    Introduction

    In October 2011, the 39 th Judicial District which consists of Franklin an d Fulton Count ies wa s notified bythe Administrative Office of Pennsylvania Courts (AOPC) of its requirement under 42 Pa. C. S . A. 1503 toparticipate in the reestablishment of magisterial districts.

    As a result of this announcemen t , judicial districts across the Commonweal th were tasked with assessingwhether it is feasible to eliminate an y magisterial districts through both an analysis of data an dconsideration of additional relevant circumstances. Statistical data and guidelines for this process wereprovided by AOPC for the last six years ( 2005 -2010) for case fi l ings for criminal, traffic, n o n -traffic,pr iva te compla in ts , civil, landlord- tenant, an d miscellaneous docket f il ings . In addition to case filingstatistics, a new measure was developed to differentiate among case types an d judicial workload.This reestablishment process occurs every ten years an d is directly related to the Federa l decennialcensus. Th e guidelines ind ica te t ha t th e 39 ` h Judicial District shall submit recommendat ions to th e AOPCregarding the reestablishment of its District Courts no later than March 30, 2012.Th e following report, along with required worksheets provided by th e AOPC, will meet the requirementsof the AOPC.

    Guidelines

    Magis teria l D is t ri ct Reestabl ishment guidel ines an d packets were provided in October 2011 by AOPC. Inaddit ion, a Regional Reestabl ishment Workshop w as h e ld in N o ve mb er 2 01 1 w h ic h wa s facil i tated byAmy Kehner, Jud ic ia l Programs Administrator with AOPC. For th e current reestablishment project, theAOPC provided standards which counties are to review and make recommendations. These standardsar e outlined in the document provided by the AOPC, Magisterial District Reestabl ishment Guidelines. Inaddition to these written guidelines, Franklin County was advised b y th e A O P C to u s e 0c l a s s datab e c a u s e Franklin County moved from 5 ` h c l a s s status to 4 th c l a s s status effective January 2 0 1 2 . L a s t l y ,Franklin County , after conferring with AOPC, elected to remove data from C en t re C o un t y because theiraverage caseload is significantly higher than all other 4 th class counties.The goal of the Supreme Court is a 10% reduction in the Commonwealth' s district courts. The AOPCpreferred method is to eliminate magisterial districts through attrition. Whenever practical, reductionsshould occu r by eliminating a district which is v ac an t o r in which t h e in c u mb en t is retiring or n otplanning to seek reelection. When elimination through attrition is not feasible, average caseload shouldbe used to evaluate whether t o e limina te on e o r m ore magisterial districts. B y using th e data providedby AOPC, the average caseloads for each judicial district should be compared to the average caseloadsfor judicial districts within same class of county.

    Recommendation:

    B e c a u s e th e 3 9 ` h J u d i c i a l District s p a n s two c o u n t i e s , magisterial districts within e a c h county weresepara te ly cons idered. Wth th is said, there is no recommendation to eliminate an y exist ing districtcourts within the 39th Judicial District. However, Realignment should occur for District Courts 39 -3 -03,39 -3 -04, and 3 9 -3 -06; and Reestablishment should occur for District Courts 39 -2 -01, 3 9 -3 -02, 39 -3 -05,39 -3 -07, 39 -4 -01, 39 -4 -02, and 39 -4 -03. There are several reasons for this recommendation.

    1 . During the 2002 Magisterial District Reestabl ishment Process, Fra nk li n Coun t y wa s a 5 t hClass County an d requested approval from AOPC to ad d an additional Magis teria l D is t ri ct39-3 -07). That request was granted and 39 -3 -07 was added. Ten years later, Franklin

    County moved from 5 1 h class status to 4t h class status, but h as elected to not ad d anothermagisterial district. Instead, believes mainta in ing seven magisterial districts are warrantedgiven a jump in class status.

    2 . Frankl in County is g rowing rap id ly . According to U . S . Census estimates, Franklin County ' spopulation grew by 15 . 7 % from 2002 ( 129, 313) to 2010 ( 149, 618) . Only two countiesexperienced growth more rapidly than Franklin County. Pike County (23 . 9 % ) an d MonroeCounty (22 .5 %) . Because of t h is growth , Franklin Coun ty moved to a 4 t h class coun ty in2012.

    3 . Franklin County h as seven Magisterial District Courts; however, the average number ofdistricts for a 4 t h class county is 8. 3 .

    4. AOPC guidelines state that all portions of the magisterial district must be contiguous. Thetwo districts with both the highest caseloads and workloads are 39 -2 -01 and 39 -3 -02. Thetwo districts with both the lowest caseloads and workloads are 39 -3 -03 and 39 -3 -06.However, these districts are not contiguous to those with the highest loads, so a simple shiftof caseload and workload from 39 -2 -01 and 39 -3 -02 to 39 -3 -03 and 39 -3 -06 is not possiblebecause this would result in a non -contiguous split.

    5 . Growth in Magisterial District 39 -3 -05 is anticipated due to Norfolk Southern IntermodalProject taking place in Antrim Township. In addition to anticipated growth within 3 9 -3 - 05, itis anticipated that th is Intermodal expansion project will bring a population increase to notonly Antrim Township, but neighboring or contiguous municipalities. Magisterial District 3 9 -3- 06 neighbors Antrim Township. Business district growth is also anticipated as a result ofthis Intermodal project.

    6. It is anticipated that Magisterial District 39 -3 -06 will see an increase in filings as a result ofcha ng e associated with a newly elected Magisterial District Judge taking office in January2012. The previous Magisterial District Judge was in office since 1981. In the first twomonths of 2012, personnel from 39 -3 -06 have shared with Court Administration thatcriminal, traffic, an d n on - raffic fi l ings are slowly on the rise an d payments /foot traffic in theoffice is increasing. It is anticipated that a change in culture and practices will continue tobe contributing factors that will lead to increased ca se loa ds a nd workloads for 3 9 -3 -06 . Inaddition to c h an ge in leadership, a large landfill business ( MountainView Reclama tion a ndWaste Managemen t ) straddles both Antrim a n d P e te rs Township , an d that as a result of

    patrols by la w enforcement, result in increased traffic fi l ings to both 3 9 -3 -05 an d 3 9 -3 -06depending on th e enter /exi t route taken (either in to Antr im Township or Peters Township).It is proposed that by designation, al l traffic related filings pertaining to this b us in e ss b e filedwith 39 -3 -06 . Traffic filings associated with th is business typically range from 15 to 30 peryear, but ca n vary depending on detail by law enforcement.

    7. Both Franklin and Fulton Counties utilize a Central Court program. With regards to FranklinCounty ' s Centra l Court , th is procedure has been establ ished since January 2001. It isproposed that there be more of a rotation by Magisterial Judges in 3 9 -3 -03 an d 3 9 -3 -06through Centra l Cour t in an effort to create more of workload equity within Fra nkli n Cou n t y.Currently, judges a re a s sig ne d to the weekly Central Court sess ions on a rotation basis. Allseven Magisterial District Judges in Franklin County will still rotate through Central Court;however, Magisterial District Judges in 39 -3 -03 and 39 -3 -06 will rotate through more often,thus increasing their workload due to increased participation in the countywide CentralCour t process. It is anticipated that this newly scheduled rotation will afford MagisterialDistrict Judges in 3 9 -2 - 01 an d 3 9 -3 -02 more scheduling opportunities within their offices,thus making overall workload more equitable within Frankl in County.

    8. All Magisterial District Judges in Franklin and Fulton Counties take rotations with regards tobeing on call. In Frank lin County , th e practice has been that th e on -call judge will docket th ecase to their office w h e n h a n dle d on call even when case is outside of their municipality.This practice will c h an g e a n d o n -c all judges will docket cases to the respective municipality.This will provide a more accurate reflection of caseloads and workloads for all districts;particularly, 3 9 -3 -03 and 3 9 -3 -06.
