CITY COUNCIL RESOLUTION NO. 5340 - ESTABLISHING RATES FORWASTEWATER SERVICE FEES; CITY COUNCIL RESOLUTION NO. 5341 ­ESTABLISHING RATES FOR SOLID WASTE SERVICE FEES. Brent Kuhn, Vavrinek,Trine, Day & Co., LLP, presented the staff report, noting the changes to the proposedutility rates and timeline.

Mayor Villalta re-opened the public hearing due to new information being presented thisevening and asked those who would like to speak to state their name and address priorto addressing the City Council. ROBERT HANNAH, 521 N. Santa Ana Street, inquiredas to whether or not the proposal is being reduced; Mr. Kuhn spoke to Council MemberStone's proposal and Council Member Silveira's proposal; JUVENAL MATOS, LosBanos, spoke of the proposed rates still being an increase, how letters should havegone out to let the community know how much their bill would be with the increase, andhow the numbers presented are unclear; DAVE ANDERSON, Los Banos, spoke of notbeing against the increase, how he sent out an email to everyone today withsuggestions on how to address the change, and confusion regarding the dump feesand how the spreadsheet is lined up; AUSTIN TERRY, 832 Olivewood Drive, spoke ofthe original proposed resolution, being on a fixed income, difficult to take the way itspresented, urged the City Council to consider the alternate proposals by CouncilMember Stone and Council Member Silveira, and his disappointment that nothing wasaccomplished on the July 6, 2011 City Council/Redevelopment Agency meeting. Noelse one came forward to speak and the public hearing was closed.

There was discussion among Council Members, staff, and Mr. Kuhn regarding thecurrent and proposed rates and effective dates and the average increase per month foreach rate under each proposal.

Council Member Stone spoke of the continuance of this discussion that has been takingplace since March, having had plenty of time to go to staff with different proposals, over80% of property owners and/or account holders did not file protests, having heard aboutthe reason for the numbers and increases, the seriousness of the need for theincreases, concern about what would happen if we did nothing or didn't adjustaccordingly, understanding that the adjustments will be difficult but they are necessary,cannot do nothing, and the need to compromise.

Council Member Sousa spoke of making headway being better than not doing anything,fines and increases in rates, dump closure project and how the delay has cost the City,thanked Council Member Silveira and Council Member Stone for making alternativesuggestions, the need to do this in a responsible manner, and how he would support aproposal before the City Council tonight.

Mayor Villalta spoke of this being a mini version of the national debt ceiling, the need tocome up with a proposal that we can live with, not going to blindly vote on something hedoesn't believe in, and how this may take more meetings and soul searching onCouncil's part.

Council Member Silveira spoke of his appreciation for Council Member Stone's workand staff's work, not being comfortable with going as high as Council Member Stone'sproposed rates, willing to move a little off what he proposed, imperative to come up withcompromises, will take some responsibility that he should have gotten those numbersto staff earlier, inquired if there can be a compromise between his proposed rates andCouncil Member Stone's proposed rates, and spoke of being bound by the Brown Act.

Council Member Stone spoke of heading in the right direction, not having an unlimitedamount of time, and the differences between her proposal and Council MemberSilveira' proposal.

Motion by Stone, seconded by Sousa to adopt City Council Resolution No. 5339 ­Establishing Rates for Water Service Fees with the amendment that the increase in theflat water rate would not go into effect until February 1, 2012 per Council MemberStone's proposal. The motion failed by the following roll call vote: AYES: Sousa, Stone;NOES: Faria, Silveira, Villalta; ABSENT: None.

Mayor Villalta spoke of not knowing the end result in numbers if they will be voting onthese rates separately, not being able to support going from one to the next, and theneed to know the total amount.

Council Member Stone spoke of how the motion that she made was directly underCouncil Member Stone's proposal and how Council had the numbers for a week.

Motion by Stone, seconded by Sousa to adopt City Council Resolution No. 5340 ­Establishing Rates for Wastewater Service Fees with the amendment to lower theincrease by 4.75 percent and not impose rates until September 1, 2011 per CouncilMember Stone's proposal. The motion failed by the following roll call vote: AYES:Sousa, Stone; NOES: Faria, Silveira, Villalta; ABSENT: None.

Motion by Stone, seconded by Sousa to adopt City Council Resolution No. 5341 ­Establishing Rates for Solid Waste Service Fees with the amendment to not imposerates until February 1, 2012 per Council Member Stone's proposal. The motion failedby the following roll call vote: AYES: Sousa, Stone; NOES: Faria, Silveira, Villalta;ABSENT: None.

City Attorney Vaughn spoke of his concern about the continuance of this item past theAugust 3, 2011 City Council/Redevelopment Agency Meeting due to Proposition 218and urged the City Council to reach a conclusion by then.

City Manager Rath asked that if the City Council had any more proposals then get it tostaff no later than Monday, July 25, 2011 so that the agenda can be distributed timely.

City Attorney Vaughn spoke to failed motions being subject to reconsideration byanyone who was on the prevailing side.

CONSIDERATION OF APPROVAL OF CITY COUNCIL RESOLUTION NO. 5343 ­DECLARING ITS INTENTION TO ENACT AN ORDINANCE WHEREBY THE CITYSHALL ELECT TO COMPLY WITH AND PARTICIPATE IN THE ALTERNATIVEVOLUNTARY REDEVELOPMENT PROGRAM CONTAINED IN PART 1.9 OFDIVISION 24 OF THE CALIFORNIA HEALTH AND SAFETY CODE. RedevelopmentAgency Director Post presented the staff report, which included a PowerPointpresentation and introduced Mark Huebsch with Stradling Yocca Carlson & Rauth.

There was discussion among Council Members, staff, and Mr. Huebsch regarding thedifference between enacting and adopting an ordinance, preference on how to pay, theright of appeal, and urgency ordinances.

City Manager Rath explained to the City Council from a staff perspective that thegeneral fund cannot afford it, having barely closed the gap with this new budget, theneed to reduce expenses, revenue declining, and cannot incur any liabilities from theRedevelopment Agency that would affect the general fund.

Motion by Sousa, seconded by Stone to adopt City Council Resolution No. 5343 ­Declaring its Intention to Enact an Ordinance Whereby the City Shall Elect to Complywith and Participate in the Alternative Voluntary Redevelopment Program in Part 1.9 ofDivision 24 of the California Health and Safety Code. The motion carried by theaffirmative action of all City Council/Redevelopment Agency Members present.

CONSIDERATION OF APPOINTMENT OF ONE (1) COUNCIL MEMBER TO SERVEON THE LEAGUE OF CALIFORNIA CITIES CENTRAL VALLEY DIVISIONEXECUTIVE COMMITTEE AND ONE (1) COUNCIL MEMBER TO SERVE AS ANALTERNATE. City Manager Rath presented the staff report.

Motion by Faria, seconded by Sousa to appoint Mayor Villalta to serve on the League ofCalifornia Cities Central Valley Division Executive. The motion carried by theaffirmative action of all City Council/ Redevelopment Agency Members present.

Motion by Stone to appoint Council Member Silveira to serve on the League ofCalifornia Cities Central Valley Division Executive Committee as an alternate. Themotion failed due to the decline of nomination by Council Member Silveira.

CITY MANAGER I EXECUTIVE DIRECTOR REPORT. City Manager Rath spoke ofthe federal highway appropriations bill and trying to get Los Banos funding.

CITY COUNCIL I REDEVELOPMENT AGENCY MEMBER REPORTS.

ELIZABETH STONE: Spoke of the Salute to Seniors Fair on September 30, 2011 inwhich there will be a special tribute to veterans.

TOM FARIA: Spoke of the Green Valley Charter School and educating the home child.

SCOTT SILVEIRA: Spoke of the 2x3 Committee, reported that the City and the LosBanos Unified School District are working on a grant for safe routes to schools puttingsidewalks around Los Banos Junior High School and Pacheco High School, andreminded all that the Milliken Museum is still open for business.

JOE SOUSA: Spoke of a citizen's missing cat that needs to come home, encouragedthe community to help this person get her pet back, and asked Mayor Villalta if he couldfind out why the bus shelter that is supposed to be at the fairgrounds hasn't beenplaced there yet.

MAYOR MICHAEL VILLALTA: Spoke of a meeting regarding the animal shelter onJuly 21, 2011 at 9:00 a.m., the Merced County Association of Governments (MCAG)Governing Board meeting that will take place on July 21, 2011 in which amongdiscussion will be regarding garbage expansion, the importance of the Billy Wrightlandfill, the number of call boxes on Highway 152 and Interstate 5 within our area wereapproved at the previous MCAG Governing Board Meeting, a plan in place to continuewith call boxes, new bus shelters in town that were approved at a previous MCAGGoverning Board meeting, the importance of the Salute to Seniors Fair, andencouraged all to visit the Milliken Museum.

Redevelopment Agency Director Post inquired if the City Council would like for it to bedisplayed on the digital sign that the museum is open. Mayor Villalta indicated that hewould like to see that happen.

Discussion:The City has bargained in good faith with the LBPSA and reached agreement on a SideLetter/Contract Extension through June 30, 2012. There are a few minor changes tothe existing Memorandum of Understanding (MOU), which clarify department practicesand city polices. Merit increases remain suspended and salary ranges remain thesame.

SIDE LETTERBETWEEN CITY OF LOS BANOS

AND OPERATING ENGINEERS'LOCAL 3,REPRESENTING THE LOS BANOS POLICE SERGEANTS' ASSOCIATION

RE: CONTRACT EXTENSION FY2011-12

This Side Letter is between the City of Los Banos (hereinafter called "City") and theOperating Engineers, Local 3 representing the Los Banos Police Sergeants' Association(hereinafter called "Union") and shall apply to all employees of the City working in theclassifications set forth in the Memorandum of Understanding (MOD) between the Cityand the Union, with reference to the following recitals:

A. WHEREAS, the City has faced ongoing- challenging economic and fiscalcircumstances;

B. WHEREAS, the City and the Union desire to extend the current MOU in place forthe following 2011-12 fiscal year;

NOW THEREFORE, the salaries, hours, fringe benefits and working conditions set forthhave been mutually agreed upon by the designated bargaining representatives of the Cityand the Union, as follows:

1. The City and the Union agree to extend the MOU between the parties which isscheduled to expire on June 30, 2011. The MOU will be extended from June 30,2011 to June 30, 2012, and shall be amended as follows:

SECTION 1 - Preamble

This Memorandum of Understanding is entered into by the City of LosBanos (hereafter referred to as the City) and Operating Engineers Localunion No.3, representing the Los Banos Police Sergeants' Association(hereafter referred to as the Union). The term will be July 1, 2-Q..l.Q-2011andthrough June 30, ;w.H 2012. Employees defined for the purpose of thisMemorandum of Understanding will mean a full time Police Sergeant.This Memorandum of Understanding is subject to Section 3500-3510 ofthe Government Code of the State of California otherwise known as the"MME" Act, the City of Los Banos Municipal Code, and Resolution No.1719.

SECTION VII - .Benefits

B. Cafeteria Plan

The City will maintain a Cafeteria Plan, pursuant to Section 125 of theInternal Revenue Code, for the purpose ofproviding employees withaccess to various health and welfare benefits. Benefits available throughthe Cafeteria Plan include, but are not limited to, medical insurance,flexible spending accounts for out-of-pocket medical expenses anddependent care, vision insurance, dental insurance and life insurancebenefits. The City agrees to provide a Cafeteria Plan Allowance to allemployees eligible to participate in City-sponsored health benefits underSection A of this Article.

1. For employees hired before July 1,2010, the City will provide, on amonthly basis, a Cafeteria Plan Allowance in the following amount:

a. Up to a maximum of the premium for the Blue Shield HMOplan for the employee's selected level of coverage (i.e.,employee only, employee plus one or employee plus family);

b. Minus the PEMHCA contribution specified in Section A;c. Plus the amount of the life insurance premium (for coverage up

to $50,000);d. Plus up to a maximum of $72.92 $73.00 per month for the

employee's selected level of coverage for City vision anddental plans combined;

e. Minus the equivalent of2.5% of the individual employee'ssalary.

2. The City agrees to grandfather employees enrolled in PERSCare as ofJuly 1,2010. Between July 1,2010 and December 31,2010, or uponthe employee's change in healthcare coverage due to a qualifyingevent (whichever occurs first), the City will provide, on a monthlybasis, a Cafeteria Plan Allowance in the following amount:

a. Up to a maximum of the premium for the PERSCare PPO planfor the employee's selected level of coverage (Le., employeeonly, employee plus one or employee plus family);

b. Minus the PEMHCA contribution specified in Section.A;c. Plus the amount of the life insurance premium (for coverage up

to $50,000); .d. Plus up to a maximum of $72.92 per month for the employee's

selected level of coverage for City vision and dental planscombined;

e. Minus the equivalent of2.5% of the individual employee'ssalary.

3. For employees hired on or after March 17,2010, the City will provide,on a monthly basis, a Cafeteria Plan Allowance, based on theemployee's level of health care coverage as provided below, minus theequivalent of2.5% of the individual employee's salary:

In 2010:

Employee Only: $566.02[2010: $586.02 (Health) - $105 (PEMHCA) + $85(DentalNision/Life)]

Employee plus One: $1034.83[2010: $1,054.83 (Health) - $105 (PEMHCA) + $85(DentaINision/Life)]

Employee plus Family: $1198.92[2010: $1,218.92 (Health) - $105 (PEMHCA) + $85(DentalNision/Life)]

In 2011:

Employee Only: $662.67Employee plus One: $1,211.21Employee plus Family: $1,403.19

4. Effective July 1,2010, the dental and vision program providedpursuant to Resolution No. 2314 will be discontinued. Employeesmust submit claims for 2009-10 fiscal year by July 30, 2010 (claimsmust be dated June 30, 2010 or earlier). On August 5,2010, anyremaining funds provided pursuant to Resolution No. 2314 will bepaid to the employee in the form of a separate check. Dental andvision plans will be available through the Cafeteria Plan.

5. Any increase to minimum monthly employer contribution underPEMHCA will result in a corresponding decrease in the employee'sCafeteria Plan Allowance.

6. Employee enrollment in dental, vision and life insurance plans offeredby the City is mandatory.

7. Effective July 1,2010, employees who opt out of medical planssponsored by the City, and who provide proof of medical coverage in agroup plan, will receive a Cafeteria Plan Allowance of $485 permonth, minus an amount equivalent to 2.5% of the employee's salary,of which part must be used to enroll in mandatory life insurance,dental insurance and vision insurance coverage.

SECTION IX - Pay Rates and Practices

G. Comp Time

Police Sergeants are permitted to accumulate a maximum amount of one hundredtwenty (120) hours compensatory time. Sergeants may cash out compensatorytime in excess of fifty-six (56) hours, up to a total of sixty-four (64) hoursmaximum cash out annually, to be paid on June 5th and December 20th

• Cash outof compensatory time will be paid by separate check upon request.

Comp Time will be handled in accordance with provisions outlined in the City'sCompensatory Time Off (CTO) Policy, refer to City of Los Banos Policy Manual.

SECTION XII - TERM

The term of this Memorandum of Understanding will commence July 1,2010, and will expire June 30, 2011 June 30, 2012, except as otherwiseprovided in this Memorandum of Understanding.

2. All other compensation will remain status quo during the period of time that thecontract is extended, until June 30, 2012.

3. The parties agree that any and all tentative agreements are hereby incorporated.Any outstanding proposals not agreed to are hereby withdrawn by the parties.Language in the MOD between the parties not changed by this tentativeagreement shall remain unchanged.

4. The statements made in Paragraphs A through B inclusive are incorporated intothis agreement.

6. This tentative agreement is subject to ratification by the bargaining unit andapproval by the Los Banos City Council.

Introduction. The City of Los Banos has six appointive city commissions. Appointedcommissioners voluntarily serve two-year terms of office with a maximum of two full terms.There is no current written policy establishing a standard procedure or criteria for recognizingindividuals serving on these commissions.

Council Member Sousa is requesting the City Council discuss and consider adoption ofstandard procedures for recognition of appointed commissioners.

Discussion. The procedures outlined in the proposed policy are intended to establishstandards for issuing formal recognition for individuals serving on appointive city commissions.

The policy provides for two types of recognition:

First: Newly appointed commission members will be presented with a Certificate ofAppointment and Oath of Office upon taking the oath ofoffice.

Second: Upon leaving office, commission members who have completed at least two fullterms of office will be presented with a Recognition Proclamation at a City Council meeting. Orin the alternative, upon completion of each full term of office, commission members who havecompleted a full term of office will be presented with a Recognition Proclamation at a CityCouncil meeting.

Recommendation. That the Council discuss and consider adoption of the attachedproposed policy entitled "Policy Establishing Standard Procedures For Recognition OfAppointed City Commissioners" or provide further direction to Staff.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LOS BANOSADOPTING A RECOGNITION POLICY FOR APPOINTED CITY

COMMISSIONERS

WHEREAS, by Ordinance the City of Los Banos has established various CityCommissions; and

WHEREAS, the City Council of the City of Los Banos wishes to establish formalwritten procedures and guidelines to recognize the valuable contribution that members ofcity commissions make to the community.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City ofLos Banos hereby adopts a policy for recognizing individuals who voluntarily serve oncity commissions as set forth in the attached policy entitled "City of Los Banos PolicyEstablishing Standard Procedures For Recognition ofAppointed City Commissioners."

CITY OF LOS BANOSPOLICY ESTABLISHING STANDARD PROCEDURES FORRECOGNITION OF APPOINTED CITY COMMISSIONERS

PURPOSE:

To establish guidelines for formal recognition in support of individuals who serve on CityCommissions.

TYPES OF RECOGNITION AWARDS:

Certificates and Proclamations: Types of recognition include Certificate of Appointmentand Oath of Office and Recognition Proclamations.

REQUEST CATEGORIES:

The City Clerk shall prepare a Certificate of Appointment and Oath of Office andRecognition Proclamations consistent with the categories below. Recognition requestsfor city commissioners not consistent with the categories and/or recognition awardsspecified below must be approved by the City Council.

Appointed Commissioners:

• City Commissioner Appointments: Newly appointed commission members willbe presented with a Certificate of Appointment and Oath of Office upon taking theoath of office.

• Outgoing City Commissioners: Upon leaving office, commission members whohave completed at least two full terms of office will be presented with a RecognitionProclamation at a City Council meeting.
