CONTEMPT OF COURT: NON-IMPLEMENTATION OF COURT ORDERS

1. Please refer Kerala HC order dated 23 Jun 2010 in WP(C) 1925312010(5) and CoB MessageNo U5/5952912010 daled 291612010 (copy given overleaf) from DGP Kerala to all SPs.It is seen that while the hbove order of the court has been implemented expeditiously, no suchcompliance with an equally important order- holding bandhs illegal- issued much earlier is seencomplied with. Without doubt, the inconvenience caused to the public, including infringement on theirright to free movement and earn their livelihod, is even more vicious in the case of enforced bandhsthan road side meetings, lt is true that bandhs are now enforced in the name of hartals and hence therewas a doubt whether the court had held the term 'bandh' illegal or the activity perpetrated in the nameof bandh, illegal. I sought copies of the High Court and apex court orders on the issue, through my

application RTI/doh ker-court orders-appln-13053L dated 31 May 20L3, from the Public

lnformation Officer under the RTI Act, O/o The Secretary, Ministry of Home Affairs, Secretariate, '

Thiruvananthapuram-695001 and was shocked to find that they did not have copies of the orders! Theapplication got hansferred, under Sec 6(3) of the RTI Act to various departments within the sameministry and also to the PlO, High Court of Kerala! While the PlO, High Court informed me, vide letterNo PIO/240/201 3 dated 317 12013 that

from Home (M) Dept letter No 628371l't1212013/Home daled 21712013, I understand that evenprocessions on road(sides) have been 'restricted'following the high court orders, However, my searchfor the order$, daled 221312012, of the High Court in WP(C) 32428 and 32429 of 2012 were futile!

2. I am reproducing a few reports published in the local media a few days earlier. lt pertains to aprocession , through the busiest roads in Palakkad, held by Popular Democratic Front on 17 Feb2015.And, horror of horrors, the police not only had not prevented it but actually facilitated it by reroutingtraffic! l, for one, cannot imagine a worse form of contempt of court than such blatant disregard forcourt orders,

3. Will the honourable court do anything to ensure that its orders are complied with in letter andspirit without fail? Permit me to quote the National Commission to review the working of theConstitution, ln its report submitted in 2002, the judiciary-headed, judiciary-heavy commission hasstated that 'Judicial system has not been able to meet even the modest expectations of the society. ltsdelays and costs are frustrating, its processes slow and uncertain. People are pushed to seekrecourse to extra-legal methods for relief. Trial system both on the civil and criminal side has utterlybroken down.' Also, 'Thus we have arrived at a situation in the judicial administration where courts aredeemed to exist for judges and lawyers and not for the pt\lic seeking justice'.

As per this report the Traffic Police had imposed restrictions, from 3 pm onwards, in connection with

Popular Front rally on 1712115. The rally would start from Manjakkulam Junction and proceed through

Town Bus Stand, Sakunthala Junction, BOC-Pattikkara Road, Railway overbridge, Municpla Bus

Stand, GB Road, Sulthapet and end at Fort Maidan, Vehicles bringing participants should be parked at

Manjakkulam and Stadium bypass Road without causing problems for other vehicles.
