Notice is hereby given in terms of the National Environmental Management Act, 1998 (Act No 107 of 1998) as amended

and the Environmental Impact Regulations (2010) that ArcelorMittal South Africa Ltd (AMSA) has submitted an

application for environmental authorisation to the Gauteng Department of Agriculture and Rural Development

(GDA&RD).

AMSA Pretoria Works was an integrated steel works that is in the process of scaling down, with only selected business units set to continue operation. Business units still in operation and of interest is a single 4 m coke battery with 51 ovens

and associated coal handling plant as well as gas cleaning plant. AMSA is currently operating a gas purification plant with the main purpose of cleaning out impurities from the gas generated in the coke making process. The clean gas is used again as energy source at the coke oven battery.

In order to comply with strict air quality standards in terms of the National Environmental Management: Air Quality Act (No 39 of 2004) by 2015, AMSA intends to replace the old gas plant with a new one, including the replacement of existing units as well as additional new units, technology and standards. Consequently, ArcelorMittal South Africa intends to undertake an Environmental Scoping Study and an Environmental Impact Assessment and submit a Scoping and EIA report respectively in support of the proposed project.

Chemicals has submitted an application for environmental authorisation to the Gauteng Department of

ArcelorMittal South Africa Pretoria Works is an integrated steel works that is in the process of scaling

down, with only selected business units set to continue operation. Within the Pretoria Works, there are

two independent ArcelorMittal business units, viz. Vereeniging Works and ArcelorMittal Coke and

Chemicals (AMCC). AMCC manages and runs the 4 m coke battery with 51 ovens and associated coal

handling plant as well as a gas cleaning plant - which is the subject of this Environmental Impact

Assessment Study. The gas cleaning plant cleans out impurities from the gas generated in the coke

making process. The clean gas is used again as energy source at the coke oven battery.

In order to comply with strict air quality standards in terms of the National Environmental Management:

Air Quality Act (No 39 of 2004) by 2015, AMCC intends upgrading the current gas plant (situated within

the Pretoria Works footprint) with new, state of the art equipment.

Consequently, AMCC intends to undertake an Environmental Scoping Study and an

Environmental Impact Assessment and submit a Scoping and EIA report respectively in support

of the proposed project.

NOTICE OF AVAILABILITY OF DRAFT ENVIRONMENTAL SCOPING REPORT FOR PUBLIC

REVIEW

All I&APs are hereby notified that the draft Environmental Scoping Report (ESR) will be available for

public comment from 28 February 2011 for a period of 40 days until 12 April 2011. The draft ESR will

summarise key environmental issues identified to date and will be available at the following places:

a) Pollution The new National Environmental Management: Air Quality Act (NEM:AQA) No 39 of 2004 that came into effect on 01 April 2010, grants a five year period during which steps are to be taken by existing plants to ensure compliance with the new standards, as stipulated in the Act. In order to comply with strict air quality standards by 2015, ArcelorMittal Coke and Chemicals (AMCC) intends upgrading the old gas plant. This process will include the replacement of existing units as well as the construction of additional new units, with improved technology and standards. This project will ultimately lead to cleaner air and a healthier working environment for AMCC employees and the surrounding landowners and communities. In addition, a baseline air quality assessment has already been undertaken as part of the Scoping Study and a detailed air quality impact assessment will be conducted in the EIA phase of the project, in order to provide a better indication of the extent of air quality impacts for the proposed project. b) Side Effects of Products used at the Plant Products that are currently produced or used at the plant are the following:

• Coke Oven Gas • Crude Tar • Crude Benzole • Wash-oil

During the upgrade of the plant the following changes will take place concerning the products: • The production of crude benzole will be replaced by Naphthalene production • The production of Sulphur will be added to the process • Sodium Hydroxide will be used in the process • Ammonia will be extracted from the gas

The enriched Naphthalene residue will be added to the crude tar. The ammonia will be cracked into nitrogen and hydrogen and will be added to the coke oven gas again. The five main products at the end of the process will be:

• Coke oven gas • Crude Tar • Sulphur • Wash-oil

• Sodium Hydroxide All products with a vapour pressure above 14 kPa will be stored in a closed system with a vapour system that is connected to the coke oven gas system. Material safety data sheets have been forwarded to Ms Diedericks on 18 April 2011. c) Noise Impacts The regulation of noise at AMCC is governed by the Occupational Health and Safety Act No. 85 of 2003: Noise Induced Hearing Loss Regulation No. R. 307. The maximum noise level that can be exposed to employees is 85 dB and thus AMCC has taken various steps to ensure that this is adhered to. These steps include: • Usage of hearing protectors by all persons entering the noise zones; • Training of employees on hazards of noise exposure, personal hygiene, proper use of noise

hearing protectors and employee responsibilities as directed in the noise regulations; • Acoustic treatment of noise emitting surfaces; • Replacement of noisy equipment with less noisy ones; • New equipment ordered has to adhere to specific noise standards; • Fencing of noise sources with acoustic enclosures; and • Shifting of operations that are a source of noise away from areas with high human traffic. d) Traffic No additional traffic is envisaged since the capacity of production at the coke ovens will remain the same after the upgrading of the gas cleaning plant.

2. The City of Tshwane Metropolitan Municipality is charged with implementing the atmospheric emission licensing system referred to in section 22 of the NEM: Air Quality Act, 2004 (AQA) and must for this purpose perform the functions of licensing authority as set out in Chapter 5 of the AQA and other provisions of this Act. In general, all development applications involving listed activities, according to the NEM: Air Quality Act, 2004 (AQA) will be required to undergo an EIA and will require a specialist Air Quality Impact Assessment

ArcelorMittal Coke and Chemicals (AMCC) are currently aware of the regulatory requirements applicable to obtaining an atmospheric emissions license (AEL) for the proposed project. To this end, AMCC have appointed SSI Environmental to act as the independent Environmental Assessment Practitioner (EAP) to obtain Environmental Authorisation for the proposed project. An Air Quality Impact Assessment (AQIA) has been commissioned as part of the EIA study and the scope and content of the AQIA is largely guided by the various requirements of the AQA. Furthermore, AMCC have already embarked on a consultation process with the City of Tshwane’s Air Quality Management Division – who have been listed as an Interested and Affected Party (I&AP) on the project’s I&AP database and both AMCC and SSI Environmental will be working very closely with

Furthermore, the operations at ArcelorMittal Coke and Chemicals are Zero Effluent Discharge (ZED). The key purpose of the ZED sump system is to ensure that the coke ovens operate as a ZED plant during dry weather flow conditions, e.g. no water is permitted to be discharged from the coke ovens premises by means of stormwater (which includes any process water). All water must either be re-used or recycled and the water consumption of the plant must be optimized. The sump system provides for 600 m3 of buffer storage capacity, to store and control contaminated stormwater in the event of spillage and rain.

a) Air Pollution The new National Environmental Management: Air Quality Act (NEM:AQA) No 39 of 2004 that came into effect on 01 April 2010, grants a five year period during which steps are to be taken by existing plants to ensure compliance with the new standards, as stipulated in the Act. In order to comply with strict air quality standards by 2015, ArcelorMittal Coke and Chemicals (AMCC) intends upgrading the old gas plant. This process will include the replacement of existing units as well as the construction of additional new units, with improved technology and standards. This project will ultimately lead to cleaner air and a healthier working environment for AMCC employees and the surrounding landowners and communities. In addition, a baseline air quality assessment has already been undertaken as part of the Scoping Study and a detailed air quality impact assessment will be conducted in the EIA phase of the project, in order to provide a better indication of the extent of air quality impacts for the proposed project. b) Handling of dioxins generated by the plant The two by products that are generated from the Coke Oven are:

• Coke oven gas • Crude Tar

All intermediate and final storage facilities where a product with a vapor pressure above 14 kPa is stored will have vapor system that is connected to the coke oven gas system. This will ensure that no emissions from storage facilities are sent to the atmosphere. The different products will be handled as follows:

• Coke Oven Gas: The gas will be cleaned in the upgraded gas plant from where it will be sent back to the battery for heating purposes. Some of the gas is used as fuel for the two boilers on site. One client inside the ArcelorMittal boundary is supplied with gas and the excess gas is flared.

• Naphthalene oil: The Naphthalene oil is pumped to the crude tar storage tank. • Crude Tar: The crude tar is supplied to ArcelorMittal’s Coke & Chemicals plant in

Vanderbijlpark for further distillation. • Sulphur: The sulphur will be sold as a final product. • Ammonia: The ammonia will be cracked into nitrogen and hydrogen. This will be rerouted to

the coke oven gas line in front of the gas plant. No specific measurements have been taken relating to dioxins emanating from the furnace.

This Environmental Impact Assessment (EIA) study is being undertaken in two phases: Phase 1 - Environmental Scoping Study (ESS) including Plan of Study for EIA; and Phase 2 - Environmental Impact Assessment (EIA) and Environmental Management Programme (EMPr). use of existing information have been used to highlight and assist in the identification of potential significant impacts (both social and biophysical) associated with the proposed project. The next phase is the EIA. The EIA will aim to: • supplement, where necessary, the assessment of the social and biophysical environments

affected by the development during the Scoping study; • assess impacts on the study area in terms of environmental criteria; • identify and recommend appropriate mitigation measures for potentially significant environmental

impacts; • complete an Environmental Management Programme (EMPr) for the inclusion of proposed

mitigation measures; and • undertake a fully inclusive public participation process to ensure that I&AP issues and concerns

are recorded and addressed. During the EIA study, all I&APs will be notified of the availability of draft reports for review and comment. Furthermore, when the Environmental Authorisation is issued by the competent authority (Gauteng Department of Agriculture and Rural Development) all registered I&APs will be notified of the decision and the appeals procedure.

9. According to the Tshwane Open Space Framework the proposed forms part of the following Open Space Typologies:

• A Green Node namely, Langeberg Mountain Range (Ecological Representative Open Space element) of Metropolitan significance. Green Nodes are essential in the provisioning of environmental goods and services, the protection of biodiversity, endangered species and ecological systems, as well as eco-based activity. Green Nodes must be protected for conservation purposes.

• A Grey Node, namely Iscor Work. The

a) A detailed air quality impact assessment study is being undertaken as part of the EIA study. The findings and recommendations will be included in the draft and final EIA Reports. The scope and content of the AQIA is largely guided by the various requirements of the AQA.

b) A detailed layout plan will be included within the EIA report and submitted to the City of Tshwane (Open Space Management Department) for perusal. This layout plan will also be made available to the surrounding Interested and Affected Parties to evaluate and comment on.

c) A detailed storm water management plan will be available at the time of construction. d) Waste handling measures during the operational phase, will be dealt with in the EMPr. e) The description of the study area contained in the draft Environmental Scoping Report indicated

that the site is underlain by dolomite. This was however, a generic description of the area. Specific geological records for the site in question indicate that the local geology underlying the study area, consist mainly of shale and intrusive diabase. The general weathering profile constitutes a soil profile that varies in depth between 0,00 m and 34,00 m, with an average depth below surface of ± 9,90 m. This is followed by weathered rock varying in depth between 6,50 m

ISSUE/COMMENT RAISED BY RESPONSE value of Grey Node lies in their socio-economic functioning: the rendering of support to primary service delivery, as well as their potential to supplement ecological (as linkages) and recreational functioning (once closed and developed as such).

The Department recommends that the following issues be taken into consideration during the EIA phase of the project:

a) A detailed air quality impact study must be undertaken as one of the specialist studies to be included in the EIA report.

b) A detailed layout plan shall be included within the EIA report and submitted to this Department for perusal. The layout plan shall also be made available for the surrounding Interested and Affected Parties to evaluate and comment on.

c) A detailed storm water management plan will need to be compiled that ensures that storm water generated on site is discharged in such a way that the receiving environment is not adversely impacted upon, considering the fact that the site is underlain by dolomite.

d) A complete waste handling and separation procedure for the operational phase should be implemented due to the handling, storage and disposal of hazardous chemicals.

e) Due to the site being underlain by dolomite, it is important that a geotechnical specialist study be conducted and submitted to this Department for review and approval during the EIA phase.

f) The applicant must take note of the applications

and 41,00 m, with an average depth below surface of ± 21,70 m, which gradually change to fractured rock varying in depth between 9,00 m and 40,00 m, with an average depth below surface of ± 30,30 m, before changing to fresh hard rock. The study area therefore does not fall within a critical dolomitic zone. A copy of the geological map for the study area was forwarded to the CoT on 18 April 2011. Furthermore, it has to be reiterated that no hazardous chemicals will be stored underground. Proper storm water measures will be implemented on site and these measures will be included into the Environmental Management Programme being compiled for the project.

f) All activities on site will comply with the Tshwane Municipality’s By-Laws. g) The EMPr will form part of the EIA Report. The EMPr is a detailed plan of action prepared to

ensure that recommendations for enhancing or ensuring positive environmental impacts and limiting or preventing negative environmental impacts are implemented during the life-cycle of the project. All I&APs will be given an opportunity to review and comment on the EMPr.
