I'vewatchedtheonlinevideoofthe8/4/15councilmeeting.IwantedtorespondtoyourcriticismofOPRAandclaimsofharassment.Firstwithregardtotheclaimthatmyrequestsareaburdensome,voluminousandharassing.IcouldputinarequesteverysingledayforfiveitemsandIwouldbewellwithinmyrights.Idonotrequestrecordsforkicksandgiggles.IamalwaysreadytodefendaSLAPPsuitandcaneasilyoutlinetoacourtorthemediawhattheexpresspurposewasforeachandeverysubmissionwas.

Myrequestshavebeenwellpacedsonottooverwhelmthecustodian.IhaveplentyexampleswhereIhaveputinrequestsattriplethevolumeandpaceasIhavehereinCapeMay.Ihaveagoodtrackrecordofbeatingservicecharges.TherewasonewiththeDeptofEducationwheretherequestwasexpectedtotake4hours.TheGRCruled"WhilethismayrepresentasignificantportionoftheCustodiansworkingday,andDOEmayreceiveseveralhundredOPRArequestseachyear,thetimerequireddoesnotplaceanextraordinaryburdenoneithertheCustodianorDOE."

Ithinkpartoftheproblemhereistheadmittedinexperienceofthecustodian.Whatistakinganextraordinaryamountoftimeisconstantneedforthesolicitorsinput.ThesolicitorhimselfseemstonothaveeffectiveknowledgeofOPRA.OnMay20thIhadtoschoolthesolicitorononeoftheveryfirstaspectsacustodianiseducatedonregardingtheuseofarequestform.(emailattached)

Acompetentlytrainedrecordscustodianwillrarelyneedlegalcounsel.

Youcan'tgripeatthepublicbecauseaninexperiencedcustodianandcounselcan'tkeepupwiththedemandsofthepublic.Thegovernmentisobligatedtoprovidetheserecords.Thepublichasarighttothem.AndImustsayhadthecustodianproperlyrespondedtothemultitudeofpeoplewhohavecometome,Iwouldhavenevergotteninvolved.Myrequestsfor2015(attached)wereonmadeonbehalfof3rdpartiesasasurrogate.TheclaimthatoneguyissittingaroundfilingOPRArequeststoharassisbaseless.

Withregardstomy"threatsoflitigation":WhenOPRAlitigationfirststartedpeoplewouldfilearequestandthensuewithoutwarning.Thecourtsweregettingaggravatedwiththesecasesanencouragedpartiestoworkoutissueswithouttheneedforcourtintervention.Iamtosomedegreerequiredtomakeknownmyintenttopursuelitigationifthecustodianfailstocomply.ThisshowsthecourtIdideverythingIcouldtocompelaproperresponse.UsuallywhenIhaveaninexperiencedcustodianthethreatoflitigationgetsthesolicitorinvolvedwhenthentellsthecustodianwheretheywentwrong.Normallyacompetentsolicitorcanbemybestadvocatetomediateadisputewithouttheneedforcourtintervention.

TheOPRAprocesshasfailedhereinCapeMayonmultiplelevels.Whenthathappenstheconspiracytheorieswhetherwarrantedornotrunwild.Youneedtofixthepublic'sperceptionofyouinthecourtofpublicopinionandsteponeistransparency.

WhatIrecommendissomeremedialtrainingforthecustodian.IwillprovidepowerpointpresentationsandvideosbytheGovernmentRecordsCounsel.Ialsorecommendyouhirespecialcounsel.IcanattestthatCooperLevensonknowswhattheyaredoingandcanprovidecompetentrepresentation.

Itsbeenmyexperienceovertheyears,thatsometimesallegationsarebaseless.InthosecasesIfiledafewrequests,thedocumentsarehandedoverquicklyandIwalkaway.Idon'tlikewastingtimeonnonsense.RecentlyIfiledarequestforlegalbillswiththeJIFforHamiltonTownshiplawsuitsandtheJIFisrefusingtogivethemup.Ihavefiledforacourtordertoreleasethem.AlthoughgovernmentlegalbillsarewellsettledcaselawandthisisaslamdunkcasetheJIFwantstofightthecasealltheway.Againbasedonexperience,peopledon'tfightoverdocumentsthatdon'tshowanything.Buttheywillgodowninflamesovertheonesthatshowwherethebodyiesareburied.
