Why ITCMI?Project was set up to be a success:

• ITC had previous experience with EI’s as well as working in many of the Tribal communities that were to be inventoried

• ITC has previously worked on and is currently apart of DITCA’s that have similar tasks involved with the Tribal Minor NSR DITCA.

• Region 5 has “only” 35 Tribes, workload did not appear painstaking/exhaustive at onset of project

Tribal Minor New Source Review Inventory Report to Leech Lake Band of Ojibwe Inter-Tribal Council of Michigan, Inc. September 11, 2012 This report summarizes the tribal minor New Source Review source inventory developed for Leech Lake Band of Ojibwe lands by the Inter-Tribal Council of Michigan in cooperation with Leech Lake Band staff. The inventory included sources potentially regulated under tribal minor New Source Review within the exterior boundaries of the Leech Lake Band of Ojibwe Reservation and off-reservation trust land. Background In 2011, EPA finalized the Federal Implementation Plan (FIP) for Tribal Lands regarding minor New Source Review (NSR) regulations. The FIP for Tribal Lands requires existing minor NSR sources on Tribal lands to register with EPA by March of 2013 and will require some new facilities and facilities undergoing modifications in Indian country to apply for air quality permits prior to construction. The threshold for applicability of these requirements are low; a source located in an attainment area would be subject to the regulations if they emit 10 tons per year of CO, NOx, SO2, or PM, 5 tons per year of VOC or PM-10, or smaller quantities of lead, fluorides, or sulfur compounds. Small businesses such as gas stations and dry cleaners may be subject to the rule, thus Region 5 could have thousands of newly regulated sources within its jurisdiction. For effective permitting, enforcement, and outreach efforts in implementing the FIP, EPA Region 5 required thorough minor NSR source inventories for each tribe within the Region. Inter-Tribal Council of Michigan (ITCM) was tasked to develop an inventory of potential minor NSR sources in Indian country across EPA Region 5. Inventory development required gathering information on tribal and non-tribal facilities through online research such as www.manta.com and verifying these sources with tribal staff. ITCM mapped the minor source locations using Geographic Information Software (GIS) and reservation/trust land boundary shapefiles provided by EPA Region 5. In addition, ITCM used Tribal Emissions Inventory Systems Software (TEISS) to estimate emissions from a subset of the inventoried sources, including gasoline service stations, automobile body repair facilities, and dry cleaners. Findings One hundred sixty-five potential minor NSR facilities were identified on the Leech Lake Band of Ojibwe Reservation. These potential minor sources spanned the range from printers to repellant and fertilizer facilities. Fifteen gasoline service stations were identified and included due to potential emissions from underground storage tank filling and fueling processes, as were airports and marinas. Seventy-nine hotel/resorts were included due to potential emissions from underground and above-ground storage tank filling, emergency generators, and other regulated processes. Auto repair facilities were included due to potential emissions from on-site generators, fuels and painting or finishing chemical use. Casino resorts, governmental buildings, medical clinics, and schools were included due to potential emissions from on-site generators

Tribal Minor New Source Review Inventory Report to Fond du Lac Band of Lake Superior Chippewa Inter-Tribal Council of Michigan, Inc. September 11, 2012 This report summarizes the tribal minor New Source Review source inventory developed for Fond du Lac Band of Lake Superior Chippewa lands by the Inter-Tribal Council of Michigan with the cooperation of Fond du Lac Band staff. The inventory included sources potentially regulated under tribal minor New Source Review within the exterior boundaries of the Fond du Lac Band of Lake Superior Chippewa Reservation and off-reservation trust land. Background In 2011, EPA finalized the Federal Implementation Plan (FIP) for Tribal Lands regarding minor New Source Review (NSR) regulations. The FIP for Tribal Lands requires existing minor NSR sources on Tribal lands to register with EPA by March of 2013 and will require some new facilities and facilities undergoing modifications in Indian country to apply for air quality permits prior to construction. The threshold for applicability of these requirements are low; a source located in an attainment area would be subject to the regulations if they emit 10 tons per year of CO, NOx, SO2, or PM, 5 tons per year of VOC or PM-10, or smaller quantities of lead, fluorides, or sulfur compounds. Small businesses such as gas stations and dry cleaners may be subject to the rule, thus Region 5 could have thousands of newly regulated sources within its jurisdiction. For effective permitting, enforcement, and outreach efforts in implementing the FIP, EPA Region 5 required thorough minor NSR source inventories for each tribe within the Region. Inter-Tribal Council of Michigan (ITCM) was tasked to develop an inventory of potential minor NSR sources in Indian country across EPA Region 5. Inventory development required gathering information on tribal and non-tribal facilities through online research such as www.manta.com and verifying these sources with tribal staff. ITCM mapped the minor source locations using Geographic Information Software (GIS) and reservation/trust land boundary shapefiles provided by EPA Region 5. In addition, ITCM used Tribal Emissions Inventory Systems Software (TEISS) to estimate emissions from a subset of the inventoried sources, including gasoline service stations, automobile body repair facilities, and dry cleaners. Findings Twenty-one potential minor NSR facilities were identified on the Fond du Lac Reservation. These potential sources include four governmental buildings, one medical clinic, and one school due to the potential emissions from heating with fossil fuels, emergency generators, underground or above-ground storage tanks, and other processes specific to each site. Three gasoline service stations, one airport, and one propane facility were included due to potential emissions from tank filling and fueling processes. The two refuse systems and a beef feedlot were included due to their potential emissions from on-site generators and/or evaporative emissions. One auto repair
