Free Patent
Free Pat ent Qual ifications
An y Filipino cit izen who is an ac tu al occupant of a r esiden tia l land m ay apply for a Free Patent
Title under th is Act, prov ided th at in hig hly ur banized cities th e land should not exceed tw o
hu ndred (200) square m eters; in oth er cities it should not exceed fiv e hun dred (500) squar e
m eters; in first class and second class mun icipalities it should not exceed sev en hu ndred fifty (7 50)squar e meters; and in all other m unicipal ities it should not exceed one thousand (1 000) square
m eters; prov ided furt her, th at t he lan d applied for is not needed for public serv ice and/or public
use.
Coverage
This Act shall cov er all lan ds tha t ar e zoned as residential a reas, including town sites as defined
un der th e Public Land A ct; Provided, Tha t n one of the prov isions of Presidential Decree No. 7 05
shall be v iolat ed. Zoned residential ar eas locat ed inside a delisted milit ar y reserv ation or
abandoned m ilitar y cam p, and those of local gov ernm ent un its or town sites wh ich preceded
Republic Act No. 7 586 or the NIPAS Law, shall a lso be cov ered by t his Act.
A pplicati on
The application on the land applied for shall be support ed by a m ap based on an a ctu al surv ey
conducted by a licensed geodetic engineer and approved by the Department of Environment and
Nat ur al Resour ces (DENR) and a t echnica l description of the la nd applied for together w ith
support ing a ffidav it of tw o (2) disinterested persons who are residing in th e baran gay of th e city or
mu nicipality where th e land is located, attesting t o the truth of the facts contained in the
application t o the effect th at the applicant th ereof has, either by him self or t hrough his
predecessor-in-inter est, actu ally resided on and c ontin uously possessed an d occupied, u nder a bona
fide claim of acquisition of ownership, th e subject lan d for a t least ten (1 0) y ears and ha s com plied
with the requ ir em ents prescr ibed in Section 1 hereof.
Special Patents
Notwithstanding a ny prov ision of law to the contra ry and subject to priv ate righ ts, if any , public
land act ua lly occupied and used for public schools, mu nicipal ha lls, public plazas or parks and
other gov ernm ent institu tions for public u se or purpose ma y be issued special patent s under thenam e of the nat ional a gency or local governm ent un it concerned; Provided, Tha t all lands titled
un der th is section shall n ot be disposed of un less sanct ioned by Congr ess if own ed by the nat ional
agency , or sanctioned by the sanggu nian concerned through an approv ed ordinance if owned by
the local gov ernment u nit.
Removal of Restrictions
The r estr ictions rega rding en cum bran ces, conv ey ances, tr ansfers or dispositions im posed in
Sections 1 1 8, 1 1 9, 1 21 , 1 22 , and 12 3 of Chapter XIII, Title VI of Comm onwealth A ct No. 1 41 , as
am ended, shall not apply to paten ts issued un der this Act.
Period for Applicati on
Al l a pplica tions shal l be filed im m edia tely aft er the effect iv it y of th is Act before the Com m unity
Env ironmen t N atu ral Resour ces Office (CENRO) of the DENR. The CENRO is mandat ed to process
the application with in one hundred and twenty (1 20) day s to include compliance with the
required notices and other legal requirements, and forward his recommendation to the Provincial
Env ironmen t Na tu ral Resources Office (PENRO), wh o shal l ha v e five (5) day s to approve or
disapprove t he patent . In case of approv al, pat ent shall be issued; in case of conflicting claim s
am ong different cla im ant s, th e par ties ma y seek the proper judicial rem edies.
Implementing Rules and Regulat ions
The Director of the Land Managem ent Bur eau of the DENR shall promu lgat e rules and regula tions
to carr y out the prov isions of this Act, a nd shall see to it tha t such a re gender r esponsiv e.
Repeali ng Clause
Al l law s, dec rees, execu tiv e orders, ex ecu tiv e issuances or l etters of inst ruct ion, rules a nd

regu lat ions, or any part t hereof, inconsistent with or contra ry to the prov isions of this Act, a rehereby deemed repealed, am ended or m odified accordingly .
Separability Clause
If, for a ny reason or reasons, an y part or parts of th is Act shall be declared unconstitut ional or
inv alid by any competent court, other parts or prov isions thereof not affected thereby shall
continue t o be in full force a nd effect.
Effectiv ity Clause
This Act shall t ake effect fifteen (15 ) day s after its publicat ion in t wo (2) nat ional n ewspapers ofgeneral circulat ion.
