THIS IS A LEGAL DOCUMENT WHICH AIFECTS YOUR LEGAL RIGHTSIn consideration of being perrniued to participate in the ROUGH-N-TUFF ENDURANCE RACE(thc l&aSe') 9g$ r{ 5, ?Ql_{, I state qq4 agrqe as follows on behalf of myself and my personalrepresentatives, next ofkin, heirs, executors, administrators, agents, and assigns, or anyone elsewho might claim or sue on my behalfASSUMPTIONAND WARNING OF RISK1. I acknowledge that the event is a hazardous activity and is an extreme test of a person'sphysical and mental limits and carry with it the potential of death, serious injury and propertyloss;2. I understand that the Race presents extreme obstacles iasluding, but not limited to: rocks, mudpits, water, tire flip, tire run, log carry, wall climb, tunnel crawl, hay bale ciimb, mud run, icetubs, swimmisg, fire, gladiators, crawling under barbed wire, slip-n-slide, and steep hills.3. I acknowledge certain detrimental physiological changes may occur while i participate in theevent, including but not limited to, heat related illness; abnormal heart beat; abnormal bloodpresslre; and, in rare instances, heart attack;4. I acknowledge that there may be motor vehicle fraffic, spectators, volunteers and othercompetitors on the evetrt course;5. I further wanant and rq)resetrt that I am not now pregnant. I understand that I am prohibitedfrom participating in the Race if I am prepant.6. I agree that it is my responsibility to determine whether I am sufficiently fit, healthy, skilledand physically tained to safely participate in the Race. I hereby represent that I am in good healthand in proper physical condition to safely participate in the Race. I certiff that I have no lnownor knowable physical or mental conditions that would a{fect my ability to safely participate in theRace, or that would result in my participation creating a risk of danger to myself or to others. Ifurther certify that I have not been advised or cautioned otherwise by a medical practitioner. Iunderstand that I am strongly advised to consult a medical practitioner before participating,especially if I am disabled, or have recently suffered any illness, injury, or impairment. I attestthat I am covered by medical insurance, individually or as part of an organization.1 .l agree not to participate in the Race unless I am medically able. ,8. I agree not to consume alcohol or drugs prior to or during the Race or ingest auy medicines orsubstances that will hhibit my mental or physical ability to safely and effectively participate inthe Race. I assume full responsibility for any injury or loss to myself or to otlers and for anydamage to any personal or real properly associated with my use or consumption ofalcohol and/ordrugs at any point prior to or during the Race. I hereby indemnifi and agree to hold harmless theReleased Parties (as defined below) from any injury, loss, or damage described in this section.9. I agree to obey all civil and criminal laws at all times.10. I voluntarily, expressly, and knowingly assume all of the risks of participating in the Race. Iacknowledge and understand that these risks include, but are not limited to: falls; illness;infection; contact or collision with spectators, Race personnel, other participants, or pedestrians;negligent or wanton acts of other participants; contact or collision with motor vehicles ormachinery; contact and the effects of contact with man-made and natural fixed objects; tenain,road and surface hazards; any defects or conditions ofthe Race course; and the effects ofweather

including high heat and./or humidity. I understand that the risks of participating in the Race maybe caused in whole or in part by: my owrl actions or inactions; the actions or inactions ofspectators, pedestrians, or other participants; and/or the actions, inactions, or negligence oftheReleased Parties (as defined below). I expressly assume all risks and take full responsibility forany and all damages, liabilities, losses, or expenses that I incur as a result ofparticipating in theRace.1 1. I agree that the Released Parties (as defined below) are not responsible for any personal itemsor property that is damaged, lost, or stolen at the Race.12. In the event of my injury, accident, or i1lness, I consent to receive medical care and treatrnentas deemed advisable in the bestjudgment ofappropriate Race personnel and/or appropriatemedical professionals. Ifnecessary, I authorize appropriate Race Personnel to consent to suchmedical care and treatnent on mybehalf. This Waiver and Release of Claims extends to anyliabilily trising ouf of oi in any way connected with the medical teatment and transportationprovided in the event of an emergency. I agree to assume liability for any and all medical costsincurred as a result of my participation in the Race that are not covered by my insurance,including but not limited to costs of: medical care and freatment; hospital stays; ambulanceservices; physician services; and pharmaceuticals. I agree to indemnifr and hold harmless theReleased Parties (as defined below) from all liability for such costs.13. I agree to and will abide by the Race requirements that no pets, wheeled baby conveyances,or other wheeled means of conveyance are permitted within the Race obstacle course.14. I agree that all entry fee payments are final and non-refi.rndable.15. I agree that the Released Parties (as defined below) reserve the right to cancel the Race in theevent of (a) accidents, labor disputes, acts of war or terrorism, military or armed conflicts,insurrections, rebellions, riots, explosious, iightring, earthquakes, fires, storms and floods; &)safety or security concenrs of the Released Parties (as defined below); or (c) atry other rqasonpursuatrt to 48 hour notice. In the event of such cancellation, there will be no refund of myregistation fee.16. I understand, agree, and accept that some ofthe obstacles may go tbrough water that has notbeen tested for chemicals, disease, or any contamination whatsoever.17. I understand that the Race course may contain wild animals, insects, and plants, and I assumethe risk of participating in the Race by and among the course contents.18. I agree not to dive into or enter the mudpit head flirst.19. I agree to abide bythe rules of the Race and to comply with the directions and instructions ofthe Race personnel. I agree to become familiar with and abide by all wriuen and/or posted rulesof the Race. I further agree to comply with all directions, instructions and decisions of the Racepersonnel, including but not limited to instructions or directions relating to the manner of my safeparticipation in the course or related activities and decisions that I will stop participation in thecourse or related activities at any time. I also agree to exhibit appropriate behavior at ali times;demonstate respect for ali people, equipment and facilities; and participate with a cooperativeand positive auitude. The Released Parties (as defined below) may dismiss me, without refund,should my behavior endanger the safety of or negatively affeet the Race, a person, facility, orprope4y of any kind.INDEMNIFICATIONI hereby agree to indemniff, defend and hold harmless the Released Parties (as defined below)from any and all expenses incurred and claims made that relate to my breach of this Agreement. Ihereby agree to indemniry, defend and hold harmless the Released Parties (as defined below)from any and all expenses incurred and all claims made by myself or others (including but notlimited to court costs, attomeys'fees and litigation expenses) that arise out of or result directly orindirectly from my breach or failure to abide by any part of this Agreement, my failure to followany rules or directions as set forth above, and/or any ofmy actions or inactions which causeinjury or damage to any other person or property. I understand that this agreement to indemniff,

defend and hold harmless operates for myself as well as on behalf ofmy spouse, children,parents, guardians, heirs, next ofkin and any legal or persoual representatives, executors,administrators, successors and assigos, or anyone else who might claim or sue on my behalf. Iunderstand and agree that the statutes and laws of the State of Illinois will apply to all mattersrelating to this Agreement, including participation in tle Race, regardless of the actual locationof the Race or the principles of conllict of laws. I agree that exclusive jurisdiction for any disputewith the Released Parties (as defined below) resides in the courts of the State of Illinois audexpressly consent to the exercise ofpenonal jurisdiction in the State oflllinois in connectionwith any dispute. I understand and agree that this Agreement is intended to be as broad andinclusive as is permitted by the State of Illinois, and that if any provision shall be found to beunlawful, void, or for any reason unenforceable, then that provision shall be severed from thisAgreemeut and does not affect the validity and enforceability of any remaining provisions.DISCLAIMERI understand that my PARTICIPATION WILL BE DENIED unless I complete and sign thisAgreement prior to the start of the Race. I understand that the Released Parties (as definedbelow) are committed to conducting the Race in a safe mamer and hold the safety of participantsin high regard. I understand that the Released Parties (as defined below) continually strive toreduce such risks and insist that all participants follow safety rules and instructions that aredesigned to protect the participants' safety. I also understand, however, that participantsregistering for the Race must recognize that there is an inherent risk of injury when choosing toparticipate in recreational activities and programs. I am solely responsible for determining ifI amphysically fit and/or skilled for the Race or activities contemplated by this Agreement.WAIVER AND RELEASE OF CLAIMSI recognize and acknowledge that there are certain risks ofphysical injury to participants in theRace, and that any physical exercise or activity involves the risk ofserious bodily injury,including permanent disability, paralysis, and death. I understand that there may be other risksassociated with such activity, either not known to me or not readily foreseeable at this time. Iunderstand that these risks may be caused by my own actions or inactions, or the actions orinactions of others. I voluntarily agree to assume the fulI risk of any and all injury, damage orloss, regardiess ofseverity, that I may sustain as a result ofsaid participation in the Race. Inconsideration of being permitted to participate in the Racg I hereby waive, release and foreverdischarge the following parties (the "Released Parties") from any and all Claims (as definedbelow): ROUGH-N-TIIFT' ENDURANCE RACE, LOUIS\ILLE ROTARY INTERACTCLUB and LOIISVILLE ILLINOIS ROTARY CLIIB (and their directors, officers,employees, age[ts, contactors, insurers and volunteers); all the Race sponsors, organizers,promoters, directors, officials, prope4y owners, and advertisers; ail other persons or entitiesinvolved with the Race; all state, city, town, county, and other governmental bodies and/ormunicipal agencies whose properly and/or personnel are used and./or who in any way assist withthe Race; and any or all paren subsidiary or afEliate companies, licensees, officers, directors,parhers, board members, shareholders, supervisors, insurers, agents, and representatives of anyof the foregoing, (each considered one of the "RELEASED PARTIEF" herein). In considerationof being permitted to participate in the Race, I hereby waive, release and forever discharge theReleased Parties from all of the following (the "Claims"): any and all claims, Iiabilities of everykind, demands, demages (including direct, indirect, incidental,,special and/or consequential),losses (economic and non-economic), and causes of action, of hny kind or nature, which I have ormay have in the future (including court costs, attorneys' fees and litigation expenses), that mayarise out of, result from, or relate to my participation in the Race or my travel to or from theRace. I understand and acknowledge that these Ciaims include, but are not limited to, causes ofaction for deatl, personal injury, partial or pemranent disability, negligence, and property damageor theft; causes of action relating to the provision of first aid, medical care, medical treatmert, ormedical decisions (at the site of the Race or elsewhere); and claims for medical or hospitalexpenses. I understand and agree that the foregoing waiver, release and discharge apply even ifthe Claims are caused by the negligent acts, omissions, or carelessness ofany ofthe ReleasedParties. I understand that this waiver, release and discharge operates for myself as well as onbehalf of my spouse, children, parents, guardians, heirs, next of kin and any iegal or personalrepresentatives, executors, administrators, successors and assigns, or anyone else who might
