    edition of the International Residential Code is published. Part IV-Energy Conservation of the latest edition of the InternationalResidential Code is hereby amended to require that supply andreturn ducts be insulated to a minimum of R-6. Furthermore, IRCR301.2.1.1 (Design Criteria) shall be amended as follows and shallonly apply to the International Residential Code:

    i. amendment of R301.2.1.1 (Design Criteria);

    ii. item 6, the American Concrete Institute, Guide to Concrete Masonry Residential

    Construction in High Winds Areas, shall be added;

    iii.item 7, Institute for Business and Home Safety, Optional Code-plus Fortified for

    Safer Living, shall be added;

    iv. item 8, Federal Alliance for Safe Homes, Optional Code-plus Blueprint for Safety,

    shall be added.

    b. Additionally, Section 302, R302.1 Exterior Walls shall be amended

    to add the following exception:i. On lots that are 50 feet or less in width and that contain a one or two family dwelling

    or townhouse that was in existence prior to October 1, 2005, the following arepermitted for rebuilding:

    (a). a projection 2 feet from the property line with a 1 hour minimum fire-resistance

    rating on the underside.

    (b). a wall 3 feet or more from the property with a 0 hour minimum fire-resistance

    rating.

    4. International Mechanical Code, 2006 Edition, and the standardsreferenced in that code for regulation of construction within thisstate. Also included for regulation, the Louisiana One- and Two-Family Supplement to the 2006 International Mechanical Code.Furthermore, the International Mechanical Code, 2006 Edition,Chapter 1, Section 101.2 Scope is amended as follows: Exception:Detached one- and two- family dwellings and multiple single-familydwellings (townhouses) not more than three stories high withseparate means of egress and their accessory structures shallcomply with the Louisiana One- and Two- Family Supplement to the

    2006 International Mechanical Code.5. The Louisiana State Plumbing Code [Part XIV (Plumbing) of theState Sanitary Code] as amended by the state health officer actingthrough the Office of Public Health of the Department of Health andHospitals. Nothing in this Part shall be construed so as to preventthe state health officer from enforcing Part XIV (Plumbing) of the

    State Sanitary Code, the enforcement of which is his statutory andregulatory responsibility.

    6. International Fuel Gas Code, 2006 Edition, and the standardsreferenced in that code for regulation of construction within thisstate.

    7. National Electrical Code, 2005 Edition.

    2. Q. Can a jurisdiction adopt the administrative chapters of thecodes referenced above, even though the state did not adoptthe administrative chapters ?

    A. Yes, jurisdictions can adopt the administrative chapters ofInternational Building Code, 2006 Edition, International ExistingBuilding Code, 2006 Edition, and the International Residential

    Code, 2006 Edition. A local government can also adopt anordinance for the local administration of the state uniformconstruction code or for any procedures in connection with thelocal enforcement of the state uniform construction code (RS40:1730.40).

    3. Q. Can a jurisdiction amend the state uniform constructioncode?

    A. No, jurisdictions cannot amend the state uniform

    construction code,with the exception of the Louisiana StatePlumbing Code (RS 40:1730.40).

    4. Q. Can a jurisdiction enforce any local ordinances that wereadopted and in effect prior to the adoption of ACT 12, thatwould amend the Louisiana State Uniform ConstructionCode?

    A. No, any amendments to the building codes prior to ACT 12 of the

    extraordinary session of the 2005 Legislature establishing theLouisiana State Uniform construction Code are no longerenforceable, with the exception of the Louisiana StatePlumbingCode. All future amendments shall be approved by the LSUCCCand shall be binding upon all local jurisdictions (RS 40:1720.22; RS40:1730.23; RS 40:1370.28; RS 40:1730.40).

    5. Q. Can a jurisdiction prohibit commercial and residentialcontractors or homeowners from using certified third-partyproviders ?

    A. No, jurisdictions cannot prohibit commercial and residential

    contractors or homeowners from using certified third-partyproviders (RS 40:1730.24).

    6. Q. Does a jurisdiction have the authority to reject a plan review orinspection conducted by a third party provider?

    A. Yes, if a jurisdiction can show that a third-party provider plan reviewor inspection does not meet code requirements. The jurisdictioncan require a re-review or re-inspection, along with re-submissionof the documents.

    7. Q. Who needs a certificate of registration?

    A. Any person who practices as a local government Building CodeEnforcement Officer (BECO) or any Third- Party Provider (TPP)acting as a Building Code Enforcement Officer, or Wind MitigationSurveyor in the State of Louisiana (RS 40:1730.36).

    8. Q. What are the qualification requirements to become a Third

    Party Provider?

    A. An individual wanting to register as a Third Party Provider must beone of the following:

    Louisiana Licensed Architect

    Louisiana Licensed Engineer

    ICC Certified Master Code Professional

    ICC Certified Building Official

    ICC Certified Plans Examiner

    ICC Certified Inspector
