AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN AND ZONING MAPS OF JOSEPHINE COUNTY (ORDINANCES 81-1 1 AND 85-1, AS AMENDED), FROM FOREST TO RESIDENTIAL AND WOODLOT RESOURCE TO RURAL RESIDENTIAL 2.5 ACRE bllN1MUM FOR A PORTION OF PROPERTY IDENTIFIED AS ASSESSOR'S MAP T36, R6, SECTION 18, TAX LOT 1300, AND DECLARING AN EMERGENCY. THE OWNER IS MARTIN McMENNA.

'JVHERE~S, the Board of County Commissioners held a public hearing on November 10, ' 993 to consider a request for a comprehensive plan and zone change for the property &scribed above pursuant to criteria contained in the Josephine County Comprehensive Plan (Ordinance 81 -1 1 As Amended); and

WHEREAS, the Josephine County Planning Commission at a public hearing gave consideration to the above identified zone change request, and made a recommendation to the Board:

WHEREAS, the Board of Commissioners held a public hearing, heard testimony, received ev~dence from the Josephine County Staff, the applicant and other interested persons, and conciuded that the applicant met his burden of proof regarding a portion of the property, and the zone change for the described portion complied with the requirements of local and state regulations; and

\iVHER&%S, owner has requested an emergency ordinance because a 90 day delay may prevent completion of development in the 1994 construction season, which will cause financial loss to owner and employees and tradesmen who depend upon construction work;

NOW, THEREFORE, based on the foregoing, the Board of County Commissioners of Josephine County Oregon, hereby ordains as follows:

SECTION 1 : Emerqencv Declared:

A state of emergency exists because timing of the permit process and the construction season are such that an additional delay of 90 days could prevent completion of the project in the 1994 building season, which will impose a substantial hardship on applicant and employees and tradesmen who depend on work in the development.

The portion of the property to be rezoned is identified by the nap attached to this ordinance as Exhibit " A .

SECTION 3: Affirmation

Except as otherwise provided herein, Josephine County Ordinance No. 85-1 is hereby affirmed as originally adopted, and heretofore amended.

SECTION 4: Effective Date

The immediate passage of this ordinance is necessary in the.public interest and it shall take effect immediately upon its final enactment and adoption.

WHEREAS, the Board of Commissioners held a public hearing on September 1, 1993 to consider the request pursuant to certain criteria contained within the Josephine County Comprehensive Plan (Ordinance 81 -1 1 As Amended), and later convened on September 15, 1993, for decision only; and

WHEREAS, the Josephine County Planning Commission at a public hearing gave consideration to the above ident~fied Comprehensive Plan and Zone Change request, and made a favorable recommendation to the Board: and

WHEREAS, the Board of Commissioners held a public hearing, heard testimony, received evidence from the Josephine County Staff, the applicant and any remonstrators, and concluded that the applicant had met his burden of proof, and that the Comprehensive Plan and Zone Change, as requested did comply with the requirements of Josephine County and State Law pertaining to such matters,

NOW, THEREFORE, based on the foregoing, the Board of County Commissioners of Josephine County Oregon, does ordain as follows:

SECTION 1 : Comprehensive Plan Amendment

The Josephine County Comprehensive Plan is hereby amended from Forest to Residential for a portion of the property identified as Assessor's Map Township 35, Range 6, Section 8: Tax Lot 100. The area to be changed is attached as Exhibit "A".

SECTION 2: Zoninq Chanqe

The Josephine County Zoning Map is hereby amended from Wocclot Resource to Rural Residential (5 Acre Minimum) for a portion of the property identified as Assessor's Map Township 35, Range 6, Section 8, Tax Lot 100. The area to be changed is attached as Exhibit "A".

AN ORDINANCE ADOPTING THE JOSEPHINE COUNTY RURAL U N D DEVELOPMENT CODE, REPEALING ORDINANCE 90-4 - THE JOSEPHINE COUNTY LAND USE HEARING RULES AND ORDINANCE 85-1 AS AMENDED - THE RURAL ZONING ORDINANCE EXCEPT FOR SECTIONS 14.100(C), 15.237 TO 15.241, AND REPEALING THE APPLICATION OF THE FOLLOWING ORDINANCES TO THE RURAL AREA OF JOSEPHINE C O U N N : ORDINANCE 90-1 - THE JOSEPHllNE C O U N N SUBDIVISION ORDINANCE; AND ORDINANCE 90-8 - THE FLOOD HAZARD ORDINANCE.

WHEREAS, the Board of County Commissioners held a public hearing on March 2 . - 1994 to consider, the adoption of the Rural Land Development Code; and

WHEREAS, the Board of County Commissioners held workshops on the Rural Land Development Code on June 25 & 28, July 1, 12, 16, & 19, August 2, 5, 9, 16, 24 & 30, September 1 , I 0, 14 & 23, October 8 & 11, 1993, January 18 & 27, and February 28, 1994; and

WHEREAS, the Board of County Commissioners and the Rural Planning Commission held joint hearings on the Rural Land Development Code on February 8 & 25, March 8 & 29, and April 19, 1993; and

WHEREAS, the Board of County Commissioners and the Rural Planning Zomm~ssion held joint workshops on the Rural Land Development Code on January 4, ! 2, 18 & 25, February I, 3, 10 & 16, and April 5, 1993; and

WHEREAS, the Josephine County Rural Planning Commission at a public hearing cn May 10, 1993 and gave consideration to the Rural Land Development Code and made a recommendation of approval to the Board; and

WHEREAS, the Board of Commissioners held a public hearing, heard testimony, received evidence from the Josephine County Staff, and the general public, and cmcluded that the proposed Rural Land Development Code, as requested did comply with the requirements of State Law pertaining to such matters on September 14 & 15, October 13 & 20, November 3 & 24, and December 8, 1993.

7 ORDINANCE NO. 94 --

AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN OF JOSEPHINE COUNTY (ORDINANCE 81-11 AS AMENDED), FROM FOREST TO RESIDENTIAL AND AMENDING THE ZONING MAP OF JOSEPHINE COUNTY (ORDINANCE 85-1 AS AMENDED), FROM WOODLOT RESOURCE TO RURAL RESIDENTIAL (5 ACRE VIINIMUM) FOR THE PROPERTY IDENTIFIED IN THE JOSEPHINE COUNTY ASSESSOR'S RECORDS AS MAP T37, R6 , SECTION 4, TAX LOT 1001. THE PROPERTY OWNERS ARE DARRELL AND DIANE BUSHNELL. THIS ORDINANCE ALSO REPEALS THE FORMER ORDINANCE, NO. 94-6.

WHEREAS, the Board of Commissioners held a public hearing on January 12, 1994 to consider the request pursuant to certain criteria contained within the Josephine County Comprehensive Plan (Ordinance 81 -1 1 As Amended); and

WHEREAS, the Josephine County Planning Commission at a public hearing gave consideration to the above identified Comprehensive Plan and Zone Change request, and made a recom'mendation to the Board; and

WHEREAS, the Board of Commissioners held a public hearing, heard testimony, received evidence from the Josephine County Planning Staff, the applicant and any remonstrators, and concluded that the applicant met his burden of proof, and thdt the Comprehensive Plan and Zone Change as requested complies with the requirements of Josephine County and State Law pertaining to such matters, and

AND WHEREAS, the Board of Commissioners previously executed. findings and an ordinance (no. 94-6) amending the comprehensive plan and zoning map for the property, but the findings and the ordinance are in error in that they include all of tax lot 1001 when only a portion of the parcel was approved for the change, and

AND WHEREAS, the Board of Commissioners have corrected its findings to accurately reflect the portion of tax lot 1001 that was approved for the change, and further desire to repeal ordinance 94-6 and adopt this ordinance so that the plan and map changes accurately reflect the changes authorized by its amended findings herein;

NOW, THEREFORE, based on the foregoing, the Board of County Commissioners of Josephine County Oregon, does ordain as follows:

SECTION 1: Comprehensive Plan Amendment

The Josepiiine County Comprehensive Plan is hereby%mended from Forest to Residential for a portion of the property identified as Assessor's Map: Township 37, Range 6, Section 4, Tax Lot 1001. WHEREAS, the Board of Ccmmissioners previously held a public hearing on January 28, 1992 concerning the applicztion by owners for a comprehensive plan and zone change for the property described above, which action culminated in Findings and Decision dated March 10, 1993; and

WHEREAS, this decision was appealed by the Department of Land Conservation and Development to the Land Use Board of Appeals, which action resulted in a stipulated remand to the Josephine County Board of Commissioners for additional action; and

WHEREAS, the Board of Commissioners held public hearings (January 26, March 16 and 30, 1994) on the request to consider issues contained in the remand decision, at which time it heard testimony, received evidence from the Josephine County Planning Staff, the applicant and any remonstrators, and concluded that the applicant has met his burden of proof, and that the Comprehensive Plan and Zone Change as requested complies with the requirements of Josephine C~un ty and State Law pertaining to such matters,
