Proposal:

The Owner is requesting permission to locate a Place of Worship within a multi-unit building, whereas By-law 1-88 requires a Place of Worship to be in a free-standing building.

Official Plan:

The subject lands are designated “General Commercial” with an Office Precinct and Special Policy Overlay by in-effect OPA #600 (Vaughan Centre Secondary Plan). The subject lands are also designated “High-Rise Mixed-Use” by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the policies of the Official Plan.

Comments:

The Development Planning Department has no concerns with the above noted application. The subject lands are Zoned C1 Restricted Commercial Zone by Zoning By-law 1-88, subject to site-specific exception 9(1030). The in-effect Official Plan designation and Zoning category permit a “Place of Worship” use on the subject lands. However, due to the definition of “Church” in Zoning By-law 1-88, the interpretation is that a “Place of Worship” shall be located in a free-standing building, and not in a multi-unit building. The Building Standards Department has advised of no other deficiencies, and that the proposal complies with all other provisions of Zoning By-law 1-88 (including parking and setback requirements). The Development Planning Department is satisfied that the proposed “Place of Worship” can operate within a multi-unit building on the subject lands, and in doing so, maintain the intent of the Zoning By-law. Further, there is an existing “Place of Worship” in the adjacent building, which successfully operates on the subject lands. Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.

Recommendation:

The Development Planning Department supports Minor Variance Application A084/13.

PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream’s cost for any relocation work.
