Advertising in your association’s trade journal is a solid approach to business development.

In fact, a recent survey done via the PPA called The Essential Medium, found B2B publications - such as Apartment Insight, to be the number one information source within any given industry when compared to other media. In the survey, respondents were asked whether they agreed or disagreed with a series of attitude statements and the PPA compiled the data, resulting in the percentages. LIONS AND TIGERS AND BEARS, OH MY! 2ND EDITION OF THE ESA TOOLKIT NOW AVAILABLEWhat do you say to a resident who requests an emotional support animal rattlesnake? Or in the more common scenario, your maintenance technician enters a resident’s unit to perform repairs and finds a pit bull living there. It seems the resident conveniently forgot to report the pet to staff at the time of move-in. Then when you send the resident a letter informing him of the community’s pet policy prohibiting aggressive breeds, the resident produces a form letter from an internet site claiming the animal is an emotional support animal. Now what do you do?

If this has happened to you, you are not alone. Under federal law, an owner must accept a reasonable accommodation request for an assistance animal (also known as a service animal or an emotional

support animal) if the resident has a disability and a disability-related need for the animal. The accommodation affords the disabled person equal opportunity to use and enjoy the dwelling unit. It’s no different than a request for grab bars or a wheelchair ramp. A resident could not properly use or enjoy the unit without the animal.

To address these scenarios, remember the law applies to reasonable accommodations so in your approval process, you may consider whether an accommodation for a poisonous snake would be reasonable. You should note that policies including breed, size and weight limitations may not be applied to assistance animals. However, the request may be denied if the specific assistance animal in question poses a direct threat to the health or safety of

others that cannot be reduced or eliminated by another reasonable accommodation.

This is a complicated issue. It makes owners and managers hesitant to say no to a request because it could lead to a fair housing discrimination complaint and substantial legal costs. To help members navigate this issue, NAA developed the NAA Toolkit, Emotional Support Animals: A Practical Guide to Reasonable Accommodation Requests in 2016. The toolkit includes:• The NA A/N MHC Fact Sheet on

Emotional Support Animals, which provides overall background on this issue. It informs members on what NAA is doing to address their concerns;

• Relevant federal guidance from the

U.S. Department of Housing and Urban Development (HUD) and the Department of Justice;

• Answers to frequently asked questions regarding reasonable accommodation requests for assistance animals;

• Scripts that owners may use in training their leasing staffs to ensure proper communication with residents on this issue;

• An introduction to sample policies and forms provided by Kirk A. Cullimore, Esq. of the Law Office of Kirk A. Cullimore;

• Sample reasonable accommodation and modification policies; and

• Sample documentation forms for residents, including instructions.

▷ For 2017, two new additions have been added to the toolkit: an addendum to the Q&A section and a sample assistance animal reasonable accommodation policy. The newly released, second edition of the toolkit is available.

Owners agree that the law helps disabled persons seek relief, whether that is a child needing a service animal to alert her to

an impending seizure or a veteran with PTSD who requires the comfort of an emotional support animal. However, the current law also allows for abuse. Owners remain frustrated as more residents are discovering how easy it is to avoid pet rent and fees by obtaining a doctor’s note for a fee from the internet. While NAA works to resolve these issues with HUD, the second edition of the toolkit should help owners and managers properly train and educate their staffs.

Additionally, NAA is offering a session focusing on this issue at the 2017 NAA Education Conference & Exposition in Atlanta, Ga. The session is scheduled to take place on Friday, June 23, from 9 a.m. to 10 a.m. and features Katie Wrenn, Regional Training and Marketing Director at Milestone Management and Past President of the First Coast Apartment Association, and Kirk A. Cullimore, Esq., owner of the Law Offices of Kirk A. Cullimore and Past President of the Utah Apartment Association. Join us as our experts provide guidance on the basics of the law and how to utilize the resources in the NAA member toolkit. There are two underlying political motivations for rent regulation: the first is a genuine, however misguided, attempt to preserve affordable rental housing opportunities; the other is an egregious attempt to stop affordable rental housing – a growth control tool.

Before I lambast those who use it to control growth, I must acknowledge those who are legitimately concerned about affordable housing – desperate, in fact. Often, they have inherited a situation they are now tasked with fixing. Problem is there are no quick-fix, silver-bullet solutions – only hard choices. They know that involves building more housing to give their constituents choice and keep prices in balance through healthy competition. They know this, but that is a long-term goal that does nothing for them today. So, despite their

best judgement, they consider some form of rent regulation for the optic of looking like they are doing something. I get it. It's irresponsible, but I get it.

Then there is the use of rent regulation as a surrogate for growth control; specifically, apartment growth control. They know by regulating it to dissuade the development of it. Good politics is like water: it follows the path of least resistance. They know that developers and investors of apartments will just go elsewhere.

I am sympathetic enough to believe that many do not personally espouse this philosophy, but community opposition to high-density development may put them in a political box. In either case, they are savvy enough to know that openly having a no-growth policy is insensitive and untenable

to the people living in an area with scarce and expensive housing. Yet in the most ironic and cruelest political machinations: the no-growth lobby can be on the same side as the pro-affordable housing advocate on the issue of rent regulation, but for far different reasons.

One supports the policy in the hopes that it will defy its history and preserve affordable housing. The other supports the policy because it knows that it will continue its long histor y of pushing housing elsewhere and make what remains more expensive.

That policy paradox is what makes rent regulations so bad. The idea that a policy can be disguised as something sympathetic to the community's needs, yet in practice, hurt the community. This is probably what

prompted no fewer than 34 states to preempt rent regulation at the municipal level. To prevent pitting cities against other cities in a game of "kick the can of my growth responsibilities to you."

This in part explains why, despite rent regulation being a colossal failure, incredulously, it still has its ardent proponents. It is only through a closer examination that we uncover its nefarious policy use. For the no-growth politician, the use of rent regulation to control growth looks like the greatest win-win scenario ever. It is like losing weight while eating whatever you want and not exercising.

Just so you know, that never happens. Despite all those late-night infomercials saying you can lose 20 pounds in a week by taking this pill, eating this grass or dedicating 10 minutes a day to so-and-so machine, it doesn't happen.

Not to be gross, but using rent regulation to control growth is like using tape worms to control your weight. While it may be a wildly successful tactic, it is a poor strategy because of its unintended consequences. What the nefarious proponents fail to understand is that while it successfully drives rental housing elsewhere, it does not control growth and ultimately hurts their pocketbook.

You see, limiting growth encourages more people to live in the same number of units. People live where they live out of convenience. Affordability is just a compromise that they make. That's when you see doubling and tripling of occupancy in units. That is more people living in fewer units creating additional community impacts without the benefit of additional property tax to pay for it. Where does the additional tax revenue to service a larger population come from when you limit rental housing? Property tax on single-family homes and businesses. Ouch.

Everybody pays for rent regulation policies, whether you chose to acknowledge it or not.

Advertising in your association’s trade journal is a solid approach to business development. In fact, a recent survey done via the PPA, called The Essential Medium, found B2B publications such as Apartment Insight, to be the No.1 information source within any given industry when compared to other media. In the survey, respondents were asked whether they agreed or disagreed with a series of attitude statements and the PPA compiled the data, resulting in the percentages. Verbatim responses were collected by the survey, which are added to exemplify the points. Here are a few excerpts:• Business publications are rated the first choice for staying in touch with what’s going on in their sector by 61% of
