YouremploymentwithManpowerYouarepermanentlyemployedbyManpowertoperformassignment-basedworkforourclients.Manpowerisyouremployer;wepayyourwagesandholidaypay,deductyourtaxandpaytheemployer’scontributionandpensionschemecontribution.

Secrecy/ConfidentialityAsaManpoweremployeeyoumayworkfornumerousclientsandcomeintocontactwithmany differentpeople.Youmustthereforeregardeverythingyougettoknowasconfidential.Neverdiscussconfidentialinformationwithanyoneelsethantheclientandyoursupervisor.Thedutyofconfidentiality alsoappliesonterminationofyourassignment.

ContractofemploymentPriortoyourfirstassignment,bothyouandManpowermustsignanemploymentcontract. Theemploymentcontractincludesgeneralprovisionspertainingtoyouremployment.Wehave translatedouremploymentcontractintoseverallanguages–pleasenotifyusifyourequirethe contractinadifferentlanguage.

AssignmentconfirmationWhenwehaveagreedonanassignment,youwillreceiveconfirmationoftheassignmentbye-mail.Thiswillstatethedurationoftheassignment,workinghours,tasks,location,hourlywages,overtimetermsandholidaypayrate.

Follow-upWewillfollowyouupregularlyandprovidefeedbackonyourwork.Itisalsoimportantthatyouprovideuswithfeedbackonwhetheryouaresatisfiedwithyourtasks,whethertheyareaccordancewiththeagreementandwhetheryouarelookingfornewchallenges.RemembertoupdateyourCVat manpower.nowhenyouhaveacquirednewqualifications.

ExtensionofassignmentsandnewassignmentsIftheclientwishestoretainyoubeyondtheagreedperiod,theclientmustcontactus.Wewill subsequentlyapproachyouregardinganextensionoftheassignment.Iftheclientdoesnotrequireanextension,wewillworktofindotherassignmentsforyou.Youarefreetoacceptordeclinenewassignmentsorextensionsofassignmentsthatyouareoffered.

TerminationofassignmentspriortotheagreedtimeInsomecasestheclientwishestoterminatetheassignmentpriortotheagreedtime.Ifyouare notifiedofsuchbytheclient,youmustnotifyyourManpowersupervisorwithoutunduedelay.Inordertoreceivesalaryfortheentireagreedassignmentperiod,yourareobligedtoacceptsuitableworkwithanotherclientfortheremainderoftheassignmentperiod.

NoticeandperiodofnoticeWhenyouhaveacceptedanassignment,youmustremainatworkfortheentiredurationoftheassignment.Ifyouwishtoterminateworkpriortotheconclusionoftheassignmentperiod,aonemonthperiodofnoticeapplies,fromthefirstdayofthemonthafternoticehasbeengiven.

Manpowermayterminatetheemploymentrelationshipifthereisjustcausefornoticeor dismissal.Inthecaseoftermination,aonemonthperiodofnoticeapplies,fromthefirstdayofthemonthfollowingthatinwhichnoticewasgiven.Theemploymentrelationshipisconcludedimmediatelyintheeventofdismissal.AlsoseetheWorkingEnvironmentAct’sprovisionsconcerningtermination.

PerformancereviewWhenyouhaveworkedfor1000hoursinthelast12months,youwillbeofferedanannualappraisalinJanuary/February.BothyouandyourManpowersupervisorcantaketheinitiativeforanappraisal,butitisourresponsibilitytoensurethattheappraisalisconducted.Theappraisalallowsusto reconcileexpectationsandrequirementsfrombothparties.

CertificateofemploymentIfyouterminateyouremploymentrelationshipwithManpower,youareentitledtoacertificateof employment.Thecertificatemustincludeyourname,dateofbirthandinformationonthetypeofworkyouhavecarriedoutandthedurationoftheemploymentrelationship.

WagesandworkingconditionsYourwagesandworkingconditionsmustcomplywiththeequaltreatmentprovisionsoftheWorkingEnvironmentAct/CivilServiceAct.Theequaltreatmentprovisionsentailthatyouasahiredassociateareentitledtothesamewagesandworkingconditionsthatyouwouldhavehadasadirectemployee(usuallytemporary)inacomparablepositionwiththeclient.Thisentailsthatyourwagetermsmayvaryindifferentassignments,andthesewillbestatedinyourassignmentconfirmations.

WorkinghoursYouragreedworkinghourswillbestatedintheassignmentconfirmation.

OvertimeIfyouareorderedtoworkovertime,thegeneralruleisthatyougetovertimepayinadditiontothenormalhourlyrate.Thiscompensationwillbestatedinyourassignmentconfirmation.ThedutytoperformovertimeworkfollowsfromtheprovisionsoftheWorkingEnvironmentAct.

AccordingtotheWorkingEnvironmentAct,thedurationofovertimeworkmaynotexceed:•10hoursinthecourseof7days•25hoursinthecourseof4weeks•200hoursinthecourseof52weeksTotalworkinghoursincludingovertimemaynotexceed13hoursper24hours.

Iftheclientisboundbyacollectiveagreement,otherworkingandovertimearrangementsmaybeagreedwiththeclient’semployeerepresentatives.Inthiscase,theseruleswillalsoapplytoyou.

AdditionalworkIfyouareworkingpart-time,youmustworkafullworkingdayandfullworkingweek (correspondingtoa100%position)inordertoreceiveovertimecompensation.Workbeyondagreedworkinghours,butwithinthescopeofa100%position,iscalledextrawork.Extraworkis compensatedattheregularhourlyrate.Thedutytoperformextraworkfollowsfromtheprovisions oftheWorkingEnvironmentAct.

ShiftworkIfyouareworkingaround-the-clockshift,acontinuousshiftorarotasystem,workinghoursandanyovertimewillbeagreedforeachindividualassignment.

DisagreementsIfthereisdisagreementwiththeclientconcerningtimesheets,youmustbringthisupwithyour Manpowersupervisor.Deliberatefalsificationoftimesheetswillbereportedandwillhave consequencesfortheemploymentrelationship.

ReimbursementoftravelandsubsistenceexpensesContactyoursupervisorassoonasyouareawarethatyouaregoingonabusinesstripsothatwemaycheckthatyouhavethenecessaryinsuranceforthetrip.Ifyouaregoingonabusinesstrip,youmaybeentitledtoadailyallowancesubjecttoagreement.Atravelexpenseformisavailableatwww.manpower.no.Theformmustbesignedbytheclientbeforebeingsubmittedtothepayrolloffice.

TaxdeductioncardYoumustsubmityourtaxdeductioncardtoyourManpowersupervisorassoonaspossible.Ifwearenotinpossessionofataxdeductioncarduponpaymentofwages,weareobligedtodeduct50%tax. Contactusatskattekort@manpower.noifyouhavequestionsconcerningyourtaxdeductioncard.

TaxexemptioncardIfwehavereceivedataxexemptioncardforthecurrentyear,wageswillbepaidwithouttax deduction.Ifwereceiveacopyofataxexemptioncard,weareobligedtodeduct50%tax.

PaymentofwagesWemusthaveyourtimesheetbeforethesubmissiondeadlineinordertopaywagesattheagreedtime. Ifwereceivethetimesheetafterthedeadline,youmustwaituntilthenextpaydayforwagestobepaid. Reducedtaxdeduction9.DecemberOnthesalarypaymenton9Decemberyourtaxdeductionwillbereducedasfollows:Timesheetfortheperiodfrom16.-30.November.(halfmonth)ispaidwithouttaxdeduction. Timesheetfortheperiodfrom1.-30.November.(fullmonth)ispaidwithhalftaxdeduction.Reducedtaxdeductionisonlymadeforthesalarypaymenton9.December.

HolidayYourrighttoholidaysanddeterminationofholidaysfollowfromtheprovisionsoftheHolidayAct.Duringanagreedassignmentperiodyouareboundbythesamerulesforholiday,holidaypay,daysoffandcompensationonsuchdaysastheclientwouldhaveusedifyouhadbeen(usuallytemporarily)employedwiththeclient.Youareentitledtoaminimumof3consecutiveweeksholidayduringtheperiod1.Juneto30.September.Remembertoagreeonholidayinwellinadvance,bothwithyourManpowersupervisorandtheclient.

HolidaypayHolidaypayispaidpursuanttotheprovisionsoftheHolidayAct.TheHolidayAct’sprovisions stipulatethatyouareentitledto21daysofholidaypercalendaryearandthatyouareentitledto holidaypayfromManpoweratarateof10.2%ofyourholidaypaybasis.Ifyouareonanassignment wheretheclienthasahigherholidaypayrate–forexample12%(correspondingto5weeksofholiday)–thisholidaypayratewillbeusedforthisassignment.Theholidaypayratemayvaryfromassignmenttoassignmentandwillbestatedonyourassignmentconfirmation.Holidaypayispaid 9June.

Payforpublicholidays(1.and17.May)Youwillreceivewagesifyouareonassignmentforatleast30daysaroundthepublicholiday.Youmustalsobeatworkfortheclientonthelastworkdaybeforeandfirstworkdayafterthepublicholiday.ThisdoesnotapplyifthesedaysareonaSundayorotherholiday(byholidayitismeantredletterdaysinthecalendar).Itisalsorequiredthatyouwerescheduledtoworkonthedayoftheweekthatthepublicholidayfallson.

Payformovableholidays(1.January,MaundyThursday,GoodFriday,EasterMonday, AscensionDay,WhitMonday,ChristmasDayandBoxingDay)Yourassignmentconfirmationwillstatewhetheryouwillbepaidformovableholidays.

Otherdaysinconnectionwithfestivals(e.gWednesdaybeforeMaundyThursday,ChristmasEve andNewYear’sEve) Youwillbepaidtheregularhourlyrateforthetimeyouareatwork,unlessotherwiseagreed.

TimeoffforotherreligiousholidaysIfyouareamemberofadifferentreligiouscommunitythantheNorwegianChurch,youareentitledtotwodaysofholidaywithoutpaypercalendaryearinconnectionwithreligiousfestivals.

YoumustnotifyyourManpowersupervisoratleast14dayspriortotheholiday(s).

Absenceand/orillnessNotificationIfyoubecomeillorareotherwiseunabletoattendworkattheagreedtime,youmustcallyourManpowersupervisorinthemorningofthefirstdayofabsence.Textmessagesande-mailswillnotbeaccepted,exceptifyouareworkingevenings/nights.Ifyouareunabletoreachyoursupervisor,pleasecallourswitchboardon22018000,whichwillconnectyoutotheappropriatedepartment.

Inthecaseofabsenceduetoillnessbeyondoneday,youmustcalluseveryday.Failuretodosomayvoidyourrighttosicknessbenefits.Anymedicalcertificatemustsubmitted/senttoyour supervisorassoonaspossible,andwithin14daysatthelatest.Inthecaseofanextensionofthemedicalcertificate,yoursupervisormustbenotifiedonthesameday.

Self-certification Youmusthavebeenemployedfortwomonthsbeforeyoucanuseself-certification.Thesetwomonthsarecalledtheentitlementperiod.Youareemployedbyusfromthemomentyoustartyourfirstassignment.Ifyouhavehadabreakbetweenassignmentsofmorethan14days,youmustearnanewentitlementperiodbeforeyoucanuseself-certification.Ifyouarestillsickbeyondtheself- certificationperiod,wemusthavemedicalcertificatethatappliesnolaterthanthefirstworkingdayaftertheself-certificationperiod.Ifnot,youlosetherighttosickpay–includingfortheself-certification days.

Ifthereisjustcausetosuspectthatself-certificationisusedwithoutbeingill,Manpowerisentitledtorevoketherightofself-certificationforsixmonths.

SicknoteYoumusthavebeenemployedforfourweeksbeforeamedicalcertificateentitlesyoutosickpay.Thesefourweekarecalledtheentitlementperiod.Ifyouhavehadabreakbetweenassignmentsofmorethan14days,whichisnotstatutoryholiday,youmustearnanewentitlementperiodbeforeyoucanuseamedicalcertificate.

Manpowerpayssicknessbenefittoyoufortheperiodyouareentitledtosicknessbenefit,butonlyfortheemployerperiodof16calendardays.AfterexpiryofthisperiodNAVpayssicknessbenefittoyouasfarasyouhavelegitimateclaimtosicknessbenefit.

Sickleaveinconnectionwithoccupationalinjuryiscoveredfromdayone,regardlessofhowlongyouhaveworkedforManpower.

SicknessbenefitandbasisforsicknessbenefitSicknessbenefitispaidfromthefirstdayofabsence.ItisarequirementthatnotificationofabsencehasbeengiventoyourManpowersupervisoronthefirstdayofabsence,andthataphysicianhasbeencontactedthesameday.Sicknessbenefitispaidas100%ofaverageincome(notincludingovertime)forthelast4weekspriortoabsence,withanupwardlimitof6xG(G=nationalinsurancebaseamount).Ifyouwork“irregularly,”alongerperiodisoftenusedtocalculatetheaverage.

Self-certification/sicknoteincaseofchildren’sorbabysitter’sillnessInordertobeentitledtoself-certification/medicalcertificatewhenchildrenareill,youmustalsobeentitledtosicknessbenefitsinthecaseofownillnessandhavebeenemployedforfourweeks. Thisrightappliesuptothecalendaryearthechildturns12.Itisalsoimportantthatyoucontactyourdoctoronthefirstdayofabsencethatcannotbedocumentedwithself-certification.Self-certificationinthecaseofsickchildrenandbabysittersmaybeusedforupto3consecutivecalendardays.

Follow-upofsickleaveAsanemployeeyouareobligedtocooperatetofindsolutionstopreventunnecessarilyprolongedabsence.Ifyoubecomeill,wemustcooperateinimplementingappropriateadaptivemeasures. Inthecaseofabsencethatisassumedtolastforaprolongedperiod,wewillsummonyouforfollow-upmeetingsandpreparefollow-upplanstogether.Youhavearesponsibilitytocooperateinthedesignandexecutionoffollow-upplans.Youareonlyobligedtoprovideinformationonyourworkability.

Ifyourabsenceisduetoconditionsattheworkplace,wewishtobeinformedofthis.YourroleinManpower’sInclusiveWorkingLifeworkistotakeresponsibilityandnotifyusifconditionsinthe assignmentoryourhealthindicatethatweshoulddosomethingtopreventfutureabsence.

Follow-upactivities:Within4weeks:Inthemeetingwewillassessthecurrentworkingsituation,thepossibilityofothertasks,adaptationandaids.

Within7weeks:Herewewilllookatthepreviousfollow-upplanandlookatmeasuresthatwere implementedoragreed,assesswhichmeasuresthathavebeeneffectiveandconsidernewmeasures.

Within6months:NAVwillsummonyou,yourdoctorandyourManpowersupervisortoameeting.Priortothismeeting,wemustupdatethefollow-upplantogether.

Doctor/dentistWhenyouhaveworkedfor750hours,youareentitledtopayduringvisitstodoctor/dentistforupto7.5hourspercalendaryear.Travelto/fromdoctor/dentistmaybeincludedinthesehours.RemembertonotifyyourManpowersupervisorinadvance.

PregnancycontrolIfyouarepregnant,youareentitledtotimeoffwithpayinconnectionwithpregnancycontrolwhenthiscannotbeundertakenoutsideofworkinghours.

CareofrelativesIfyouarecaringforcloserelativesinthefinalstagesoflife,youareentitledto60daysleave.CarebenefitisgrantedbyandpaidbyNAV.Youareentitledtoleavewithoutpayforupto10dayseverycalendaryeartoprovidenecessarycareforparents,spouse,cohabitantorregisteredpartner.Thesameappliesifyouarecaringforadisabledorchronicallysickchild.Thisappliesfromthecalendaryearafterthechildturns18.

Health,safetyandenvironment(HSE)OurHSEroutinesareintendedtoensurethatyouhavegoodworkingconditions.Bygoodworkingconditionsitismeantboththephysicalaspectsoftheworkingenvironmentandaworkplacethatprovidesopportunitiesforwell-beinganddevelopment.ReadmoreaboutourHSEroutinesintheHSEmanual.

SubstanceabusepolicyManpowerhaszerotolerancetowardstheuseofintoxicants.Youmustnotbeundertheinfluenceofalcoholorotherintoxicantsoranaestheticsubstancesduringworkhours,orhaveabsenceduetosubstanceuse.Breachesofthisprovisionwillhaveconsequencesfortheemploymentrelationship.

ManpowerhasanagreementwithAKAN(theWorkplaceAdvisoryCenterforissuesrelatedto alcohol,drugsandaddictivegamblingintheworkplace).ThepurposeofourAKANworkistopreventsubstanceabuseproblemsamongemployees,preventaccidents,ensurequalityandagoodworkingenvironment,aswellashelpemployeeswithsubstanceabuseproblemsattheearliestpossibletime.

Oncertainassignmentstheclientdemandsconsentfortestingforsubstanceswhenthisisrequiredbystatuteorregulation,appliestoapositionwhichinvolvesparticularlyhighrisk,orwhentheclientdeemsitnecessarytoprotectlifeorhealth.Theneedtodemandtestingforsubstancesisordinarilyclarifiedpriortoenteringintoassignmentcontracts,butitmayalsobecomearequirementinexistingassignments.Questionsconcerningtheclient’saccesstothismayberaisedwithyourManpowersupervisor.

Ifyouareinneedofadviceandguidance,youmayenquirewithyoursupervisor,whointurnwillcontactourAKANsupervisor.Suchmattersareconfidential,andenquiriesarenotsubjecttoregistration.

InsuranceOccupationalinjuryandillnessAsanemployeeofManpoweryouhaveoccupationalinjuryinsurance.Occupationalinjuryinsuranceapplieswhenyouareonassignmentforus.Theinsurancecoversinjuriesand/orillnessesinflicteduponyou:whileworking,attheworkplaceandduringworkinghours.Ifyouareinjuredonthewaytoorfromwork,orinyourfreetime,youarenotcoveredbyManpower’sinsurance.CompensationamountsfollowfromtheActrelatingtoindustrialinjuryinsurance.

Ifyouaresounluckyastoexperienceanoccupationalinjuryoroccupationalillness,itisimportantthatyourManpowersupervisorisinformedassoonaspossible.Togetherwithyoursupervisoryoumustcompleteanoccupationalinjuryform,whichissenttoyourlocalNAVoffice.NAVwillconsiderwhethertheinjuryisapprovedasanoccupationalinjury/illnessornot.Onceyouhavereceiveda letterfromNAVconfirmingsuchapproval,youmayapplyforarefundforexpensesincurredforpublicmedicaltreatmentfromHELFO.Damagetoclothes,objects,etc.arenotrefunded.Sickleavein connectionwithoccupationalinjuryiscoveredfromdayone,regardlesshowlongyouhaveworkedforManpower.

OffshoreinsuranceForthoseworkingoffshorewehaveaseparateoffshoreinsurance.Theinsurancecoversbodilyinjuryordeathasaresultofanaccidentthatoccursoffshore.Compensationisprovidedintheeventofdeathorpermanentmedicaldisability.Theinsuranceamountisupto45G(G=nationalinsurancebaseamount).Thecoverageiscoordinatedwithoccupationalinjurypayments,suchthat45Gisthemaximumcombinedpaymentthatmayoccurintheeventofaccidents.

BusinesstravelinsuranceYouarecoveredbyourbusinesstravelinsuranceifyouareamemberoftheNorwegianNational Insuranceandthetripdoesnotlastformorethan45days.Theinsurancecoverstravelonbehalfoftheclientinconnectionwithassignments.Rewardtrips,kick-offs,contestsandthelikearealsocoveredbytheinsurance,providedthatthesearenottakenasholiday.Inaddition,”naturalfreetime”asaresultofbusinesstraveliscoveredbytheinsurance,butholidaystakenoutduringabusinesstriparenotcovered.

Pension

PensionAllemployeeswhohaveturned20years,whoworkmorethana20%positionandwhoaremembersoftheNorwegianNationalInsurance,areenrolledintheManpower’spensionschemewithStorebrand.ThismeansthatManpowerpaysanamountcorrespondingto2%ofyourincomebetween 1Gand12G(G=nationalinsurancebaseamount).Theamountisnotdeductedfromyourwages,butispaidinadditiontoyourwages.

Youareenrolledfromthefirstmonthyouhavesubmittedtimesheetsshowingthatyouhaveworkedatleast20%ofafullmonth.Youmusthavebeenamemberoftheschemefor12monthsinordertobeentitledtoapaid-uppolicy.
