The operation of uninsured vehicles hasbecome an increasing and clearlyrecognizable problem on public roadways. Itis the policy of the Irving Police Departmentto conduct traffic enforcement that willprovide the maximum protection to allindividuals who use the roadways. As partof this strategy, the department’s goal is toensure that all vehicles are operated with theinsurance coverage required by law.

When officers encounter individualswho fail to maintain the required coverage, enforcement action will be taken. Respondingto this problem, which continues to plaguelaw enforcement and responsible driversacross the state, a policy has been authorizedallowing a stronger approach to gaincompliance to the law.

The Irving RamblerRe: Letters to the Editor

P.O. Box 177731Irving, Texas 75017

Letters to the EditorDear Editor,

The City of Irving is facing a number ofdifficult challenges. The declining tax base, the urgency for revitalizing ourneighborhoods to protect our investmentsin our homes and a sense of not being heard;all impact the future of our city. We will befacing decisions resulting from the Cowboys’move to Arlington that will chart a course forthe next 30 years. Never in our history hasthe need for strong, experienced leadershipbeen so apparent.

It is my belief that Lowell Cannaday isthe kind of man that can help build the

position, I feel it most important to take thetime to write down my thoughts on themayoral race in our great city.

Let me begin by saying that our city isin a time of great change. If you look around, you will see the face of Irving is changing ona daily basis. New people, new business andnew challenges. With change comes thenecessity for good, strong, competentleadership that will focus and channel thischange for the greater good of our faircity. Marvin Randle is a solid, intelligent,faith-based man whose contributions to thecity of Irving have been a standard for manyyears. He always has and always will lookout for the best interest of the citizens of thiscity. Bottom line, Marvin Randle is the leaderthat is necessary for this time. In closing I ask just one thing, do a bigfavor for the future of our city. Take the timeto learn more about Marvin Randle. I believethat you will find, like I already know, that heis about the future of Irving. Then I trulybelieve that you, the citizens of the city ofIrving, will elect Marvin Randle to this criticalpost. Thank you and may you all be blessed.

Dear Editor:I know that many of you did not

have your “1st” choice make it to the Mayoralrun-off for the June 11th election. However, with that said, I believe we now need to grouptogether and vote for the man who will bestrun our city. I believe that man to be HerbertGears.

Herb has done many good things forthis City. I know I cheered when he did awaywith the gas chamber for unwanted dogs andcats. We should be getting a Parkland Clinicin the future thanks to hard work from Herb.Herb wants better pay for our police officersand fire fighters. Something these goodpeople need and deserve! Herb has receivedthe Elected Leader of the Year award fromKeep Irving Beautiful for his work inenvironmental issues. Herb was a hugesupporter of the VOTE NO side (and still is)concerning the alcohol issue. He gave histime and money to support this effort. Iconsider Herb the most qualified to run ourCity and the person to make the best choicesconcerning City issues. I urge ALL of you toget out and vote and to elect Herbert Gearsas our next Mayor of Irving, Texas....

Karen Harmon

WHAT HERB GEARS DIDN’T TELL ME... When I received a campaign brochure afew weeks ago from Herb Gears, I wassurprised to read that he had been endorsedfor mayor by The Dallas Morning News,Irving edition editorial. A quote from theeditorial was printed in his brochure. THEN I noticed the DATE under theendorsement. It was April 24, 2004. It wasNOT a mayoral endorsement at all, but ratherthe endorsement in his race against Beth VanDyne for Irving City Council. Herb Gears lostthat race.

Comments from a 13 year old

partnerships to oversee thecreation of a new vision forIrving. We can no longer affordto “wait and see” whathappens. Lowell has anextensive financial andadministrative backgroundmanaging multi-million dollarbudgets in both the private andpublic sector. He can beginimmediately, using his talentsin defining issues and craftingsolutions that will beinvaluable in charting our newcourse for the future.

Lowell has served us wellfor the past 10 years. We woulddo well to take advantage ofhis expertise and successfulrecord by electing LowellCannaday to the Irving CityCouncil in Place 5.

Joe Goddard

Letter to the editor:

In the near future our citywill be going through a criticalelection for City Council and

Mayor. As a long time resident of Irving, mywife and I have seen many changes in ourcity. We feel it is time to elect a strong leaderto guide and direct our cities future. We willbe supporting David Cole for City CouncilPlace 5.

David has been raised in this city, andcurrently is a business owner here. He hasshown integrity and dedication in his pastcivic responsibilities, but most importantly, are his concerns for family, friends and thecitizens of Irving. David will work to unifythe city and will focus on the immediatechallenges that we face today. His experiencewill help him in supporting the citieseconomic development, while maintainingneighborhood integrity. He will bring a fresh, new attitude to city hall.

My family and I look forward to our citymoving in a positive direction and by electingDavid Cole he will get Irving back on track.

Sincerely,Darin and Erika Furbush

Dear Editor:

When I started searching for the bestmayoral candidate, I first began reading flyersthat came through the mail. I then went tothe Internet to check and verify some of theinformation. That search convinced me thatHerbert Gears would be the best choice.

Not knowing Herbert personally, Idecided to become involved in his campaign. In the following weeks of labeling flyers anddelivering yard signs I was able to talkextensively with Herb. What impressed memost was that he did not go out of his way totell me what I wanted to hear. He focused onmy ideas and what would be best for Irving. As a high school teacher for the past 34 yearsI can relate to the importance of doing whatis best for the majority of people. A goodmayor must listen to people from all parts ofthe city and bring them together with acommon goal of “we” not “me”. To do thattakes a person who has INTEGRITY, ishonest and is willing to hear all input beforemaking a decision. I believe that HerbertGears is that kind of person.

Randle a “spoiled child”?To the editor:

What happened to this newspaper’s coverage of the run-off for mayor election? There was just a small mentionin the April 26 paper concerning the election results. Thiswas probably as newsworthy as anything else in Irving. Our mayor, Marvin Randle, had quite a few things tosay to the majority of voters who elected a new mayor.

The Dallas Morning News covered it. I was personallyamused by Randle’s temper tantrum but was also em-barrassed for the city that we would have had such anelected official representing this city. His statements soundas if they came from a spoiled child who was very usedto getting his way and finally did not.

According to the Dallas Morning News, Randle said, “Itwas all the negative elements in Irving that got togetherto defeat me.” He also said, “Bobby Raper got all thelow-class firemen - not all the firemen - but the oneswho want to featherbed it, the ones who don’t want towork. He got some of the Christian church vote becausehe told lies and innuendos.”

The Morning News stated that Randle would not nameany specific Raper statement as lies.

In my opinion, he would not name any because therewere none. Randle’s last minute dirty tricks did not workfor him. the people had had enough and voted him out.Thank goodness!

Sign this one of the negative elements of Irving as wellas a low-class firemen’s daughter.

RUN-OFF ELECTION JUNE 11TH

EARLY VOTING BEGINS MAY 25TH

Pol. Adv. Paid for by the David Cole for City Council Campaign TroyKelley, Treasurer, 105 E. Rochelle Road, Irving, TX 75062

Dear Irving Residents,I am your candidate for City Council, Place 5. I work hard, am dependable

and have a great heart and concern for people; however, I am not a politician! I ama lifelong resident and 18-year business owner/leader who is not influenced by specialinterest groups. I am deeply concerned about the direction Irving is headed andhave no hidden agendas. You can trust that I will do what I truly believe is best forIrving. I will represent the citizens.

I will be a new voice at City Hall. Very important to the citizens of Irving, Iam not an “insider” at City Hall. I have not worked in city government which makesme independent from, untainted by, and respectively and inquiringly skeptical of,city management. Because I am not a retired city employee, have not worked in thetrenches of City Hall, made agreements with management, tweaked press and newsreleases, been in their meetings, or argued for one department over another, I cantruly say – I AM AND WILL BE THE CITIZEN’S REPRESENTATIVE – ANINDEPENDENT DECISION MAKER!

I am humbled by the confidence and trust Irving residents have shown in meand my ability to be an effective leader for the citizens of Irving. I would appreciateyour consideration and support. For questions, campaign literature, yard signs, and volunteer information, I encourage you to contact me at (972) 252-8511or online at www.votedavidcole.com.

Voting early is critical! Please plan to vote before school ends and summer vacation begins. Thank You!

Herb Gears deceived me and anyone elsereading that campaign brochure by placingthis year-old endorsement under his “HerbertGears for Mayor” banner, indicating theDallas Morning News had endorsed him formayor. They had NOT! What otherinformation in his campaign materials orpublic statements are deceptive? If we cannotexpect integrity in our mayor, what kind ofleadership and government will Irving have?

Letters to the EditorI have known Marvin Randle for over 30

years and have worked with him as a citycouncilman, mayor, and president of theIrving Chamber of Commerce. He is anindividual I trust. He is a man of integrity. IURGE you to support Marvin Randle formayor and JOIN ME in voting for him in therun-off election.

Mike CarterWith her sly and sometimes earthy sense

of humor, Anita Poynor can be fall out of yourchair funny, but she was all seriousness whenshe contacted me and told me about thefollowing scam that stung her and herhusband for a hundred-and-twenty bucks.

A couple of weeks ago a telemarketerfrom Buyers Union representing himself as aWal-Mart employee called the Poynorhome to offer gift certificates good at Wal-Mart as well as local restaurants and otherIrving businesses. The telemarketer wasconvincing, even gave them his employeenumber. The usual rules applied.

The man told them, “We will send you apromotional package and if you don’t likethe service you can cancel anytime within 30days and keep the gift certificates we sendyou for free. You will only have to pay $3.95for shipping and handling of the initialpackage. We will not charge your account forthe service for 30 days.”

The certificates, the telemarketer assuredAnita’s husband, who actually took the call, were genuine gift certificates and not coupons

for merchandise. Anita’s husband thought itwould be a worthwhile and agreed to receivethe promotional package.

A week later the Poyners discoveredtheir checking account had been charged$119.90 for the package as well as has havingbeen charged $3.95. They called the 800number Buyers Union provides for questionsand discovered that the promotionwas not being conducted by Buyers Union.Rather Buyers Union had hired a companyto conduct the promotion for them.

When Anita called that company, theyexpressed surprise that she thought thispromotion was a scam. It also refused torefund the money, so the Poynors are out$123.85 for a package they were told wouldonly cost them $3.95 and have had to closetheir checking account to ensure no othercharges go through.

As marketing has become increasinglymulti-leveled, the opportunities for rip-offartists have multiplied. Remember whensomeone calls you offering something forfree, that nothing is free. Somebody alwayspays, and it might be you.

Irving Girls Softball Association (IGSA)hosted a national American SoftballAssociation tournament over the MemorialDay holiday. Girls 14-years-old and underfrom 32 different teams arrived on Irving ballfields ready to play.

Despite the bad weather, it was KathyWilkins’ job to ensure the tournament ransmoothly. Ms. Wilkins is the assistanttournament director and head scorekeeperfor IGSA.

“Saturday morning we had games goingon at both Trinity View and Southwest Park.As the rain threatened lightning struck atransformer near Trinity View leaving two of

the playing fields without power. So we hadto do things the old fashioned way. Then therain started and we had to delay thetournament,” Ms. Wilkins said.

“We took all the teams playing at TrinityView and brought them to play at SouthwestPark. Saturday we had two games played andthat was it. I was at the field at 5:30 a.m.Sunday morning to make a decision aboutwhether the games would be played or not.”

“We had to play. It was one of thosetournaments where we couldn’t cancel. If theteams win here, they go on to the Hall ofFame Qualifier in Oklahoma. It is a big deal.Sunday morning at 7:30 the fields were ready.

We told the teams to be there at 10 o’clock tostart play. We changed the time limit from 75minutes to 60 minutes. Some how, some waywe got all of the teams played. Our last gameSunday was played at 2:30 in the morning, and we started again at nine on Mondaymorning. We didn’t get to finish thetournament Monday because of rain. However, we did determine which two teamswill advance to Oklahoma,” Ms. Wilkins said.

“I have been doing this for 12 years, andI have never seen as many people at the

Southwest Park ball field as we had MemorialDay weekend. You could not even go thebathroom. There were just tons of peopleespecially during the game changes. It wasawesome to see that many people here; itwas just great.”

“Overall the tournament went wellexcept the rain delayed everything. All theteams were happy. The girls just want to playball, they don’t care if it is raining,” Ms.Wilkins said.

car in a tournament before he was old enoughto drive.

Steve Murray, Foosball Hall of FameMember and tournament director, estimatedthat in addition to the 260 competitorsparticipating, approximately 150 familymembers, friends and foosball enthusiastattended this year’s tournament.

“This is the largest, most prestigiousstate championship of all the statetournaments. Even though this is a smallertournament, as far as the tour events, theyhave dubbed this the fourth major. We havethree major events during the course of theyear: the International Championships, theNationals and the World Championships. However, Texas State has become so popularit has been labeled the fourth major,” Mr.Murray said.

“We have players from at least 18different states. We have some international

players, some Canadians and some guys fromEngland. We probably have more out-of-towners than we have local players.”

“People at the tournament can listen toa play-by-play, live-action broadcast on anFM station. We also have the internet radiogoing for people who are not at thetournament. The stats, as the tournamentprogresses, are posted on the internet. So,people who are not here who wanted to behere can keep up with what is going on,” hesaid.

The level of competition is good andeverybody is having a great time,” Mr.Murray said.

Stacey Myers, remote sales coordinatorand webmaster for foosball.com, said thatfoosball is a great sport for everyone, especially youngsters.

“The best thing about foosball is anyonecan play. Many sports like golf, you reallyhave to be strong and you have to be abledeliver the club with strength. In foosball wehave guys that are 6 ft. 5 in. and 4 ft. 8 in.even women are competitive. There are plentyof women who whoop-up on men. It is sucha unilateral sport. A person can becomerelatively good very, very rapidly. You cango from zero to decent in a short period oftime assuming you follow techniques,” Mr.Myers said.

“It is like many other sports because ithas a good camaraderie; everybody likeseach other. Foosball has something that manyother sports don’t have, foosball has eyecontact. You play across a table and youlooking right at the other person so there isconversation during the game. When

competitors are playing a tournament for bigmoney, there is not much conversation. When people are playing at a recreationcenter or billiards hall, they can make fun ofeach other, laugh at each other’s silliness, there is so much more conversation than exitsin other sports. In pool, there is one personat the table playing and everyone elsewatches. In ping-pong, players are busyjumping around. In foosball, players arestanding right there and they can laugh andgoof-off. The game is quick, it’s not slow.Four people can play at once, it is not a myturn – your turn type of sport.”

“Churches and recreation centers are abig deal to foosball.com. We go out of ourway to help them provide foosball for theyouth. Ten years ago, foosball was in lots ofbowling allies, recreation centers andarcades. Now unfortunately because of thedesire to have rip-the-guy’s-head-off videogames, foosball has been pushed out. Videogames are fine, but they do nothing for thehuman. Whereas foosball allows humaninteraction dealing with victory and defeat,it teaches kids how to be descent peopleinvolved in competition and not to becomejerks. The hand-eye coordination, motor skillsand physical aspects of foosball are reallygood for the body,” Mr. Myers said.

“The younger, newer players are able toget so much out of coming to a tournamentlike this and playing with the older guys.More experienced players will take anyamount of time to help young playersimprove their game.”

“The tournament itself, the Texas StateChampionship, is one of the oldest statetournaments. Texas foosball spread like avirus across the state back in the 70s and80s. When Texas-style foosball really becamestrong, it took over the rest of the country.Texas-style foosball is the quickest foosballin the world,” Mr. Myers said.

“American foosball is very strong, hardand fast. European foosball is much morecontrolled, catching the ball and moving itaround. American foosball is pow, crushingshots, dominant passing and super-strong.Everyone here exemplifies the American-style. The players here demonstrate power;finesse is not what we go for. Everyone drivesthe ball home. Most beginners who come toa tournament like this can’t even see theshots, because they are blindingly fast.”

“All of the top dogs in America comehere. This is a regional tournament that hasescalated up to a major tournament by itself. The Texas State Championship has walkedup to the top of the list and really should beconsidered a major because of the turnout.Everybody who is anybody in foosballcomes to this tournament. The competitionlevel and the number of entries is equivalentto any tournament in the nationalchampionships. The only tournaments thatrival the Texas State Championship are theworld championships and the internationalchampionships,” Mr. Myers said.

Gregg “Jeep” Perrie, Foosball Hall ofFame Member and Pro Master competitor, has been playing foosball for 31 years andsaid that he hopes to be able continue toplay well into his 100’s.

“It’s always nice to come play foosballand see your friends. Foosball is a hobby.Four or five times a year, I get to travel aroundthe country and the world to play foosball. Itbecomes part of your life. The people becomevery close friends. When you’re good atsomething and you’re competitive, then youwant to do that. You want test your skillsagainst other players and see how you fare.I’ve played in tournaments in Switzerland,France, Germany, England and Canada. Iplayed for a beer on a little island that is partof Thailand called Cosa Mui and lost the firstone; but I won a couple back,” Mr. Perriesaid.

hosted its annual Butterfly Celebration andeducational fair.

Over the past several months, BereanChristian Academy first graders have hand-raised butterflies in the classroom andstudied the habits, behaviors and lifecycleof butterflies, lady-bugs and other insects. The young students and older studentvolunteers learned about gardening andcaring for plants that attract butterflies in a“butterfly habitat” located on the school’sgrounds which is certified by the TexasDiscovery Garden in Fair Park.

As the majority of butterflies reachedmaturity and became ready for release, thestudents prepared exhibits and activities toteach others in the community the knowledgethey have learned. Students took visitors ontours of the school’s garden areas and of ascreened tenet filled with live butterflies.Visitors touring the tent were invited to coaxthe butterflies onto their fingers and handswith sugar water. Students answeredquestions and encouraged their visitors toplay games, make crafts, dress in butterfly

costumes and view a short movie aboutbutterflies. The celebration included mountedbutterfly displays by local expert Paris Milanand an expanded exotic insect display byErnest Ryan. After learning about insects, visitors could sample complementary cookiesand lemonade or purchase butterfly relateditems including Dallas author, JudyHominick’s book, How to Grow Your QwnButterflies for Young Butterfly Lovers in theSouth.

First grade teacher, Ruth Gitchel, hasbeen studying butterflies and passing on herknowledge to youngsters for several years.

“We have been raising butterflies forabout 18 years now, and we have held acommunity fair for about five years,” Ms.Gitchel said. “We invited people from thesenior citizens’ group to attend, and I’ve doneprograms for 12 Oaks and a home schoolgroup. This is an educational fair. Our whole

purpose is to teach our children themetamorphosis of the butterfly; the entirelife-cycle. We consider it important in ourteachings from a Christian view-point. Thefair is a very important part of teaching that.”

“We have a lot of activities to show thechildren the stages of butterfly development. We have live lady-bugs, and live butterfliessome wild caught and some hand-raised. Allof the first grade children got to raisebutterflies in the classroom. This is a school-wide project. We have volunteer studentswho work after school in the garden. Weteach students gardening skills, how to growplants and keep out weeds withoutpesticides. This program also teachesstudents how to interact with other studentsin the public. Student volunteers teach otherkids from the neighborhood the things thatthey have learned by helping those who cometo the fair,” Ms. Gitchel said.

While volunteering as a butterfly tentguide, fifth grader Rebecca Hollanddemonstrates how to use butterflies as hairaccessories.

“I’ve lived in Dallas for three years andjust recently, in February, I found out that wehad a VA Medical Center. I want to showpeople that giving time to the VA is just ascool as attending a Toy Run at Christmastime. I talked with a few VA residents, and

they had heard earlier in the week that radiostation representatives were going to be atthe VA Medical Center, and they didn’tbelieve it would happen. The residentsthought no one would come to the hospitalfor something like that. We had 35 bikes showup this first time, and I’m counting ondoubling that next year, and the year afterthat, and the year after that, and on andon. Five of my Brothers from the MilitaryVeterans MC rode down for this; one Brothercame all the way down from Illinois. This runis about bikers coming together to show theirappreciation for those who have served, whether you’re a veteran or a supporter, justbeing there is enough,” Mr. McReynoldssaid.

Steve Mills, a MVMC member, rode his2005 Harley from Bloomington, IL toparticipate in the Memorial Day bike run.

“I rode down to support one of ourmembers who put on the VA run. I feel thepeople forget about the veterans, and mostof the VA hospitals in the country havelimited funds. So any time that I can, I like tohelp out as much as I can, being that I am amilitary veteran myself. I served in the U.S.Army from ‘84 to ‘87, so I feel very strongabout military veterans. When we go to VAhospital, the veterans are so happy to seeus. The veterans like seeing the bikes andtalking about the bikes. We had a little bikeshow at the hospital and the veterans got tovote for the bikes they liked best. At the endof the day they said ‘thanks for coming’, butI told them ‘thanks for serving and thanksfor helping to keep our great country free’,”Mr. Mills said.

Mr. McReynolds said. “There are veteransin our own backyard that need our support. Iwanted to show VA residents that they arenot forgotten, and people want to show theirsupport and appreciation for what veteranshave done.”

Happi Tymes, Mid-Cities, and Cow TownClown Allies held their second annual jointmeeting at the South MacArthur Church ofChrist. Almost 100 entertainers fromArlington, Mid-Cities and Fort Worthattended the meeting. Each year the meeting

rotates from one alley to another, so eachgroup has opportunities to be host.

Magician comedian, Bo Gerard, entertained the group. He also spoke abouthow he develops a show and otherperformers who have inspired him.

Area clowns attend annual meetingEarl Warren, vice president of the Happi

Tymes Alley, said that clown meetings bringentertainers together socially.

“We don’t want any splits between thealleys. Clowns are pretty muchhomogeneous; we share. We felt like we couldget together and bring people in to lecturelike Bo Gerard tonight as a group with foodand entertainment. We had Chuck Lehrlecture last year, a very good children’sentertainer. Magicians, face painters andother types of entertainers have notnecessarily associated closely with clownallies. We want to foster good relations

between everyone in this type of business,”Mr. Warren said.

Hal Hudgins, president of the HappiTymes Alley, is a caricature artist andmagician.

“This meeting is a great chance formagicians, clowns and face painters to getto know each other better rather than simplygoing separate ways. We are all in thebusiness of entertaining primarily children. We have some clowns who actually make aliving entertaining. Some other clownsentertain simply because it is something theylove to do. Often clowns visit hospitals andnursing homes and give of themselves asclowns,” he said.

Edward Fitzgerald, also known as Bucklethe Clown, explained why clown clubs arecalled allies.

“The clowns never had a very highranking in the circus. All of the head-linersgot their own dressing rooms, and when thecircus traveled with the big-top, the dressingrooms were tents. The clowns did not rankhigh enough to have a tent, so they had toget ready in the alley between the tents. Theycalled the area for the clowns the ‘clownalley’. We kept the name, hence, any clowngroup is known as an alley,” Mr. Fitzgeraldsaid.

Adam Sandler as a golfer? Okay.Wedding Singer? Sure. Ex Pro Football playerin prison garb? Fine, if it’s funny.

The Longest Yard is a remake of the 1974prison movie where the cons put together arag tag team in order to take on the guards.Paul Crewe (Adam Sandler) is a famousquarterback whose life takes a plummet, andhe ends up in prison for a drunk driving binge. When the warden (James Cromwell) has Paulput together a scrimmage team to help hisguards get ready for the season, the inmatesdecide to use this as a chance to inflict someretaliatory abuse on the sadistic jailers.

If this movie does anything, it provesthat you can have some very funny momentswith no script, terrible acting and sophomoriclocker room humor. Chris Rock (Caretaker)does for The Longest Yard what WandaSykes did for Monster-in-Law a few weeksback. He adds the one-liners that are the vitallink in this chain-gang chuckler. Anotherelement that keeps this film from totallytanking is its array of oddball inmates.Director Peter Segal does a decent job of

helping the characters feed off of each otherfor a handful of laughs.

Burt Reynolds also stars as Coach NateScarborough, a former Heisman Trophywinner doing a long stretch for some crimeor another. Reynolds starred in the originalfilm playing the same lead role as Sandlerplays in this version. Football fans will beexcited to see former Cowboy Michael Irvinback in action even if it isn’t a real jersey. While rap icon Nelly turns in a surprisinglywell acted performance showing he might justhave some big screen skills.

Though this movie has quite a few funnymoments it is still a renter at best or morefitting for a couple of buddies wanting tobeat the heat and catch an afternoon flickafter dropping the wife and kids off forMadagascar. If you frequent the movies oftenyou may be okay with this movie, but if thisis your one chance to get out of the housefor a while, there are better things to see.

The Longest Yard is rated PG-13 forcrude and sexual humor, violence, languageand drug references. The language is fairlystrong and you might not want your 10 yearold repeating most of what is heard in this 90minute plus run.

I give it 3 and a half out of 5 missedtackles. With a Spin on The Longest Yard,I’m Matt Mungle.

When your Realtor writes your contract,it’s imperative that he or she pay attention todetail. A lot can happen between the buyerand seller of if a box is checked or leftunchecked or something required of thecontract is no completed.

The title items in a contract may costyou a lot of money or sabotage your contractaltogether if not handled properly. Especiallyif the situation is competitive, the listingagent is looking for reasons to rejectcontracts and as much as reasons to keepone that’s going to be a win-win scenario forthe seller. These little items may make thedifference in accepting or rejecting your offer.Even if you’re proposing more money theterms may stop your offer dead in its tracks.

Below are some “small” items that cancause a lot of headaches or kill your contractif not handled well.

Checking the appropriate boxes

Within the body of the Texas Real Estatepromulgated contract form are several“boxes” that need to be checked, basicallythe “who will pay for what” and the “whathappens when” of the offer, for instance, whois responsible for paying for the Title Policy,Survey, Residential Service Contract, BuyerAdditional Closing Costs, and more.

Many deadlines are also built into thecontract form such as the expected closingdates by which the buyer should receiveproperty, disclosures, and length of optionperiod, just to name a few. In a competitivemarket, correctly navigating these terms canmake the difference in your offer beingaccepted, or another buyer getting the nodfrom the seller.

Amendments, addenda

Home Owner Association Amendment,Third Party Financing Addendum, Buyer orSeller Temporary Lease are just a few of theamendments that you might be including inan offer, Neglecting to pay attention to these“extras” could come back later to haunt you.

Tammy Davis has been a licensedRealtor since 1994 and is an agent withColdwell-Banker Residential Brokerage inIrving.

Tammy DavisIn contracts, it’s all about the bottom

line, right?? Yes…and no.The terms, how much the seller will net,

the closing costs for the buyer, and who’s

paying for what can mean a difference ofthousands of dollars. A lot happens from theacceptance and execution of a contract towhen the closing takes place and it’simportant that the little things have beentaken care of.

Home owner associations transfer fees andspecial assessments can cause a surprise atthe closing, dates for approving financingcan make a difference n your ability to meetyour contractual obligations and terms oftemporary lease, or the absence of one cannegatively affect you, even leave to brieflyoccupy the property without insurance.

Disclosures

Buyers and sellers will be asked to signseveral forms that have nothing to do withthe transaction as far as the commitment isconcerned, it’s just a form designating thatyou’ve been told something for example—property condition disclosure, RESPAdisclosure, agency disclosure, federal leadbased grant disclosure, disclosure ofbrokerage relationship. For the protection ofall parties, being informed of the purpose ofeach of these disclosures is essential.

Having a professional will be helpful toinsure the appropriate boxes have beenselected, correct disclosures correlated, andnecessary addenda included can make adifference to the real bottom line.

Most importantly, don’t wait until theday before you actually write a contract tosit and read it over first so you get to knowthe document ahead of time. The averagehome search is 45-60 days; review thecontract form with your professional any timeduring the home search process preferablysooner, rather than later.

There’s no good reason for not knowingwhat it says and what it may require of youbefore you actually have to submit it for yournext home. Discuss with your realtor theapproach you want to take so that when youfind the right home, you are prepared to writethe contract to make it yours.

Toyota of Irving Used Cars,1700 W. Airport Frwy,

Irving, TX 75062

By Brynne SissomIn every city, there are a few businesses

that grow with the city and become anchors. In this city, Toyota of Irving is one of them.Irving was still a bedroom community whenVernon Schoemaker moved his family fromAmarillo to Irving so he could run the newToyota dealership in1968. Toyota wasexpanding, and after 19 successful years inthe car sales business with his uncle,Shoemaker decided to move to the Metroplex.

Vernon Schoemaker’s son, David, 52, isgeneral manager of the dealership.

“Dad was originally from Minnesota. Itwas the mid-50’s; Dad was just released fromthe Navy after service in Korea. He visitedhis uncle in Amarillo with the intention ofbuying a car. His uncle offered him a car anda job. Dad admired his uncle’s success andaccepted the job,” David Schoemaker said.

“When Toyota asked us to take a look,we came to the Dallas area to look at fourdifferent locations, Irving, Arlington, OakCliff, and Fort Worth. My dad’s uncle wasn’tsure that the market was big enough and wasgoing to turn the offer down, but my dadtold his uncle that if he didn’t want it, he didwant it. We moved to Irving soon after,” Mr.Schoemaker said.

Toyota began building cars in 1937 andtheir first marketing venture in America wasin 1962-63. It failed, but the company triedagain in 1965 and succeeded by implementinga national network of dealerships. Toyota

Schoemaker’s Toyota Dealership has grown with Irvingsold nearly 10,000 cars in 1966, and sawsteady progress after that. The company sold135,000 cars in 1969 and averaged 10-12,000per month in 1970. This success meant thatToyota had a fleet of six ships carrying 1,300autos apiece on a continuous schedule tothe United States.

What is the name of the dealership? The family’s dealership was first located onIrving Boulevard at the intersection ofRoger’s Street. Starting with four staffers, thebusiness grew to fill nine buildings. In 1979,Toyota relocated to its current location at1999 West Airport Freeway with a staffcomplement of 195.

Vernon Schoemaker and his son, David, now run the dealership together. David’s sonJereme, 28, started working at “the shop”when he was 13, picking up trash and sodacans. Jereme graduated from Macarthur HighSchool in 1994 and now sells cars in the usedcar division.

“I think it is used cars that make mygranddad tick. He’s over here at least twice aday. You are expected to do more when it’s afamily business. You take it more seriouslyand personally when it is a family endeavor,”Jereme Shoemaker said.

His father, David Shoemaker, graduatedin MacArthur’s second class of seniors, in1968.

“I believe that we have succeededbecause we still offer an economical product. Our cars can still run way over 100,000 miles

with no major repairs. Road Test Magazineawarded the Corona the Import Car of theYear in 1969, and in 1970, the Mark II won it.Our cars are still winners,” he said. Who isspeaking?

David Schoemaker explained that thefamily’s business has changed withtechnology.

“With the Internet and technology theway it is, you have to stay on top of things. It isn’t brick and mortar the way it used to be.There are more dealers too, so competition iskeen,” David Schoemaker said.

Toyota of Irving continues to flourishin the middle of the city, a sign of a family’spride and joy.

A FUNERAL’S PURPOSE

The primary purpose of a funeral is to help mourners confirm the reality and finality ofdeath. It does so in a climate of grief that allows the sorrows of one to become the sorrowsof all. As such, a funeral is an occasion in which love is given, without any expectation ofanything in return. It is an occasion of generosity, in which the community can pay itsrespects, and that allows people to remember and honor their loved one in a special way. Asa central gathering place, the funeral encourages mourners to face the pain of their loss andexpress their thoughts and feelings. Amidst this supportive atmosphere, mourners can beginthe grief process and move forward.

It is important to recognize that funerals are for the living - for those who will suffer thetrauma of losing a loved one. The funeral declares that a death has occurred and commemo-rates the life that has been lived. At DONNELLY’S COLONIAL FUNERAL HOME, webelieve that it is through the funeral process that a number of emotional needs are met forboth children and adults. The gathering of family and friends for the visitation and funeralservice helps provide emotional support to survivors and helps them face the reality ofdeath. Pol. adv. paid by Marvin Randle for Mayor, 500 Farine Drive, Irving 75062.

Brynne SissomIrving has considerable promise if city officials and

investors cooperate to take advantage of opportunities todayto revitalize neighborhoods and business areas. In manycases, South Irving is a well-kept secret. A report called ABlueprint for the Future of Irving from a group of residentsoffers recommendations for revitalization that couldstrengthen and provide direction for the south side of thecity.

In response to a request from Mayor Putnam, the IrvingSouth Economic Resources Values and Economics or ISERVEcommittee was formed to study quality of life issues in Irving, particularly South Irving. The report covers Irving from southof Highway 183 including the areas west of Beltline Road. The Blueprint was a completely resident-driven endeavorwith the costs of the research and report borne by thecommittee members.

John Danish, Planning and Zoning Committee Chair, waschair of the Blueprint committee.

“We feel the report is truly an honest portrayal of whereSouth Irving is in 2005,” Mr. Danish said. “Any attempt todevelop or redevelop South Irving must take in thecomplexities of the area and be comprehensive enough tosucceed. An ill-considered program could do more harm thangood.”

Throughout the city, quality of life issues are hot topics. However, there are perceptions and then there are realities, which do not always match. Blueprint considers severalidentified perceptions and through expert testimony, interviews, and research from official state and local real estaterecords, the police department, city housing department,Census data, Keep Irving Beautiful, human services, etc.,the reality became clear.

According to the report, “Irving has the potential to bea gateway to the suburbs if the right mix of revitalization andredevelopment takes place, but the City needs to capitalizeon its strengths through aggressive revitalization of bothbusiness and residential areas.”

The committee reports that quality of life is not dropping, but city officials need to make changes in certain areas andtake advantage of opportunities presenting themselves. Inorder to plan for the future, a city needs to identify anddevelop its potential. People living in South Irving know thearea is showing its age and is ripe for redevelopment. Onerecommendation from the report encouraged mixed–usedzoning so, for example, artists could create, sell their creationsor give classes and live in the same building. Businessesbased on this model could add charm to a shady avenue ofrestaurants and boutiques. Irving has two South Irving transitcenters, and eventually will include a rail line connecting tothe northern part of the city. The presence of expanded transitsystem creates opportunities for extensive development.

“There is more vitality in the area of Nursery and IrvingBoulevard than there is in Plymouth Park,” Mr. Danish said.“In the Nursery area, we have set standards for signage, pututilities underground, and the owners of much of the areainvested in revitalization of the buildings. We need to pullthat revitalization into Plymouth Park now. The IrvingBoulevard corridor has so much to offer in terms locationand vitality.”

One perception of South Irving is that its property valueis declining. However, the committee came to the conclusion

‘Blueprint’ offers researched perspectives for South Irvingthat they are not. In fact, South Irving commercial propertiesare less vacant than in the rest of the City, and valuations aremore stable than in Las Colinas. Commercial properties inthe southern sector seem to offer the right rent forentrepreneurs launching new businesses and more areminority-owned. Private investment is making a differencewith renovations in some locations. Further, rapidimprovements would require public-private partnerships ormore private investment. Finally, in the vicinity of the DARTstation, the City must consider community development andtake advantage of this hub where people and transit meet.

Residential properties reflect their owner’s care and insome cases renovation is a must. From drive-by observationit appears that many owners are actively improving them. From the report:

More than 80% of residential property in South Irvinghas risen in value each year for the past five years.

More than 2800 new single-family homes have been builtin Irving in the past 5 years, a substantial portion in SouthIrving.

More than 500 new single-family homes in prices rangingfrom $150,000-$220,000 are planned for South Irving.

The City’s federal grants program is providing significantnew moderately-priced housing in South Irving throughpartnerships and subsidies with private developers.

More than 49% of Irving homes are 30 or more yearsold; 6% are over 50 years old.

Blueprint also considered cultural blending andsuggests that city leadership needs to reflect the diverseethnic population. The report outlined the possibility ofsingle-member districts to remedy this. Racism, codeenforcement, the school district and crime were also coveredin the report.

While South Irving is not perfect and could benefit frommore facelifts, it is built on solid ground. It remains to beseen if the opportunities revealed by the report will spur acreative, visionary endeavor to build a pedestrian enclave inSouth Irving complete with shopping, eating, history, artand music. Vision, coupled with practical changes andcreativity, could make all the difference as South Irving waitsto emerge in profitable beauty and charm.
