That the development hereby permitted shall be started within three years of the date of this permission.

Reason: To accord with the provisions of the Town and Country Planning (Scotland) Act 1997 (as amended by the Planning etc (Scotland) Act 2006).

That the development hereby permitted shall not start until a Notice of Initiation has been submitted to the satisfaction of the Planning Authority.

Reason: To accord with the Town and Country Planning (Scotland) Act 1997 (as amended by the Planning etc (Scotland) Act 2006).

That within 4 weeks of the development hereby permitted being brought into use a Notice of Completion shall be submitted to the satisfaction of the Planning Authority.

Reason: To accord with the provisions of the Town and Country Planning (Scotland) Act 1997 (as amended by the Planning etc (Scotland) Act 2006), to monitor the development, to enable the Planning Authority to retain effective control.

That the development hereby permitted shall be carried out strictly in accordance with the approved details submitted as part of the application and no change to those details shall be made without prior written approval of the Planning Authority.

Reason: To clarify the drawings on which this approval of permission is founded.

That before the retail unit hereby approved is operational, the associated parking and manoeuvring area as shown on the approved plans, shall be levelled, properly drained and surfaced in a material which the Planning Authority has approved in writing before the start of surfacing work and clearly marked out, and shall, thereafter, be maintained as parking and manoeuvring areas.

Reason: In order that vehicles can enter and leave the site in forward gear and to ensure adequate parking provision.

That BEFORE the development hereby permitted starts, a scheme of boundary treatments, including planters on both frontages to be set back outwith the 2 metre wide footway shall be submitted to, and approved in writing by the Planning Authority.

Reason: To enable the Planning Authority to consider these aspects in detail.

That prior to the operation of the use hereby permitted, all works approved under the terms of condition 6 above, shall be completed and maintained to the satisfaction of the Planning Authority.

Reason: In the interests of the visual amenity of the area.

That before the development hereby permitted starts, a management and maintenance scheme shall be submitted to, and approved in writing by the Planning Authority, and it shall include proposals for the continuing care, maintenance and protection of:-

(a) the proposed parking areas; (b) the proposed external lighting; (c) the proposed planters.

Reason: To enable the Planning Authority to consider these aspects in detail.

9. That BEFORE development hereby permitted becomes operational, the management and maintenance scheme approved under the terms of condition 8; shall be in operation.

Reason: To ensure ongoing maintenance in the interests of visual amenity.

10. That the design, installation and operation of any air conditioning/ventilation or other plant for the proposed development and any other noise associated with the completed development shall be such as will not give rise to a noise level, assessed with the windows open, within any dwelling or noise sensitive buildings in excess of the equivalent to Noise Rating Curve (N.R.C.) 35 between 07.00 hours and 20.00 hours and N.R.C. 25 at all other times.

Reason: To safeguard the amenity of the adjoining residential area.

Site Descrintion

The application site is relatively flat and prominently situated at corner of Woodside Street and Lismore Drive, Kirkwood, Coatbridge. The building in question is a vacant pub building with wide tarmac pavement /forecourt to south and west of the building. The existing building is single-storey with dual pitched T-plan roof with flat gable fronting on to Woodside Street. The site is bounded to the north by an electricity sub-station beyond and further to the north of which lies the Neighbourhood Centre of Kirkwood which contains a mixture of shops, Council one stop shop, Post office and a Credit Union as well as a bookmakers and a public house. Kirkwood Library and Community Centre and car park are to the east of the site. To the south and west of the site are residential areas.

Pronosed DeveloDment

The proposed development involves the conversion of the existing vacant public house building to form a new retail unit with a gross floor area of 409 square metres with pedestrian access from the Woodside Street frontage and a parking area for three cars and service delivery area at the eastern end of the site accessed from Lismore Drive. Additionally, the proposal includes the installation of an ATM on the Woodside Street frontage and the formation of and blocking off of other windows on the public elevations. A small extension is also proposed on the southwest corner of the building.

Annlicant’s Sumortina Information

The applicant argues that the former public house use became unviable and was placed into administration over 5 years ago. Despite extensive marketing no viable interest for the reuse as a public house or other use has materialised. The applicant further argues that the proposed retail use provides the opportunity to reduce travel by providing enhanced convenience shopping provision within easy walking distance of a significant residential population and will support and enhance existing retail provision in the adjacent Kirkwood Neighbourhood Centre. Due to the walk-in catchment and public transport links within the area, significant parking is not required. The applicant considers that the proposal accords with local plan policy as it will not be of detriment to residential amenity, is of a scale (409 square metres gross) that is less than half of the threshold (1000 square metres) that requires a Retail Impact Assessment and therefore assessment of the impact on existing retail is not required or relevant. The applicant also argues that the proposal is for the re-use and conversion of an existing building which has environmental benefits and that the renovation of this vacant building would be an immediate community benefit and would have a greater benefit to the local community and neighbourhood centre than residential development.

The applicant also submitted a letter addressing objections made on the grounds of traffic and road safety. The applicant has stated that 3 parking spaces will be provided and that servicing will take place outwith peak times. The applicant further argues that the site has good public transport links and footpath infrastructure, there is a sizeable residential catchment within an 800metre radius (10 minute walk) and that the shop will generate ’walk in’ ’basket type’ trips. The applicant also states that there is ample unrestricted parking on Lismore Drive and that ‘the available parking provision is adequate to serve the proposed development, and that existing local parking restrictions are sufficient to ensure the continued safe operation of the local road network’. The applicant also states that an on-site review of the Woodside Road/Lismore junction has concluded that the road network is ‘lightly trafficked’. The applicant concludes by saying that it is considered that the proposed shop will

generate a minimal amount of car based trips, is consistent with local and national policies in terms of sustainable development and that the existing road network can accommodate the proposal without compromising road safety.

4. Site Historv

4.1 None relevant.

5. Development Plan

5.1 The application raises no strategic issues and can therefore be assessed in terms of Local Plan policies.

5.2 The application site is covered by Policy HCF2A, which allocates the site as a short term housing site, in the North Lanarkshire Local Plan. Policy HCFlA is also of relevance. This policy presumes against developments detrimental to residential amenity whilst indicating that development which is of an ancillary nature may be acceptable, subject to impact on residential amenity and provision for servicing and parking.

6. Consultations

6.1 A summary of comments from consultees is as follows:

a) Transportation: Recommend refusal of the application unless 21 parking spaces are provided.

7. Remesentat ions

7.1 Following the standard neighbour notification process and newspaper advertisement, 327 representations have been received including one from Councillor Smith. Most of the objections were in the form of a pro-forma letter; however, following acknowledgements being sent to the addresses provided, nine parties contacted the case officer to indicate that they had not objected to the proposal.

8. Plannina Assessment

8.1 Section 25 of the Town and Country Planning (Scotland) Act 1997 requires that planning decisions must be made in accordance with the development plan unless material considerations indicate otherwise.

8.2 DeveloDment Plan: North Lanarkshire Local Plan (NLLP): The site is covered by local plan policy HCF2A Short Term Housing site. This designation is part of an identified housing site that includes the adjoining Community Centre and Library. Given the nature of the proposed development, the criteria contained within Policy HCFl A Protecting Residential Amenity and Community Facilities are applicable. This policy presumes against developments detrimental to residential amenity. New development which is of an ancillary nature may be acceptable subject to impact on residential amenity and provision for servicing and parking (discussed below).

Whilst the application site is not within the identified local centre (Policy RTC l ) , it is not within an exclusively residential area, being on the edge of the designated neighbourhood centre to the north with retail and civic uses, and the civic and assembly uses of the library and community centre to the east and residential area to the south and west. This Public House cannot be described as being in an exclusively residential area despite the provisions of the development plan. It is also considered that policy HCFl A (Protecting Residential Amenity and Community Facilities) is

aimed at enabling small shops selling consumables to residents at an immediate location within exclusively residential areas. Such proposals are not intended to attract shoppers from the wider district thereby limiting the impact on residential amenity. Positioning this proposal on the edge of the neighbourhood centre will also focus the impact away from the residential area notwithstanding its intermediate scale, effectively complying with the policy in protecting residential amenity.

In considering retail and town centres it should be noted that Policy RTCl seeks to protect the North Lanarkshire Centre Network as the focus for retail, civic, leisure and community uses. Although not within the identified retail centre, this site is adjacent to the designated neighbourhood centre.

8.4

8.5 Retail proposals outside the designated neighbourhood centre require to be assessed under Policy RTC3 (A) (Assessing Retail and Commercial Development). As the floor space of the proposal falls short of 1,000 sq m gross threshold (less than half 409 square metres) where the detailed assessments required by Policy RTC 3 (A) would apply, Policy RTC 3 (A) is not applicable in this case. Notwithstanding the scale being considered appropriate to the location, the applicant has argued that the proposal would have a supportive impact on the neighbourhood centre.

8.6 The physical impact of the proposal is also considered in the North Lanarkshire Local Plan (NLLP) which requires proposed developments to be assessed against policies DSP 1 (Amount of Development), DSP 2 (Location of Development), DSP 3 (Impact of Development) and DSP 4 (Quality of Development). Due to the limited nature of the development, Policy DSP 1 and DSP3 are not relevant. Policy DSP2 considers the location of development while DSP4 considers detailed design and both policies are discussed below.

8.10 Policy DSP 2 covers the location of development. Amongst other matters, this policy specifies that for developments to be acceptable, they should be consistent with locational criteria including, the use of brown field sites, supporting the hierarchy of sustainable transport modes, safeguarding vitality and viability of centres (concurs with policy, RTC3 (Assessing Retail and Commercial Development)) in considering the foregoing the proposal is accords with this policy.

8.11 Policy DSP4 considers the quality of development. In this respect the proposal achieves an acceptable quality of development as in this case, a conversion and renovation of the existing building is proposed which represents a significant improvement to the condition and attractiveness of the building and site and as such, the visual amenity of the surrounding area. A condition covering landscape details and associated maintenance agreement is recommending. In this respect the proposal accords with policy DSP4.

8.12 Consultees: Transportation

Transportation has recommended refusal unless the site is served by 21 spaces. There is therefore a shortfall in the recommended in curtilage parking levels. However, in this case, it is considered that the benefits associated with bringing this vacant building back into use outweigh the shortfall in dedicated parking. It is also recognised that existing parking provision is available nearby as well as on street parking. Furthermore, due to the site location, it is considered that a significant number of customers will walk from nearby residential areas. The site is also easily accessible in terms of the local bus route.

8.1 3 Representation: Following the standard neighbour notification process, 327 letters of representation were received and are summarised below:-

Comment: It is not considered that the proposal would encourage additional levels of

anti-social behaviour or attract more anti-social behaviour than the previous Public House use.

0 Point of objection: There are enough shops and the proposal will detrimentally impact on existing shopping provision within the Neighbourhood Centre.

Comment: In terms of existing provision of shops and services within the neighbourhood centre it is noted that there are 5 vacant shop units within the Woodside Street parade of shops (formerly occupied by a butchers, chemist, hardware store, Tanning salon and convenience store). Existing occupied units are Scotmid, Boots, Indian Takeaway, Newsagents, Post Office, Chip shop, convenience store and Public House. Across the road there is a credit union, newsagents, an office and a vacant unit formerly occupied by a chemists. Including the former Monkland Inn, to which this application relates, there approximately 7 vacant units within the area and 11 occupied units. As previously stated in paragraph 8.5 above, because the floor space of the proposal falls short of 1,000 sq m gross (less than half 409 square metres) assessment under Policy RTC 3 (A) does not apply. In other words, in terms of planning, the proposed floor area is not considered to be of a size that could significantly impact on adjacent centre retail provision and as such, a assessment of retail impact is not considered necessary. The scale of the proposed shop is governed by the re-use of the former public house building and is therefore considered to be appropriate to the location. The applicant has argued that the proposal would have a supportive impact on the neighbourhood centre. In this regard, it is considered that the proposed shop and existing retail units can co-exist at this neighbourhood centre location. The proposal would result in one less vacant unit within the area and provide much needed urban renewal to the site and positively impact on the surrounding area in terms of the quality of the physical environment.

Point of Objection: The development will lead to road safety issues as a result of traffic generation, parking and deliveries to the shop.

Comment: As previously stated in paragraph 8.12, there is a shortfall in the recommended in-curtilage parking levels for the site. In this case, it is considered that a significant number of potential customers will walk to the proposed shop due to the close proximity of housing and the sites central location within the footpath network and local bus route. Additionally, the existing pedestrian crossing points on Lismore Drive are within a 20mph residential zone. The parking provision as proposed is therefore considered to be acceptable. It is also recognised that existing parking is available nearby as well as on street parking. In terms of deliveries, this is a matter for the management of a shop and it is expected, that for practical reasons deliveries would take place outwith peak times.

9. Conclusions

9.1 This development would bring a long-term vacant property back into use, and it is considered that the development would integrate satisfactorily with the existing character of the area, as such; it is considered that the proposed development would not unacceptably impact on the established residential amenity of the area or significantly impact on the adjacent neighbourhood centre by virtue of scale. Having regard to the foregoing, it is acknowledged that the proposal complies with the adopted Local Plan policy for the site, rendering the proposed re-use of this vacant building compatible with the designated residential area. It is therefore recommended that the application be approved subject to the attached conditions.
