    A RESOLUTION PROVIDING THE LEAGUE OF COLLEGE COUNCILS UP DILIMANSSUPPORT AGAINST THE UNFAIR LABOR PRACTICES OF PLDT-DIGITEL

    CONTEXT: That on January 21, 2013, the Supreme Court issued with finality its decisionregarding the almost twenty-year long case filed by the Digitel Employees Union. The Decisionaffirmed DEUs right to collectively bargain, as previously acknowledged by the DOLE Secretaryand the National Labor Relations Commissions 2006 directive. The Decision by the highestcourt of the land confirmed the obligation of PLDT-Digitel to commence CBA negotiations withthe DEU, the right of the DEU employees to be reinstated with full back pay and the finding thatDigitel was guilty of Unfair Labor Practice. The Decision also upheld that the contractualizationDigitel organized in the form of Digiserv, eventually resulting to the termination of 100employees, was illegal and was done in bad faith. The termination of 100 women employeesafter the Assumption of Jurisdiction was declared contemptuous. The Supreme Court findingsalso state that PLDT-Digitel should award each of the illegally dismissed union member-employees the amount of P10,000.00 and P5,000.00 as moral and exemplary damages,respectively.WHEREAS, the League of College Councils establishes its support against the practice ofcontractualization and its affirmation of the right of the Digitel Employees Union to security oftenure. The LCC affirms the Supreme Court Ruling that Digitels action to form Digiserv wasillegal on the grounds that it was a labor-only contractor, a set-up expressly prohibited by law.

    WHEREAS, the League of College Councils upholds the obligation of PLDT-Digitel to commenceCollective Bargaining Agreement negotiations with the Digitel Employees Union as stated in theSC Ruling. Furthermore, this was strengthened by DOLEs resolution stating that the pendencyof a petition for cancellation of union registration does not preclude collective bargaining.

    WHEREAS, the League of College of Councils calls for the immediate acknowledgment byPLDT/Digitel of its duties to its employees as stated in the Supreme Court Decision. As PLDT-Digitel, the countrys market share leader in the telecommunications industry, the companymust resolutely take the lead in ensuring fair labor practices in its organization and move tocomply with the Ruling issued upon it by the highest court of the land. As students of thepremiere state university in the Philippines, the LCC believes that issues such as labordisputes are vital to our understanding as future members of the countrys labor force. Suchunjust and unethical practices will never be acceptable, thus our resolution to unite with themembers of the DEU in their struggle against contractualization and for their right to tenure,right to organize and right to collectively bargain.
