Belgrave Square Garden, Open Space, Belgrave Square, SW1 (Knightsbridge and Belgravia Ward / not in cumulative impact area)
This was an application for a new premises licence. The applicant had previously operated under Temporary Event Notices for use of the Garden. The
application had originally involved a maximum of 15 events per year for licensable activities within Core Hours (23:30 Monday to Thursday, midnight Friday
and Saturday and 22:30 on Sunday) and a maximum of five events per year to 01:30. This was amended prior to the meeting to 12 events within Core Hours
and three events to 01:00.
Residents, Environmental Health and the Police all had concerns about the potential scale of events. The applicant was proposing a maximum capacity of
1000. All parties noted that there had been a significant increase in the number of events proposed for the new premises licence in comparison to the TENs.
The local residents’ society was keen that the application was refused but in the event the Sub-Committee was minded to grant, requested that the number of
events were reduced to a maximum of five per year, that the terminal hour was no later than 22:00 Monday to Saturday and 21:00 on Sunday and that the
maximum capacity was 250.
Following concerns having been expressed by the objectors, the applicant further reduced the maximum number of events to seven, all within Core Hours.
The Sub-Committee decided that it was appropriate to grant a maximum of five events per year to Core Hours with a maximum capacity of 500 people.
Wingstop Restaurants, Basement to Second Floor, 138-140 Shaftesbury Avenue, W1 (St James’s Ward / West End Cumulative Impact Area)
This was an application for a new premises licence. The Applicant’s Representative advised at the hearing that the application was being amended with
takeaway food not being sought after 23:00. On sales were sought until midnight and off sales until 23:00 Monday to Saturday and 22:30 on Sunday.
The Applicant’s Representative described the operation of the premises where the focus is on chicken wings. Customers would collect the food and drink
from a counter (the food was cooked at the premises) and take it back to their seats. There would be no waiter or waitress service. On sales would be
ancillary to the meal. Off sales would be ancillary to a takeaway meal.
The Licensing Authority and the residents’ association expressed concerns about the increase in cumulative impact. The residents’ association requested that
off sales ceased at 21:00.

The Sub-Committee considered that the premises was supplying fast food in the West End Cumulative Impact Area. The Sub-Committee granted the
application in part so that the sale of alcohol was permitted until 23:00 Monday to Saturday and 22:30 on Sunday. These hours were in keeping with the fact
that the applicant could have takeaway until 23:00 without it being licensed and alcohol was ancillary to food. The aspect of the application relating to late
night refreshment (indoors) was refused in keeping with policy. The closing time permitted was 23:30 Monday to Saturday and 22:30 on Sunday. The Sub-
Committee took into account that there is not just the takeaway aspect of the fast food policy but also the fact that people are remaining in the cumulative
impact area having consumed alcohol.
The Plaza, 116-128 Oxford Street, W1 (West End Ward / West End Cumulative Impact Area)
This was an application for a new premises licence. The applicant was seeking Core Hours for on sales of alcohol, late night refreshment (indoors) and the
playing of recorded music. The Applicant was requesting an extra half hour each day in relation to the hours the premises are open to the public.
The Licensing Authority had submitted a representation due to the premises having a capacity of 190 people in the West End Cumulative Impact Area.
However, they advised the Sub-Committee that the Applicant had offered vastly improved conditions following discussions between the parties. These
included that the supply of alcohol would only be available in the bar area prior to meals and not after meals which was in keeping with the Council’s policy.
The applicant had also agreed the Council’s model restaurant condition, MC66.
The Sub-Committee, taking the conditions offered into account, granted the application.
Trattoria Da Aldo, Basement and Ground Floor, 51 Greek Street, W1 (West End Ward / West End Cumulative Impact Area)
This was an application to vary the premises licence. The first aspect the applicant sought to vary was changes to the premises layout. The second was to
amend a condition on the existing licence, increasing the maximum capacity from 40 including staff to 54 excluding staff. The third was to add a works
condition to the licence.
The Licensing Authority submitted a representation objecting to the increase in capacity in the West End Cumulative Impact Area. The conditions on the
existing licence required alcohol to be ancillary to a table meal and supplied by waiter or waitress service. During the hearing, the Applicant’s Representative
offered the Council’s model restaurant condition, MC66. The offering of this condition was welcomed by the Licensing Authority although the point was made

that the existing hours of operation (which had not changed) were in excess of Core Hours and that more people would be dispersing into the Cumulative
Impact Area then in the event of an increased capacity.
The Sub-Committee considered that the proposed conditions promoted the licensing objectives and granted the application.
