17 Section 1. Findings.

18 A. lbere are five vacancies for Navajo Nation District Court Judge.

19 B. The Law and Order Committee, in accordance with statutory requirements of2 N.N.C.

20 §601, has completed its screening process for applicants for these vacant positions.

21 C. Pursuant to 2 N.N.C. §601(B)(7) and 7 N.N.C. §355(A), the Law and Order Committee

22 determines the qualifications for all applicants for judicial appointment, including

23 positions for District Court Judges and Justices of the Supreme Court. The names of

24 those deemed qualified are forwarded to the President of the Navajo Nation for

25 appointment. The Navajo Nation Council confirms all judicial appointments. Pursuant

26 to 7 N.N.C. §355(B), those confirmed by the Navajo Nation Council must serve a two­

27 year probationary term. Thereafter, permanent judicial appointments are subject to a

28 determination of satisfactory completion of probation term by the Law and Order

29 Committee of the Navajo Nation Council, permanent appointment by the President of the

Section 2. Recommendation for appointment.

The Law and Order Committee of the Navajo Nation Council, pursuant to 2 N.N.C.

§601(B)(7) and 7 N.N.C. §355(A), hereby submits to the President of the Navajo Nation, Ms.

Victoria Yazzie for consideration for appointment to fill a current vacation position for Navajo

Nation District Court Judge, subject to confinnation by the Navajo Nation Council.

Section 3. Directive.

The Office of Legislative Services shall immediately submit all documents provided by

Ms. Victoria Yazzie to the Office of the President, Navajo Nation. Such documents contain

confidential infonnation and accordingly shall remain confidential unless the applicant consents

to its public disclosure.

This is a letter of recommendation for Ms. Victoria R. Yazzie. Victoria is a person with good moral character and displays good judgment.

I would highly recommend Victoria for any employment position she is seeking. Victoria is very assertive, knowledgeable and professional both personally and within her employment. She is a great person to know and work with. I have been an acquaintance of Victoria for more than twenty (20) years. I am familiar with the type of work she does many years as a tribal court advocate and tribal prosecutor. She can work under duress and handle stress quite effectively.

Victoria is an impeccable speaker and presenter in legal training, chapter houses and counseling in the legal field. I am aware that Victoria has worked with programs such as the Navajo Nation police department, behavioral health, tribal judges, prosecutors, and courts throughout the Navajo Nation. I have listened to Victoria's lectures and they are usually of high intellectual quality.

BACKGROUND INFORMATION: Mrs. Yazzie is a 56 year old married woman and mother to six grown children. She and her common law husband maintain two residences presently, as she lives in Shiprock, while he is a caretaker for his father in Newcomb. She is ve~

understanding of her husband's obligation to care for his father, and looks forward t<> ..he day when he can return home.

Mrs. Yazzie was raised on the 1\'avajo nation as one of nine children. She attended ]Jrivate boarding school in Utah for much of her junior high and high school education. On breaks, she describes coming home to work with her father on the family farm. She credits her father as being a good role model in her life and teaching her to help others when she could. A::fter completing high school in Shiprock, she attended San Juan College where she earned 4n Associate of Arts degree in law. She later completed a Bachelor's degree in Educatjon. With the exception of one year of teaching school, the total of her professional work has been in the legal field. She passed the Bar Association for the Navajo Nation in 1995 and has ~o..ked as an attorney ever since. She describes her passion for law as an opportunity to help others: by working diligently to uncover the truth.

Mrs. Yazzie reports no psychiatric disorders in herself or her family, except her fath er:» who abused alcohol. She denies using alcohol or drugs. She describes the ability to cope vvith difficulties by dealing with things directly and then moving on.

TESTS ADMINISTERED: Mrs. Yazzie was administered the Minnesota Multiph.;asic Personality Inventory (N1MPI-2) and Substance Abuse Subtle Screening Inventory ( S ASSIE-3) to provide objective data for this assessment.

On the Ml\1PI-2, Mrs. Yazzie's profile suggests good ego strength with no signs of emotional disturbance. She appears to be a clear thinker who approaches problems reasonably and systematically. Such individuals are comfortable socially, verbally fluent and often -take a leadership role.

Her work is likely to be neat, organized and meticulous. While she is somewhat moralistic and prefers conventional norms, she often takes a creative and imaginative approach to problem solving. She very much enjoys her work and gets pleasure from being productive.

On the SASSIE-3, Mrs. Yazzie's results did not indicate substance abuse. On the test, she describes herself as believing in the law and obeying societal rules. At the same time, she understands others flaws, and is willing to provide advice and assistance. She presents herself as a self-assured, confident and happy individual who handles emotional difficulties and stressors well. These results are consistent with her described history and .tv'IMPI-2 results.

SUMMARY AND RECOMMENDATIONS: Mrs. Yazzie is a very pleasant, professional woman who has managed to balance raising a family with a long-term career as an attorney. Her passion is for the legal field, where she is able to apply her ample intelligence and compassion for her clients. The interview and test results indicate a well-balanced individual with strong coping skills who is able to handle stressors well. This letter accurately represents my views of the character and abilities of Ms. Victoria Yazzie of Kayenta, Arizona and may therefore be used a£ a reference source. I have known Ms. Yazzie for over twenty three years, and during this time I have had the opportunity to observe her professional progression in taking on new challenges, to note her ethics and character, and to hear commentary on her legal knowledge in prosecuting cases within the Navajo Nation Courts. Therefore, please accept this letter ofreference for Ms. Victoria Yazzie as a Judge within the Navajo Nation Judicial Branch. My sources ofreference are articulated below.

First, during my professional affiliation and association with Ms. Yazzie in the capacity as a Navajo Nation district prosecutor and her immediate supervisor I was consistently intrigued by her willingness to take on new challenges. This is even more evident by her current application for a Judgeship within the Navajo Nation Judicial Branch. I am not talking about a quality that is pW"e selfish ambition, but I am referring to a quality that is rooted in a desire to create a better life for the Navajo people. Consequently, it is my sincere belief that Ms. Yazzie would make an excellent Judge because of the rare quality evidenced in her willingness to take new challenges. As a judicial professional in the Arizona State Courts and an appointed Commissioner in the Navajo Nation Family Courts 1 perceive that this quality is one that is lacking in so many potential candidates for Navajo Nation judicial office. Ms. Yazzie clearly embraces this quality which allows her to willingly accept additional duties and responsibilities. This character is one that places her above many other candidates for a Judge within the Navajo judicial court system.

Secondly, during my professional association with Ms. Yazzie she consistently demonstrated that she possesses the ethics and integrity required to be a Judge within the Navajo Nation Judicial Branch. 1 have never heard of any incidents or activities that would bring Ms. Yazzie or the Navajo Nation into disrepute. This is an important quality for a Judge and I sincerely believe Ms. Yazzie has not been involved in situations that could cause major character issues to be levied against her. fn fact, her ethics and integrity is supported by her traditional knowledge of the Navajo Common Law. I have always known her to be fair, honest and above reproach in her dealings.

Thirdly, it is my belief and information that Ms. Yazzie possesses the legal knowledge necessary to focus on complex issues at hand in cases that are beard before the Navajo Nation Courts. She has been a police dispatcher, private legal counsel and a Senior Prosecutor for many years and has gained a wealth of legal knowledge and experience that could be used for the furtherance of Navajo Nation judicial system. More importantly, she speaks Navajo fluently and she understands traditional and cultural issues related to cases brought before the Navajo Nation courts. Ms. Yazzie possesses the knowledge to develop Navajo Fundamental Law in her court decisions and opinions. She is raised in a home with strong cultural values.

Finally, as a member in good standing with the Navajo Nation Bar Association, and as a person personally aware ofthe issues I mentioned above, it is with great pleasure that I offer this reference for Ms. Yazzie.
