ORDINANCE NO. 2018-006

AN ORDINANCE AMENDING THE COUNTY CODE ( ORDINANCE NO. 2018-004) BY

CREATING CHAPTER 5. 30, REGULATION OF UTILITY RATES AND FEES

WHEREAS. Josephine County has provided for a new organization of its codesand ordinances that is pending adoption; and

WHEREAS, the Charter of Josephine County and state law provide the Countywith all the authority necessary to regulate its affairs, consistent with the Constitutionsand laws of the United States and the State of Oregon; and

WHEREAS, included in the County' s authority is the authority to regulate publicutilities within the County, including their provision of services and their rates and fees;and

WHEREAS, it appears that public utilities may attempt to install new types ofmeters to measure the use or consumption of electricity by individual rate- payingcustomers of the utility; and

WHEREAS, it appears that electric utilities may attempt to impose an additionalfee for those customers who opt not to accept the new meter types: and

WHEREAS, this issue is of particular concern for the citizens of Josephine

County and for their elected representatives; now, therefore,

The Board of County Commissioners of Josephine County ordains as follows:

SECTION 1. 00 TITLE

This ordinance shall be known as the Josephine County Utility Regulation Ordinance.

SECTION 2. 00 CODIFICATION

This ordinance shall be codified in the newly organized code as JCC 05. 30. 01, entitledProhibition of opt- out fees by utility provider."

SECTION 3. 00 PURPOSE AND INTENT

The purpose of this ordinance is to protect the citizens of Josephine County fromarbitrary and excessive fees imposed by the providers of electric utility services.

SECTION 4.00 DEFINITIONS

For the purposes of this ordinance;

A. Public Utility Commission means the Public Utility Commission of theState of Oregon.

B. Provider, utility or public utility mean an entity whose operation is regulated bythe Public Utility Commission and that is engaged in providing electricity orelectric service to rate- paying consumers, whether residential, commercial orindustrial.

C. Op- out fee means a fee, charge, assessment, or other monetary paymentrequired of a consumer by a utility when the consumer refuses or declines toaccept a new so- called " smart meter" installed to measure the consumer' s usage

of electricity.

SECTION 5. 00 AUTHORITY

The Board of Commissioners of Josephine County has authority to regulate matters ofcounty concern within the county, under the provisions of the Constitution of the State ofOregon, the statutes of the State of Oregon, and the Charter of Josephine County.

SECTION 6. 00 PROHIBITED ACTIONS

6. 01 No public utility, or any other entity whose operations are regulated by the PublicUtility Commission, shall assess, charge, require or collect any opt-out fee or anyother charge, fee or assessment of any kind based upon or related to the factthat a consumer of electric service refuses or declines to accept a " smart meter"

to measure the consumption of electricity.

6. 02 If the utility has installed a " smart meter" prior to the effective date of thisordinance and the consumer whose service is affected by that "smart meter"demands that the utility remove the meter, the utility must remove the " smartmeter" and replace it with a non- radio frequency meter within thirty ( 30) daysafter receiving the demand. The consumer shall have ninety (90) days after theeffective date of this ordinance to make the demand, in writing, to the utility.

6. 03 The utility must work to institute alternative reading or reporting methods forconsumers who request such services.

SECTION 7. 00 PENALTIES

Each violation of the terms or provisions of this ordinances is a Class A violation, the

fine for which is $ 2000. 00 for each such violation. Each assessment. charge, or fee is

a separate violation, even if assessed against a single consumer.

SECTION 8. 00 SEVERABILITY

In the event that any part or portion of this ordinance is found to be invalid orunenforceable, all remaining parts remain in full force and effect. The titles of sections

or subsections in this ordinance are provided for reference only and are not part of thisordinance nor an expression of intent.

SECTION 9. 00 EFFECTIVE DATE

First reading by the Board of County Commissioners this 17th day of October, 2018.

Second reading and adoption by the Board of County Commissioners at least thirteendays after the first reading this day of 2018. This Ordinance shall take

effect ninety (90) days after its adoption by the Board of County Commissioners.

Sheriff' s Auction of May 30, 2018

WHEREAS, Josephine County owns a certain parcel of land acquired by theCounty by foreclosure of delinquent tax liens, or otherwise, which parcel is described inExhibit 1, attached hereto and by this reference made a part hereof; and

WHEREAS, by Order No. 2018- 032, dated April 18, 2018, the Josephine CountyBoard of Commissioners, directed the Sheriff to sell the above-described property at apublic Sheriff's auction pursuant to ORS 275. 110 — 275. 160; and

WHEREAS, the above-described property remained unsold following the Sheriffssale held on May 30, 2018; and

WHEREAS, the Josephine County Board of Commissioners has determined thatit is in the best interest of the County to sell and convey the above- described property byprivate sale as authorized by ORS 275. 200; now, therefore,

IT IS HEREBY ORDERED as follows:

1. The county land parcel, described in Exhibit 1, shall be sold at private sale,without further notice, pursuant to ORS 275. 200, for the amounts and under the terms set

out in Exhibit 1.

2. Distribution of the proceeds of the sale shall be made as follows:

a. The County Finance Director is hereby directed to deduct from thegross proceeds the amounts authorized by ORS 275. 275( 1)( a),specifically, refund County Fund 40 the amount of 10% of the grossproceeds of the sale, for property management administrative costsincurred in the inventory, designation and sale of the property.

b. After the refund is made as authorized by ORS 275. 275( 1)( a), theCounty Treasurer shall credit proceeds from the sale to Fund 47,Property Reserve, for Parks Department.

3. Notice as to Municipal Claim: No Municipal claims were asserted.

4. Pursuant to ORS 275. 250, a copy of this Order shall be filed with the

Order No. 2018- 067

of qualified landowners of the land proposed to be annexed to the district, as required by ORS 198. 765.2) A written endorsement of approval by the District Board.3) A description of the land to be annexed to the district.

WHEREAS, following proper notice, the Board of County Commissioners having held a public hearing on thepetition pursuant to ORS 198. 857( 3), and having considered the criteria prescribed by ORS 198. 857( 4), FINDSthat the petition satisfies the requirements of ORS 198. 857 and declares its approval of the petition;

NOW, THEREFORE, IT IS HEREBY ORDERED that the Josephine County Board of Commissioners declaresthat the parcel of land, described in Exhibit 1 attached hereto and incorporated herein, is annexed to theILLINOIS VALLEY FIRE DISTRICT.

IT IS FURTHER ORDERED that in accordance with ORS 198. 780, duplicate copies of this order of district

annexation shall be filed with the Department of Revenue, the Secretary of State, the Josephine County Clerk,and the Josephine County Assessor within ten( 10) days of the date this Order is entered.
