DATE:

TO:

FROM:

Grant Uyeyama, Director of Development Planning Development Planning Department

MEETING DATE:

March 21, 2013

OWNER: Rose Battisti FILE(S): A060/13 Location:

53 Cartwright Boulevard, Vaughan Ward 3, Vicinity of Rutherford Road and Weston Road

Proposal:

The Owner is requesting permission to continue construction of an accessory structure (cabana/shed) with the following variances:

Variance Proposed Required 1 Maximum floor area of the accessory

structure 41.13m2 10m2

2 Maximum building height of the accessory structure

3.71m 2.5m

3 Minimum interior side yard setback to the accessory structure

0.60m 1.5m

4 Minimum rear yard setback to the accessory structure

0.60m 7.5m

5 Maximum eave projection 0.50m 0.30m

Official Plan:

The subject lands are designated “Low Density Residential” by in-effect OPA #240 (Woodbridge Community Plan). The subject lands are also designated “Low Rise Residential” by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the policies of the Official Plan.

Comments:

The subject lands maintain a shed with an approximate total area of 10.22m2. In addition to the existing shed, the Owner is proposing an additional covered structure attached to frame of the shed. The proposed portion of the accessory structure with an approximate total area of 30.91m2 is covered, open and unenclosed. As a majority of the accessory structure is open and unenclosed, there will be little impact on the adjacent neighbour to the east. Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.

Recommendation:

The Development Planning Department supports Minor Variance Application A060/13.

Condition(s):

None.
