Don't you just love spring? It's a time for fresh starts with new energy and anticipation of yet another beautiful summer in Lincoln. We are so lucky as Lincolnites to have well planned and well maintained parks and trails, challenging and affordable recreation options and a sense of community pride and support for various charities and non-profits. As a

life-long lincolnite I have never been more proud of the direction our community is heading and the growth and investments being made.

We have challenges ahead of us but I have great respect for community leaders, both business and civic, and their ability to lead through experience and thoughtful understanding. This is evident in the most recent vote by our City Council to nealry unanimously pass a resolution offered by Councilman Roy Christensen to return the expected property tax re-evaluation windfall to the taxpayers.

With the current two-year budget set, no additional tax dollars are required or necessary to fund the operations of the city. Property taxes were increased in order to fund this year's budget and to fund the second year of the two-year budget as well. It was stated by several councilmembers in their comments prior to voting that this is non-binding agreement, that it was merely symbolic, but the fact is, six of the seven councilmembers recognize that we as taxpayers are tapped out. We need property tax relief and I for one appreciate the efforts put forth and commitment made to the taxpayers of Lincoln. Thank you councilmembers!

Sticking with local politics, I encourage everyone to participate in our cities upcoming city election by supporting candidates that support your personal views and most importantly, VOTE. Eight individuals are running for three at-large city council seats of which six will pass through the April 4 primary to the May 2 general election. The LIBA PAC has endorsed three of the candidates for their support of their commitment to working to ensure the success of Nebraska business and families.

Those endorsed candidates are, Roy Christensen, Tom Nesbitt and Brayden McLaughlin. These three men when elected, will work on growing economic development in Lincoln as well as assisting and supporting job creators and providers. All three are concerned with the high property tax rates in Lincoln and support fiscal prudence with the taxpayers money. I am also

We also have a contested race in District 5, Board of Education primary election. The LIBA PAC has endorsed both of the candidates for this race. Lanny Boswell and Preston Harris are both highly qualified for a position on our board of education and will prioritize high quality outcomes for the community and our children.

Please exercise your right as a citizen of Lincoln and vote for thse candidates. To the candidates, thank you for your willingness to serve and best wishes in the upcoming elections.

You have an employee come to you and say the stress of their job is getting to be too much and they need a “mental health day” off from work. How can you respond as their employer?

DEPRESSION, PTSD & OTHER MENTAL HEALTH CONDITIONS IN THE WORKPLACE: YOUR LEGAL RIGHTSThe EEOC in December issued this resource document that

explains workplace rights for individuals with mental health conditions under the Americans with Disabilities Act of 1990 (“ADA”). The EEOC in this resource document found employees who have depression, post-traumatic stress disorder (“PTSD”), or another mental health condition, are protected against discrimination and harassment at work because of their condition, have workplace privacy rights, and may have a legal right to get reasonable accommodations that can help them perform and keep their job.

FAMILY AND MEDICAL LEAVE ACT (“FMLA”)The federal FMLA may cover an employee’s leave request if the mental illness relating from stress qualifies as a “serious health condition” under the FMLA. Accordingly, the employer must know that the leave request “triggers” and recognize, based on the information that it has, when an employee’s absence may qualify as FMLA leave and ask for more information if appropriate.

EMPLOYER COVERAGEThe federal ADA covers employers with 15 or more employees for each working day in each of 20 or more calendar weeks in the current or preceding calendar year. The Nebraska Fair Employment Practice Act also prohibits employers with 15 or more employees for each working day in each of 20 or more calendar weeks in the current or preceding calendar year from discriminating in the workplace based on disability. Even if you do not have 15 or more employees, which is required for employers to be subject to the federal Title VII or the Nebraska Fair Employment Practice Act, you may still be covered under the Lincoln Municipal Code anti-discrimination law. The City of Lincoln Municipal Code prohibits discrimination in the workplace based on disability. Employers subject to the Lincoln Municipal Code need only employ four or more employees for each working day in each of 20 or more calendar weeks in the current or preceding calendar year. The federal FMLA covers private sector employers who employ 50 or more employees for at least 20 work weeks in the current or preceding calendar year.

RESPONSE TO A REASONABLE ACCOMODATION REQUESTThe EEOC in its recent resource document on mental health coverage stated in response to the following question: “What will happen after I ask for a reasonable accommodation?”:

Your employer may ask you to put your request in writing, and to generally describe your condition and how it affects your work. The employer also may ask you to submit a letter from your health care provider documenting that you have a mental health condition, and that you need an accommodation because of it. If you do not want the employer to know your specific diagnosis, it may be enough to provide documentation that describes your condition more generally (by stating, for example, that you have an "anxiety disorder"). Your employer also might ask your health care provider whether particular accommodations would meet your needs. You can help your health care provider understand the law of reasonable accommodation by bringing a copy of the EEOC publication The Mental Health Provider's Role in a Client's Request for a Reasonable Accommodation at Work to your appointment.

If a reasonable accommodation would help you to do your job, your employer must give you one unless the accommodation involves significant difficulty or expense. If more than one accommodation would work, the employer can choose which one to give you. Your employer can't legally fire you, or refuse to hire or

I NEED A “MENTAL HEALTH DAY” OFF FROM WORK!promote you, because you asked for a reasonable accommodation or because you need one. It also cannot charge you for the cost of the accommodation.

EMPLOYEE CANNOT DO THEIR REGULAR JOB EVEN WITH AN ACCOMMODATIONAccording to the EEOC even if your employee cannot perform all the essential functions of their job to normal standards and have no paid leave available, the employee still may be entitled to unpaid leave as a reasonable accommodation if that leave will help the employee get to a point where they can perform those functions. The EEOC also points out that the employee may qualify for FMLA leave which is enforced by the U.S. Department of Labor. Finally, if the employee is permanently unable to do their regular job, the EEOC recommends that the employee ask the employer to reassign them to a job that they can do as a reasonable accommodation.

EMPLOYER’S PROACTIVE RESPONSELIBA members need to ensure that they are ADA and FMLA compliant while also combatting abuse. You need to ensure that your leave policies are compliant with the federal and state laws and that your supervisors understand these laws. Supervisors need to be aware of the paperwork requirements for leave requests, particularly under the FMLA, and what they can ask of an employee when that employee requests that “mental health day off” from work.

Large companies, like Wal-Mart, are perceived as deep pockets and attractive targets for lawsuits. In 2000, Wal-Mart was sued 4,851 times, or once every two hours, making Wal-Mart the second most commonly sued entity, behind the US government. By 2016, suits against Wal-Mart had increased to 20 times a day.

Wal-Mart, as the nation’s largest private employer (1.5 million U.S. employees), also faces exposure from employment suits. Recently, in Kelleher v. Wal-Mart, the Eighth Circuit examined a suit against Wal-Mart by an employee alleging disability discrimination, failure to accommodate, retaliation, and harassment.

The Court noted the plaintiff began at Wal-Mart unloading trucks before switching to nighttime stocker, a position also requiring physical activity.

In 2009, the plaintiff sought an accommodation for an additional 15-minute shift break to take medicine following a diagnosis of multiple sclerosis. Despite lack of documentation, the plaintiff was accommodated with longer breaks and no use of ladders.

In 2011, following an appendectomy, the plaintiff submitted another accommodation request for an additional 15-minute break; however, the note from her physician indicated she would need a 3-minute break every 45 minutes and couldn’t lift over 10 lbs., lift overhead, walk over 300 feet, or work in freezers.

Wal-Mart determined the plaintiff couldn’t perform the essential functions of her job and placed her on unpaid leave while they ascertained a suitable position. She was transferred to overnight

cashier (with a raise), although she also continued stocking without the use of ladders.

In filing suit, the plaintiff claimed retaliation by giving a $.40 raise (instead of $.50); requiring her to work alone; difficult assignments; supervisors rolling their eyes at her, ostracizing her, holding her to a higher standard, and giving her twice the workload of others while asking her about the completion of her work.

In upholding summary judgment against her, the Court noted the plaintiff: 1) had to demonstrate a qualifying disability (undisputed), 2) could perform with or without a reasonable accommodation (which the Court did not address), and 3) must have received an adverse employment action, which the Court held was both absent and dispositive in the case.

Specifically, the Court found being moved to cashier, for which she received a raise, and other “minor changes in duties or working conditions, even unpalatable or unwelcome ones, which cause no materially significant disadvantage, do not rise to the level of an adverse employment action.”

Further, regarding eye-rolling supervisors, the Court noted anti-discrimination laws do not create a general civility code. Teasing, offhand comments, and isolated incidents (unless extremely serious) will not amount to discriminatory changes in the terms and conditions of employment, especially when the plaintiff conceded supervisors treated many employees poorly.

Learn from Wal-Mart, which aggressively defends frivolous lawsuits to deter them, even when it might be cheaper to settle. Wal-Mart also had written job descriptions and gave reasonable accommodations. It required medical documentation. It acted thoroughly after thoughtful analysis. In short, learn from Wal-Mart.

City Returns the WindfallBy Coby Mach

I recently appeared before the Lincoln City Council to talk about the upcoming windfall of property taxes. This was my message:

On behalf of the Lincoln Independent Business Association I am here to support the resolution that would return the property tax reevaluation windfall to the taxpayers.

Members of the city council, your two year budget is set.

Your two year budget is done.

Property taxes were increased in order to fund this year’s budget and to fund next year’s budget, so you have all the money you need.

On top of that, you have over $1 million dollars in extra money due to personnel savings. No one expected you would have an extra million, but you do, and now you are trying to decide how to spend it.

In short, you do not need a single dime of the property tax reevaluation windfall.

There should be no debate about what to do with the reevaluation windfall. Return the windfall to the taxpayers.

This windfall is not coming from commercial property, office property, retail or manufacturing. The windfall is coming from homeowners. As a community we need to stand up for families and their ability to afford a home.

Certainly the City Council could find a hundred ways to spend this windfall. But we urge you to return it homeowners.

The recent housing market conditions have played a part in the increased values throughout Lincoln. In January of 2014, there was close to 1,300 single-family residential listings in the Lincoln housing market. That number has dwindled to 743 as of December 2016. The low supply and high demand have caused the median house price in the Lincoln area to reach a new record high of $166,000.

The valuation increase, however, should be a benefit to homeowners, not a windfall to local taxing authorities. We reject any notion that reinvesting the property tax revaluation revenue increase is an example of reinvesting the growth dividend. Such a notion assumes that the cause of the so-called “dividend” was the growth of Lincoln. Certainly, there was an increase in the overall value of property, but this was largely influenced by the high-demand, low-supply residential housing market of the past three years.

I was asked by one council member if LIBA would send the same message to all taxing authorities. The answer is yes. And we encourage you to do the same. Your voice counts and I hope you will take the time and effort to contact your elected official.

Finally, I would like to thank the members of the City Council who voted for the resolution that would lower the property tax rate. Roy Christensen, Trent Fellers, Cyndi Lamm, Leirion Gaylor Baird, Jon Camp and Carl Eskridge.

Budget Monitoring CommitteeThe Budget Monitoring Committee meets on the third Tuesday of every month. During the March meeting, the Committee discussed budget concerns at the City, County, and LPS levels. The Committee received updates from City Councilwoman Cyndi Lamm, County Commissioner Roma Amundson, and Lincoln Public Schools Board Member Matt Schulte. There is continued concern that local taxing entities will get a major windfall from the drastic increase in property valuations. The City Council adopted a non-binding resolution on March 20 in which it pledged it “will not rely on the increased property tax revenue … to increase spending”. The measure passed 6-1.

The next Budget Monitoring Committee meeting will be held April 18 starting at 7:30 a.m. at the LIBA office.

Legislative Action CommitteeThe Legislative Action Committee meets the first Thursday of every month. During the March meeting, the Committee discussed primarily the Lincoln City Charter. In the past, the Committee has discussed various potential revisions and improvements of the City Charter. Dr. Robert Blair, Professor of Public Administration and Urban Studies and Director of the Urban Studies Program at the University of Nebraska at Omaha, will be the guest presenter at the April meeting. Dr. Blair will deliver a presentation to the Committee regarding the costs and benefits of two different forms of municipal government.

The April meeting will be April 6 at 11:45 AM at the LIBA office.

School LiaisonThe March School Liaison Committee meeting

was cancelled. An issue the Committee continues to monitor is the potential that the Lincoln Board of Education may potentially rely on the property tax revaluation windfall in its upcoming budget process. In the next weeks and months, the Board will be preparing to set its budget for the 2017-2018 fiscal year, and it is important for constituents to communicate with the Board.

The School Liaison Committee meets the first Tuesday of every month. The next meeting will take place Tuesday, April 4 at 11:45 AM at the LIBA office. LPS representatives will join us in April.

Government CaucusThe LIBA Government Caucus meets on the fourth Tuesday of every month with speakers that are engaged in the community. The speakers for the March meeting were the candidates for District 5 Lincoln Board of Education, Preston Harris and Lanny Boswell. The next meeting will be April 25 at 11:45 a.m. at Pizza Ranch, 8420 Lexington Avenue. To join us, please call the LIBA office at 402-466-3419.

LIBA LuncheonThe March LIBA Luncheon featured seven of the eight candidates for Lincoln City Council. Deb Andrews, Leirion Gaylor Baird, Lou Braatz III, Roy Christensen, Brayden McLaughlin, Tom Nesbitt, and Bennie Shobe had five minutes each to discuss what they would do with the property tax windfall funds and how they would work for Lincoln businesses if elected. Before the City Council Forum Bill Lien was awarded with the Chairman’s Gavel for his leadership as Chairman of the LIBA Board of Directors. Ken Svoboda recently succeeded Mr. Lien as Chairman.

Next month’s LIBA lunch will be in the Jasmine Room at the Grand Manse on Tuesday, April 18 at 11:30 a.m. Our guest speaker will be Speaker of the Nebraska Legislature, Senator Jim Scheer. Lunch is $13 and is served buffet style. Parking is also free in the Graduate Hotel parking garage across the street as long as it is available.

Bizco BiznetLIBA’s April Bizco Biznet will be Thursday, April 13 from 4:30 to 6:30 p.m. and hosted by Custom Blinds & Design, 6101 S. 56th Street. Drinks and hors d’oeuvres will be served. This event is open to all LIBA members and their guests. Bring a friend and enjoy some great food, drinks, and networking!
