INTRODUCTION This solicitation is being issued by the New York State Department of Corrections and Community Supervision (DOCCS).

DOCCS Mission Statement

To improve public safety by providing a continuity of appropriate treatment services in safe and secure facilities where inmates’ needs are addressed and they are prepared for release, followed by supportive services under community supervision to facilitate a successful completion of their sentence.

DOCCS’ Goals include the following:

Create and maintain an atmosphere where both inmates and staff feel secure.

Develop and implement positive individualized treatment plans for each inmate that includes post release reentry plans.

Teach inmates the need for discipline and respect, and the importance of a mature understanding of a work ethic.

Establish a needs/risk approach to treatment and community supervision to ensure a continuity of services.

Assist all staff by providing the training and tools needed to perform their duties while enhancing their skills.

Offer career development opportunities for all staff.

Purpose The purpose is to establish multiple agreements with vendors to provide Inmate Food and Sundry Package Service to the DOCCS inmate population. This solicitation is being conducted as a non-competitive recruitment. Approvals will be made to multiple responsive and responsible vendors who meet minimum qualifications as determined by DOCCS. Vendors must comply with all DOCCS policies and security requirements and provide approved merchandise at fair prices to inmates, their families and friends. Implementation of the application process or, if selected, the provision of providing goods and services by a vendor must result in no expense incurred by NYS DOCCS. The goals of the NYS DOCCS package program are to maximize the availability of food and sundry packages for inmates and to have vendors offer a variety of items at competitive pricing while maintaining high security and providing an efficient operation. DOCCS is determined to eliminate contraband from being introduced through food and sundry packages. Additionally, DOCCS wants to keep package processing time to a minimum, and ensure inmates only receive items permitted by DOCCS. In order to meet these goals, DOCCS is opening up the market to allow a variety of vendors that meet the vendor application criteria to participate in the program. The vendor approval process is based upon the prospective vendor meeting DOCCS criteria. Once approved, DOCCS will provide the vendor with an approval statement which the vendor is required to place on the cover of its catalogs and on its websites. DOCCS approval statement only indicates that the vendor has received DOCCS approval to provide packages to DOCCS inmates and does not constitute any type of endorsement. DOCCS does not guarantee any volume of sales to approved vendors. DOCCS does not receive commissions from inmate package sales nor is it soliciting commissions from any agreement resulting from this package program.

NOTE: This is a tentative timetable, which may ONLY be modified to address DOCCS’ needs.

MANDATORY VENDOR CONFERENCE Due to security restrictions, all Vendors must pre-register 48 hours prior to the conference by contacting the Contract Procurement Unit at (518) 436-7886 ext. 3135 or e-mail [email protected]. It is recommended that attendees arrive at least fifteen minutes prior to scheduled time of the conference with photo identification. Questions during the conference will be permitted. However, verbal answers are not official answers. All questions asked at the conference must be submitted via email to [email protected] by April 28, 2017 to the designated contact for this solicitation. Please reference “Inmate Vendor Package Program” on the subject line of your email. Official answers to all questions will be distributed by DOCCS via email to all attendees of the conference and also posted in the New York State Contract Reporter and on the DOCCS website. DOCCS shall not be held liable for any costs incurred by a vendor to attend the mandatory vendor conference.

INMATE VENDOR PACKAGE PROGRAM APPLICATION PROCESS

DOCCS is accepting applications from vendors seeking authorization to provide packages of preapproved personal food and property items to inmates. DOCCS Directive No. 4911A (Inmate Packages) allows inmates placed in the custody of DOCCS to receive and order packages of food, clothing and other items of personal property through approved vendors. These packages are subject to restrictions as identified in the Directive. The vendor approval process is not complete until the prospective vendor receives approval by authorized DOCCS personnel and an agreement is fully executed.

Applications will be reviewed by the DOCCS staff. In order to be considered as an approved vendor, the application must clearly identify all processes and comply with vendor criteria as outlined in the Vendor Application Criteria Information beginning on page five (5). Prospective vendors who attend the Mandatory Vendor Conference must submit applications by May 19, 2017. Prospective vendors denied participation may resubmit a vendor application upon DOCCS reinitiating the application process. DOCCS will open an enrollment period for future interested vendors. The timeframe for such will be at the Department’s sole discretion and will only be utilized if deemed necessary to meet DOCCS ongoing requirements. Additional recruitment periods will

be advertised in the NYS Contract Reporter. Vendors must register with the New York State Contract Reporter in order to receive notifications about this package program. DOCCS will notify each vendor if they are approved or disapproved from participation in the Inmate Food and Sundry Package Program. The approved vendors contact information will be posted on the DOCCS website at www.doccs.ny.gov and will also be made available to the inmate population in correctional facilities. It is the responsibility of the vendor to send correctional facilities their catalog and ordering information for the inmate population and placement within visiting areas. Vendors are required to maintain the approved items listed in their catalog or on-line without adding items. On a limited basis, DOCCS will make exceptions and review items for approval to be added to the catalog during the year. Pricing and shipping and handling charges must remain firm for the first year. Price and shipping and handling charge increases will be allowed every 6 months thereafter and must be clearly identified to purchasers (e.g. updated catalogs/internet pricing). Price decreases or special pricing for approved items is allowed at any time, but must be less than the price listed in the catalog or on-line. Pricing and shipping and handling charges must remain reasonable. DOCCS reserves the right to request further information to make a determination of price and shipping and handling charges reasonableness. DOCCS staff may inspect the vendor’s warehouse to review and approve their order taking, package filling processes, and security requirements as outlined in the Vendor Application Criteria Information. Two-years after the effective date of the agreement, approved vendors must send DOCCS a letter requesting to re-apply and continue service during the new DOCCS application process. If a vendor is not in good standing with DOCCS, the vendor will be required to resubmit the Vendor Application Criteria Information correcting deficiencies and revising policies or processes to resolve DOCCS’ concerns.

DOCCS INFORMATION

Most inmates are allowed to receive packages and articles as outlined in Directive #4911A” Inmate Packages”. Items will be purchased through approved vendors by eligible inmates, family, and friends. Package services will be provided to correctional facilities throughout New York State (see Attachment 1 – Map of NY Correctional Facilities). The average daily inmate population at each facility can be located in Attachment 2. When the vendor receives an order, they will first verify that the inmate is eligible to receive a package via an inquiry to DOCCS utilizing a real time web service. Vendors will also be required to notify DOCCS (real time), via web service, that a package order has been placed. If an order is placed for an inmate that is ineligible to receive a package at the time the order was placed or if a package contains any items that are not approved by DOCCS, the package will be returned to the vendor at the vendor’s expense.

NYS RESERVED RIGHTS New York State Reserves the right to:

1. Reject any or all Applications received in response to the solicitation;

2. Withdraw the solicitation at any time, at the sole discretion of the Agency;

3. Make an approval under the solicitation in whole or in part;

4. Disqualify any vendor whose application fails to conform to the requirements of the solicitation;

5. Seek clarifications and revisions of solicitation;

6. Amend the solicitation requirements prior to opening vendor responses to correct errors or oversights, or to supply additional information, as it becomes available;

7. Direct vendors, prior to the Application Deadline, to submit application modifications addressing subsequent solicitation amendments;

8. Change any of the schedule dates with notification through the NYS Contract Reporter;

9. Eliminate any mandatory, non-material specifications that cannot be complied with by all of the prospective vendors;

10. Waive any requirements that are not material;

11. Utilize any and all ideas submitted in the responses received;

12. Negotiate with the vendor responding to this solicitation within the solicitation requirements to serve the best interests of the State. This includes requesting clarifications of any or all Vendor Applications;

13. If an incorrect reference/parameter/component/product/etc. is stated by DOCCS or by the vendor, the evident parameter/component/product shall prevail; the proper alternative or corrected parameter/model/code number(s) shall be considered.

VENDOR APPLICATION CRITERIA INFORMATION

Applications will be reviewed based upon thoroughness in responding to each of the following items. All required forms/documents shall be submitted with the application and all proposed services must be adequately and completely described. A response in sequential order is required to provide DOCCS with the best method to review your application. It is the responsibility of the vendor applying to verify the completeness of its application and its suitability to meet the requirements. Applications that fail to conform to all requirements set forth may be considered non-responsive and may be rejected. DOCCS shall not be held liable for any costs incurred by the vendor in the preparation, production or submission of an application, or for any work performed by a vendor prior to or following the approval of an Agreement.

1. Vendor shall submit a cover sheet to include all of the following information:

a. The vendor’s legal structure (e.g. a New York corporation) and principal place of business.

b. List of people who prepared the application process, including their title, name, address, telephone number, fax number, e-mail address and a project representative that has authority to answer questions regarding the submitted application for qualification.

c. A list of all subcontractors or independent vendors, if any, that the vendor will use to provide services.

d. A statement that the vendor has a minimum of the following: Three (3) years experience providing inmate packages in a manner as described on Page 8, #11. The systems must have been in full production servicing at least one (1) year for at least three (3) government agencies.

e. A statement that the Vendor’s Application meets all the requirements of the Vendor Application Criteria.

f. A statement that the vendor is capable of shipping packages to inmates within 3 business days, but no later than 7 business days of receipt of a paid order.

g. A statement that the vendor will submit to, and cooperate with, unannounced inspections by NYS DOCCS.

2. Vendor must provide a self-certified, inventory report showing that they possess a minimum of $250,000 (advertised retail value) of merchandise on the premises (this merchandise is subject to physical verification by DOCCS). The vendor must include the physical location of said merchandise. The minimum $250,000 value of merchandise must be maintained by the vendor on premises at all times (subject to unannounced inspections by DOCCS).

3. Past Performance

Security Incidents: Vendors must provide details on all incidents of security breaches, including lost or misused data, in last three (3) years. Explain the nature and extent of the incident, remedial actions taken, and current status.

Terminated Contracts/Agreements: Vendors are required to identify all contracts/agreements it had with correctional authorities that were terminated for reasons other than contract-term completion within the past three (3) year period. (i.e., terminated for just cause)

Financial Stability: Vendor must document its ability to service an agreement through submission of financial statements documenting past sales history. The Vendor must be financially stable and able to substantiate the financial statements of its company. DOCCS reserves the right to request additional documentation from the Vendor and to request reports on financial stability from independent financial rating services. DOCCS reserves the right to reject any vendor who does not demonstrate financial stability sufficient for the scope of this program.

4. Vendor must have the necessary insurance to comply with New York State requirements. Vendor shall maintain insurance with a Commercial General Liability insurance policy with Warehouse Legal Liability policy for a minimum of $1,000,000 per occurrence. A copy of Certification of Insurance will be required with this application.

Workers’ Compensation And Disability: A policy covering the obligations of a successful vendor applicant in accordance with the provisions of Chapter 41, Laws of 1914, as amended, known as the Workers’ Compensation Law, and the agreement shall be void, and of no effect unless the successful vendor procures such policy, and maintains it through the end of the agreement term. A copy of the certificates must be submitted from a successful vendor. The name and FEIN of the business entity must be identical to the name and FEIN identified on the proof of coverage or exemption. In the instance of exemption, please be advised that the WCB does not verify Attestations for Exemption. It is incumbent on the state contracting entity to verify the validity of the entity's reason for exemption; please verify and provide a copy of the signed and dated exemption certificate.

5. Vendor shall possess a valid New York State business license (if applicable), incorporation documents if the corporation is located within the state of New York, a letter from the Secretary of State or, if not a New York state business, an affidavit that business is in good standing with the state, province, or country in which business is headquartered. A copy of business license and resale permit will be required.

6. Vendor must offer products in at least seven (7) of the ten (10) Product Categories referenced below. Vendor should offer multiple selections in each category when possible.

Please note: Vendors offering religious articles (Product Category J) are exempt and do not need to meet the minimum of 7 categories.

Vendor shall provide a list of products or a catalog identifying items and prices for DOCCS to review and approve. Once the products offered are approved, unless DOCCS makes an exception, no additional items can be added to the list. Final catalogs from approved vendors are due June 30, 2017. DOCCS reserves the right to remove an item at any time. On a limited basis, DOCCS will make exceptions and allow items to be added to the catalog during the year. Special pricing is allowed, but must be less than the price listed in the catalog or on-line. Glass and metal containers are not acceptable. The list of available products must clearly identify Kosher and Halal foods as well as any items containing pork.

7. Vendor must supply ample copies of approved catalogs, flyers, and order forms, free of charge, to DOCCS facilities in English and Spanish. The information should include the vendor’s ordering policies, instructions on how to order items, and internet links for on-line service. Catalogs and websites must indicate prices for all items and expiration dates of prices. They must also include the shipping weight of each individual item and a method for calculating the total gross weight of the inmate package. All catalog and online orders in excess of 30 pounds (including packaging) will not be accepted. Vendor is responsible to adhere to the weight requirements as outlined in Directive 4911A.

A large percentage of the DOCCS inmate population is non-English speaking. Vendor must identify if websites, and telephone services are available in any other supported languages.

8. Vendor must submit a link or mock-up of the vendor’s business/company flyers and website for DOCCS to review the visitor log-in and product selection options. The approved vendor’s flyers and websites must display a memo or link to the memo from DOCCS affirming the company is an approved vendor for the inmate package program.

9. Upon DOCCS approval of a vendor, all catalogs, order forms, and web sites must prominently display the following disclaimer:

NYS DOCCS has approved this independent vendor to sell merchandise to inmates and the public. NYS DOCCS’ brief review and approval of this vendor was strictly limited to minimum security requirements and general business intent. NYS DOCCS is not affiliated with this vendor and does not guarantee that the vendor will fulfill any obligations, perform as expected, nor permanently remain in business, nor does NYS DOCCS guarantee the vendor's products in any way. Any purchases from this vendor are at the buyer’s sole risk. NYS DOCCS assumes no liability whatsoever for such purchases, nor any aspect thereof. Any issues or disputes regarding the vendor's products are the sole responsibility of the buyer and/or the vendor, and NYS DOCCS is not obligated to mediate or resolve any such disputes.

10. Vendor must have a “no backorder” policy and substitutions shall not be permitted. Orders should normally be processed within 3 business days of receipt of payment. The vendor may choose to hold orders for out of stock items but orders must be fulfilled within 7 business days. In the event that an item is out of stock longer than a 7 business day processing time, a refund will be issued to the purchaser.

11. Vendor must document its method for filling orders. A blind pull system, where the person filling the order does not know the identity of the inmate who is receiving the order or the identity of the person who placed the order is required. Vendor’s staff responsible for receiving orders, assigning purchase order numbers, and/or secure numerical identifiers shall not be allowed to assemble packages.

12. Vendor must provide names and identification information including date of hire and position title for all staff providing services for the NYS DOCCS inmate package program. Current state driver’s licenses are accepted as valid identification.

Vendor must conduct pre-employment background checks for employees hired after the application approval period and provide evidence of such on demand. Existing employees are subject to the same requirements as of the date of the approval of the vendor’s application by NYS DOCCS if involved in processing, receiving orders, packaging or sending vendor packages. The vendor must provide evidence of these requirements having been completed from a business certified to conduct such checks.

13. Vendor’s receiving, packaging, and shipping areas must be monitored by a Closed Circuit Television System. Backup video tapes or other medium providing a record of activities must be held for 30 days and must contain date/time stamp and the ability to identify vendor staff. Tapes must be available for NYS DOCCS to review upon request.

14. Two copies of the purchase receipt or shipping invoice shall be included in each package and a copy shall be forwarded to the purchaser if purchased by a non-inmate. (Email confirmation is acceptable for orders placed over the internet).

15. Prior to each shipment of packages, the vendor should provide the receiving facility a shipping manifest containing inmate names, inmate DIN that corresponds to each package shipped. The shipping manifest shall be sent to the facility via e-mail. (The vendor needs to detail how this will be accomplished.)

Packages shall display a shipping label with the inmate’s name and Department Identification Number (DIN) and purchaser’s information (name/address) in a barcoded and scannable format. Standard shipping labels may be used, but shall only provide the vendor’s return address; the correctional facility’s address, and clearly display the secure numeric identifier to facilitate comparison with the shipping manifest.

16. Vendor must indicate acceptable payment methods with the following minimum methods being required by DOCCS:

a. Major credit card; b. Cashier Check / Money Order; and c. Institution check for inmate orders.

The vendor is prohibited from charging fees associated with the processing of payments.

17. Vendor’s return policy must be clearly stated in catalogs and on web-sites.

18. If there is a problem or concern with an order, the vendor must provide a toll-free, customer service number for customers to call and submit an example of a postage-paid complaint form for inmates to complete and send to the vendor. All order disputes are solely between the vendor and the purchaser and must be settled without involvement of DOCCS. Vendor must identify if customer service or complaint forms are available in Spanish and list any other supported languages.

19. Vendor must refund any overpayment if funds are received in excess of the price of the order.

20. All available clothing categories must come in all sizes. For example, while a vendor may offer 3 brands of t-shirts, a minimum of one brand must be available in the full range of sizes for both male and female inmates, but preferably all the brands would be offered in a full range of sizes. All clothing must comply with security requirements as detailed in Directive #4911A.

21. Vendor must clearly identify the shipping/handling policies including the following:

a. Vendor must utilize DOCCS web service to verify inmate location and eligibility to receive packages prior to accepting an order.

b. If an inmate is not at the facility at the time of delivery, the facility will return the package to the vendor. The vendor must provide a means of package forwarding at the vendor’s expense for inmates that have moved from one facility to another.

c. Vendor must identify the shipping company it will use to ship individual packages to facilities. Once the package program starts, no change of shipping companies will be allowed without DOCCS’ approval which shall not be unreasonably withheld.

d. The vendor must provide the shipping and handling charges that apply to packages ordered. Please see section labeled “Inmate Vendor Package Program Application Process for shipping and handling price changes once the vendor is approved.

e. Vendor is responsible to replace any item that is missing or damaged during shipping.

22. Package restrictions – Vendor must indicate ability to meet the package requirements as outlined in Directive #4911A. Promotional materials (e.g. prizes, informational disks etc.) or other non-product items or substances sealed within original packaging or attached to an allowable article will be removed prior to shipment. Please describe how orders will be packaged for shipping and indicate the shipping method to be utilized.

23. Vendor must provide an example of a quarterly report that includes the number of packages per DOCCS correctional facility, total number of such packages, the amount of sales per facility, and the total amount of such sales. Separate reports for inmate purchases and family/friends purchases are required. DOCCS requires the vendor to send a daily FTP file report of packages shipped with information regarding the package, including but not limited to, purchaser, inmate DIN, package date, package number, and items in the package. The vendor is responsible for sending these reports to the designated DOCCS employee(s) to be identified at a later date. All of these reports are required to be sent electronically in an electronic format with sorting capabilities.

24. Vendor must indicate its experience and ability to work with real time web services. Vendor is responsible to utilize this data to know if inmates are eligible to receive packages. The vendor must have a procedure to handle the situation if the inmate is not eligible.

The proposed systems will be required to routinely exchange data with DOCCS. These are necessary to ensure the proposed systems are aware of all information necessary to perform required business processes, (such as ensuring purchases only occur at the facility housing the inmate). Similarly, DOCCS will require information from the proposed systems. The vendor and DOCCS will develop the exact details of all data exchanges upon approval and an agreement. These details include, but are not limited to, file layouts, data formats, exchange frequency and exchange methodology. The vendor must detail data exchange methodology capabilities (i.e., FTP, web services, etc.). Communication access for data exchange must be available at all times. Where appropriate, DOCCS will make a reasonable attempt to add or modify formats or schemas to accommodate the vendor for new services implemented resulting from an agreement. NIEM Standards The vendor agrees to migrate the existing data exchange requirements to data standards consistent with the National Information Exchange Model as they become operational at no cost to DOCCS. Vendors may find additional information regarding NIEM standards at http://www.niem.gov.

25. Vendor must agree to comply with all applicable NYS and DOCCS policies, procedures, regulations and directives throughout the term of the agreement. Specifically, vendor is to be made aware of and agree to the following, as currently written, or as revised:
