Dear Mr. Lynn,

I am writing in resppnse to your undated letter'that wasreceived in the Committee office on June 2, 1980.

I am very concerned about allegations contained in the affi-davits from the Long Beach patients that were attached to yourletter. I sent each of the affidavits to the Director at theLong Beach ~~~C for his Tesponse. I have also forwarded yourletter to the VA's Chief Medical Director (copy of my letterenclosed) and asked him to review the matter as'well. OnceI have heard back from each of them, I will be back in touchwith you.

Although I would hope my position on this issue is obvious,I want to state that I am totally opposed to any veteran suffer- '

ing mistreatment while receiving VA care because of his or herexpression of grievances relating to that care, and I am committedto taking whatever steps might be necessary to preclude any suchoccurrences at Long Beach VAMCor elsewhere in the VA health-caresystem.

With regard to the patient re?resentative position that will beestablished at Long Beach, Committee staff have again been in-formed unequivocally by management at Long Beach that the personwho will fill this position will respond to all patient complaints,not just to those from outpatients. I regret that there seems tohave been some misunderstanding on this matter. I would also notethat it is my view, which I believe is shared by the Center'smanagement, that more than one such patient representative posi-tion san be justified in a facility'the size of Long Beach and,once some experience is gained with the initial position andappropriate resources can be identified, further patient repre-sentative positions will be established.

I regret that you are apparently dissatisfied with my effortson behalf of your Committee's pursuit of space at Long BeachVA Medical Center. I am not in a positi9n to dictate to afacility director how he or she should assign space in thefacility, nor do I believe I should be in such a position.What I can do, and what I did in your situation, is urge thata request for space at a particular facility receive full,appropriate, and timely consideration by the VA. It is myunderstanding that a decision was made in your case that, be-cause the only statutory authority for the VA to provide space,section 3402(a)(2) of title 38, United States Code, is limitedto providing space to "paid full-time representatives of nationalorganizations [recognized by the VA Administrator] '.', a descrip-tion that does not apply to your Committee, the VA was unableto grant your request. .I understand further, however, that theLong Beach management has granted you access to a space for aperiod of time each weeK during which time you tan meet withpatients. I hope.that this solution, although less than yousought, together with the establishment of a formal patientrepresentative position, will help assure that mechanisms existat Long Beach VAMC that will provide veteran patients withaccess to individuals who they feel will help address concernsthey may have in connection with their care at that facility.

Thank you for writing and bringing the concerns of'the four.patients to my attention. I appreciate your dedication to thewell-being of veterans.
