December 21st held true to as the first day of winter! If you wanted a white Christmas that was delivered and the cold weather has arrived! A two week cold spell is not unusual in our Region and two or three cold events are common for the season. We hope you were able to enjoy Christmas with your families and were able to Ring in the New Year while Mother Nature decided to throw in well below zero temperatures.

As we welcome in the New Year we welcome in some new rules for the trucking industry. Hopefully we will be able to deliver the volume of products that we have in the past. I enjoy the four seasons that we get to experience in South Dakota, but sometimes the weather can be a challenge. Now that winter has arrived drivers

across the country must deal with extreme weather and winter driving conditions. Ice, snow, high winds, poor visibility, frigid temperatures and other hazards impact driver safety. When driving in these conditions it is important to be prepared. In one of our insurance publications it lists four areas that a driver should always prepare for are vehicle inspections, maintenance, route planning and roadside emergencies. Conducting thorough vehicle inspections, before, during and after a trip and resolving any main-tenance issues promptly are important. Drivers should plan their routes by watching weather reports and receiving up to date weather changes and working with shippers and receivers in the event of roadside delays. Remind drivers to pack cold weather cloth-ing, extra food and water, and other emergency supplies in the event they get caught out in the elements.

When driving in winter conditions and road conditions deteriorate it’s important to make good decisions to park the truck if conditions are too hazardous to drive in.

We need to remember:

• Avoid distractions- get plenty of sleep to avoid fatigue and put away cell phones before driving

• Maintain proper following distance-maintain a minimum of six seconds following distance in normal conditions and add an additional second for each hazard present, like snow or high winds.

• Observe proper speed for conditions- drivers should slow down as road conditions get worse and not to exceed the posted speed limit.

• Be attentive to the road ahead- drivers should watch for slowing traffic ahead as well as other hazards.

• Maintain one lane- drivers should avoid lane-hopping and other aggressive driving behaviors that can lead to a lane change crash, or cause others to lose control.

Following these guidelines will help us be prepared to watch out for the other drivers on the road in adverse driving conditions.

Well, our December and January weather has certainly reminded me that we will not escape a typical South Dakota winter. Snow and cold temperatures have certainly taken hold making outdoor activities limited. The end of December served as a reminder that winter driving takes skills that not all drivers have mastered.

The 2018 Session of the South Dakota Legislature started on January 9th. I have again moved to my “winter camp” in the capitol city. As you have heard me say before, I am always excited to go to Pierre and represent your interests to the state legislature, but I am equally excited for mid-March when I can get back to my office in Sioux Falls.

It appears that your sister association, the South Dakota Automobile Dealers Association, will have sev-eral bills that have a direct affect on the membership. I am quite sure the trucking industry will also have issues that will take some vigilant watching. As in other years, please pay close attention to your email so you can be informed as to what is going on in the State Capitol. I may be asking for your help with calls to legislators if it becomes necessary to move an issue.

The only “heavy lift” that I anticipate at this time is a worker compensation insurance bill that will draw some fire in the halls. Passage of this bill will have a direct financial affect on every employer in South Dakota. Stay tuned. There is more to come!

The session is starting as they always do; slow with a lot of posturing and consensus building. As you know, there is again a budget shortfall making for little budget negotiation.

I am writing this message while sitting on a bench outside the SD House of Representatives. I need to cut this off and get back to work. As the legislative session progresses, if you need to contact me, please call your SDTA Office. The staff will make sure I get a message to call you. Continue to atten-tively watch your email during the legislative session to stay informed about what is going on. Remem-ber, we are all in this together!

I look forward to getting back to my office on March 12th and sleeping in my own bed again. Hopeful-ly, my wife and our dog still remember me when I get there! Although I really enjoy this duty each year, I also firmly believe that happiness is Pierre in the rearview mirror.

With all the extra work and confusion of the holiday issue, the article I found in an insurance publication last month, which I sent in to be published didn’t make it to print in the December issue of the “Trucking News.” I still wanted everyone to read this. It expresses the impor-tance, benefits and value of supporting your states trucking associations. The article is printed on page 15 of this issue.

Over the years, I have talked with many other states association staff and members. I have to say, we have one of the strongest and most active associations in the United States. That may be hard for some to believe, but just do a little research. You will find out very soon just how active and valuable our SDTA Association is. Just about every issue out there starts on a State level in some form one way or another.

With all of the focus this past year on the ELD mandate, I think we lost sight of everything else that had an effect on the trucking industry over the past year. Here is a review of some of the issues and changes made the past year:

January - President Trump called for a freeze on new regulations. He also called for federal agencies to eliminate two old regula-tions for every new one.

February - President Trump’s regulatory freeze puts the death knell on the speed limiter mandate. The FMCSA issued new guidance regarding the ELD mandate that allowed owner-operators with older ELD’s that aren’t compliant with the mandate two more years to comply.

March - The FMCSA announces it would end the 34-hour restart regulation requiring two consecutive early morning periods and that it would not go back into effect. FMCSA outlines its progress toward a flexible split sleeper berth program. DOT announces it will withdraw its Safety Fitness Determination Rule.

April - OOIDA makes a personal plea to Transportation Secretary Elaine Chao to nix the ELD mandate.

May - Preparations begin for the 72-hour Commercial Vehicle Alliance inspection blitz in June.

June - OOIDA’s challenges to the ELD mandate were effectively killed when the US Supreme Court declined to hear a lawsuit challeng-ing the rule.

July - FMCSA announced the sleep apnea rulemaking that had been in the works would be nixed.

August - Truckers put on alert for the first total eclipse in the US in nearly 40 years. At least portions of 14 states saw a total eclipse of the sun when the moon blocked the sun out for nearly three minutes.

September - The ELD mandate suffers another blow when the House of Representatives rejects an amendment to the 2018 appro-priations package that would have stalled the ELD mandate for at least 10 months.

October - Glider kit industry scores a major win when the Environmental Protection Agency formally proposed to repeal Obama’s epa emission regulations placed on glider kits.

November - Agriculture, livestock and bee haulers are given a 90- day extension on the ELD December 18th deadline.

December - What else can you say, but the ELD mandate goes into effect.

A lot has gone on this past year. I don’t see the upcoming year to be any less active. So let’s roll up our sleeves and dig in!

A little closer to home and to share a little humor that certainly made me laugh... Jerry Reimers from Dynamite Trucking told me the other day he has his ELD up and running. I asked him how is it working. With a lot of frustration in his voice he told me, “I sure don’t like what the damn thing is telling me!” Change is hard! I see this as being a mandate for EVERYONE in the future.

It is with a heavy heart that we pass on the news of the death of Darwyn Stebbins.

Trucking was Darwyn’s life and his hobby. He was an avid supporter of the South Dakota Trucking Association and a member for many, many years.

Nobody had a bigger heart than Darwyn. He was the person that stopped on the road to give assistance to weary travelers who didn’t even know him. He was the person who would always say hello to you no matter who you were. He was the person who would help other people in trouble in whatever way he could. He was not a man seeking riches, but was a man rich in kindness, goodness and friendliness to his fellow man. He was the person who never in-tentionally did harm to man or animal through his words or deeds. He was the person the saying goes that would give the shirt off his back if you needed it. He was not a church going man, but was as much a Christian in his thoughts, words and deeds that a person can be.

In lieu of flowers please make a donation in one of two ways: 1) donate blood as often as possible, Darwyn was long time donor and received hundreds of units of blood these past two years, 2)Because of his love for animals donate to your local animal shelter as often as possible.

Preparation Key to Staying Free From FluThough influenza (flu) season doesn’t peak until there is usually snow on the ground in the Upper Midwest, the peak time experts recommend getting vaccinated falls between September and Novem-ber. All people age 6 months or older are advised to get an annual flu vaccine.

“Vaccination is the best way to prevent the flu virus,” explains Jennifer Schriever, M.D., a family medi-cine provider with Sanford Health in Sioux Falls.

Schriever says the seasonal flu vaccine protects against three common influenza viruses that re-search indicates will be most common. She also stresses the safety of the vaccination for pregnant women and their unborn children — as well as the importance of the protection it provides for both. Pregnant mothers pass on protective antibodies, which helps keep the baby flu-free until 6 months old and able to receive a flu vaccination on their own.

Flu season starts in the fall before peaking around the end of December and is generally considered over in April. During the 2016-17 season, 43 South Dakotans died of influenza.

Of the flu-related deaths, 88 percent of patients were 64 years old or older. As people age, their immune systems don’t provide the protections they once did. This diminished immune system function increases risk for flu and other related ailments and complications.

In all, in South Dakota last flu season there were 2,043 confirmed cases and 950 hospitalizations.

What is flu?

The flu is a contagious respiratory illness caused by influenza virus. The virus spreads through person-to-person contact and droplets made when infected people cough, sneeze or talk. These droplets can be inhaled directly or picked up on common surfaces, making good hand hygiene another crucial component in keeping the flu at bay.

Generally causing mild to severe illness, flu can lead to death. It is particularly dangerous in very young children, older adults and people with chronic health conditions. There are a variety of signs and symptoms of the flu, including: fever or chills, cough, sore throat, runny or stuffy nose, muscle or body aches, headaches, fatigue. Children, more commonly than adults, experience vomiting and diar-rhea when infected.

What to do?

Sanford Health offers flu vaccines on a walk-in basis at family medicine and children’s clinics and will also have scheduled days for people to come to a clinic to be vaccinated. Additionally, any patient can request a shot at a regularly scheduled appointment.

Extension to Repair, Replace, and/or Service Malfunctioning ELDsPer 49 CFR 395.34(d), a motor carrier may request an extension to correct, repair, replace, or service a malfunctioning ELD. The motor carrier must submit its request to the FMCSA Division Administra-tor (DA) in the State where the motor carrier's principal place of business is located within 5 days after a driver notifies the motor carrier of the malfunction. The request must include:• The name, address, and telephone number of the motor carrier representative who is submitting the

request;• The make, model, and serial number of each malfunctioning ELD;• The date and geographical location of each ELD malfunction as reported by the driver to the motor

carrier; and• A concise statement describing actions taken by the motor carrier to make a good faith effort to repair,

replace, or service the malfunctioning ELD units, including why the motor carrier needs additional time beyond the 8 days provided by this section.

When an extension is granted, the DA will provide the motor carrier with a letter confirming the motor-carrier 's request. The letter permits the motor carrier to use paper logs for a specified period of time, as determined by the DA. The letter will also advise the motor carrier to maintain a copy of the letter at the motor carrier 's principle place of business and to ensure that the driver has a copy in her or his possession.For South Dakota based bus and trucking companies, the requests should be sent to:

2018 Carrier Registration Period, With Reduced Fee Structure, to Open After 90-Day DelayJames Jaillet | @trucknewsJJ | January 3, 2018

Starting as early as Friday, carriers will be able to complete the annual federal registration process for 2018 and pay their annual registration fees, following a roughly 90-day delay in this year’s process. The U.S. DOT’s Unified Carrier Registration board has also reduced the fees carriers will pay to register with the DOT, cutting 2018’s fees by 9.1 percent across the board.

Fees will climb slightly for 2019, but will still be 4.6 percent lower than 2017’s fees. All carriers operating in interstate trucking are required to register and pay an annual registration fee each year. Brokers, private carriers and freight forwarders are also required to register and pay.

The agency is scheduled to publish Friday, January 5 a Final Rule establishing the 2018 fees and opening the registration process. The Commercial Vehicle Safety Alliance has said it will not begin enforcement of 2018 registration until 90 days after FMCSA publishes the Final Rule, meaning carriers and independent owner-operators will have until April 5 to register and pay their annual fees.

Here are the fees for the next two years, compared to the 2017 fees:

The three-month delay in the opening of the 2018’s registration process came after legal questions swirled around a DOT pro-posal issued in September that announced the lower fees and bumped the registration date to November 1, 2017. Registration typically begins on October 1 each year and runs through December 31.

The UCR Board faced a lawsuit from the Small Business in Transportation Coalition, who claimed the Board violated federal open meetings laws by failing to give proper notice about a meeting held to decide the new fee structure and the 2018 registra-tion period. Though a court agreed that the Board failed to provide proper public notice about the meeting, it upheld the deci-sions made by the board at the meeting.

Separately, the state of Texas sought to block the changes due to a squabble with the Board over revenue sharing. The Texas DMV claims the UCR has shorted it more than $33 million in owed revenue since 2007 — about $3 million a year, the state claims.

The DOT was able to proceed with the rule, regardless of Texas’ claims. The state will have to pursue another avenue to rectify the issue, if there is one, the DOT says.
