Course Description This course evaluates research on how legal environments in the global economy shape decision-making and the ethical issues that emerge from disparate legal systems and practices. The course will specifically address practices legal in a subsidiary country but in violation of the corporation's ethical standards. Purpose and Approach The purpose of this course is not to teach law, but to explore and gain an understanding of the process by which ethical leadership shapes business decision making and influences the business environment. Learners will examine the ways in which business decision making is impacted by cross-cultural factors, legal implications, and the strategic goals of the organization. The course flows from a theoretical foundation of the business ethics environment to an understanding of ethics decision making within the global and legal context. Course Changes Assignments in this document take priority. While the reading assignments and learning objectives remain the same as indicated on the rEsource page, some of the assignments in this syllabus have been customized for this particular course. Attendance in Online Courses

A learner will be considered in attendance for a given week of online instruction if he or she posts at least once in any forum on two different days during the online week of Tuesday through Monday. Deadlines for attendance are based on Mountain Standard Time. Working privately with me via email does not count toward the attendance required by the University. Any learner who fails to make these weekly postings will be required to withdraw from the course without a grade and will subsequently be required to retake the course in directed study format. The Online Campus processes these withdrawals automatically. There is a maximum of three directed studies allowed for a student during the entire program. Directed studies are not an entirely favorable substitute for online classes, as learners miss the valuable interaction of their cohort members. Participation for Online Courses Learners are expected to participate, on at least 5 days out of each 7-day week, in several conference discussions relating to the subject matter for the week. This is a required part of your grade. Participation consists of notes you send above and beyond graded assignments. This generally means the messages you send as replies to messages from your classmates and me. Participation will be counted only in the Main forum. Messages posted in the Assignments, Chat Room, or in the Learning Team forums will not count towards your class participation score. In the Main forum, I will post “Questions for Class Discussion”. Please review, respond and discuss other’s responses to these questions as they are an important component of participation. Please note that both quantity and quality are important considerations when it comes to participation. A message that says simply, "I agree," for example, would not constitute participation because it does not add anything of substance to the discussion. In order to earn full participation points, you must add something of substance to the discussion 5 out of 7 days per week—this would consist of new ideas, your perspectives, pointed follow-up questions, etc. Expectations for Discussion Question Responses and Weekly Summaries Discussion question responses should be at least 200-300 words. In residency and online classes, learners subdivide their groups into Learning Teams. The Learning Team is a cooperative team of 3 to 5 learners who work together to accomplish course team projects. In each online class, learners form new Learning Teams, and as such, Learning Teams may or may not include people who have previously been teamed together. Learning Teams are a vital part of the learning environment at University of Phoenix. Just as groups change in professional work environments, Learning Teams will change at various times throughout the program. The School of Advanced Studies strives to facilitate the opportunity for learners to practice collaborative skills with many members of their cohort along their doctoral journey. University of Phoenix Grading Guidelines Any learner who does not maintain a minimum grade point average (GPA) of 3.0 will be placed on academic probation, as the learner must meet minimum academic standards to earn his or her degree. Academic probation will last for three consecutive courses, during which time the learner must raise his or her GPA to a minimum of 3.0 and earn a grade of B or better in each course. Any learner who earns a course grade of C+ or lower must repeat that course. A learner repeating the course who is not on academic probation must earn a grade of B- or better. Standards for Written Work Depth of Scholarship Assignments should represent the learner’s careful, thoughtful efforts to cover the key elements of the topic thoroughly. Content should go beyond mere description or paraphrasing. The work should be thematic and based on an analytical framework of the learner’s choosing. Originality of Ideas and Research All assignments must demonstrate a unique, creative approach to the problem being studied and represent the original work of the learner. Theoretical and Conceptual Framework Assignments should display the learner’s understanding of the theories and concepts relevant to the topic. Learners should form their arguments by taking competing concepts and theories into account. Use of Literature Assignments should be grounded in appropriate, adequate, and timely academic literature. Although learners are not required to participate in online discussion during the first 2 weeks of class, the University’s online attendance policy will be enforced. For clarification, the policy is stated below. In order to be in attendance during a week, learners must post at least one message to one of the course forums on 2 separate days. If a learner is not in attendance for 2 or more weeks for a course that is 5 or more weeks in length, he or she will be automatically withdrawn and will not be eligible to receive credit or earn a letter grade. Individual: Each learner will research and select a recent (2001 or later) United States Supreme Court case dealing with a business ethics issue. You will use this case for a Week Three individual assignment. Learning Team: New Theory Proposal: Global Business Ethics (Used for Weeks Three, Four, and Seven Learning Team assignments) The Learning Team project requires that the team synthesize the key concepts addressed in this course, insights learned from previous courses, and observations of current issues in the global business-ethics legal landscape into a comprehensive, doctoral-level development of a proposed new theory. The new theory must be based on an observation of activities in the global business-ethics legal landscape. Learning Teams are asked to draw on insights learned in previous classes and taxonomies developed in their first-year coursework (e.g. leadership journal, transformational leadership, finance, marketing, organizational behavior, and e-business strategy). These insights will establish a theme for the project and help in the development of research questions and proposed variables of a new theory.

Learning Teams are allowed to select the observation/issue(s). Teams will report their selections for my approval in Week Three. The objective of the global business-ethics theory development is to analyze and identify possible ethical-issues and/or legal related factors affecting the turbulence and trends in the global business environment. For example, a theory may be developed about organizational behavior variables in relationship to German legal practices and European Economic Community treaty regulations on employment, social affairs and citizenship. Learning Teams are asked to identify and research a major global business-ethics observation. Observations include processes, conflicts, or situations which need improvement and/or interpretation. The observations may be expressed as a conceptual problem, action problem, or a value problem (Merriam, 1997). For more information on problem statements, please see the Types of Problem Statements section in the Doctor of Business Administration Research Handbook. Develop a research question(s) and hypothesis(es) related to the observation. Identify 1 to 2 variables for research that may yield insight on the understanding of the research question(s). Please note that no data will be collected for this assignment. Conduct and write a brief literature review of these variables. Include a balanced discussion of differing viewpoints in the literature review, supported with studies. Based on the team’s observation and analysis of the literature, develop a new theory and recommended hypothesis(es) for future studies to test. The final report will follow a general dissertation Chapters 1, 2, and 3 format followed by a conclusion section. The specific analytical elements are listed in the following descriptions of individual deliverables. For additional information regarding dissertations, consult the Doctor of Business Administration Research Handbook. 4. Implications and Conclusions: Each week, learners must create a brief statement of how the week’s learning has affected their thought process. Individual (Due Day 7, Monday): Business Ethics Theories Taxonomy – Approximately 1200-1500 words Submit a taxonomy of 10 business ethics theories that integrates germinal and current research. Use appropriate supporting references and citations. Categorize the taxonomy with headings that address the general description of the theories, criticisms of the theories, current examples of the theories, and all other attributes you find significant. This taxonomy should be comprehensive enough to serve as reference for the individual and Learning Team assignments in this course. Taxonomies will be evaluated for completeness, adherence to APA standards for writing, formatting, citations/references and applicability. When preparing the Taxonomy paper, please adhere to the following guidelines: - Identify EXACTLY 10 ethical theories. There are so many to choose from that it is simply more effective if you focus on the 10 that you find most credible and/or interesting. - Prepare the paper as a normal, APA style research paper. Include an abstract. Each of the 10 ethical theories should be its own section. - For each of the theories, its section of the paper should include the following components: 1. A heading that identifies the name of the theory,

2. A paragraph that describes the theory, along with the source of the theory (this part should include appropriate citations to where you obtained your information), 3. A paragraph that provides an example, real or hypothetical, of the ethical theory in action in a business scenario, 4. A paragraph that offers a scholarly critique of the theory, and, 5. A list of references in proper APA format. Again, this should be done in a standard APA paper style and not as a grid, matrix or table. Submit your taxonomy to the class’s main forum, and observe the other cohort members’ submissions in order to expand your taxonomy to include any perspectives (cultural, socio-cultural, racial, religious, etc.) you may not have considered. The combined effort should serve as a comparative review of global and domestic business ethics and legal theories. This taxonomy can be used to complete future assignments and to prepare for the Collaborative Case Study in Year Three of the program. Your consideration may include, but should not be limited to, the following theories and general theorists: Theories: Utilitarianism, Deontology, Teleology (e.g. consequentialism, aertaic), Intuitionism, Virtue Ethics, Rights and Justice, Social Contract; and the concepts of metaethics, descriptive ethics, normative ethics, and applied ethics. Germinal and contemporary theorists and thinkers: Aristotle, Thomas Hobbes, John Locke, Jean Jacques Rousseau, Immanuel Kant, John Steward Mill, Lawrence Kohlberg, John Rawls, Robert Nozick, Alan Gewirth, Derrick Bell, Sandra Day O’Connor, Tim Hatcher, Scott Reynolds, William Rehnquist, and Thurgood Marshall (information on many Supreme Court justices can be found on the following Web site: www.michaelariens.com/conlaw/justices/list.htm b. Supreme Court Case Assignment (Due Day 7, Monday) Please use the following format in preparing the analysis of your Supreme Court Case.

In a forum message, posted in the Main forum, identify the following:

1. Name of the case: 2. Date of the case:

3. A brief summary of the issue the court decided. The "issue" is typically stated something like this: "Whether money deposited into an I.R.A. account is exempt from creditors during a bankruptcy proceed." Or, "Whether the due process and

First Amendment rights of a comatose patient are violated by removal of a feeding tube when there are conflicting opinions as to the patient's wishes." Or "Whether the police must inform suspects that have been arrested of their Constitutional rights to an counsel, to not be a witness against themselves, and that the government must provide counsel if the suspect cannot afford it." 4. The court's answer, known in legal-eze as "the holding." The holding is simply an answer to the question asked in the "issue." For example, "Money deposited into an I.R.A. account is exempt from creditors during a bankruptcy proceeding." Or, "The due process and First Amendment rights of a comatose patient are not violated by removal . . . " Note that in the answer you do not provide any analysis or explanation. That comes later. 5. A brief summary of just the relevant facts. This should be 100-200 words at most. Relevant facts are those that the court actually considered in making its decision. It does not include all the background information leading up to the present situation. For example: "The plaintiffs, Mr. & Mrs. Gomez, had contributed regularly to an I.R.A. account. They also have money in their regular checking and banking account. The Gomez family fell on hard times and ultimately filed for bankruptcy. The creditors attempted to include the money in their I.R.A. as assets that would be used to satisfy their claims. The lower court agreed that is was not protected under bankruptcy law because it was not a "pension" or similar type of account that was specifically tied to a person's age. The Gomez's claimed that I.R.A. accounts are tied to age because although you can withdraw your money at any time, doing so prior to reaching the prescribed age carries with it a substantial penalty. This assignment counts as participation. Please discuss each others responses. 6. Rationale, ethical background, and business discipline. Here, you provide the meat of your response. Explain why the Supreme Court decided as it did. What ethical framework seems to underlie their decision? What business discipline seems to be involved in this case? How might this ethical framework affect other aspects of a business discipline and decision? c. Learning Team (Due Day 5, Saturday): Submit the Learning Team’s choice of a current case, drawn from the cases researched in Weeks One and Two for my approval. Additionally, identify the ethical theory that appears to be at issue and the business discipline (HR, marketing, finance, etc.) involved in the case. 7. Discussion Questions (Due Day 4, Friday):

Learners must formulate a response to the Discussion Questions posted by me, referencing supporting literature wherever appropriate. Learners should continue to discuss each other’s responses throughout the course week. 8. Implications and Conclusions (Due Day 7, Monday): Each week, learners must create a brief statement of how the week’s learning has affected their thought process. The new theory must be based on an observation of activities in the global business-ethics legal landscape. Learning Teams are asked to draw on insights learned in previous classes and taxonomies developed in their Year One classes (e.g. leadership journal, transformational leadership, finance, marketing, organizational behavior, and e-business strategy). These insights will establish a theme for the project and help in the development of research questions and proposed variables of a new theory. The objective of the global business-ethics theory development is to analyze and identify possible ethical-issues and/or legal related factors affecting the turbulence and trends in the global business environment and economy.
