadi basin were discussed and considered

by the Sub-Committee II constituted by the SCILR for System Studies for identification of most appropriate plan in its 4th, 6th and 7th meetings respectively held on 28.07.2015, 21.08.2015 and 29.09.2015. It was then decided to carry out system simulation studies of Mahanadi-Godavari link including the water balance studies to ascertain the surplus water available for diversion of through National Institute of Hydrology (NIH), Roorkee. The NIH, Roorkee has submitted the draft report on water balance study of the Mahanadi-Godavari link project and the same has been projected in the 8th meeting of the Sub-Committee held on 13.05.2016. The draft report was also sent to the Government of Odisha for their views. The observations of Government of Odisha have been received vide their letter dated 29.06.2016.

The study has been completed in July 2016. The draft report prepared by the NIH

has been presented in the 9th meeting of the Sub-Committee II held on 30.08.2016. It was decided that water balance study of Mahanadi-Godavari link project may be revised after revising the ultimate water utilization data and suggestions of the Sub Committee on System Studies. The report is under revision by NIH during the reporting period. IB Himalayan Rivers Development Component

Out of the total 14 links identified under the Himalayan Rivers Development Component, FRs by considering the Indian portion of 2 links namely, Sarda-Yamuna and Ghagra-Yamuna are completed. Draft FRs pertaining to 7 links are also completed and are:

i) Yamuna-Rajasthan link ii) Farakka-Sunderbans link iii) Ganga(Farakka)-Damodar-Subernarekha link iv) Subernarekha-Mahanadi link v) Chunar-Sone Barrage link vi) Rajasthan-Sabarmati link vii) Gandak-Ganga link

Survey and Investigation(S&I) work of Kosi-Ghaghara link in Indian Portion has been completed. The S&I of Sone Dam–Southern Tributaries of Ganga (STG) is under progress. The remaining two links are presently not included in target because the two links, namely 1. Kosi-Mechi link lies entirely in Nepal and 2. Jogighopa-Tista-Farrakka (J-T-F) link is an alternate of the M-S-T-G Link.

An alternative option (forest free) for the M-S-T-G link (Manas-Tista) without involving lifts of various magnitudes has been worked out by NWDA and the preparation of its Feasibility Report is under progress.

Present planning and studies of M-S-T-G link was presented by NWDA in the Sixth meeting of the Special Committee held on 15.09.2015. It was then informed that the PFR of the M-S-T-G was completed in 1996 and the FR as per original alignment could not be completed as the M-S-T-G is passing through Manas and Buxa Tiger Reserves and other forests. Considering the practical difficulties for surveys and investigations in these reaches, NWDA has carried out the alternate forest free alignment study involving about 80m lift.

The FR of the alternate alignment of M-S-T-G link is under final stage of preparation

and after completion the same will be submitted to the Government of West Bengal, Assam and Bihar for their views on the FR. IB.1 Consensus Building Process for Manas-Sankosh-Tista-Ganga Link Project The M-S-T-G link project was discussed by the Sub-Committee for System Studies for evaluation of most appropriate alternative plan in its 5th meeting held on 28.07.2015. Hon‟ble Minster (WR, RD&GR) has requested the Hon‟ble Chief Minister, West Bengal vide letter dated 31.12.2015 sought support to the Project Proposal. Representative of the Government of West Bengal desired that their suggestions may be considered in the report.

A Team of Senior Officers of Ministry of WR, RD & GR led by Special Secretary, Ministry of WR, RD & GR; Director General, NWDA; and other Senior Officers of NWDA held a meeting with the Chief Secretary, Government of West Bengal at Kolkata on 17.08.2015 regarding Sankosh-Mahanadi Link System, comprising of four links namely; Sankosh-Tista (first phase of the M-S-T-G link); Ganga - Damodar – Subernarekha (G-D-S); Subernarekha-Mahanadi(S-M) and Farakka-Sunderbans (F-S) link projects. The team requested the Government of West Bengal for agreeing to the proposal and preparation of its DPRs by NWDA. The State Government was also requested to furnish their suggestions towards improvement of the proposal.

A Presentation by Special Secretary, MoWR, RD & GR was made to the Hon‟ble

Minister of Transport regarding Mahanadi-Godavari and Sankosh-Mahanadi Link System on 06.07.2016.

The DPRs of the linkage systems will be taken up only after getting formal approvals from the Government of West Bengal and other concerned States.

III . Detailed Project Report III.1 Ken-Betwa Link Project (Phase-I) III.1.1 Background

A tripartite MoU for the preparation of DPR of Ken-Betwa Link Project was signed amongst the Union Government of India, Governments of Madhya Pradesh and Uttar Pradesh on 25.8.2005. The DPR for the Phase-I of project was completed by NWDA and sent to the concerned States of Uttar Pradesh (UP) and Madhya Pradesh (MP) in April-2010. III.1.2 Project Components of Ken-Betwa Link Project (Phase-I)

The Ken-Betwa link Phase-I envisages diversion of surplus water of Ken basin to water deficit Betwa basin. The project will irrigate enroute areas and the identified command areas in UP and MP. A 77 m high dam, namely Daudhan with gross capacity of 2953 Million Cubic Meters (MCM) is proposed across the river Ken, about 2.5 km upstream of existing Gangau Weir on Ken River. The reservoir involves a submergence of 9000 ha area, out of which 5803 ha comes under Panna Tiger Reserve (PTR) which includes 4141 ha of forest area. PTR are coming under submergence is 7.6% of the total Panna Tiger Reserve area. The total length of the link canal will be 221 km including length of tunnels. Two power houses, one at the toe of the dam and other at the outlet of lower level tunnel are also proposed to generate power with a total installed capacity of 78 MW.

The total cost of the project has been estimated to be Rs.18057.08 crore (at price

level 2015-16). The Benefit Cost (BC) ratio for the project is worked out to be 1.56 and Internal Rate of Return (IRR) as 12%. III.1.3 Project Benefits

The project will provide irrigation to an area of 6,35,661 ha annually (3,69,881 ha in MP and 2,65,780 ha in UP) against the CCA of 5,15,215 ha (2,87,842 ha in MP and 2,27,373 ha in UP). Chhattarpur, Tikamgarh & Panna districts of MP and Mahoba, Banda & Jhansi districts of UP will get benefit from the proposed irrigation. The project will also provide 49 MCM of water for enroute drinking water supply to the UP & MP population of about 13.42 lakh. The project will also generate 78 MW of hydropower.

The Ken–Betwa Link Project has been included as a National Project and also a part of Prime Minister‟s Bundelkhand Package.

III.1.4 Present Status Techno-economic Clearance: Techno economic clearance to the project accorded by the Advisory Committee Chaired by Secretary (WR,RD&GR) in its meeting held on 8.7.2016

subject to submission of Environment, Wildlife & Forest Clearances from MoEF&CC and MoTA clearance. Wildlife Clearance: Standing committee of NBWL of MoEF&CC chaired by the Hon‟ble Minister (MoEF&CC) in its 39th meeting held on 23.08.2016 recommended the project for according Wildlife clearances. The Ministry issued wildlife clearance on 21.09.2016 with certain conditions. Environmental Clearance: Newly Constituted Expert Appraisal Committee of MoEF&CC considered the Environment Clearance (EC) in its first meeting held on 30.12.2016 and recommended the project for grant of environmental clearance with certain conditions. Forest Land Diversion Clearance: NWDA submitted the proposal for Forest Land Diversion Clearance (FLDC) to MoEF& CC and made all the compliances of queries raised by them. The proposal of according the FLDC for the project has been considered by Forest Advisory Committee (FAC) in its meeting held during 9th-10th November, 2016 and constituted a Sub-Committee with a direction to inspect the site, verify relevant documents/reports and furnish its report to FAC. Clearance from Ministry of Tribal Affairs: The proposal seeking clearance from Ministry of Tribal Affairs (MoTA), Government of India for Resettlement and Rehabilitation (R&R) plan for the Project Affected Families (STPFs) in respect of Scheduled Tribes Ken-Betwa Link Project (Phase-I) has been submitted to the Secretary, MoTA in the prescribed format on 7.06.2016 along with supporting documents. Investment Clearance of Project (Phase-I): To expedite the implementation of the project, the investment clearance proposal for Rs.18057.08 crore was submitted by NWDA to CWC in prescribed format on 4.10.2016. Appraisal by CWC completed. CWC submitted the proposal to Commissioner (SPR), MoWR, RD & GR and considered in the meeting of MoWR, RD&GR on 7.10.2016. The same is under process in the MoWR, RD &GR. The Ministry of Finance has been requested on 8.12.2016 to consider the funding requirement at 90:10 ratios. III.2 Ken-Betwa Link Project (Phase-II)

The DPR for the Ken-Betwa Link Project (Phase-II) has been completed and submitted to the Governments of MP and UP in January, 2014. The Project consists of one major dam at Lower Orr and four barrages at Neemkheda; Barari; Kotha and Kesari. The Project will provide annual irrigation of 98847 ha in MP and water supply to 1.65 Lakh populations. The estimated cost of the project is Rs. 2282.94 crores (2012-13 price level) and the Benefit-Cost Ratio for the project is worked out to be 1.56 and Internal Rate of Return (IRR) as 14.87%.

III.2.1 Present Status

(a) Environmental Clearance of Lower Orr Dam The Environmental Clearance for Lower Orr dam has been considered by the EAC of MoEF & CC in its 93rd meeting held on 02.05.2016 and recommended the project proposal for grant of EC. The MoEF & CC vide its letter dated 29.07.2016 requested NWDA to submit a copy of the Phase-I Forest Clearance for consideration of recommendations of the EAC for issue of EC for Lower Orr dam.

(b) Forest Clearance of Lower Orr Dam

Application of the forest clearance of Lower Orr dam under Ken-Betwa Link Project (Phase-II) has been submitted to the MoEF & CC on 02.10.2014. The FLDC compliance of all online comments of MoEF&CC on Form-I for the forest clearance has been completed.

Approval of the CAT Plan from the Chief Conservator of Forests (CCF), Shivpuri and Ashok Nagar, MP has been received and uploaded on the website of MoEF & CC. The proposal of FLDC in respect of Lower Orr dam has been submitted by the Government of MP along with its recommendations to the MoEF&CC.

The FAC of the MoEF&CC has discussed the proposal in its meeting held on 10.11.2016 and constituted a Committee with a direction to inspect the site, verify relevant documents/reports and furnish its report to FAC. III.3 Damanganga-Pinjal Link Project III.3.1 Background

Damanganga-Pinjal (D-P) link project is one of the proposed links of NWDA coming under the Peninsular Rivers Development Component of the NPP. As a result of the concerted efforts taken by NWDA, a consensus was arrived amongst the State Governments of Gujarat and Maharashtra for the preparation of the DPR of the D-P link project. A Memorandum of Understanding was signed by the State Goverments of Gujarat and Maharashtra and Union Government of India on 03.05.2010 at New Delhi for the preparation of the DPR.

III.3.2 Project Components and Benefits

The main components of the proposed D-P link project are 1. construction of Bhugad dam across the river Damanganga near Bhugad village of Trimbak taluka in Nasik district of Maharashtra; 2. Khargihill dam at Khargihill across the river Vagh, a tributary of Damanganga river near Behadpada village in Jawhar taluka of Thane district of Maharashtra, 3. Pinjal dam (proposed by the Government of Maharashtra), across the river Pinjal, near village Khidse in Wada taluka of Thane district and 4. two tunnels of lengths 17.488 km and 25.224 km for connecting respectively Bhugad reservoir with Khargihill reservoir and Khargihill reservoir with Pinjal reservoir.

The project will provide 579 MCM of water annually to Mumbai Metropolitan City for

augmentation of its domestic water supply requirement and generation of 5 MW of hydropower. The water diversion through the D-P link project is planned in such a manner that it will provide about 1,586 MLD of water for the augmentation of domestic water supply requirement of the Mumbai City and 865 MLD of water from the Pinjal dam project. Thus a total quantity of 2,451 MLD would be made available through the project components. The cost of the project components is Rs. 3008 crore at 2015-16 price level. The B.C. ratio is 1.95. As per the DPR, the construction time required for the project is estimated to be seven years. III.3.3 Present Status

The DPR of D-P Link Project has been completed by NWDA in March, 2014 and submitted to the Governments of Maharasthra and Gujarat. It was decided that Municipal Corporation of Greater Mumbai (MCGM) would be responsible for initiating further action for the implementation of the projects including statuatory clearances. Techno-economical Clearance: The Advisory Committee of MoWR, RD&GR in its meeting held on 8.7.2016 has accorded the techno-economic clearance subject to submission of forest clearance from the MoEF&CC for diversion of 1673.78 ha forest land and clearance for the R&R of the project affected tribal population from MoTA. Water Sharing: The issue of Water Sharing has been discussed in the various meetings of the Special Committee for ILR. Efforts to resolve the issue are continuing. The MoWR, RD&GR team led by Secretary, WR, RD&GR met the Chief Minister, Government of Gujarat on 31.12.2016 and made presentation on this link. Response received from the Government of Gujarat was positive. Forest Land Diversion Clearance: The online application for receiving the FLDC submitted to the MoEF & CC on 30.06.2016. Clearance from the Ministry of Tribal Affairs: The application for taking MoTA clearance was submitted to the MoTA, Government of India on 30.06.2016. III.4 Par-Tapi-Narmada Link Project III.4.1 Background

The FR of Par-Tapi-Narmada (P-T-N) link project was prepared by NWDA during

October, 2005 and circulated to all concerned State Governments and Members of Technical Advisory Committee (TAC) of NWDA. A tripartite MoU was signed by the states of Gujarat and Maharashtra and the Union Government on 3.5.2010 at New Delhi for preparation of the DPR of P-T-N link project.

III.4.2 Project Components and Benefits

The P-T-N link project envisages constructions of six dams namely, (i) Jheri dam across the river Par in Peint taluka of Nasik district in Maharashtra State; (ii) Paikhed dam across Nar River a tributary of Par River near village Paikhed in Dharampur taluka of Valsad district of Gujarat; (iii) Chasmandava dam across river Tan, a tributary of river Auranga near village Chasmandava in Dharampur taluka of Valsad district in Gujarat State; (iv) Chikkar dam across river Ambica near village Chikkar in Ahwa taluka of Dangs district of Gujarat; (v) Dabdar dam across river Khapri, a tributary of river Ambica river near village Dabdar in Ahwa taluka of Dangs district of Gujarat; and (vi) Kelwan dam across river Purna near village Kelwan in Ahwa taluka of Dangs district in Gujarat State. Also, construction of two diversion barrages – one each in the downstream of Paikhed and Chasmandava dams; six power houses and construction of 406 km long link canal/tunnel passing through Dharampur taluka of Valsad district, Ahwa taluka of Dang district, Vansda taluka of Navsari district, Vyara and Songadh talukas of Tapi district, Mandvi and Mangrol talukas of Surat district, Valia, Jhagadia and Nandod talukas of Bharuch district, Tilakwada Mahal and Sankheda talukas of Vadodara district of the Gujarat State connecting all six dams with existing Miyagam Branch Canal of Narmada canal system are envisaged.

After considering the in-basin requirements of water for various purposes in the

ultimate stage of development, about 1330 MCM of water would be available for transfer from Par, Auranga, Ambica and Purna river basins. The surplus water proposed for diversion through the P-T-N link shall take over the part command of the existing Miyagam Branch Canal of Narmada Canal of Sardar Sarovar Project and the Narmada water so saved shall be utilized to extend the irrigation facilities and also to meet the drinking water and other requirements in the drought prone Saurashtra and Kutch region of North Gujarat.

The project will provide irrigation to a total area of 2.30 lakh hectare annually which includes 0.77 lakh hectare new command area in its enroute region in Navsar, Surat, Dang and Bharuch districts of Gujarat State and target command of 1.53 lakh hectare area in the drought prone Saurashtra and Kutch region of Gujarat through substitution.

The project will also generate about 102 million units of hydropower from the power

houses proposed at various dams and canal falls, besides providing drinking water to the villages coming in the region. Total cost of the link project at the price level of the year 2014-15 has been worked out as Rs.9279 crores. The BC ratio of the project has been assessed to be 1.12 and IRR has been computed as 10.43%. As per the DPR, the construction time of the project is estimated to be seven years. III.4.3 Present Status

The DPR of the P-T-N link was completed in August 2015. The Government of Gujarat has suggested to some modifications/revisions in the DPR in July 2016. Revisions are being carried out by NWDA while the observations of the Government of Maharashtra on the DPR are awaited.

As P-T-N and D-P link projects are interlinked, it was decided that the issue of water sharing in both the projects would be discussed first at the senior officer‟s level from both States and MoWR, RD & GR. Accordingly, the matter regarding sharing of the water between the States of Gujarat and Maharashtra has been discussed in the last four meetings of the Special Committeeand efforts in this regard are continued.

Discussions have also been held on the P-T-N and D-P link projects between the Officer on Special Duty (OSD), MoWR, RD & GR and Chief Secretary, Government of Gujarat on 15.11.2016. As per the suggestions of the Government of Gujarat, new tribal areas have now been included under the command areas of the P-T-N link project coming enroute of the link canal and also in Panchmahal and Chota Udepur districts coming under the Narmada Command. The OSD, MoWR, RD & GR vide letter dated 25.11.2016 requested for the consent of the Government of Gujarat for the new irrigation planning of the link project so as to revise the DPR and facilitate strategies for early implementation of the link project.

The MoWR, RD & GR team led by Secretary (WR, RD & GR) met the Hon‟ble Chief Minister of Gujarat on 31.12.2016 at Gandhinagar and made presentation on this link. The response received from the Government of Gujarat was positive. IV. Preparation of Pre-Feasibility Reports of Intra-State Link Projects

As a follow up of the decisions taken during the presentation before the Hon‟ble Prime Minister, Government of India on 11.10.2004, the Ministry of Water Resources in June 2005 conveyed its approval to identify Intra-State links in the State like Bihar and prepare PFRs/FRs of Intra-State links by NWDA. The work has now been added in the functions of NWDA after the approval in the Special General Meeting of NWDA Society held on 28.06.2006.

Subsequently, NWDA has requested all the States / UTs to inform the details of

Intra–State links pertaining to their region for further studies by NWDA. So far, NWDA has thus received 46 proposals of Intra – State links from the 9 States of Maharashtra, Gujarat, Jharkhand, Odisha, Bihar, Rajasthan, Tamil Nadu, Chhattisgarh and Karnataka. By now, the preparation of PFRs of 36 Intra-State Links has been completed. V. Preparation of Detailed Project Reports of Intra-State Link Projects

The DPRs of two Intra-State links of Bihar State viz., Burhi Gandak – Noon – Baya – Ganga and Kosi – Mechi link have been completed respectively in December 2013 and March 2014.

The technical appraisal of Kosi-Mechi Intra-State link project of Bihar has been

completed by CWC. Advisory Committee on irrigation, flood control & multipurpose projects of MoWR, RD & GR Chaired by Secretary (WR, RD & GR) considered the proposal in its meeting held on 08.07.2016 and accorded techno-economic clearance subject to the submission of all other statutory clearances from MoEF&CC, MoTA for R&R of Tribal Population and optimum water utilization. It is agreed that all the necessary statutory

clearances will be obtained by the concerned Government of Bihar. The EIA studies also yet to be got done by the Government of Bihar.

The DPR of Burhi Gandak-Noon-Baya-Ganga link project is under techno- economic

appraisal in CWC. The observations received from the various directorates of CWC on hydrology, design aspects, irrigation planning and cost estimates are under various stages of compliance.

The status on preparation of the DPRs of other Intra-State links pertaining to the States of Tamil Nadu, Maharashtra and Gujarat is given below:

Maharashtra

Wain Ganga - Nalganga (Purna Tapi) link is under progress. The quantum of water to be transferred has been revised by Govt. of Maharashtra from 300 MCM to 1912 MCM which has resulted increasing the length from about 189 km to 470 km.

Gujarat

As a follow up action for the preparation of DPR of Damanganga-Sabarmati-Chorwad Intra State link, the PFR of the link has been revised.

VI. Decision Arrived on Preparations of DPRs of Intra-State Link Projects

The work for preparation of DPRs of Intra-State link projects was added in the functions/mandate of NWDA vide MoWR, RD & GR Resolution dated 19.05.2011 and Gazette notification dated 11.06.2011. Accordingly, the DPRs of Intra-State link projects as proposed by States are being prepared by NWDA with the funds provided to NWDA through Grants - in – Aid by the Ministry of WR, RD & GR. Recently, the Ministry of WR, RD&GR vide their letter No. 2/12/2015-BM/2217 dated 1.12.2015 has conveyed the following decision regarding the funding of DPR of Intra-State links as:

“NWDA should generally confine itself to inter-state river linkage project DPR. They

can take up intra-state river linkage projects only as consultancy works, if awarded by any State Government. The Government of India fund should not be utilized for DPR preparation of intra-state river linking projects”.

In view of the above decision/direction given by the Ministry of WR, RD, & GR,

henceforth the preparation of DPRs of Intra-State link projects by NWDA will be taken up as a consultancy work and the related cost will be borne by the concerned State Government. VII. Special Committee on Interlinking of Rivers

The Hon‟ble Supreme Court vide its judgment dated 27.02.2012 in the Writ Petition (Civil) No. 512 of 2002 on „Networking of Rivers‟ alongwith Writ Petition No. 668 of 2002 has directed the Union of India and particularly the Ministry of Water Resources to constitute a Committee under the Chairmanship of the Hon‟ble Minister of Water Resources

for the implementation of Interlinking of Rivers Programme. In compliance, the MoWR, RD & GR has constituted a Committee called Special Committee on Interlinking of Rivers (SCILR) vide Gazette Notification dated 23.09.2014.

The SCILR has constituted four specific Sub-Committees; (i) Sub-Committee for

Comprehensive Evaluation of Various Studies/Reports; (ii) Sub-Committee for System Studies for Identification of most Appropriate Alternate Plan; (iii) Sub-Committee for Resturing of National Water Development Agency; and (vi) Sub-Committee for Consensus Building through negotiations and arriving at agreement between concerned States. The three Sub-Committees at Sl.No. (i) to Sl.No.(iii) have been constituted vide MoWR, RD & GR O.M. dated 13.02.2015. The Sub-Committee at Sl.No. (iv) the group to speed up the process of arriving at consensus amongst the States on the proposal of IBWT of NWDA, constituted vide MoWR, RD & GR letter dated 20.01.2016 has been renamed as Sub-committee for the consensus building through negotiations and arriving at agreements between the concerned States.

Upto December 2016, in total 11 meetings of the SCILR, 7 meetings of the Sub-

Committee-I, 9 meeting of the Sub-Committee-II and 2 meetings of the Sub-Committee-IV have been held. The Sub-Committee-III namely on restructuring of NWDA has submitted its report to the Ministry of WR, RD & GR on 21.09.2015. The Ministry has been directed to examine the report by the SCILR on priority. The SCILR during its 9th meeting held on 29.04.2016 advised the Seceretary, MoWR, RD &GR to process the Restructuring of NWDA on priority. VIII Task Force on Interlinking of Rivers The Ministry of Water Resources, RD & GR in compliance to the decision of the Union Cabinet in its meeting held on 24.07.2014 with approval of the Competent Authority constituted a Task Force on Inter Linking of Rivers (TFILR) under the Chairmanship of Shri B.N. Navalawala, Chief Advisor, Ministry of WR, RD & GR vide their letter 13.04.2015 to look into the issues relating to ILR.

The last (5th) meeting of the TFILR was held on 25.10.2016 at New Delhi under the Chairmanship of Shri Navalawala. The main issues taken up for consideration in the meeting were (i) how ILR projects could be used in peak season to recharge groundwater aquifer, (ii) experiences of Public Private Partnership (PPP) in case of infrastructure could be made use of, (iii) guidelines for working out surplus water estimation in water balance studies, (iv) constitution of group on legal aspect, and (v) system simulation studies of Mahanadi-Godavari link project. ILR in Parliament

A. Lok Sabha

1.1 Current Status of Interlinking of Rivers

Under the NPP, NWDA has identified 14 links under Himalayan Rivers Development Component and 16 links under Peninsular Rivers Development Component based on field surveys and investigations and detailed studies. Out of these, FRs of 14 links under Peninsular Component and 2 links (Indian portion) under Himalayan Component have been prepared. Present status of IBWT Links, the States involved, name of rivers and status of FRs/DPRs is given at Annexure – I.

Four priority links for preparations of their DPRs under the Peninsular Component

have been identified viz; Ken-Betwa Link (Phase –I & II); D-P Link, P-T-N Link and Mahanadi-Godavari link. The DPR of Ken – Betwa Link Project is ready and its various statutory clearances are in advance stages. The DPR of D-P link is also ready. The D-P Link Project was considered by the Advisory Committee on Irrigation, Flood Control & Multipurpose Projects of Ministry of Water Resources, RD & GR chaired by the Secretary (WR, RD & GR) in its 129th meeting held on 8th July, 2016. The Advisory Committee has accorded the techno-economic clearance to the project subject to the following:

(i) Submission of FC from MoEF & CC for diversion of 1673.78 ha of forest land. (ii) Clearance for the R&R of tribal population from MoTA.

The DPR of P-T-N link project has also been completed by NWDA and submitted to the concerned States of Gujarat and Maharashtra in August 2015.

The DPR of Mahanadi-Godavari link could not be taken up as the Government of Odisha was not agreeable for Mahanadi-Godavari link, a mother link of 9 link systems viz., Mahanadi-Godavari-Krishna-Pennar-Palar-Cauvery-Vaigai-Gundar linkage systems due to large submergence involved in Manibhadra Dam. Based on the suggestions of WRD, Govt. of Odisha, NWDA has prepared a preliminary revised proposal of Mahanadi- Godavari Link Project with reduced submergence and has been submitted to the State Govt. of Odisha. Also a presentation on the revised proposal of Mahanadi-Godavari Link Project has been made to the Hon‟ble Chief Minister, Govt. of Odisha on 29.05.2015 by the senior officers of MoWR, RD & GR. The water balance study of Mahanadi basin is being revised by NIH, Roorkee. A Joint Committee of MoWR,RD & GR and WRD, Governments of Andhra Pradesh, Chhattisgarh and Odisha has been set up vide MoWR, RD & GR letter dated 26.04.2016 to speed up the process of having consensus on the planning and preparation of DPR of Mahanadi-Godavari link and to resolve the issues related to Polavaram Project. The first meeting of the Committee was held on 2nd June 2016 at New Delhi under the chairmanship of Special Secretary, MoWR, RD &GR. After the finalisation of Mahanadi-Godavari Link Project proposal, NWDA will take up the remaining links of Mahanadi -Godavari-Krishna-

Pennar-Palar-Cauvery-Vaigai-Gundar linkage systems in consultation with concerned State Governments. The initial cost of the Interlinking projects as estimated in Preliminary studies at Pre-feasibility/Feasibility stage is Rs. 5.60 lakh crore at 2002 price level. The total expenditure likely to be incurred on interlinking of rivers can only be known after completion of all individual DPRs. As per the DPR, the estimated cost of Ken-Betwa Link Project Phase-I and Phase-II are about Rs. 18057.08 crores (2015-16 price level) and Rs.2282.94 crores (2012-13 price level) respectively. Ken-Betwa Link Project has been declared as National Project by the Government of India in the year 2008. The estimated cost of D-P link Project is about Rs. 3008 crores (2015-16 price level). The estimated cost of P-T-N link project is Rs. 9279 Crore (at 2014-15 price level). Sub-Committee (ii) for System Studies for Identifications of Most Appropriate Alternate Plan: Nine meetings of the Sub-Committee–II have been held so far and the last meeting was held on 30.08.2016 at CWC, New Delhi.

Sub-Committee (iii) for Restructuring of National Water Development Agency: The Committee was constituted under the Chairmanship of Shri M. Gopal Krishnan former Chairman, CWC. Seven meetings of the Sub-Committee-III have been held and last meeting was held on 10.09.2015.

The Sub Committee on Restructuring of National Water Development Agency has submitted its report to the Ministry of Water Resources, RD&GR on 21.09.2015. A presentation on “Restructuring of NWDA” was made before Hon‟ble Minister (WR, RD&GR) on 30.05.2016. The Report on the Restructuring of NWDA is under consideration in the Ministry. Sub-Committee (iv) for Consensus building through Negotiations and Arriving at Agreement between Concerned States: A Consensus Group has been constituted by Ministry of Water Resources in June, 2002, under the Chairmanship of Chairman, Central Water Commission with DG, NWDA as Member Secretary. 11 meetings of the Group were held. This group has been renamed as „Sub-Committee for consensus building through negotiations and arriving at agreements between the concerned states‟. This Sub-Committee has held two meetings on 17.04.2015 and 30.10.2015.

Constitution of Task Force for Interlinking of Rivers (2015): The Union Cabinet while approving the constitution of Special Committee for ILR in its meeting held on 24th July, 2014 directed that a committee comprising of experts be constituted to look into the issues relating to inter linking of rivers. In compliance to the direction of Union Cabinet, MoWR, RD & GR vide O.M. dated 13.04. 2015 has constituted a Task Force for Interlinking of Rivers (TF-ILR) under the Chairmanship of Shri B.N.Navalawala, Chief Advisor, MoWR, RD&GR. Task Force will assist the Special Committee for ILR and MoWR, RD&GR regarding the implementation of ILR Programme. Five meetings of the Task Force have been held respectively on 23.04.2015; 05.11.2015; 28.04.2016; 15.06.2016 and 25.10.2016. Constitution of Group on Legal Aspects under Task Force: In pursuance of the decision of the Task Force for Interlinking of Rivers taken in its 4th meeting held on 15.06.2016, a Group has been constituted vide Office Memorandum No. NWDA/Tech/400/5/2015/948-958 dated 18.07.2016 to look into the legal aspects and required enabling provisions for implementation of Interlinking of Rivers and other related issues. Four meetings of the legal group have been held so far and the last meeting was held on 04.11.2016. Some of the States have certain views/observations regarding ILR Projects, the details of which are given at Annexure-II.

The SCILR chaired by Hon‟ble Union Minister (WR, RD &GR) as per the direction of

the Hon‟ble Supreme Court is expediting the progress and effective implementation in the Interlinking of Rivers projects. Eleven meetings of the SCILR have been held so far and the last meeting was held on November 09, 2016 at New Delhi. Various views and observations on the Interlinking of Rivers Programme have been received from State Governments,

experts and other stakeholders in the meetings of the SCILR. The Special Committee would consider all such observations appropriately while planning and formulating the ILR projects.

The implementation of any interlinking project is yet to be taken up. As such no

project is in progress or completed. Thus no amount has been allocated/released/spent on the project so far for any of river link projects.

At the time of preparation of DPR of the individual project, detailed Environmental

Impact Assessment (EIA) studies as per Terms of Reference approved by the Environmental Appraisal Committee (EAC) of Ministry of Environment and Forest & CC (MoEF&CC) are carried out. All the environmental impacts and issues arising out of the EIA studies are duly addressed in Environmental Management Plan, which forms a part of the DPR.

Resettlement and Rehabilitation (R&R) Plan in respect of project affected persons is

an integral part of the implementation of any Inter Linking of River project and is included in the DPR.

The estimated number of individuals affected will be known only after the

completion of the DPR of individual River Link Project. As per the DPR, the estimated numbers of families which are likely to be affected due to the river-linking project in Ken-Betwa Link Project (Phase I & II), Damanganga-Pinjal Link Project and Par-Tapi-Narmada Link Project are 2529, 2302 and 2509 respectively.

The Government is pursuing the Interlinking of Rivers program in a consultative

manner. The implementation of the ILR projects involves various steps such as preparation of Pre-feasibility Reports(PFRs) /Feasibility Reports (FRs) of links; negotiation and consensus among concerned States; agreement with neighboring countries, if link involves area lying in those countries; preparation of DPRs of the projects; clearance from appraisal agencies which includes clearance by the MoEF&CC and MoTA, techno-economic clearance by Technical Advisory Committee of MoWR, RD & GR, investment clearance and the time required for the completion of the project as per the DPR.

The stage of implementation of a project would be reached after its DPR is prepared

with the consensus of concerned States and the requisite statutory clearances are obtained. Thus the implementation of the projects will take varying periods of time.

The implementation of National Perspective Plan would give benefits of 25 million ha

of irrigation from surface waters, 10 million ha by increased use of groundwater, raising the ultimate irrigation potential from 140 million ha to 175 million ha and generation of 34000 mega watt of power, apart from the incidental benefits of flood control, navigation, water supply, fisheries, salinity and pollution control etc.

three links i.e. Pennar (Somasila) - Cauvery (Grand Anicut) link, Cauvery (Kattalai) - Vaigai -Gundar link and Pamba - Achankovil - Vaippar link under Peninsular Component of NPP have been carried out. The feasibility reports of these three links have been prepared and circulated to the concerned States.

Surveys and investigations of one intra-State link i.e. Ponnaiyar–Palar link of Tamilnadu has also been carried out for preparation of DPR. The DPR of Ponnaiyar–Palar link is being finalised.

1.4 The Current Status of ILR Project with Regard to Tista River

As envisaged in NPP for water resources development through IBWT prepared by

MoWR, RD&GR, NWDA has identified 16 links under Peninsular and 14 links under Himalayan components. One of the link namely M-S-T-G link under the Himalayan component of the NPP envisages diversion of the surplus waters of Manas and Sankosh rivers with supplementation from the intermediate major streams, namely Aie, Raidak, Torsa and Jaldhaka for the benefit of augmenting the flows of Ganga at Farakka and further transfer to water short areas of Krishna, Pennar and Cauvery basins and providing irrigation facilities to the enroute command areas. The link will cross Tista River but will not have any augmentation of water from Tista River. Preparation of the FR of this link is under progress.

1.5 Inter Basin Water Transfer Links Related to Bihar

Two IBWT Links under the NPP namely i) Kosi-Mechi link, (entirely lies in Nepal) and ii) Kosi-Ghaghara link are proposed to divert flood water of Kosi river, which originate in Nepal. The PFR of both the links have been prepared. As the Kosi-Mechi link entirely lies in Nepal, it requires agreement with the neighboring country of Nepal for preparation of its FR/DPR. The work of preparation of the FR of Kosi-Ghaghara link falling in the Indian portion is in progress. For taking up FR/DPR of these links bilateral understanding and agreement with Government of Nepal is necessary.

NWDA has completed the DPR of 2 Intra-State link of Burhi-Gandak-Noon-Baya-

Ganga and Kosi-Mechi link and submitted to the Government of Bihar. The DPR of Burhi Gandak-Noon-Baya-Ganga link project is under techno-economic appraisal in CWC. All the necessary statutory clearances of Burhi-Gandak-Noon-Baya-Ganga link will be obtained by the Government of Bihar.

Technical Appraisal of Kosi-Mechi link has been completed by CWC. Advisory

Committee of the MoWR, RD & GR accepted the proposal on 8.7.2016 with respect to techno-economic feasibility.

2. Any Special Grants to NWDA to Develop New Irrigation Projects in the Country

The Government has not sanctioned any special grants to NWDA to develop new

irrigation projects in the country so far. However, NWDA has been identified to act as an agency for borrowing resources from Long Term Irrigation Fund (LTIF) and release Central Assistance to the State Governments towards the prioritized Pradhan Mantri Krishi Sinchayee Yojana (PMKSY) -AIBP (Major & Medium Irrigation) Projects and their Command Area Development and Water Management (CADWM) works, for their completion in time bound manner. Memorandum of Agreement for borrowing from NABARD to fund Central share in these projects was signed by the MoWR, RD & GR, NWDA and NABARD on 06.09.2016.

B. Rajya Sabha

1.1 Constitution of Task Force for Interlinking of Rivers

Earlier, a Task Force on Interlinking of Rivers under the Chairmanship of Shri Suresh

P. Prabhu, the then Member of Parliament, Lok Sabha was constituted on 13.12.2002. The Task force held 12 meetings and submitted its report in the form of Action Plans I & II on 30.04.2003 and 16.04.2004 respectively and thus completed its role. Thereafter, it was wound up by the MoWR with effect from 31.12.2004. The Union Cabinet while approving the constitution of SCILR in its meeting held on 24.07. 2014 directed that a committee comprising of experts be constituted to look into the issues relating to ILRs. In compliance to the direction of Union Cabinet, MoWR,RD&GR vide O.M. dated 13.04.2015 has constituted a TFILR under the Chairmanship of Shri B.N.Navalawala, Chief Advisor, MoWR,RD&GR and consists of various experts and officials. The Task Force will assist the SCILR and MoWR,RD&GR regarding the implementation of ILR Programme. The term of the Task Force is for a period of two years or till further order, whichever is earlier.

Five meetings of the Task Force have been held on 23.04.2015; 05.11.2015; 28.04. 2016; 15.06.2016; and 25.10.2016 respectively. The minutes of the meetings were issued as and when the finalizations of the same have been taken place. TFILR has consulted with various State Governments including Tamil Nadu while deliberating on various issues relating to ILR projects including the issue of surplus water. The matter is still under consideration of the Task Force. The tenure of Task Force is 2 years. It has not submitted its report so far.

1.2 Linking of River Godavari and River Krishna in Andhra Pradesh

Under the NPP prepared by the then Ministry of Irrigation now MoWR,RD&GR and CWC has identified 30 links (16 under Peninsular Component & 14 under Himalayan Component) for preparation of FRs. The FR of one link under Peninsular Component namely the Godavari (Polavaram) – Krishna (Vijayawada) link was prepared and circulated

on 24.11.1999. The Godavari (Polavaram) – Krishna (Vijayawada) link is a part of Polavaram project of the Andhra Pradesh. The Government of Andhra Pradesh has taken up the above project including link components as per their own planning.

Now the Government of India has constituted a Polavaram Project Authority (PPA) for the execution of the Polavaram Irrigation Project in accordance with the Section 90 of Andhra Pradesh Reorganisation Act, 2014.

As per the information gathered from the PPA, since the Polavaram Irrigation

Project Head Works are yet to be completed and construction of the Right Main Canal is already at the final stage of completion, Government of Andhra Pradesh envisaged Pattiseema Lift Scheme to lift the water from river Godavari and transfer it to river Krishna through the existing Polavaram Right Main Canal. The positive aspects in existing river link project in the country are the domestic water supply, industrial water need and irrigation water supply to the water short areas besides increasing in groundwater levels.

1.3 Sanctioning of Fund for 50 Irrigation Projects Prioritized under PMKSY

The NABARD has sanctioned a total loan amount of Rs. 19,702 crore for funding of Central Assistance for 50 irrigation projects prioritized under PMKSY through LTIF to NWDA. So far, Rs 1500 crore have been released to NWDA by the NABARD as per sanction issued by the MoWR,RD&GR and the same have been disbursed to the 9 State Governments of Gujarat, Karnataka, Madhya Pradesh, Maharashtra, Manipur, Odisha, Punjab, Rajasthan, and Telangana for their respective projects.

1.4 Status on Progress, Funds Earmarked and Tentative Time Limit for

ILR Projects

The implementation of any interlinking project is yet to be taken up. As such no project is in progress or completed. Thus no amount has been allocated/released on the project so far for any river links project. The Government is pursuing the Interlinking of Rivers program in a consultative manner. The implementation of Inter linking of Rivers projects involves various steps such as preparation of PFRs / FRs of links, negotiation and consensus among concerned States, agreement with neighboring countries if link involves area lying in those countries, preparation of DPRs of the projects, clearance from appraisal agencies which includes clearance by the MoEF&CC and MoTA, techno-economic clearance by TAC of MoWR, RD & GR, investment clearance and the time required for the completion of the project as per the DPR.

The time limit for the completion of individual link project can be identified only after the requisite statutory clearances are obtained and Detailed Project Reports are techno-economically approved. Thus, the implementation of the projects will take varying periods of time.

ILR in Media

1. The River Link Project

The article came on Hindustan Times of Delhi edition dated 28.11.2016 under the heading”Trouble brews over Ken-Betwa water sharing” written by Pankaj Jaiswal and KumKum Dasgupta‟. In the article, it was mentioned that “A MoU was signed in 2005 between the Centre and the two states to start work on the project. The Ken-Betwa link is now the dream project of Union water resources minister and Jhansi MP Uma Bharti. According to the National Water Development Agency, the project will provide irrigation, domestic and industrial water supply and power to Chhatarpur, Panna and Tikamgarh (Madhya Pradesh) and Mahoba, Jhansi and Banda (Uttar Pradesh).

These six districts and seven others in the two states form the Bundelkhand region,

which has been drought-hit for the last six years. Estimated to cost Rs. 7,615 crore, the project has got clearance from the National Board for Wildlife and is awaiting environmental clearance.

There are several criticisms of the project: First, Ken is not „water surplus‟. Ken is not

a perennial river and so does not have excess water and the threat of flooding, which the government is using as a ruse, is only there for three months during peak rainy seasons, explained Ashish Sagar, a Banda-based activist”.

He alleged that the BJP is pushing this project as it wants to get Rajput and

Kshatriya votes of Jhansi. Uma Bharti is a Lodh Rajput. Second, the river flows 60 to 70 feet lower than the Betwa and at least 30% of the 78 MW that would be generated by the proposed hydro-project would be used to pump the water up.

Third, India does not need so much hydropower. “India is planning to add 1 lakh

MW of solar power. Where is the need for additional hydro-power at huge environmental and social costs?” asked Manoj Misra, who heads the Yamuna Jiye Abhiyaan.

Fourth, the tiger lobby is opposing it as it will submerge 10% of Panna Tiger Reserve

(Ken flows through it) to build the Daudhan Dam on Ken.

“There is a functional British-era dam at Daudhan. Why do we need another?” asked Sagar. For the BJP, however, the river linking project will be a big election promise…….

Views of NWDA

Firstly, the water yield and water balance studies of Ken basin upto Daudhan dam site has been carried out by NWDA based on the norms and guidelines approved by Technical Advisory Committee (TAC) of NWDA comprising the composition of Chairman, CWC as Chairman of the TAC and Senior Officers of Central and State Government Departments, Ministries not below the rank of Chief Engineer as Members and Director General, NWDA as Member-Secretary.

Secondly, it may also be taken into account that India is a monsoonic country with about 70% of its population is involved with agro-related industrial and farming activities for their day-to-day based livelihood. At the same time, the availability of water from recipitation is confined a period of about 3-4 months of the monsoon season and its applicable to Ken river basin as well. Hence, the excess availability of rain water during the 3-4 months of June, July, August and September is required to be stored at the viable identified site at Daudhan site so as to store, conserve and raise the water level in such a manner to allow gravity flow for the supply of water to be released to the downstream stretches through gated sluies for catering to the needs of downstream demands during monsoon months, non-monsoon months, non-lean season and lean season for domestic water supply, irrigation, transmission losses and environmental flow requirements in a controlled manner. In the process, it is also plan to generate 78 MW of hydropower as a clean and cheapest generation of power as an indirect benefit to be accrued from the Ken-Betwa link proposal, which in turn will add further value and overall benefits of the ILR project.

Here, it is relevant to mention that the water to be released to the Ken river is

proposed to be about 2000 MCM after power generation through 32 m wide and 405 m long Tail Race Channel (TRC) for providing irrigation in the command areas of Uttar Pradesh and Madhya Pradesh through Bariyarpur pickup weir. Thus the river between Daudhan dam and the existing Gangau weir located 2.5 km downstream and up to Bariyarpur pickup weir will have abundant flow of water. The month-wise and season-wise provisions of e-flows proposed have already been incorporated in the Environmental Impact Assessment (EIA) & Environment Management Plan(EMP) Reports.In view of e-flow releases, there will be a minimum flow of 2.971 cumec water in the river throughout the year even though the river is dry for about five months (January to May) in natural conditions. This continuous flow will further enable the sustaining of downstream ecology, fishery and overall development of the region. Hence, the construction of Daudhan dam will be a boom to the specific region.

Again, regarding submergence; a detailed study has been conducted for analyzing the negative as well positive impacts due to reduction top 5 m height of dam from the overall proposed height of the dam of 77 m (10% reduction in height) and seen that it will create a loss of about 580 MCM of stored water (14% of live storage) and reduce submergence of 888 ha of forest area. The reduction in height of the dam will further cause loss of irrigation to 1.16 Lakh ha of cropland (CCA) and livelihood of 11 lakhs people. Hence, the stored water is critical for success of Rabi irrigation and last watering (in the event of early withdrawal of monsoon) for Kharif crops. Large economic benefits from agriculture are expected to be reaped from Rabi crop as well. In view of the submergence that may happen at the event of filling up of the Daudhan reservoir, Compensatory afforestation is proposed for the area coming under submergence inaddition to Catchment Area Treatment and Green Belt Plantation around the dam, buildings and all along the canal banks. Cost estimate for the same has already been provided under EMP as per the latest guide line of Forest Department of the Government of MP. Hence, the Ken-Betwa link project is studied by considering very minute issues and related adverse impacts to ensure its acceptability and adaptability for the overall economic development of the region and people concerned.

2. Single Tribunal to Arbitrate Inter-State Water Disputes

The news item appeared in “Hindu”, Delhi edition, dated 19.12.2016 and projected that “The Centre has decided to set up a single, permanent Tribunal to adjudicate all inter-State river water disputes, a step which is aimed at resolving grievances of States in a speedy manner. This body will subsume existing tribunals.

Besides the tribunal, the government has also proposed to float some Benches by

amending the Inter-State Water Disputes Act, 1956 to look into disputes as and when required. Unlike the tribunal, the Benches will cease to exist once the disputes are resolved.

A decision to approve an amendment to the Act was taken at the Union Cabinet

earlier this week. The amendment is likely to be introduced in the next Parliament session. “There will be only one permanent tribunal with retired Supreme Court judge as its chairperson. There will be benches formed as and when required. The benches though will be wound up once a dispute is resolve”, Water Resources Ministry secretary Shashi Shekhar said.

Earlier, Mr. Shekhar said, watertribunals “tookages” to deliver final awards into

disputes, where as the proposed Tribunal is expected to deliver its verdict during a spano three years.

Along with the tribunal, the amendment proposes to set up Dispute Resolution

Committee (DRC). The DRC, comprising experts and policy-makers, is proposed to handle disputes prior to the tribunal. “...whenever a State will request, the Centre will set up a DRC. We expect, most disputes will get resolved at the DRC‟s level itself. But if a State is not satisfied, it can approach the tribunal.”

3. Grappling with Water Disputes

The news was projected in “Hindu” dated 20.12.2016 of Delhi edition and indicated

that “A permanent tribunal to adjudicate river water disputes between States will undoubtedly be a vast improvement over the present system of setting up adhoc tribunals. The Union Cabinet‟s proposal to have a permanent tribunal that will subsume existing tribunals is expected to provide for speedier adjudication. But whether this will resolve the problem of protracted proceedings is doubtful. Given the number of ongoing inter-State disputes and those likely to arise in future, it may be difficult for a single institution with a former Supreme Court judge as its chairperson to give its ruling within three years. Secondly, its interlocutory orders as well as final award are likely to be challenged in the Supreme Court. This month, in a landmark verdict, the Supreme Court said it had unfettered power to hear an appeal arising from a river water dispute tribunal under Article 136 of the Constitution. It has interpreted the ouster clause in the Inter- State Water Disputes Act as one that merely bars the court from entertaining an original complaint or suit on its own, but not its power to hear appeals against a tribunal‟s decision. Thus, finality and enforcement of a tribunal‟s award may remain elusive. The idea

of a Dispute Resolution Committee, an expert body that will seek to resolve inter- State differences before a tribunal is approached, will prove to be another disincentive for needles litigation.

A positive feature of the proposed changes is that there will be an expert agency to collect data on rainfall, irrigation and surface water flows. This acquires importance because party – States have a tendency to fiercely question data provided by the other side. A permanent forum having reliable date in its hands sounds like an ideal mechanism to apportion water. However, a confusing aspect is that benches of the permanent tribunal are going to be created to look into disputes as and when they arise. It is not clear in what way these temporary benches would be different from the present tribunals. A larger and more significant downside to any adjudicatory framework is the refusal or reluctance of parties to abide by judicial orders. Having an institutional mechanism is one thing, but infusing a sense of responsibility in those helming State governments is quite another. What is at stake is not merely a set of competing claims over riparian rights. Water disputes have humanitarian dimensions, including agrarian problems worsened by drought and monsoon failures. Adjudication, by whatever mechanism, should not be at the mercy of partisan leaders who turn claims into dangerously emotive issues. Institutional mechanisms should be backed by the political will to make them work”.

4. Ken-Betwa River Linking Project to be Launched Soon

The media report dated 27.12.2016 “Hindustan Times”, highlighted under the above cited heading is projected in Press Trust of India coverage. There it is indicated that The ambitious Ken-Betwa river-linking project will be launched once it‟s funding pattern is decided, Union Water Resources Minister Uma Bharti said here on Monday.

The ministry has received wildlife clearance for the multi-crore project, first such

initiative aimed at linking inter-state rivers in the country. However, it awaits forest and environment approvals.

The NITI Aayog had earlier recommended funding pattern for the project as per

Accelerated Irrigation Benefit Programme (AIBP). I have requested the Aayog that the funding pattern has to be 90:10 (Centre: state sharing pattern) or 100% (centrallyfunded). The moment the funding pattern is decided, the project will be launched,” she said.

Bharti made the remarks during an event in which she handed over a cheque of Rs

1981 crore issued by NABARD to Andhra Pradesh Chief Minister Chandrababu Naidu for Polavaram project.

Union Finance Minister Arun Jaitley and urban development minister Venkaiah Naidu

also attended the event. Bharti though did not specify by when the funding pattern will be finalised for the river-linking project. NABARD issued cheques worth Rs 830 crore and Rs 463 crore for completing irrigation projects in Maharashtra and Gujarat respectively.

5. Polavaram Project Gets Central Funds

The news came as a special correspondence of Hindu dated 27.12.2016 and it

indicated that The Centre on Monday released Rs.1,981.54 crore, through the National Bank for Agricultural and Rural Development (NABARD), for Andhra Pradesh‟s ambitious Rs.16,000 crore Polavaram irrigation project along the Godavari river.

Releasing the amount, Finance Minister Arun Jaitley said this should quell any sense of distrust that the people of the State had developed towards the Centre over funding for the project.

Stressing that returns on investments in irrigation projects for agriculture can be visible by next season as opposed to investments in sectors such as manufacturing, where returns take a „reasonably long period‟ to register, the Finance Minister said that such projects also lead to social satisfaction and economic prosperity.

He was speaking at an event attended by Andhra Pradesh Chief Minister Chandrababu Naidu, Union Water Resources Minister Uma Bharti, where funding was also disbursed for 99 irrigation projects in Gujarat and Maharashtra under the Long Term Irrigation Fund announced in Budget 2016-17.

“Using water resources to its optimal level is one of our prime goals and it is important that a very large part of funding goes to this,” Mr. Jaitley said.

Stating that the people of Andhra Pradesh had been nursing a feeling of economic discrimination and unfair treatment since the division of the State, Mr. Jaitley said it was due to the BJP‟s efforts that the UPA government made some commitments, though without any financial allocation.

“The responsibility of fulfilling what we had said, fell on us. There are obviously challenges, but we were clear from the very first day that every promise we had made in the form of assistance would be satisfied,” Mr. Jaitley siad.

Terming the issue of water in the State‟s dry regions as very sensitive, he said that it took some time for the Centre to find a way to fund the Polavaram project, but it had finally done it. Restoring trust

“Not only is today‟s event a launch pad for a great project in Andhra Pradesh, it is also restoring a sense of confidence and trust in the people of AP.”

Referring to the lessons from Gujarat and Maharashtra, which he said had taken significant strides on the irrigation front, Mr. Jaitley said: “If you remember, Gujarat was virtually dry in regions such as Saurashtra, Rajkot, Kutch, but they worked ahead of time and over the last 15 years, it‟s agricultural growth showed substantial enhancement.

6. Ken-Betwa Project Gets Green Nod The news article of Hindu, dated 27.12.2016 by Bishwa Mohan highlighted that “The

National Board for Wildlife” (NBWL) has given its much-awaited clearance, paving the way for work to begin for linking Ken and Betwa rivers, which will benefit six districts of Uttar Pradesh and Madhya Pradesh in terms of meeting the irirrigation, drinking water and electricity needs. "Construction work will start after deciding its funding pattern", said Union Water Resources Minister Uma Bharti. Since the project requires diversion of forest land of Panna Tiger Reserve, it was required to be formally cleared by the board. The clearance has finally come with certain conditions which include integration of nearby sanctuaries including Rani Durgavati and Ranipur with the Panna Tiger Reserve to compensate for the loss of tiger habitat and complete ban of fresh mining lease in the area. The board also wants the National Tiger Conservation Authority (NTCA) to take care of the landscape plan for the area with the help of state forest department and Wildlife Institute of India (WII). Though the Rs 9,000 crore project had got the Union Cabinet's clearance in July 2014, work could not begin as the mandatory clearance from NBWL got stuck amid objections from environmentalists and wildlife conservationists.

The Ken-Betwa ILR project will transfer surplus water from the Ken River to the Betwa basin through a 221 km canal. The concrete canal will pass through Jhansi, Banda and Mahoba districts of UP and Chhatarpur, Panna and Tikamgarh districts of MP. The Ken-Betwa link is one of the 30 inter-linking of river (ILR) projects, conceived by the Centre. The project had got a green signal from the Supreme Court following the tripartite MoU involving UP, MP and the Centre. The apex court had in February 2012 directed the Centre (the then UPA-II Government) to implement ILR in a time-bound manner and appointed a high-powered committee for its planning and implementation.

Though nearly 8,650 hectares of forest land - including part of Panna National Park - in Madhya Pradesh will be submerged due to implementation of the Ken-Betwa project, the MoU had factored in the issues of larger benefit to the water-starved region of both states. The ILR plan has been in the pipeline since 1982 when the government set up the National Water Development Agency (NWDA) to carry out water balance and feasibility studies for river linking. It, however, got its first major push under then Prime Minister Atal Bihari Vajpayee during NDA rule (1999-2004) as a solution to many issues including floods, irrigation and hydropower”.

Bharati said that the project is set for take-off as soon as the funding pattern was decided now that the "last hurdle" too had been cleared with the green signal from the National Board for Wildlife (NBWL).

It is learnt that the water resources ministry is keen to start work in January itself, in

an effort to showcase the work as a 'new year gift' to the people of Bundelkhand region of Uttar Pradesh and Madhya Pradesh. The move has the potential of sending a positive signal to the electorate of UP ahead of the state assembly polls likely in February.

Taking objection to Bharti's remark, water and river conservationists led by Himanshu Thakkar of the South Asia Network on Dams, Rivers & People (SANDRP) said, "The NBWL recommendation does not mean the final wildlife clearance as all recommendations for de-notification of protected areas are scheduled to go to the Central Empowered Committee appointed by the Supreme Court and the CEC has to decide if they would like to refer the recommendation to the Supreme Court or not. That step is yet to be taken". In a letter written to the minister, they said, "The NBWL recommendation is based on a number of conditions, which will actually require a fresh environmental impact assessment". Officials in the water resources ministry, however, disagree. "The wildlife clearance was a major obstacle. This was indeed the last hurdle, required environment and forest clearances will now be given to the Ken-Betwa project quickly. It is expected that the environment clearance will come in a meeting on Friday while the forest clearance may follow soon." The Ken-Betwa ILR project is meant to transfer surplus water from Ken river to Betwa basin through a 221km canal. Environmentalists, including Manoj Misra of the Yamuna Jiye Abhiyaan, flagged other issues as well before the project work could actually start”.

Glimpses of NWDA

1. Involvement of NWDA in India Water Week-2016 NWDA has been entrusted by the MoWR, RD & GR with the task of organizing the

India Water Week (IWW). The first IWW-2012 was organized in the year 2012 with the main theme “Water Energy and Food Security-Call for Solutions”. The event helped in crystallizing the approach towards timely implementation of water resource interventions for the sake of bringing energy as well as food securities. The theme of the second IWW-2013 was “Efficient Management of Water” and focused upon various measures to be adopted for improving the water use efficiencies and achieving goals towards the commitments taken under National Action Programme on Climate Change. The third event was conducted by concentrating on the theme “Water Resource Management for Sustainable Development”. During the event various issues dealt with were basin wise availabilities of the water resources and its prompt and optimum utilizations for ensuring timely and sustainable developments.

The fourth IWW- 2016 has been successfully organized during 4 to 8 April 2016. The

main theme of the occasion was on “Water for All-Striving Together” like the mantra

“lcdk lkFk lcdk fodkl”. The world Leader/Country, who is wellknown in agriculture

sector in dealing water conservation and innovation technologies, namely Israel, was the Partner Country for the IWW-2016 event. The Hon‟ble Minister for Agriculture, Government of Israel- Mr. Uri Ariel personally led the Israel delegation. In addition to the Agriculture Minister and Senior Officials of Israel, Experts/Senior Officers from the Countries of Hungary, Zimbabwe, Burundi, Niger, Sierra Leone, Bhutan, Nepal, Democratic Republic of Kango and Philippines were also participated and enriched the technical sessions,presentations followe by deliberations thereon. The State Governments of India, namely Madhya Pradesh, Maharashtra, Andhra, Gujarat, Karnataka, Rajasthan and Telangana were also immensely participated and strongly supported as Partner States and shared the best and renowned practices emerged from their respective States. About 1500 delegates from India and abroad participated in the Conference. In totality, 213 papers were presented under various dedicated technical sessions comprising of Seminars, Panel Discussions, Brainstroming, Side Events and Special Sessions of the Conference.

The IWW-2016 International Conference thus encompassed to deliberate almost all

the major topics related to water resources development and management and provided the right platform for the Water Resources Fraternity to come out with pragmatic strategies for achieving the goal of “Water for All – Striving together”, in line with the Government of India‟s Vision- “Sab Ka Sath, Sab Ka Vikaas”. The entire event was successfully organized by NWDA in close association especially with CWC, CGWB, WAPCOS and other organizations of MoWR, RD & GR, Government of India.

Under the IWW-2016, about 60 Nos. of Exhibitions were also stalled and showcased

their products for the benefits of all the stakeholders concerned. The IWW-2016 exhibition also, hence, provided a joint platform in projecting all subjects matters related with “Sabka Sath- Sabka Vikas”. The prominent exhibitions exhibited were Namami Gange (MoWR,RD

In addition to these exhibitors, the exhibitions stalled by the Partner Country Israel were supported the main theme and appreciated by the delegates and dignitaries participated from worldwide countries as well as in India.

2. Special Committee for Interlinking of Rivers

As mentioned earlier, the Hon‟ble Supreme Court vide its judgment dated

27.02.2012 in the Writ Petition (Civil) No. 512 of 2002 on „Networking of Rivers‟ alongwith Writ Petition No. 668 of 2002 has directed the Union of India and particularly the MoWR to constitute a Committee under the chairmanship of Hon‟ble Union Minister of Water Resources for the implementation of Interlinking of Rivers (ILR) Programme. In compliance, the MoWR, RD and GR has constituted a committee called Special Committee on Interlinking of Rivers (SCILR) vide Gazette Notification dated 23.09.2014. So far 11 meetings of the SCILR held.

2.1 Eleventh Meeting of SCILR

The eleventh meeting of the SCILR was held on 09.11.2016 at Vigyan Bhawan, New Delhi under the chairmanship of Shri Vijay Goel, Hon‟ble Minister of State for Water Resources, River Development and Ganga Rejuvenation and Hon'ble Minister of State (Independent Charge) for Ministry of Youth Affairs and Sports. Shri Narottam Mishra, Hon‟ble Minister for Water Resources, Government of Madhya Pradesh; Shri Surendra Singh Patel, Hon‟ble Minister of State for

Irrigation, Uttar Pradesh; Shri S. Venugopal Chary, Special Representative of Telangana Cabinet, and Members/Representatives from various Central Government and State Government Organizations/Departments attended the meeting.

At the outset, the Hon‟ble Minister of State for WR, RD & GR while extending a warm welcome to the participants, it is mentioned that the ILR programme is very important for enhancing water and food security of the country and would be helpful in providing water to water short, drought prone and rainfed farming areas. He also added by saying that the Government of India is committed for implementation of ILR with the consensus and cooperation of the concerned State Governments. In the meeting the Hon‟ble Minister also informed that

various clearances in respect of Ken-Betwa link project are in advanced stages of processing. He also stated that the TFILR is also examining all the relevant issues in detailed with regard to ILR programme so as to help in bringing speedy consensus amongst the State Governments while also examining the issue of surplus water available in a basin.

The agenda items discussed during the meeting were related with the status of various statuatory clearances pertaining to Ken-Betwa (Phase I & II); P-T-N and D-P Link Projects. One of the other main agenda items discussed in the meeting was System Simulation Studies of Mahanadi-Godavari link project and the revision of its Hydrological Studies being done by NWDA with the support of NIH. The status of Intra-State links pertaining to the State Governments of Tamil Nadu and Karnataka was also covered in the meeting. While hearing the view from a Representative of Government of Kerala that Barapole-Upper Cauvery Intra-State link proposed by Karnataka State is not an intra-State link and requested to review the link project, the Director General, NWDA informed that DPR of any Intra-State link would be taken up only with the consent of concerned States.

In the 11th meeting SCILR, the issues related with restructuring of NWDA was also

presented and Shri Gopalakrishnan, Chairman of the Sub-Committee on Restructuring of NWDA informed that the tasks assigned to NWDA are very huge and accomplishing the entrusted and mandated works restructuring of NWDA is to be done immediately. The report on restructuring of NWDA is under consideration in the MoWR, RD & GR.

3. Involvement of NWDA in Pradhan Mantri Krishi Sinchayee Yojana Pradhan Mantri Krishi Sinchayee Yojana (PMKSY) was launched in 2015-16 with an aim to enhance physical access of water on farm and expand cultivable area under assured irrigation, improve on farm water use efficiency, introduce sustainable water conservation practices etc. Under PMKSY, major and medium irrigation/multipurpose irrigation projects are being funded under PMKSY-AIBP and Repair, Renovation and Restoration (RRR) of Water Bodies, surface Minor Irrigation (SMI) projects and Command Area Development & Water Management (CADWM) projects are being funded under PMKSY – Har Khet Ko Pani (HKKP). The Union Finance Minister announced in his Budget Speech 2016-17 creation of a dedicated Long Term Irrigation Fund (LTIF) in NABARD with an initial corpus of about Rs.20,000 Crore to be contributed through budgetary resources of Government of India, market borrowings to be raised by National Bank for Agriculture and Rural Development (NABARD), etc. In turn, the Union Cabinet has approved the proposal of Ministry of Water Resources, River Development and Ganga Rejuvenation (MoWR, RD & GR) for establishment of a Mission for completion of prioritized irrigation projects and funding arrangements. The LTIF would be utilized by the Central and State Government to bridge the requirement of funds for completion of the identified (presently 99) irrigation projects, including CAD works.

Government of India has identified NWDA to act as an Agency for borrowing resources from out of LTIF, as also to release funds as Central Assistance to the State

Governments towards the identified irrigation projects. Accordingly, a Memorandum of Agreement (MoA) made on the 06.09.2016. The MoA was made between the Secretary, MoWR, RD & GR, GoI (as the first party), NWDA (as the second party) and NABARD (as the third party).

3.1. Management of loans received from NABARD under PMKSY

It is decided to manage the loans received from NABARD as given below: (i) Release of Central Assistance to States after receiving approval from NABARD (ii) Processing of proposals through Project Monitoring Unit (iii) Preparation of payment of loan plan for the current year 2016-17 (iv) Third party monitoring visists through Project Monitoring Unit (v) Updation in MIS system through Project Monitoring Unit

3.2. Establishment of Project Monitoring Unit: A Project Monitoring Unit (PMU) will be established under NWDA to work in coordination with CWC for monitoring and updation of information (MIS) under PMKSY. 3.3. Processing of Proposal: The PMU shall prepare a comprehensive note based upon monitoring reports of the third party and CWC regarding eligibility of release of Central Assistance (CA) funds to States concerned. Further, recommendation to NABARD shall also be given regarding release of States share.

3.4. Release of Central Assistance Funds to States: NWDA shall act as a pass through Agency for CA to be provided to the States concerned through NABARD funding. It shall ensure that funds received from NABARD are released for projects within one day of its receipt from NABARD so as to avoid any parking of funds. 3.5. Third Party Monitoring: Based on joint proposals received in Mmission, third party monitoring visits would be planned in such a way that such reports can be made available before release of next installment. Further, the visits of third party shall be planned keeping in view of the visits that shall be made by the CWC.

3.6. NABARD Funding under PMKSY–AIBP: The PMU to be established under NWDA will help NWDA to process for NABARD funding and release of CA to the concerned States

under PMKSY-AIBP (Acelerated Irrigation Benefit Projects). The PMU will be headed by an Officer of the rank of Chief Engineer with supporting units comprising of experts. Rs. 1500 Crore was distributed to the Governments of NWRWS&K Department,

Gujarat; Madhya Pradesh; Odisha; Telangana; Manipur; Maharashtra; Punjab; Karnataka; and Rajasthan under PMKSY fund upto October, 2016. Further Rs. 499.91 Crore was distributed to the Governments of Karnataka; Madhya

Pradesh; Odisha; Telangana; and Maharashtra and Rs.1981.00 Crore was released as 1st instalment to Polavaram Project Authority under PMKSY fund in December, 2016.

4. Involvement of NWDA in India International Trade Fair -2016

The annual flagship event of India Trade Promotion Organisation (ITPO),

Government of India, organized the 36th India International Trade Fair (IITF) during the period starting from 14 to 17 November, 2016. The Hon‟ble President of India, Mr Pranab Mukherjee while inaugurating the iconic event mentioned that the IITF showcases the reflections of India‟s commitment to bring benefits to its economic reforms to its masses. Shri Ravi Shankar Prasad, Union Minister of Electronics and IT, Law and Justice, Government of India, presided over the colourful inaugural function held at Pragati Maidan, New Delhi.

Among the high dignitaries present on the occasion were Smt. Nirmala Sitharaman, Minister of State for Commerce and Industry; Shri Manohar Lal Khattar, Chief Minister of Haryana (Focus State); Shri Chandreshwar Prasad, Minister of Urban Development, Housing and Transport Department, Government of Jharkhand (Partner State); Shri Uma Shanker Gupta, Minister for MSME, Government of Madhya Pradesh (Partner State); Her Excellency Dr. Cho Hyun, The Ambassador of the Republic of Korea (Partner Country); and HE Excellency Mr. Vitaly a Prima, The Ambassador Extraordinary and Plenipotentiary of the Republic of Belarus (Focus Country).

About 7000 participants witnessed and actively participated in the fair. Over 150 companies from 27 countries such as Australia, Afghanistan, Belarus, Bahrain, Bangladesh, Bhutan, China, Germany, Hong Kong, Iran, Kuwait, Kyrgyzstan, Myanmar, Netherlands, Oman, Sri Lanka, South Africa, South Korea, Singapore, Tibet, Turkey, Thailand, UAE and UK took part in the event and showcased their advancements in technologies and applications thereon. The domestic participation profile covered almost all the States and Union Territories, Central Government Ministries/Departments, Public Sector Undertakings, Export Promotion Councils, Commodity Board, Financial Institutions, Corporate and Non-Government Organisations.

The NWDA participated in the IITF with major emphasis on display of its studies and issues related to ILR. During the fair, the details of various IBWT as well as Intra-State Link proposals especially pertaining to Ken-Betwa Link Project was exhibited in the stall of NWDA, which was set up as a part of the Pavilion of the MoWR, RD & GR. The visitors to the NWDA stall were appraised about the IBWT links particularly the priorized and nationalized Ken-Betwa (Phase I & II) ILR project being studied by NWDA.
