PRESIDENT’S MESSAGE

I hope everyone enjoyed the much needed rain that we received this winter. With our lakes and reservoirs rising, and hills turning beautifully green, we can be grateful to have a little relief from the severe drought that our two counties had been experiencing.

The Santa Barbara Ventura County Dental Society is grateful for you, our members, and we appreciate your continued membership. Our dental society is 780 members strong, making us the 12th largest component out of 32 in the state of California. Our local dental society alone has more members than many other state’s entire associations, including Oregon, Idaho, Vermont, and Hawaii to name just a few. In addition to this, the CDA as a whole has hit a milestone of over 27,000 member dentists in the state, a record number. By being a member of the SBVCDS and CDA, you are contributing to the collective strength that enables us to positively shape the future of dentistry and advocate for our members against negative influences that we could not stand against alone.

One of the negative influences that many of us feel in our practices is the financial squeeze from insurance carriers. As many of you may have recently heard, the CDA stepped in on behalf of its members against Delta Dental 3 ½ years ago after Delta attempted to change Participating Dentist Agreements (PDA) and significantly decrease Premier network reimbursement rates. After a lengthy litigation, the CDA has struck a very favorable settlement against Delta Dental on behalf of its members. The settlement is being approved in the courts over the next month, and Premier Providers affected by the fee changes will be reimbursed according to the class action suit shortly thereafter. There are many other important benefits as part of the settlement, and CDA has set up a dedicated settlement website at cda.org/delta, where members can view the entire settlement summary and keep up to date on the latest information.

One other extremely important and beneficial outcome to the lengthy litigation taken against Delta was the

prevention of fee decreases over those 3 ½ years of legal battle. This alone ended up saving California dentists nearly half a billion (yes, that’s a B) dollars in fee reimbursements. This amount of saved income alone can justify most members’ annual dues many years over. Again, this is only possible with you, our members, and our collective strength in numbers.

On the component level, we are planning a wonderful social at the Tower Club on Saturday, April 8. It is an enjoyable evening of camaraderie and fun, and I want to encourage everyone that may be considering to join us. Please bring your significant others and staff, and come have some fun with us. Call Linda at the Dental Society to RSVP, and I look forward to seeing many of you there. Additional events occurring throughout the year for our members include Member Benefit Days in Lompoc, Santa Barbara, Oxnard, and Thousand Oaks. Come and finish your required licensure classes for infection control, dental practice act, and CPR renewal. We also have many C.E. classes, as well as our annual golf social in September at the Ojai Valley Inn to look forward to.

We are always striving to engage our members more at the SBVCDS, and ultimately we are here to serve on your behalf. If you have any ideas or concerns, or if you need help with something professionally, than please contact us. SBVCDS Members,

2017 is well under way at CDA. It has been a busy and significant year so far.

Our membership has grown to an all-time high at over 27,000 members.

Through CDS’s continued work on the Delta Dental litigation over the last 3½ years CDA has had a successful settlement. This process has blocked fee reduction to participating members saving nearly half a billion dollars in fee reductions and a settlement for those impacted by delta’s actions. If you are one of the affected members you will be receiving a settlement from Delta. No action is required on your part. You are automatically included in the settlement. For more information on the settlement please check CDA.org.

The creation of the TDSC company and it services are well under way. The rollout of their services has begun to a restricted number of dentist in its testing phase and will be available to all members in the near future. The initial service available will be to provide the group purchasing power of CDA to allow individual members to purchase supplies at a completive rates of a large groups. This is anticipated to provide substantial saving to individual member dentists. Also coming available is full service practice consulting for our members. Watch for more info to come on the rollout of these services.

Due to the ongoing opioid epidemic CDA offers new CURES and opioid resource guide. This is an online resource to help dentists with requirement and best practices when prescribing opioids. This is a part of CDA’s efforts to address and combat California’s opioid epidemic and to ensure members have the most up-to date information to maintain compliance in the dental practice. This information is also available at CDA.org.

In March I attended the CDA Leadership Education Conference.  It is so inspiring to be surrounded by 49 other Trustees who have stepped up to leadership and are working for our profession.  I am honored to serve for our component.  As always, please contact me, or Linda at the Society office, if there is any more we can do for you.

CDA’s long legal battle against Delta Dental has resulted in a settlement with significant concessions from the dental benefit plan. Filed in 2013, the legal action stems from CDA’s relentless determination to do what’s right for members after learning of Delta’s intention to cut Premier Provider reimbursement rates by 8 to 12 percent. CDA wanted to send a message to Delta, holding it accountable for fair business practices and transparency. And CDA’s success in blocking Delta’s reimbursement rate reduction for more than three years has saved providers nearly a half billion dollars.

“Our members needed us to take a stand on their behalf — to protect their rights to good faith and fair dealing — and that’s exactly what we did. And after 3 ½ years in a hard-fought legal battle, we were successful,” said CDA President Clelan Ehrler, DDS, MS.

In the course of litigation, and in addition to maintaining that Delta Dental had not fairly and adequately disclosed its plan to reduce reimbursement rates, CDA also discovered that Delta Dental had been imposing additional limitations on Premier provider annual fee filings, which the Participating Dentist Agreements did not allow. Dentists should be aware that Delta Dental intends to implement amended rules for participating dentists if the settlement is approved, although it cannot take effect until 120 days after the court gives final approval to the settlement.

CDA recently announced that there is now a formal proposed settlement agreement on behalf of all California dentists who served as Delta Dental Premier Providers any time between Jan. 1, 2011, and Dec. 31, 2016. Key settlement outcomes include the following:

• Delta Dental must provide 120 days’ written notice of significant PDA changes to all contracted providers.

• Delta Dental must provide each Premier dentist affected by any attempt to reduce reimbursement fee maximum levels with an individualized analysis of the potential financial impact to his or her practice, based on that dentist’s prior 12-month submissions to Delta Dental.

• Delta Dental must pay $34,750,000 to Premier dentists who filed annual fee adjustments with Delta Dental that were below the maximum amounts allowed but that were nonetheless reduced by Delta Dental based on its own self-determined “inflation adjustment percentage” (referred to by Delta Dental as “INAP”). Not every Premier dentist had his or her fees reduced by the INAP, in which case those individuals will not receive any payment. Those dentists who did have their fees limited by this procedure will receive some proportionate retroactive reimbursement.

As part of the settlement agreement, the litigation has been restated in a class action complaint and members will have 45 days from the mailing of the legal notice to object and/or opt out of the class action, if desired. The court hearing for final approval of the settlement is expected to occur by the end of April.

After the court approves the class and the notice, any questions regarding the notice or the proposed settlement, including the amount dentists may be eligible to receive under the proposed settlement (subject to appropriate confidentiality limitations), should be directed to the class notice administrator. Delta Dental hired Rust Consulting to administer the settlement after it is approved by the court and a website will be established at deltadentalofcaliforniasettlement.com.

If the answer is no, you may be missing out on a revenue stream and source of new patients?

Today’s focus for children’s dentistry is PREVENTION. The Santa Barbara-Ventura Counties Dental Care Foundation points out that guidelines recommend that every child be seen by a dentist starting at 1 year of age or when the first tooth erupts. If you are not open to seeing these very young patients, you may be missing a growing influx of patients. Pediatric physicians are being encouraged to include an oral health evaluation and fluoride varnish application at every well-child visit. So who will these physicians recommend these patients to see? There are not enough pediatric dentists to see all the children in each county (and most don’t accept Denti-Cal). Will your office see these young patients? Will your office be the one to bill for oral health services for these patients?

But, you say, you feel uncomfortable seeing these very young patients. The solution is to find out how to fit them into your practice. A straightforward step is to attend the CE course on April 21 sponsored by The SB/VC Dental Society entitled “Pediatric Dentistry for the General Practitioner and their Assistants.” This practical course discusses the practical examination techniques for infants, toddlers and school-aged children as well as managing the parents.

Can’t make that date? Here are some simple suggestions: • Very young children can ride on mom’s (or dad’s) lap and get a fun ride in the dental chair. The focus is to get the child accustomed to the atmosphere of the dental office and having a stranger put their fingers in the child’s mouth. The focus is fun at this time.• Fluoride varnish can be applied just to the erupted teeth and as the child gets used to this, it will be easier to apply the varnish as more teeth erupt.• Oral health education can be given to parents at each visit to include good nutrition for the entire family. This is the only way to change the home environment and eliminate soda pop usage. The parents will see the advantages for themselves as well as the children.• As the child gets older and more cooperative, tooth polishing can be instituted. • Should the child need restorative services, the child should already be accustomed to the office, the decay should be small and simple to restore. Should this not be the case, referral to a pediatric dentist can be made.

For this time and effort, your office should see loyalty from the parents (they continue to visit your office). Parents will bring other siblings and recommend other relatives or friends to your office. The very young child will grow and continue to be a patient at YOUR office creating a stream of new patients for which you can bill for oral health services. Please consider accepting very young patients in your office, if you do not already do so.

A Past President of the American Academy of Cosmetic Dentistry, Dr. Hugh Flax has lectured and authored in Europe, Japan, Canada, and the United States on lasers, smile design, and advance restorative techniques to enhance the skills of dental teams in making their care world class for their patients.

Dr. Flax received his DDS degree from Emory University in 1983 following undergraduate Phi Beta Kappa honors. He was President of the Atlanta Chapter of the AACD (1996-1998) and founded the Georgia Academy of Cosmetic Dentistry in 2007. He is on the Editorial Board of the Journal of Cosmetic Dentistry and Practical Periodontics and Restorative Dentistry. He has been the Chairperson of the AACD Private Education Advisory Council, the 2008 AACD Meeting, the 2010 AACD European Meeting, and was a member of the AACD Board of Directors for over 8 years. Outside of the AACD, Dr. Flax is a member of the ADA, AGD, ALD, AAID, ICOI, Catapult Elite, and the L.D. Pankey Alumni Association. He is also a certified Fellow with World Clinical Laser Institute. Lastly, he is a Fellow of both the International Academy of Dentofacial Therapeutics and ICOI.

Fictitious Business NameThe Dental Practice Act requires dentists who practice under any name other than the name under which he or she is licensed to have a fictitious name permit from the Dental Board. Also, any association or partnership or corporation or group of three or more dentists may practice under a fictitious name if, and only if, the entity holds an outstanding, unexpired, unsuspended and unrevoked permit issued by the Dental Board. Requirements for the permit can be found on the Dental Board website (dbc.ca.gov/licensees/dds/permits_index.shtml).

Business and Profession Code Section 1804 states that: “Notwithstanding subdivision (i) of Section 1680 and subdivision (g) of Section 1701, the name of a dental corporation and any name or names under which it may be rendering professional services shall contain and be restricted (emphasis added) to the name or the last name of one or more of the present, prospective or former shareholders and shall include the words “dental corporation” or wording or abbreviations denoting corporate existence, unless otherwise authorized by a valid permit issued pursuant to Section 1701.5.” A dental corporation that practices under its corporate name does not need a fictitious name permit.

Dental practices operating with a Dental Board-issued fictitious name permit also must comply with another state requirement. California requires all for-profit businesses that use a fictitious business name to file a fictitious business name statement with the clerk of the county where the business is located. Such statement shall be filed no more than 40 days from the time the business starts transactions. Specific information is required in the statement, and the statement must be published in a general circulation newspaper within 30 days of filing the fictitious business name statement. The statement must be published once a week for four consecutive weeks, or as otherwise allowed in Government Code Section 6064. An affidavit showing publication of statement must be filed with the county clerk within 30 days after the fourth publication of the statement. A fictitious name statement typically expires five years from the date it was filed.
