DriveAway Hire Car Excess InsuranceWhat is Insurance Excess?

Most car rental rates include basic insurance – Collision Damage Waiver

Insurance (CDW), Third Party Liability and Theft Protection (TP). In the event

that a rental vehicle is stolen or accidently damaged (whether the driver is

at fault or not), an Insurance Excess is charged. The Insurance Excess is the

maximum amount the renter is liable for. The cost varies depending on the

supplier, country and vehicle type e.g. in France the excess can range from

EUR500-1800. Additional insurance to reduce the excess is optional and

can be purchased from DriveAway Holidays at the time of booking your car

rental or direct from the supplier when picking up your car. It may also be

included in your travel insurance, so check your policy before you leave.

DriveAway Hire Car Excess Insurance is an optional product offered by

DriveAway Holidays to refund the excess amount charged by the car rental

supplier. It provides you with hassle free extra cover when renting a car.

For between AUD5.50-7.50 per day, you will be covered for the supplier’s

damage and theft excess costs incurred locally. Should the local supplier

charge you the excess amount on the vehicle, you may claim up to

AUD5,000 through DriveAway Holidays* when you return to Australia.

FREQUENTLY ASKED QUESTIONSHow much does DriveAway Hire Car Excess Insurance cover?

You will be reimbursed up to AUD5,000 of the damage and theft excess

amount charged by the car rental supplier in the event of damage or

theft of the vehicle.

Is the daily rate charged for every rental day?

Yes. The charge is between AUD5.50-7.50 per day depending on the car group.

I have paid for DriveAway Hire Car Excess Insurance. The car rental

supplier states that they have never heard of it and insist I take out

their damage and theft excess cover. Should I take out their excess

cover as well?

DriveAway Hire Car Excess Insurance is an agreement between you and

DriveAway Holidays. Supplier excess reduction options may be available

directly from a supplier at an additional cost. If the renter accepts any excess

reduction offered by the supplier they are not entitled to a refund from

DriveAway Holidays, Accident & Health International Underwriting Pty Ltd

or CGU Insurance Limited.

Is my credit card still frozen at the time of collecting the vehicle if I take

DriveAway Hire Car Excess Insurance?

Yes. The full excess amount will be charged in the case of theft or damage,

however the amount is recoverable up to AUD5,000 from DriveAway Holidays

provided all claim conditions are met.

How do I make a claim?

To claim excess charges you must provide the following to DriveAway Holidays:

• Rental Agreement with the drivers name matching that of the

DriveAway Voucher.

• A completed claim form. You can obtain a claim from by visiting

www.driveaway.com.au or emailing [email protected]

• A police report (if applicable).

• An accident report or theft report from the car rental supplier (if applicable).

• A receipt of the excess being charged by the supplier and a copy of the

clients credit card.

• The repairer’s invoice which confirms the final repair costs

(DriveAway Holidays will assist you to obtain this)

Upon receipt of the above forms, DriveAway Holidays will assess your claim.

Do I get a full or partial refund if I don’t make a claim?

No, once the rental has commenced, DriveAway Hire Car Excess Insurance is

non-refundable.

Do I need DriveAway Hire Car Excess Insurance if I have travel insurance?

We recommend you check your travel insurance policy to ensure you are

sufficiently covered.

How do I book DriveAway Hire Car Excess Insurance?At the time of making your car rental reservation, simply advise our

consultants you would like to book your car rental with DriveAway

Hire Car Excess Insurance. If you are booking online, the option to

purchase DriveAway Hire Car Excess Insurance will appear in the last

step of the booking process under the “About this Quote” section.

- In common with most car rental suppliers, DriveAway Hire Car Excess Insurance does not cover damage to windows, wheels, tyres, the roof, underside & interior of the vehicle, towing charges or damage/theft caused negligently, willfully or recklessly.

- DriveAway Hire Car Excess Insurance does not cover claims where the vehicle (including 4 wheel drives) is taken off road or on unsealed surfaces.

- DriveAway Hire Car Excess Insurance does not cover driver negligence whereby the driver is under the influence of alcohol or other substances. In addition, the driver of the vehicle must meet the requirements of the car rental supplier.

- Theft covers the vehicle only, not personal contents.

- In the event that keys are lost and/or damaged you will be liable for replacement costs. Further costs may be applicable if the lost keys are directly related to the theft of the vehicle.

- Supplier excess reduction options may be available directly from a supplier at an additional cost. QUOTESCar Rental and Peugeot Leasing quotes are valid for 7 days and are in Australian Dollars. Motorhome and other product quotes are valid for 3 days and are in Australian Dollars.

PAYMENTCar Rental/ Ferries/ Other Products – Please refer to your valid invoice for all payment due dates. Also refer to the terms and conditions of your booking for further information as some product terms may vary. Peugeot Leasing – DriveAway Holidays requires final payment 6 weeks prior to departure from Australia, unless specified otherwise. If for any reason final payment is not received by the due date, DriveAway Holidays reserve the right to treat the reservation as a cancellation. Motorhomes – DriveAway Holidays requires final payment 9 weeks prior to departure from Australia. For all Australian motorhome rentals, final payment is required 9 weeks prior to collection. For all reservations inside 9 weeks of departure/collection date, final payment will be required at time of reservation. If for any reason full payment is not received by the due date, DriveAway Holidays reserve the right to treat the reservation as a cancellation. Credit Card Fees: Where bookings made by credit card 2.0% surcharge will be charged on the total amount.

INVOICESAn invoice is sent upon confirmation of your reservation outlining all aspects of products booked. Confirmations are subject to unadvised changes in depot hours, fleet conditions, stop-sells and one way hires until full payment has been received.

TRAVEL DOCUMENTSOnce payment is received, a travel voucher will be issued. For special requests e.g. child seat, ski rack etc and/or specialty vehicles, a travel voucher is issued upon full payment and once confirmation has been received from the supplier. Please note vouchers are accountable documents and serve as exchange vouchers for products you have booked. Non-presentation of your vouchers may result in charges being applied locally.

There are some instances however where documentation is not required. This will be advised at time of reservation.

AMENDMENTSNo charge, unless applied by the supplier. If an amendment occurs, DriveAway Holidays reserves the right to re-price. All amendments must be made directly with DriveAway Holidays. Conditions apply. In some cases, travel agent charges will also apply.

REISSUE FEENo charge, unless applied by the supplier.

CANCELLATIONSNo charge if the booking is cancelled prior to collection. In some cases supplier levied fees and/or travel agent charges may apply. If a booking is cancelled after collection or is a ‘no show’, a cancellation fee of AUD110 plus supplier levied fees (if applicable) will be charged. FREQUENT FLYER POINTSNot applicable on any DriveAway Holidays products.

REFUNDSNo refund will be made on any part of a package provided and not used; this includes unused car/motorhome rental days, Peugeot Leasing days and unused accommodation. DriveAway Holidays does not authorise the employees of any supplier to promise refunds to clients.

TRAVEL INSURANCEWe strongly recommend that you take out suitable travel insurance with maximum rental vehicle excess cover. Alternatively, ask DriveAway Holidays for a DriveAway Hire Car Excess Insurance rate to cover the car excess (see pages 16-17 for full details).Travel Insurance can be arranged through your Travel Agent.

CAR & MOTORHOME RENTAL^Beat Price Guarantee: DriveAway Holidays will beat any international product by AUD10 per booking and any domestic product by AUD1 per booking. The competing price/quote must meet the following criteria:- Be available for Australian residents only. - Be a ‘fully prepaid’ rate. DriveAway Holidays cannot beat ‘pay

on collection’ quotes.- Is available to any member of the general public e.g. Qantas

Security Deposit: All car and motorhome rental companies require a minimum of one internationally recognised credit card (Prestige/Luxury cars require two credit cards) for a security bond. Contact DriveAway Holidays for details.Age Limit: Generally the minimum age is 21 years (up to 30 years for some luxury vehicles) but can vary between car and motorhome rental companies and country. Drivers Qualifications: All drivers must hold a full valid drivers licence with a clean driving record for a minimum of one year. Some countries require a licence to be held for a longer period. A learner or provisional drivers licence is not accepted. An international licence is required for many countries including

Vehicles are supplied with a full tank of petrol on collection (exceptions apply). You are advised to refuel your vehicle prior to return and maintain receipts to avoid refuelling charges. Some companies may offer a pre-paid fuel option, which is a pre-determined amount regardless of the amount of fuel remaining upon return of your vehicle. If accepted no refund is available.Insurance Excess: In the event of theft or accidental damage to the vehicle, an excess will apply. Please enquire at the time of booking. PEUGEOT LEASINGBooking: Deliveries within France must be booked at least 35 days (20 days for Paris) in advance. Deliveries outside France must be booked 6 weeks in advance. Late bookings are not guaranteed.Lease Forms: It is essential that original lease forms, together with a photocopy of the registered driver’s passport are returned at least 6 weeks prior to the delivery of your Peugeot. If you hold a European passport, a photocopy of your European passport, a copy of your Australian Permanent Residency or a copy of a utility bill confirming your residency which is 6 months old is also required. Late return of these documents will delay delivery of your vehicle.Vehicle: All Peugeot vehicles are left hand drive (including collections in London). The definition and/or specifications of the Peugeot vehicles displayed in this brochure are subject to change without notice.Duration: Minimum lease period is 21 days, excluding the Expert Tepee where the minimum is 40 days. Maximum 175 days. Peugeot Leasing is based on calendar days.Additional Drivers: Additional drivers are free, however the registered driver must be in the vehicle at all times whilst the additional driver is driving. Exception: immediate family members may drive locally without the registered driver in the vehicle. Under no circumstances can the family member take the vehicle across any borders without the registered driver being in the vehicle. Immediate family members are spouse, son or daughter of the registered driver travelling under the same surname and residential address as the registered driver. All additional drivers must comply with all requirements of the lease. Fuel: All vehicles are supplied with 10-15 litres of fuel free of charge. LIABILITYLiability: Certain provisions of the Competition and Consumer Act (including, without limitation, the Australian Consumer Law) and other State, Territory or Commonwealth laws in Australia, as amended or replaced from time to time, (collectively “ACL”) apply to the operation of these terms and conditions and provide consumers (as that expression is used in the ACL) and others with certain rights (referred to collectively as the “consumer guarantees”) in relation to goods or services purchased by those persons. Other than consumer guarantees, which are not excluded, modified or restricted by this provision, DriveAway Holidays does not give

any guarantee or warranty or make any representation of any kind, express or implied, with respect to the supply by DriveAway Holidays or others of any goods or services in this brochure. Other than in respect of goods or services supplied to consumers or goods or services that are of a kind ordinarily acquired for personal, domestic or household use or consumption, DriveAway Holidays’ liability for the breach of any condition or warranty, whether express or implied (other than warranties or conditions in relation to title, encumbrances and quiet possession) is limited, at DriveAway Holidays’ option, to:- in the case of goods; the replacement of the goods, the supply

of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods; or

- in the case of services; the supplying of the services again or the payment of the cost of having the services supplied again.

Subject to rights that the Customer may have under the ACL, which are not excluded, modified or restricted by this provision, DriveAway Holidays is not liable to the Customer or any other person, whether in contract, tort or otherwise, for any loss or damages (including without limitation specific, indirect, consequential or economic loss) howsoever caused arising from any event.Notwithstanding anything contained in this brochure, nothing in these terms and conditions:- excludes, restricts or modifies or purports to have the effect of

excluding, restricting or modifying any condition or warranty that is implied by, or consumer guarantee specified by, the ACL or DriveAway Holiday’s liability under any such condition, warranty or guarantee; or

- gives rise to any liability on the Customer’s part or qualifies DriveAway Holiday’s liability in circumstances where DriveAway Holidays is in breach of these terms and conditions, including any conditions or warranties implied, or consumer guarantees specified, by the ACL.

RESPONSIBILITY FOR INFORMATION AND SUPPLY OF GOODS OR SERVICES BY THIRD PARTIESResponsibility for Information: Vehicle specifications, photographs, illustrations, third party charges, third party conditions and information relating to goods or services provided by third parties contained in this brochure (collectively “Information”) are provided by third parties to DriveAway Holidays. All Information is subject to change without notice. The Customer must not rely on this Information. Any descriptions of the goods or services of any third parties in the Information is by way of identification only and the use or reliance on that description by any person shall not constitute any contract between that person and DriveAway Holidays as a sale by description. The Customer must make their own independent enquiries and investigations and undertake their own assessment of any Information before deciding whether or not the goods or services referred to in the Information are suitable for the requirements of the Customer. Without limiting the generality of this paragraph, city maps in this brochure are not to scale and car depot locations in this brochure are approximate only. Supply of Goods or Services by Third Parties: The goods and services identified in this brochure may be provided by a third party. In order for the Customer to obtain goods and services provided by a third party, the Customer may be required by that third party to agree to, and be bound by, terms and conditions that are specified by that third party. Any person intending to enter into an agreement with a third party must make their own independent enquiries and assessments in relation to the effect of the terms and conditions of that agreement before doing so. Subject to rights that the Customer may have under the ACL, which are not excluded, modified or restricted by this provision, the Customer acknowledges and agrees that DriveAway Holidays has no control over and no responsibility for any terms and conditions agreed between the Customer and a third party.

THIRD PARTY LIABILITY (DAMAGE OUTSIDE THE VEHICLE)Provides cover for public liability and is subject to the car rental company’s terms and conditions on the rental agreement. DriveAway Holidays strongly recommends travelers purchase travel insurance to cover themselves and their passengers.

GOVERNING LAWThese terms and conditions are governed in all respects by the law of the State of New South Wales and the Customer irrevocably submits to the non-exclusive jurisdiction of the Courts of New South Wales and the Federal Court of Australia.
