1999 I brought rescued cats to BeingKind for intake and adoption. I paid for all veterinary fees, intake fee of $65 (see table below) and was allowed to screen and deliver cats. By 3/13/99 I was volunteering to clean cages. I was working as a Desktop Publishing Operator at Investment Banking firms in New York and eventually began typing out and composing an adoption manual for BeingKind. Marlene Kess, Director of BeingKind (soon to be KittyKind), asked me to do merge letters & labels as a volunteer. I was told to save all receipts for pet care so that I can claim it on taxes. Marlene Kess, would give me a letter for IRS.

I eventually served in a volunteer capacity as typist for Marlene Kess, creating database files, letters for taxes and donations, an adoption package which would later become the beginning of their website and labels as well as cage cards and other typing projects as needed.

At this point my cats were: Zoe; Echo: Honeybear; Katey; Thomas; Hamlet; Blackie; Sportshoes; Passover; Luciano; Placido; Mushie; Raven; Q and Willie.

By March 26, 1999 Marlene Kess, was asking for more of my time with volunteer work. I realized that boundaries needed to be set.

3/28/99: Left cage tags at Petco for BK. Orange & White Kitten/Cat eyes infected. One cat in another cage (Banjo) was terrified of the other cat. Madrid/Twig same thing: Twig is terrified but not moved to another cage.

My personal vet says Bronchitis is a symptom of allergies. Clorox cleanup is too strong for the cats at BeingKind.

Leo 1/8/00Intake: Was told to help stabilize him as he was diabetic. Told to give him 9U of insulin. Lucky vet was there and I insisted that the dosage was too high. It would have killed the cat, who only needed 1U.

Leo bit me through the palm of my hand. Cat is very upset. Marlene said to bring him back that they would euthanize him. I was shocked and later she laughed and said she was kidding – that she was not going to euthanize him.

Eventually Leo became a lovely cat but too sick with ear polyps and mouth cancer to just adopt out. Marlene said, “He’s your cat now.”

Told by Marlene Kess that she was a h-ousecat surrendered by owner. Has vaccs & is spayed.Told to isolate her. I called Marlene and told her I have no place to isolate the cat. She said to “put her in your closet.” I argued that the cat is meowing repetitively and I would not do that, I said I didn’t want her to die in my closet. Finally, was told to take her to your vet, we’ll reimburse you.

Per Mobile Vet cat has encephalitis and fever. It explains why she kept pressing her face into a towel: Pain. She was euthanized at 7:15 pmMarlene Kess, told my vet to “just give cat supportive care” because she could not locate (Board Member) who was the cat’s official caretaker.Awful event, Dr. Kaufman very angry over Kess protestations that cat should only be put on fluids and antibiotics. A Blizzard was expected later that night. No reimbursement. With exception of veterinarian everyone acting as if I did something wrong.

MARLENE KESS threw a fit. Called me up and said I was hateful. Has no place to put the cats. I told her I could no longer care for KK cats. Volunteer stealing from KK, bragging about it to me. 1/12/06: 8:30 a.m. spoke to Hilary on cell phone. Told her to try paying one bill at a time if necessary but to make an arrangement vs. just saying “we have no money”. Offered her the option of paying down via use of kk vet etc. She asked if I had copies of the bills. I repeated that I did – she has asked me this before. She asked if these were just KK cats and again, I repeated that they were.

5/1/06 Felt need to break off relations with KittyKind and Marlene. That will require me to drop off the cats I am burdened with due to intakes that were supposed to be temporary (one week) and have continued in my care for over many years.

Now (volunteer) is being evicted or inspected by Marshall. KittyKind wants to bring 2 cats to my apartment for one week. That has changed to “keep them and keep the adoption fee.”

Why was Celeste transferred from Hilary’s care to mine?

What about cats that I was told to bring to Petco and when not adopted was told I’d have to bring back to my apt?

Emily, Cathy and even (volunteer) have no trouble reaching Hilary on the cell phone and I can’t reach her and rarely get responses to messages left?!

There have been times when I wait 5 – 6 days after leaving numerous messages before I get a return call and then she is in traffic and I get cut off.

Bringing Dulsura, Celeste, Simone back to Petco would leave me with Paco, Tiger, Magellen, Daqueri, Ozzie, Sapphire, Princess Pumpkin, Monsi – then I still have 17 cats still with me.

5/4/06: Sabina not doing well. Vomiting, trouble using litterbox.

5/7/06: Hilary left message assuring me we could talk without interruptions. Discussed situation at Petco with (a volunteer who was removed from Board of Directors).

5/11/06 Marlene is already in Brooklyn. Says house hasn’t been sold yet. Living Rent Free with a KittyKind volunteer.

5/13/06: Went to Petco 3pm to clean kitten’s ears and (replaced Board Member) was there. She had a side cage and all kittens she had taken in past weekend had blue cages (I had been told KittyKind had no space).Called Hilary and told her I needed a side cage or blue cage next weekend for Beverly’s cats: She said we “need to talk” and would call me back.

5/19/06: Returned Beverly’s cats to Petco. Miriam began asking a lot of annoying questions. Ran into Elfie.

5/21/06: Volunteer with eviction notice called to say both cats that I returned were adopted.

5/26/06: Dulsura and Celeste to Petco. My carrier is still missing. Hilary called Petco while I was leaving and asked to speak to me. I told Judy I could not talk to her as I was “in a hurry” Got home to a Voice Mail from Hilary saying she had wanted to tell me not to leave cats at Petco due to lack of cages.

5/30/06: Was at Petco and was told that Dulsura had run out of the cage and was loose in the store.

6/1/06: Went to Petco to pick up a carrier. Voice mail not working?

6/2/06: Took Simone and Paco to Petco. Judy was there – no cages were set up. She said Hilary wanted me to call her. She said Hilary had tried calling me and that I could not leave any cats there. Left note for Hilary and cats at Petco.Sabina doing very poorly. Endstage?

6/6/06: I don’t have the heart to turn any more cats back over to KittyKind. I worry that they’ll turn them over to Marlene despite her conviction for animal abuse. Some of the remaining cats have end stage renal failure. Definitely won’t put cats through that stress.

6/9/06: Worried about Sabina. Handfed her. This is not normal for her.

6/10/06: Tiger is blocked and cannot urinate. All vets closed. Only thing I could do was to take him to AMC in Manhattan. He was admitted to the hospital.

6/12/06: Told to p/u Tiger and bring him home from AMC. Stopped by Dr. Jacobson and Sabina was euthanized. Cancer metastasized she had

more tumors and was extremely anemic.. $94.00

6/13/06: Called Hilary, I told her about Sabina and Tiger and the bills. She said KK doesn’t have that kind of $. I told her I don’t have it either but that AMC gave me a payment plan and I’d leave a copy for her.

She said I could bring Chester in and one other cat (Ozzie).

6/14/06: Phone message from Hilary to just bring one cat.My cat: Luciano blocked too.Took Chester to Petco – Dulsura is back in cage.My carrier finally turned up.Home: Picked up Luciano from Dr. Jacobson

6/16/06: Now Simba seems to be losing energy and is eating much less

6/19/06: Mailed letter to Hilary Composed letter to Marlene Simba very dehydrated.Dulsura ran out of cage again. I am told Elfie took her home.Was told that Hilary said, “Josie will have to take her back.”

6/20/06: Magda died: Cardiomyopathy and a blockage in her stomach.

6/21/06: Sent Letter to Marlene.

6/23/06: Sabina & Simba: Dr. Jacobson. Simba no longer needs insulin.Lulu and Ozzie to Petco. Comment made by someone at Petcothat if I fostered them for so long they were mine.No info on Chester.

6/24/06s: Simba test results. Creatinin levels should be .5 – 2.5 They are 5.23. Wastold by vet to just make her comfortable. Chester was back at Petco with dirty paws and dirty face.

6/27/06 (Volunteer) called me to get information on Lulu & Ozzie. Hilary not available to get or give information. I heard her voice in the background.

7/3/06: Advised Hilary I would be going to Civil court re: Money owed to me. I asked about how (volunteer), (volunteer)and others were repaid for money they paid to gets cats from NJACC. I understand (volunteer) paid $800 to recover cats for MARLENE KESS and (volunteer) Paid $600 to recover cats for MARLENE KESS. Per Hilary, (volunteer)has been reimbursed in full from Adoption money at Petco. (volunteer) has been reimbursed $500.

7/18/06: Simba died due to Kidney failure.

8/6/06: Hilary called Wayne and he called me. It turns out Wayne’s friend Richie bought Tiger to KK and paid an intake fee of $200.

8/24/06: called Hilary. -left vm 8/17/06 re donation letter promised in July. IRS advised me to contact Attorney General and to hire attorney for 2004 money owed to me.

8/31/06: called Hilary re AMC bill going into collection.

9/1/06: Called Hilary re: current AMC bill. Left Message.

9/8/06: Case of Urinary SO from vet.

9/24/06: Left message with Hilary re: AMC bill and $20,000 owed to me.

10/11/06: Received Final Notice from AMC. Left Message on Hilary’s cell phone. Per Hilary they have an extension until November 1st. $754.80.

11/10/06 Incoming call: (volunteer). KK owes her $700 out of pocket for medical bill.

11/16/05 Incoming call: Marlene Kess– wants to meet me to repay $3,000 owed to me.

12/12/06: Received another final notice from AMC. Spoke to Hilary 12/15/06, Bal. $377.40.

12/15/06 Hilary offered to exchange Monsi for Lulu. Monsi to see KittyKind vet for Teeth cleaning first. KK to pay vet. Says will pay AMC balance.

12/28/06: 2 Cases Urinary SO $61.00

12/31/06: Received bill from AMC. Balance still not paid.

3/10/07 Left VM for Hilary re Sapphire’s health problem and I don’t have email.

3/10/07 (volunteer) called on Hilary’s behalf. Hilary wants to know what I need for Sapphire. I actually had called about Tiger’s needs and she thought I was calling about my past message about Sapphire. Finally, picked up phone and I told her I’m not calling about Tiger but about Sapphire. Sapphire to vet, FIP, euthanized.
