International Commercial Arbitration and African States Practice, Participation and Institutional Development International Commercial Arbitration and African States is a timely assess- ment of the arbitral process in the African context. The book focuses on the contribution that arbitration, and other methods of alternative dispute resolution, may make to the development of African states and peoples, while satisfying the legitimate expectations of inward investors and traders. Although focusing on dispute resolution regimes affecting or concerning African states and their nationals, the work will also have practical, policy and comparative implications for dispute resolution, commercial arbitration and foreign investment in other regions. International Commercial Arbitration and African States is a timely assess-

ment of the arbitral process in the African context. The book focuses on

Amazu A. Asouzu is Lecturer in Law at the School of Law, King’s

College London, University of London. He has served as an arbitrator

and is a consultant to governments, private parties and international

organisations. He studied in Nigeria and in the United Kingdom, and is

qualified as a legal practitioner in Nigeria.

cambridge studies in international and comparative law

This series (established in 1946 by Professors Gutteridge, Hersch Lauterpacht andMcNair) is a forum for studies of high quality in the fields of public and privateinternational law and comparative law. Although these are distinct legal sub-disci-plines, developments since 1946 confirm their interrelation. Comparative law isincreasingly used as a tool in the making of law at national, regional and interna-tional levels. Private international law is now often affected by international con-ventions, and the issues faced by classical conflicts rules are frequently dealt withby substantive harmonisation of law under international auspices. Mixed interna-tional arbitrations, especially those involving state economic activity, raise mixedquestions of public and private international law, while in many fields (such as theprotection of human rights and democratic standards, investment guarantees andinternational criminal law) international and national systems interact. Nationalconstitutional arrangements relating to ‘foreign affairs’, and to the implementationof international norms, are a focus of attention.

Professor Sir Robert Jennings edited the series from 1981. Following his retire-ment as General Editor, an editorial board has been created and CambridgeUniversity Press has recommitted itself to the series, affirming its broad scope.

The Board welcomes works of a theoretical or interdisciplinary character, andthose focusing on new approaches to international or comparative law or conflictsof law. Studies of particular institutions or problems are equally welcome, as aretranslations of the best work published in other languages.

Foreword

The internationalization of goods and services and, indeed, the phenom-enon of globalization have underscored the importance of internationalcommercial transactions as essential aspects of the dynamics of interna-tional commercial intercourse. Confronted by the reality of these devel-opments, African countries, like other developing countries, nowappreciate that these transactions are inescapable for the implementa-tion of their economic and social programmes. African governmentsand private parties involved in negotiating international business trans-actions such as loan agreements, petroleum and mining agreements,industrial joint ventures, management agreements, international pro-curement contracts, international supply contracts, bilateral or interna-tional trade agreements and bilateral investment agreements have cometo the realization that foreign parties to these transactions, i.e. foreigngovernments, transnational corporations, international banks, foreigninvestors, international suppliers and contractors, all insist on an appro-priate dispute settlement mechanism, which is invariably internationalarbitration.

Such parties predominantly prefer international arbitration because ofthe strong perception that an international forum for settling disputesprovides some insurance against possible bias by a national judiciary.Thus, African countries caught in the web of a plethora of internationaltransactions recognize the virtual inevitability of accepting internationalcommercial arbitration. Indeed, the acceptance of international arbitra-tion has become an invariable ingredient of the liberalization packageswhich African countries, and developing countries elsewhere, provide asa sine qua non of their strategies to attract foreign investment and tech-nology, international finance and foreign trade.

Notwithstanding this realism, the African experience of international

commercial arbitration is bedevilled by a woeful lack of expertise and eng-lightenment. African parties to international commercial transactionsoften find themselves hauled before international arbitral fora in distantcapitals that invoke and apply procedures, rules and laws and issuerulings of which they have little understanding. The results have been dis-astrous for some African parties.

Dr Amazu Asouzu, a distiguished scholar, is therefore to be warmly con-gratulated on producing a major work that addresses this critical concern.There is no doubt that the study will make a great contribution to thedemystification of international commercial arbitration in Africa.

The book begins with a general survey of dispute resolution mecha-nisms and then proceeds to deal in depth with international commercialarbitration – its institutional infrastructure, its development in Africaand the rules and procedures of the various arbitration institutions.

The author then embarks on an illuminating analysis of the experienceof African states in international arbitration and conciliation and endswith thoughtful and insightful prescriptions for the future of arbitrationon the continent.

Dr Asouzu has placed in his debt governments, business executives,lawyers and other parties in Africa who are involved in internationaltransactions.
