1.0 INTRODUCTION

1.1 Preamble

This Statement of Heritage Impact has been prepared to investigate the Proposed Reinstatement of the Existing Front Verandah at 22 Brooklyn Street, Strathfield South.

The subject site at 22 Brooklyn Street, Strathfield South:

Is listed under Strathfield Council Local Environmental Plan (LEP) 2012, Schedule 5 – Environmental Heritage – Heritage Item I221.

As such the property is subject to the heritage provisions contained in Part 5.10 Heritage Conservation of Strathfield Council Local Environmental Plan (LEP) 2012, referred to below as Strathfield LEP 2012. Before granting consent under this clause Council must take into consideration the effect of the proposed development on the heritage significance of the item. This report evaluates the likely impact of the proposed development on the heritage item. This Heritage Impact Statement has been prepared on behalf of the owner of the subject site. 1.2 Authorship

No historical archaeological investigation and land title search was carried out on the subject site.

2.0 Site Identification

The subject site at 22 Brooklyn Street, Strathfield South is located on the eastern side of the street. It has a frontage to Brooklyn Street of approximately 15 metres and a total land area of approximately 705 square metres (15m x 47m). It is identified by the NSW Department of Lands as Lot 12 Section 1 DP 440. (refer Figure 1).

2.1 Site Context: Brooklyn Strret

Brooklyn Street is a quiet centrally located residential area characterised by a tree lined landscape and a mix of predominately single storey housing styles, ranging from Inter – War period bungalows to late twentieth century infill dwellings. (refer Figure 2)

It is located within walking distance (approximately 150 metres) to the major arterial road (Hume Highway) and (approximately 400 metres) to Strathfield South Public School.

3.0 Proposed Development

I have examined Drawing No. A100 dated 7 June 2016 prepared by Sing Wong Design. It is proposed to Reinstate the Existing Front Verandah on the subject site:

Demolition - Verandah

Demolition of the existing concrete slab;

Demolition of the existing brick base walls;

Remove damaged and or broken tiles.

New Work – Verandah

New concrete strip footing;

Rebuild 230mm brick base walls;

New concrete slab on 230mm brick base walls;

Repair existing marble edging and provide new tiles to match the existing pattern and design;

Replace existing frieze and metal posts;

Paint metal posts to match existing colour. New Work – External (Minor)

New concrete dish drain to the northern side of the dwelling.

4.0 Heritage Management Framework The subject site at 22 Brooklyn Street is identified as a Heritage Item under Strathfield Council LEP 2012 Schedule 5 – Environmental Heritage – Heritage Item I221 (refer Figure 3).

4.1 Established Heritage Significance of the Heritage Item I221 “Temora” 22 Brooklyn Street, Strathfield South History:

“Temora” was built in 1891 for the Pilcher family, who operated the pilcher Bakery on Liverpool Road. Frederick Pilcher was the owner and occupant from 1891. It was later owner by Henry Chesterton Pilcher, baker and Mayor of Enfield (1903). The Pilcher family owned H.C. Pilcher Bakery, which traded for nearly 100 years at Enfield. Pilcher Street Enfield ios named for Henry pilcher. After Pilcher’s death in 1923, the property was acquired by Samuel Evans, dairyman.

Physical description:

“Temora” is a single storey brick Victorian Filigree style house. It has a steeply pitched hipped roof of corrugated steel and a bullnosed verandah, hipped at the ends. The verandah is supported on four fluted cast iron columns with decorative capitals, brackets and cast iron frieze. There are two brick chimneys each with a pair of terracotta chimney pots. The symmetrical façade has a front door a toplight and sidelights and is flanked by single timber-framed double-hung windows. The house has slate front steps with rendered risers flanked by splayed, rendered square posts (originally to support pot plants or statues).

Statement of Significance: “Temora” is a rare and substantially intact example of modest Victorian Filigree style house in the Strathfield district. “Temora” is important as a home of Henry Chesterton Pilcher for most of the early twentieth century. Pilcher’s family operated Pilcher’s Bakery at Enfield for many years and Pilcher was Mayor of Enfield in 1903.

5.0 Assessment of Heritage Impacts 5.1 Evaluation of Strathfield LEP 2012: The Strathfield LEP 2012 contains the following relevant heritage provisions applicable to the proposed development:

5.10 Heritage conservation

Note. Heritage items (if any) are listed and described in Schedule 5. Heritage conservation areas (if any) are shown on the Heritage Map as well as being described in Schedule 5.

(1) Objectives

The objectives of this clause are as follows:

(a) to conserve the environmental heritage of Strathfield,

(b) to conserve the heritage significance of heritage items and heritage conservation areas,

including associated fabric, settings and views,

(c) to conserve archaeological sites,

(d) to conserve Aboriginal objects and Aboriginal places of heritage significance.

Comment: Approval is being sought from Council to Reinstate the Existing Front Verandah at 22 Brooklyn Street, Strathfield South which is a Heritage Item (I221). This Statement of Heritage Impact will assist in the assessment of these matters. (2) Requirement for consent

Development consent is required for any of the following:

(a) demolishing or moving any of the following or altering the exterior of any of the

following (including, in the case of a building, making changes to its detail, fabric, finish or

appearance):

(i) a heritage item,

(ii) an Aboriginal object,

(iii) a building, work, relic or tree within a heritage conservation area,

(b) altering a heritage item that is a building by making structural changes to its interior or by

making changes to anything inside the item that is specified in Schedule 5 in relation to the

item,

(c) disturbing or excavating an archaeological site while knowing, or having reasonable

cause to suspect, that the disturbance or excavation will or is likely to result in a relic being

discovered, exposed, moved, damaged or destroyed,

(d) disturbing or excavating an Aboriginal place of heritage significance,

(e) erecting a building on land:

(i) on which a heritage item is located or that is within a heritage conservation area, or

(ii) on which an Aboriginal object is located or that is within an Aboriginal place of heritage

significance,

(f) subdividing land:

(i) on which a heritage item is located or that is within a heritage conservation area, or

(ii) on which an Aboriginal object is located or that is within an Aboriginal place of heritage

significance.

Comment: Approval is being sought from Council to Reinstate the Existing Front

Verandah at 22 Brooklyn Street, Strathfield South which is a Heritage Item (I221). This Statement of Heritage Impact will assist in the assessment of these matters.

(3) When consent not required

However, development consent under this clause is not required if:

(a) the applicant has notified the consent authority of the proposed development and the

consent authority has advised the applicant in writing before any work is carried out that it is

satisfied that the proposed development:

(i) is of a minor nature or is for the maintenance of the heritage item, Aboriginal object,

Aboriginal place of heritage significance or archaeological site or a building, work, relic, tree

or place within the heritage conservation area, and

(ii) would not adversely affect the heritage significance of the heritage item, Aboriginal

object, Aboriginal place, archaeological site or heritage conservation area, or

(b) the development is in a cemetery or burial ground and the proposed development:

(i) is the creation of a new grave or monument, or excavation or disturbance of land for the

purpose of conserving or repairing monuments or grave markers, and

(ii) would not cause disturbance to human remains, relics, Aboriginal objects in the form of

grave goods, or to an Aboriginal place of heritage significance, or

(c) the development is limited to the removal of a tree or other vegetation that the Council is

satisfied is a risk to human life or property, or

(d) the development is exempt development.

Comment: Not Applicable.

(4) Effect of proposed development on heritage significance

The consent authority must, before granting consent under this clause in respect of a heritage

item or heritage conservation area, consider the effect of the proposed development on the

heritage significance of the item or area concerned. This subclause applies regardless of

whether a heritage management document is prepared under subclause (5) or a heritage

conservation management plan is submitted under subclause (6).

Comment: This Statement of Heritage Impact will assist in the assessment of these matters.

(5) Heritage assessment

The consent authority may, before granting consent to any development:

(a) on land on which a heritage item is located, or

(b) on land that is within a heritage conservation area, or

(c) on land that is within the vicinity of land referred to in paragraph (a) or (b),

require a heritage management document to be prepared that assesses the extent to which the

carrying out of the proposed development would affect the heritage significance of the

heritage item or heritage conservation area concerned.

Comment: This Statement of Heritage Impact satisfies this requirement.

(6) Heritage conservation management plans

The consent authority may require, after considering the heritage significance of a heritage

item and the extent of change proposed to it, the submission of a heritage conservation

management plan before granting consent under this clause.

Comment: Not Applicable.

(7) Archaeological sites

The consent authority must, before granting consent under this clause to the carrying out of

development on an archaeological site (other than land listed on the State Heritage Register

or to which an interim heritage order under the Heritage Act 1977 applies):

(a) notify the Heritage Council of its intention to grant consent, and

(b) take into consideration any response received from the Heritage Council within 28 days

after the notice is sent.

Comment: Not Applicable.

(8) Aboriginal places of heritage significance

The consent authority must, before granting consent under this clause to the carrying out of

development in an Aboriginal place of heritage significance:

(a) consider the effect of the proposed development on the heritage significance of the place

and any Aboriginal object known or reasonably likely to be located at the place by means of

an adequate investigation and assessment (which may involve consideration of a heritage

impact statement), and

(b) notify the local Aboriginal communities, in writing or in such other manner as may be

appropriate, about the application and take into consideration any response received within

28 days after the notice is sent.

Comment: Not Applicable.

(9) Demolition of nominated State heritage items

The consent authority must, before granting consent under this clause for the demolition of a

nominated State heritage item:

(a) notify the Heritage Council about the application, and

(b) take into consideration any response received from the Heritage Council within 28 days

after the notice is sent.

Comment: Not Applicable.

(10) Conservation incentives

The consent authority may grant consent to development for any purpose of a building that is

a heritage item or of the land on which such a building is erected, or for any purpose on an

Aboriginal place of heritage significance, even though development for that purpose would

otherwise not be allowed by this Plan, if the consent authority is satisfied that:

(a) the conservation of the heritage item or Aboriginal place of heritage significance is

facilitated by the granting of consent, and

(b) the proposed development is in accordance with a heritage management document that

has been approved by the consent authority, and

(c) the consent to the proposed development would require that all necessary conservation

work identified in the heritage management document is carried out, and

(d) the proposed development would not adversely affect the heritage significance of the

heritage item, including its setting, or the heritage significance of the Aboriginal place of

heritage significance, and

(e) the proposed development would not have any significant adverse effect on the amenity

of the surrounding area.

Comment: Not Applicable.

5.2 Evaluation of Strathfield DC 2005: The Strathfield DCP 2005 contains the following relevant heritage provisions applicable to the proposed development: 1.11 Heritage and Conservation Heritage is an important feature of Strathfield’s built and natural environment providing the municipality with its distinct and unique qualities. It enhances the status of the Municipality as a high quality and desirable place. Heritage items and conservation areas in the Strathfield Municipality are identified in Schedule 9 and 10 of the Strathfield Planning Scheme Ordinance. Additional items and conservation areas (as indicated in draft Local Environmental Plan 105), will be listed upon the gazettal of draft LEP 105. Prior to granting development consent, Council is required to consider the extent of impact of proposed development affecting heritage items or conservation areas. Applicants must demonstrate to Council how the heritage significance of the item or conservation area will be affected and specify any measures proposed to minimize that impact.

Strathfield Council’s “Heritage Guidelines for Planning and Development in the Strathfield Municipality” should be referred for further information. Statements of heritage impact are best prepared by suitably qualified and experienced heritage consultants. For a list of qualified persons or organisations please refer to the Heritage Office website link available on Council’s website (www.strathfield.nsw.gov.au). Objectives A. To preserve and enhance the visual and environmental amenity of heritage items and heritage conservation areas within the municipality of Strathfield. B. Ensure all development affecting heritage items and conservation areas is designed to be compatible in setting, scale, setbacks, form, materials and character with the building and surrounding area. C. Ensure that development in the vicinity of a heritage item or conservation area does not have an adverse impact on the heritage significance or setting and that development is compatible in setting, scale, setbacks, form, materials and character with the item or conservation area. D. Conserve archaeological sites and places of Aboriginal significance. Controls 1. A statement of heritage impact is required for proposed development: a) Affecting a heritage item; b) Within a heritage conservation area; or c) In the vicinity of an item or heritage conservation area. 2. This statement must set out the heritage significance of the structure or place and assess the extent to which carrying out of proposed development would affect the significance of the heritage item or heritage conservation area concerned and outline measures to minimise any identified impact.

Comment: This Statement of Heritage Impact satisfies this requirement. 4 HERITAGE AND CONSERVATION 4 1 Controls Refer to Section 1.1 of the General Introduction to the Consolidated DCP in regards to objectives and controls. A Heritage Impact Statement must accompany any development application involving works associated with a heritage listed item or dwelling located within a Heritage Conservation zone.

Comment: This Statement of Heritage Impact satisfies this requirement.

5.3 Evaluation of NSW Heritage Office Criteria

The following assesses the impact on the heritage item under the criteria of the NSW Heritage Office.

Minor Partial Demolition

Criterion (a) – Is the demolition essential for the heritage item to function?

The existing front verandah has been adversely affected by settlement to the foundations of the brick base walls. This has resulted in significant cracking to the rendered brick base walls as well as broken tiles to the verandah floor and other associated damage which requires rectification works. In its current state the front verandah is in poor condition and the demolition is considered to be essential in order to reinstate the front verandah back to its original condition and moreover to ensure that it retains its aesthetic signifance.

Criterion (b) – Are important features of the item affected by the demolition (e.g. fireplaces in

buildings)?

The proposed demolition is contained specifically to the front verandah. The important features of the item are retained including the fireplaces as well as the front façade feature elements such as the front door with toplight and sidelights, double hung windows, stone threshold and stairs. Furthermore the front verandah will be reinstated with the marble edging repaired, broken tiles replaced (to match the original pattern and design) and the same with the frieze and cast iron posts.

Criterion (c) – Is the resolution to partially demolish sympathetic to the heritage significance of

the item?

The proposed demolition is sympathethic to the heritage significance of the item as the works reinstate the front verandah thereby retaining its aesthetic significance and positive contribution to the streetscape and locality.

Criterion (d) – If the partial demolition is a result of the condition of the fabric, is it certain

that the fabric cannot be repaired?

Due to the condition of the foundations, rendered brick base walls, concrete slab and broken tiles it is not practical or viable that they can be repaired.

6.0 Recommendation & Conclusion The Council should have no hesitation, from a heritage perspective, in approving this development application for the following reasons:

The heritage objectives under Strathfield Council LEP 2012 & DCP 2005 have been achieved with the proposed works to the existing front verandah being sympathetic to the heritage significance of the item. Moreover it is considered that the proposed works enhance and preserve the item thus allowing its aesthetic and historical significance to be appreciated by the owners and public;

The assessment of the impact on the heritage item under the criteria of the NSW Heritage Office demonstrates that the proposed works have merit and respects the heritage significance of the item.

On the strength of the foregoing, it is recommended that the proposed development be approved.
