REMARKS: General: This is a genuine and unreserved dispersal sale which has been arranged on behalf of the Executors of the Late Mr D.A Longwill – ‘’Alec’’. The machinery implements and tractors on offer are a result of Alec’s lifetime dealing in farm machinery and equipment.

Location: Odstone is a hamlet situated in North West Leicestershire, located approximately one mile off the A447 between Hinckley and Ibstock. The sale will be fully signposted on the day of the sale. Please refer to the location map. The nearest postcode is CV13 0QS.

Covid – 19 Guidelines: If you are showing any Covid -19 symptoms, then you must not attend the sale.

Registration: We would encourage pre-auction bidding registration to be carried out either at the viewing or via email. A form will be available from karena@foxbennett.co.uk.

The Day of the Sale: Hand sanitiser will be available on the day and you may also be requested on the sale day to have your temperature checked with a ‘’non-contact’’ thermometer on entering the sale field.

It is the aim for the sale to be conducted under the 1 metre plus rule social distancing guidelines. Face masks will be available if required. Prior to attending the Auction Office, buyers will be required to use the hand sanitiser available prior to passing paperwork or monies across to the auctioneers. People attending the sale are also requested to bring their own pens. All people attending the sale will be required to leave their contact details and addresses on arrival. Payments: Card Payments: Intending purchasers are encouraged to pay by debit card on the day. Credit Cards or any cards which make a charge against the payee are not acceptable. Cheques: Intending Purchasers not known to the Auctioneers must produce, prior to bidding, an acceptable Banker’s reference. Cash: Cash payment is acceptable, subject to the Money Laundering Regulations. Bidding: The Auctioneers reserve the right to refuse the bid of any unknown potential Purchaser.

Money Laundering Regulation 2007: All persons paying for lots in excess or anticipated to be in excess of £10,000 will be required to produce to the Auctioneers before bidding a form of identification such as a passport, driving licence or shotgun certificate.

Other Information: VAT at the standard rate will be added to the purchase price of all lots if applicable.

Health & Safety: Included in this sale are a number of Lots which have not been used for some time and may be suitable for spares or are in need of repair. The Purchaser is totally responsible for the safe use of any items acquired at this sale.

Clearance of Lots: All lots must be cleared within 7 days of the sale or by arrangement with the vendors or by arrangement with the Vendors. Purchasers are reminded that all lots become the Purchasers’ responsibility at the fall of the hammer and are advised to take up effective insurance immediately.

Export of Goods.

All goods purchased at Brown & Co or Fox Bennett auctions that are to be exported or removed from the United Kingdom will:

1. Be dealt with under the requirements set out of HM Customs andExcise publications:

a) VAT Notice 703 dated April 2014 – Export of goods from theUnited Kingdom.

Removals: Conditions for zero rating

2. Be ZERO RATED for VAT purposes subject to the followingconditions being met:

a) The buyer provides the joint auctioneers with their VAT/FISCALNUMBER (which will be verified with UK Customs & Excise) atthe time of purchase.

b) The goods are removed from the United Kingdom within threemonths from the time of supply (the date of auction).

c) The joint auctioneers are provided with valid commercialdocumentary evidence that the goods have been removed fromthe United Kingdom within three months from the date of theauction.

Unless and until the above requirements are fulfilled Buyers will be charged VAT at the United Kingdom standard rate (currently 20%). This will only be refunded if all requirements within the regulations are met within the specified time limits.

CONDITIONS OF SALE:

(1) The highest bidder shall be the Purchaser and if any dispute shall arise between two or more bidders, the Lot in question may be put up again and resold at the Auctioneers sole discretion.

(2) Each Lot after being knocked down shall be considered as delivered to the Purchaser thereof, and the Auctioneers will not neither will any person in their employ, hold themselves responsible for the safety of such Lot. (3) Payment in full shall be made by the Purchaser to the Auctioneers on the day of sale and if demanded by the Auctioneers or their Clerk at any time during the progress of the sale shall be paid forthwith. (4) (a) The risk in the Goods shall pass to the Purchaser on the fall of the

hammer, but the ownership (whether it be equitable, beneficial, absolute, legal or otherwise) of the Goods shall not pass until payment in full to the Auctioneers by the Purchaser of all sums due has been made.

(b) Until the time of such payment, the following provisions shall apply: (i) The Goods shall be stored or kept separate and apart from other Goods and livestock belonging to or in the possession of the Purchaser. (ii) The Purchaser shall take proper care of the Goods. (iii) The Purchaser shall be deemed to have authority to deal with the Goods as if the Purchaser were the owner of them, but the Purchaser must account to the Auctioneers or all sums payable to the Purchaser by a third party as a result of any dealing with the Goods until such time as payment in full to the Auctioneers has been made. (iv) Any product, by-product or living thing derived from, produced by, born to or derived from that born to the Goods shall be the property of the Auctioneers and shall be stored and kept separate and apart from any product, by-product or living thing belonging to the Purchaser and the Purchaser shall immediately account to the Auctioneers for any consideration passing under any contract for the sale of such product or living thing. (v) The Auctioneers may enter upon any premises where the Purchaser has stored the Goods or the Auctioneers reasonably believe the Goods to be stored in order to re-possess the Goods. (5) If the Purchaser shall fail to make payment in full on the day of sale, interest at the rate of 2% above the base rate from time to time of the National Westminster Bank Plc shall be paid by the Purchaser on any balance owing by the Purchaser from the date of sale until the date of payment unless the Auctioneers shall decide to waive the Condition. (6) In these Conditions of Sale, the words the Goods shall be deemed to include all manner of things living or dead, including livestock offered for sale by the Auctioneers.

(7) The Auctioneers reserve on behalf of both themselves and of the Vendor the

right to bid on behalf of the Vendor. (8) Upon any Purchaser failing to comply with these Conditions, the Lot or Lots bought by the Purchaser may be resold by Public Auction or Private Treaty, at the Auctioneers discretion and any expenses incurred or deficiency arising from such resale shall be made good by the defaulter at the present Sale.

(9) Strangers paying by cheque must before the Sale produce to the Auctioneers their Bankers or other references. (10) The Terms and Conditions herein cannot be varied by any person acting or purporting to act as Employee or Agent of the Auctioneers. (11) The Terms and Conditions herein shall not be affected by any previous dealings between the Auctioneers and the Purchaser. Each particular Sale shall be regarded as a separate and new Contract, having no relation to other Contracts between the Auctioneers and the Purchaser. (12) The Purchaser shall be bound by the Auctions (Bidding Agreements) Acts 1927 and 1969. (13) All Goods whether livestock or deadstock shall be taken to with all faults and errors of description as to barrenness, time of calving, health or otherwise. (14) Should any question arise not provided or in the foregoing Conditions, the decision of the Auctioneers shall be final and binding on the Purchaser. (15) In the event of any dispute or refusal to pay or of non-payment on the part of

the Purchaser, the Auctioneers may, entirely at their discretion, annul and cancel the sale of such Lot or Lots.

(16) Persons attending the sale are respectfully reminded that verbal or physical

abuse to any person, especially the Auctioneers’ staff, will not be tolerated. (17) The Auctioneers sell as agent for the Vendor and as such are not responsible

for any default by the Vendor or Purchaser. The Auctioneers have absolute discretion without giving any reason to refuse any bid, to divide any Lot, to combine any two or more Lots, to withdraw any Lot from the auction and in case of dispute put up any Lot for auction again.

(18) Unless a warranty is specifically given for a particular Lot at the time of the Sale all Lots are sold with all faults and imperfections and errors of description. Purchasers should satisfy themselves prior to the sale of the Lot as to the condition of each Lot and should exercise and rely on their own judgement as to whether the Lot accords with its description. Neither the Auctioneers, their servants nor agents are responsible for errors of description or for the genuineness or authenticity of any Lot. Unless otherwise stated no warranty is given by the Auctioneers, their servants or agents or by any Vendor to any Purchaser in respect of any Lot and any express or implied conditions or warranties are excluded to the fullest extent permitted by law.

(19) All Lots whether sold or unsold may not be removed from the Sale ground without a pass for the removal of Lots. Passes must be obtained from the Auctioneers’ offices. All Lots must be checked out by a representative of the Auctioneers. All Lots purchased must be cleared from the Sale ground within seven days of the date of the Sale in which they were purchased. (iii) The

Auctioneers reserve the right to sell entirely without reserve by auction at the next, or at any future Sale, any sold or unsold Lot which remains in the Sale ground for longer than this, unless they have received and accepted in their sole opinion a satisfactory explanation in writing from the Purchaser or Vendor as to why the Lot remains in the Sale ground.
