Well the beast of bureaucracy just keeps getting bigger in our government and it’s costing all of us. We the people are the government, but are we in control. We as businesses feel the slowing economy so we cut as needed. With the cuts that we make we quickly realize that those cuts just get filled in with more taxes (fees, fines, permits, licenses, tickets, & whatever other names they have for taxes). We cut to manage our expenses and

the bureaucrats need more so they just take it with more taxes. I have heard your frustration and feel your pain myself.

One of the largest expenses businesses have are employment costs. In Washington State one of our largest employment costs is Labor and Industries, industrial insurance. Labor and Industries has a monopoly for industrial insurance in Washington. Over the past ten years businesses have improved their on the job safety performance and decreased the number of injuries by fifty two percent. During that same ten years, your labor and industries taxes have increased by fifty three percent and since 1999 labor and industries administrative cost have increased eighty two percent. If we ran our businesses that way we would be out of business. Labor and Industries is a broken system with no plan for repair.

We have an opportunity to do something more than complain about this broken system. Since our elected servants aren’t

fixing the broken system, we the people will. Your state BIAW leadership has taken the lead on Initiative 1082 to offer an option to the monopoly the state has by privatizing industrial insurance. What this will mean for business owners is much lower industrial insurance premiums because of competition from private industry. What this means for employees is no more industrial insurance being pulled from their paychecks. What this means for Washington State is being one step closer to being a business friendly state.

Our opportunity is here now in the form of Initiative 1082. I’m asking you to get the signature form in your hands and get every person (registered voter) you know to sign it. If you know businesses with store fronts ask if you can leave one there. Keep one in your trucks, get your family, friends, co-workers, neighbors and even strangers to sign it. It doesn’t matter if you have twenty signatures or one signature get them in. If you need them delivered to you, contact any staff member and we will get them to you or pick up the ones you have signed. Let’s use our time not to complain about terrible business environment in Washington state, but make a positive difference by getting signatures and voting yes on initiative 1082 this November. I’m always in awe of and very grateful for the continued generosity and compassion that our members have for those in need. Again this year, we had an opportunity to participate in the annual Rebuilding Together Day on May 15—an opportunity to make much needed improvements to the homes of those who are generally elderly, disabled, or simply cannot afford to have the repairs completed on their own accord.

While this month’s edition of the Builders’ News contains an article specific to this year’s Rebuilding Together Day, I wanted to take just a moment in my article to wholeheartedly thank those NCHBA members who continue to get involved in giving back to the communities in which we live, work and raise our families. I’m so proud to represent a group of professionals who not only provide for a very basic human need—shelter, but who are also so willing to step up and help improve the lives of those in need. THANK YOU!

By now, hopefully every single member is keenly aware of our initiative effort to privatize the workers’ compensation system in Washington State. Initiative 1082 is scheduled to appear on this November’s ballot, and would allow private insurers to compete with the state Department of Labor and Industries and sell workers’ compensation insurance to employers in Washington State.

The bottom-line here is this: we’re one of only four states with a government monopoly on workers’ compensation insurance. As a result, our costs are way, way too high; our system is inefficient and failing and our employers need other options, not sky-rocketing rates! I-1082 will make it possible to provide those other options.

In order to ensure that we garner the 241,000 voter signatures (actually 300,000 for good measure) necessary to place the Initiative on the November ballot, we need every member’s help! Specifically, if you have yet to sign the I-1082 ballot, please call me and I’ll get one to you. Furthermore, I ask that you commit to immediately taking at least one ballot and gather at least twenty signatures from your family, friends, employees and acquaintances. We must have all 300,000 signatures turned into the Secretary of State’s office by June 30. If everyone will commit to doing just this, we cannot help but succeed! Please, please call me for your ballot now. Thank you!

On another note, recently, the NCHBA commissioned the National Association of Home Builders to complete a study of the local impact of home building in Chelan and Douglas Counties. This study was predicated on a model developed by the NAHB in 1997 and has been applied to over 650 markets throughout the country—a tried and true model. In May, Dr. Elliot Eisenberg travelled to Wenatchee from Washington DC to present the findings of this study to an audience comprised of elected officials, jurisdiction staff, builders, realtors and many more.

The results of the study are more comprehensive than what I can do justice in the very limited space that I have available. I highly encourage you to visit the NCHBA website at www.nchba.cc for links to the report, as well as other related information. I would like to sincerely thank the North Central Washington Association of Realtors and the North Central Washington Economic Development District for partnering with us to make Dr. Eisenberg’s presentation possible. Furthermore, I would like to thank NCHBA member, Jack Corning, for making his condo in Leavenworth available for Dr. Eisenberg during his stay.

Last, I wish to remind you that because of your individual commitment to membership in this Association, we’re able to continue to fight to protect our collective membership and our industry in a time where small business is challenged as never before. If ever you doubt that your individual membership makes this possible, simply consider what would happen if each and every one of our valued members were to assume that nobody would miss them, and that the fight would go on without them. Whenever I say something silly or get stumped on one of Marc’s big words, he generally tells me that I am “a bubble off plumb.” For the longest time, I didn’t know what that meant, so I went searching for the answer…it means (more or less) “not quite right.” Well lately, there seems to be a lot going on that is “a bubble off plumb”…like our weather!! We are used to hot sunny days through the month of May; a little wind tied in, but not this cold, rainy stuff.

Over the last few months, we have been tried and tested with our schedule of events and membership! I am pleased to announce that we survived and were very successful across the board. We added in a new event in April, the Trades Rodeo, which was an immense success! We also added in some BBQ’s and a dinner to thank our valued members for their support in recruiting and retaining members! It may not sound like a lot was going on, but then you add in our most successful, fun and most talked about Golf Tournament, two NBN’s and committee meetings for upcoming events, you then have a full load! For me…I live for chaos! I would much rather be busy than bored and the thrill of pulling it all together in the end is amazing! Our staff has so much support throughout every event and all throughout membership that it is never just us here at the office working on things. We have very dedicated event chair persons and volunteers whose day-to-day job is NOT working for the NCHBA, but they still find the time to help with events and membership! We all have life outside of our jobs and the fact that our volunteers make the NCHBA part of their outside life is incredible. Who could ever ask for more?? I say it over and over, and mean it every time…we have the BEST volunteers in the whole world! We could not even come close to doing what we do, for you, our members, without the support and dedication from the members that jump in to help! There are even some members who have not missed volunteering or attending one event since the day they joined! WOW…that is incredible! I asked this member the other day why he makes it a point to be there for it all and he said, “Because you get out of your membership what you put into it and by being here, I have gotten a lot back out of it. It is great to be involved and be a part of something that you believe in and want to support. The benefit comes back to you tenfold.” His statement is so true. And I hope that many more of you will find that getting involved is easy and you shouldn’t be afraid to try it out! Busy is busy and we get that. Finding time between soccer games, school functions and LIFE is sometimes hard to do, but when the benefit of doing so could make the rest of your day, month or year, you should at least get out there and try it out!

For those of you who are more on the shy side, or not good in crowds, here is a little overview of how networking works. It’s like the Read It, Write It, Say It Rules of Memorization! In order to remember something, like a how to spell a word for instance, you first read it, then write it and then say it out loud! Networking and marketing work the same way! Attend a Nothing But Networking, put on a name tag and go shake a

hand. That person will READ your name, you SAY your name in your introduction and then you hand them a business card. That person has now done three things that will help them to remember you, what you do and hopefully do business with you or refer your name. If that person doesn’t, maybe one of the other 65 people you meet that evening will. All it will take for your evening to be a success is ONE! Marketing under this same thought process is just as simple. Run an ad…people will see it! Run a few radio spots so they can hear your message and then try sending out a post card or an insert…something they can have in their hands! After a few times, people will know who you are and what you do! But you have to be out there to begin with for any of it to happen! The days of not needing to be out in front of your target audience in the form of advertising, because you are already so busy you can’t handle anymore work, are slowly coming to an end if not a screeching halt! We are here to help you meet people and market to your target audience. Every single member of the NCHBA is in your target audience, with the small exception of your specific competition! Work with me, work with us…give the NCHBA a chance to help you find new ways to market your company and what you have to offer! Come out and attend a Nothing But Networking or a GMD, sit on a committee and help plan events…we have a place for everyone! All you have to do is call the NCHBA and we will work with you and your needs and find the perfect place for you to start!

“There Is No Point Going Anywhere If People Don’t Remember You Were There”

Networking is indispensable these days, but if you go to business events and no one remembers you afterward, you’ve wasted your time. Such contacts only work if you make yourself memorable.

Happily, this does not mean you have to arrive on a pogo stick or be loud and boisterous. Here are some strategies that let you walk into a room with quiet self-assurance, confident that people will enjoy meeting you and recall you afterwards.

Arrive looking your best. If you are having a busy day before going to a business meeting, keep a change of clothes in your office or car so you can walk in unwrinkled.

“Work” your name tag. We’re all more likely to retain information that we see and hear at the same time, so wear your name tag up on your shoulder. That way, people can read it as they hear you say your name. Some women put their name tags down on their handbags or in the most amazing places. Put it where people aren’t afraid to look!

Develop a distinctive “signature.” Men can wear ties that people will comment on. An investment banker I know wears a money tie. In business groups, I stand out because I wear a hat. When people are asked, “Do you know Patricia Fripp?” the usual reply is, “Yes, she’s the one who always wears hats.” Of course, if hats suddenly become mandatory fashion, I’d go bareheaded to get noticed.

Develop an unforgettable greeting. When you introduce yourself, don’t just say your name and your job title. Instead, start by describing what you do for people. A financial planner says, “I help rich people sleep at night.” One of my responses is, “I make conventions and sales meetings more exciting.” Almost invariably, my new friend has to ask, “How do you do that?” Immediately I get to market myself: “You know how companies have meetings that are supposed to be stimulating, but they’re usually dull and boring? Well, I present practical ideas in an

entertaining way so people stay awake, have a good time and get the company’s message. My name is Patricia Fripp, and I’m a professional speaker.” People remember the vivid pictures you create in their minds more than the words you say.

Overcome any shyness. If you feel uncomfortable at organized events, volunteer to be a greeter. You stand there with a label that says “Greeter” next to your name tag, and you have a specific job. “How do you do? I’m Chris Carter. Nice to meet you. Name tags are here. Food is there. How do you do? I’m Chris Carter. Nice to meet you.” Soon you start feeling like the host of a party. You’ve broken the ice with lots of people, so it will be easier to approach and talk to them later. Look for opportunities to be helpful at such events. I attended a Leukemia Society charity lunch and fashion show which was a fundraiser for a friend. My goal was to be emcee. They had never thought of having one, but I offered some suggestions and I was dressed for the part, so I offered to do it. My friend and her husband, experts at fundraising events loved the idea. I was highly visible, always feel more comfortable with a ‘job’ at any event, and my friends looked like heroes.

Greet everyone. Don’t ignore people you recognize if you’ve forgotten their name. Smile and ask a provocative question like, “What is the most exciting thing that’s happened to you since we met?” or, “What is your biggest recent success?” or, “What are you most looking forward to?” And never feel afraid to say, “The last time we met, we had such a great conversation. Will you remind me what your name is?” My friend Susan RoAne tells people, “Forgive me for forgetting your name. Since I passed forty, it’s hard to remember my own.”

Follow up. Always send a note or brochure the next day to the people you have met. Keep their cards, and make notes of what you said in case you meet them at another event.

These are all positive, pleasant, easy ways to be memorable. Get the most out of your networking time and energy by making yourself worth remembering!

On March 25th, The Floorman hosted the first NBN for 2010! Despite it being a rainy day, many members came out to see “The Best Little Floor House In Wenatchee.” A drawing was held for the people that could name two of the actors in the movie that plays off of and the winner was Paul Colson with Claffey’s Painting!

The pulled pork, homemade potato salad and beans kept the attendees coming back for seconds and of course there were cheers of joy from the door prize winners:

On April 27th 2010, the NCHBA, and Wenatchee Valley Tech Center, presented their first “Trades Rodeo”, and I believe that everyone involved would have to say that it was a huge success for an inaugural event. Thank you to all of the Contractors, businesses, and volunteers that came together to take this idea from concept to reality. I could go on and on about all of the people, trials and tribulations of the day … However, I am going to digress to a more

personal experience of the “Trades Rodeo”.

On the morning of the “rodeo” as I was backing my trailer up to unload and set up, I was pleasantly surprised to see a familiar face in my mirror guiding me into place. Dad had unexpectedly decided to come into town, and help me out for the day. As always, when my Dad shows up on the job to help me out, my stress level drops, and my mind is able to slow down a little.

I had already planned to talk about how 51 years ago, as a high school senior, my Dad was enrolled in a construction trades program, but it was so much better to actually have him there. Together we told students how Dad had attended a program much the same as the construction trades program offered at Wenatchee Valley Tech, and how 2 days after graduating from Bellingham High School, he went to work for a local home builder. Dad would work for the same builder for 17 years, before the builder retired and Dad moved on to do more commercial, and industrial construction. We mentioned that I too, had attended the same vocational-technical school while I was in high school, albeit to become an automotive collision repair technician. We then went on to show the students some of the tools of the trade, and gave them a little hands on experience.

It was fun to see the enthusiasm that Dad still has for the trade, that has been such a part of his life. A trade, that even through bad days, he enjoyed and found rewarding. A trade, that supported his family, and provided for his retirement. A trade, that led me into my own business. As Dad said “ a trade that at the end of the day, you could stand back and see what you had done.” Moreover, that future generations can look at, and see what you’ve done.

43 years after Dad started his carpentry career, I had the privilege to work together with him on his last job before he retired. Dad’s last job was building a new Health Science building at the same technical school he, and I, had attended during high school. It was a bittersweet job, for as much as Dad was looking forward to retirement; he was going to miss all of the camaraderie, people, and satisfaction that came with being a carpenter. Being a carpenter was more than just a job, to my Dad, it is who he is.

Participating in and helping to organize this “Trades Rodeo” has really opened my eyes to the work that needs to be done to ensure that young people can take advantage of the opportunities in the building trades, and other non-college professions. Sharing the “Trades Rodeo” with my Dad reminded me why it is so important that we make sure that this work is done. The “Trades Rodeo” is a great start, and Wenatchee Valley Tech, can be a valuable partner for our industry. I am looking forward to great things in the future. Thanks Dad!

Member News Member News“Let’s Make a Deal” came to Wentachee! Hosts of the May NBN, Jean Schweitzer and Laura Camarillo with Dreamscapes Cabinet Sales & Design, put on a great show with fantastic appetizers and plenty of cold beverages!

There was a great turnout, despite the wind a-whipping...it was the month of May after all!! The lucky “Let’s Make A Deal” contestants were Ed Gardner (E.D.Y Construction Corp.), Susan Day (SLD Companies, Inc.), Anita Van Stralen (Pioneer Title Company), Dave Lutz (The Floorman), Ken Clarke (QED Solutions), Bill Lane (The Glass Works) and Rich Pipkin (Vandermeer Forest Products). The final Grand Prize winner, from the few that decided to trade up, was Ed Gardner and he won a Martha Stewart Cast Iron Casserole Dish worth $70 (He’ll be making Jean and Laura lunch)!!! The show was a fantastic idea and a ton of fun and the networking was a total success too!

When you heard the NCHBA was putting on a Trades Rodeo, what was your first thought? Cowboys and bucking broncs? Close...but not quite! We held our first annual Trades Rodeo at the WV Tech Center on April 27th! The amount of time, effort and dollars invested into this one event was extraordinary, but well worth it! We would like to thank Allen & Kim Tangeman from First Choice Collision Center for their financial support of this event and covering the costs of the busing. Without their support, this event would have never happened! There are so many to thank, so we will keep it short and simple! THANK YOU TO EVERYONE INVOLVED! It was a fantastic event that the kids, teachers, instructors and volunteers all enjoyed and will remember for a long time! Thank you to Alcoa for donating the very necessary hard hats - Home Depot and Lowe’s Home Improvement Warehouse for donating safety glasses - Star Rentals for donating the construction safety vests...your contributions were highly valued and appreciated! The NCHBA recently commissioned an economic impact study be conducted by the National Association of Home Builders (NAHB) Housing Policy Department. Results of the study show that Wenatchee’s home building industry not only pays for itself, its economic impact results in new income and jobs for Washingtonians and additional revenue for local governments.

Every representative 100 single-family and 15 multifamily homes that were built across the metro area in 2009 will generate a cumulative $25.2 million in revenue, compared to $10.5 million in costs over the next 15 years. By the end of the first year the housing industry’s economic impacts more than offset the fiscal costs resulting in a fiscal surplus to local governments. And, by the end of the first year the fiscal surpluses generated are more than enough to pay off all debt and result in a surplus available to pay for additional government services. Single-family and multifamily housing produces a net income to local governments of $4.0 million the first year and $771,500 each and every year thereafter.

“These results show that home building is more than paying its own way and should put to rest the notion that existing home owners are subsidizing new home construction here in Wenatchee,” said Dr. Elliot Eisenberg, the Senior Economist who conducted the analysis of the impact of home building in the Wenatchee, WA MSA.—which encompasses both Chelan and Douglas Counties. “This

is an excellent result and tells me that local residents should be thanking the building industry for footing the bill for a lot of services.”

The economic impact study looks at the impact of the construction industry in three phases: the construction phase; the ripple effect; and, the occupancy phase. The impact of the three phases are added up, and then compared to the cost of services such as education, fire, police, utilities, parks and recreation and roads that are required to support the new housing units.

Recently, Dr. Eisenberg presented the findings of the study to a group of elected officials, city and county staff, NCHBA members, Realtors, members of the media and others. The NCHBA would like to recognize and thank the North Central Washington Association of Realtors and the North Central Washington Economic Development District for their support in helping to make the study and presentation possible.

Dr. Elliot Isenberg, from NAHB was in town on May 19th and gave a presentation to about 70 folks at the CTC. Dr. Eisenberg is an economist and his presentation was about the impact to the local economy of new home construction, particularly how that activity creates jobs and generates tax revenue for local governments.

His full report is available at NCHBA. In summary, he estimates that the one-year impact of building 100 new homes amounts to around $23 million in local income, results in the employment of 443 people, creates $4 million in local taxes and fees, generates $6.5 million in income to local business and produces over $4.4 million in wages. That’s a pretty impressive impact on the local economy.

There were quite a few local elected officials and local government staff in attendance, which is a good thing, because those are the folks that, aside from the marketplace itself, have the biggest impact on the vitality of the building industry, through policy implementation and regulatory practices.

Local elected officials are well aware of the impact of economic activity relative to local government budgets. I was listening to Steve Hair interview one of the Douglas County Commissioners, Ken Stanton, the other day, discussing the development occurring in the vicinity of Third St. SE in East Wenatchee, and Ken was very pleased to see Town Ford and Apple Valley Honda beginning construction in that area and commented on how important sales taxes are to the County budget. Of course the biggest sales tax generator of all is new construction.

On the other hand, it seems there is somewhat of a disconnect between understanding the importance of economic activity to local budgets and the regulatory environment that seems at times to be designed to throttle that very vitality that replenishes the local government coffers.

For instance, impact fees are continually being levied or proposed for new development. I had the opportunity to discuss some thoughts about impact fees with Dr. Eisenberg while he was in town, and he agrees that they are a particularly egregious example of local government having a negative impact on economic prosperity, and consequently, local government budgets.

Impact fees, by their very nature, are very popular politically, simply because they are levied against new homeowners, and when the policy is put in place to levy them, the people paying them don’t even known, and thus cannot object. For current property owners, they become a windfall, whether current property owners realize it or not. That’s because of the way the real estate market works with respect to establishing appraised values by analyzing comparable sales. When a new home (through impact fees) is forced to pay a surcharge which is reflected in the sales price, regardless of the reason, that affects all appraisals of similar properties, and of course the appraisals are higher roughly by the amount of the impact fee.

The effect of impact fees, aside from the above, is to simply increase the price of new housing, thereby effectively decreasing the supply and putting homes out of the reach of more people.

The point is that when regulations are under consideration by local government, it should always be with the consideration that when artificial restrictions of any kind are placed on the housing marketplace, prices go up and economic vitality is comprised to at least some degree.

May 14th, 2010 was one heck of a gorgeous day! With so much rain and wind prior to that Friday, right up to that Friday, we lucked out and had the sun shining bright, a light wind and not a cloud in the sky! UNTIL...about 16th the hole that is! That is when the sky turned black with dark clouds and they opened up with the heaviest rainfall we have seen in a while! It was unreal! Thankfully it only lasted about 15 minutes, but that was enough to run some golfers off! So, for those of you who missed the Dinner & Awards Ceremony, sponsored by NCNB, here is a little recap for you!

Dinner was incredible! John Bryant, with JASCO Catering always goes above and beyond catering our events! Many thanks to John for the fantastic food! Dinner was followed by some raffle give-a-ways, quite a few prizes actually, and some high dollar stuff to boot! Something new this year was the Big R Game Ticket! Every golfer was given a Big R Game Ticket in their tee-bag with an offer on the back and a number on the front! At the dinner, three random numbers were drawn (had to be present to play) and those three lucky winners were allowed to choose between box #1, #2 or #3 that all appeared identical, but what was inside was not even close!! It was a ton of fun and an interactive game we plan to do again next year!

During the tournament, out on hole #14, there was a Black Jack table, courtesy of Trinity Inflatables, where players were given a chance to enter into a drawing for a Cobra ZL Driver, valued at around $400, for only $5! And, if they entered the drawing, they got to play a complimentary hand of Black Jack! Who wouldn’t want to play a hand of Black Jack while waiting for the team ahead to finish play? It was a ton of fun and will most likely return again next year! There was also a hole-in-one opportunity to win a 2010 GMC Canyon Crewcab from Sangster Motors. Unfortunately, there were no winners on the truck or the $2,000 at the Jet City Equipment Putting Contest! Maybe next year!

The NCHBA Golf Classic, sponsored by Marson and Marson Lumber, Inc., continues to strive to put on a fun, interactive and memorable tournament! Be Prepared for Energy Code Changes14

Last year, BIAW members waged a major battle to stop onerous changes to the Washington State Energy Code. While BIAW, with the help of local HBA’s and association members succeeded in modifying some of the energy code proposals, the State Building Code Council (SBCC) still adopted sweeping changes to the energy code, Collectively, the new provisions could increase the cost of a new home by $10,000 or more.

BIAW is hopeful a legal challenge will be successful in delaying or stopping the most restrictive part of the energy code. However, builders should be prepared to comply with the new energy provisions slated to take effect July 1. To help educate builders to the new energy code, as well as the differences between the 2006 IRC and 2009 IRC, BIAW has been holding code classes which began early spring. Stay tuned for a schedule of upcoming building code classes.

Listed below are the major changes adopted this year to the Washington State Energy Code. For a complete listing of all the changes or a copy of the new energy code, contact Eric Lohnes at BIAW. A copy of the energy code is available online at www.sbcc.wa.gov.

• Additional Energy Efficiency Requirements—Builders must pick up one credit from a set of upgrades to the building envelope, HVAC equipment, water heater, improved air leakage control, or the inclusion of renewable energy. A one point credit is available for homes less than 1,500 square feet meeting certain specifications, while a one point debit is incurred by homes exceeding 5,000 square feet.

• Increased Building Envelope Stringency—Component and rigid envelope mandates for structures such as walls, windows and ceilings demand higher R and U-values.

• Duct Placement and Testing—Ducts must be leak tested, using new maximum leakage rates.

• Envelope insulation is not permitted to be displaced by ducts in exterior walls, floors, or ceilings. Building cavities are not allowed to be used as ducts.

• Air Leakage Testing—Blower door testing is required in all residential buildings and structures.

In the investment world, there aren’t many certainties, but here’s one of them: Prices will always go up and down. As an individual investor, you can’t do anything about this volatility. But the way you respond to it could make a big difference in your long-term investment success.

Many investors think they can “beat” volatility by trying to time the market – in other words, by buying when prices are low and selling

when prices are high. In theory, this is an excellent strategy, but in reality, it’s pretty much impossible to follow – because no one can really predict, with any accuracy, market highs and lows.

So instead of attempting to time the market, you’re much better off by following a time-tested strategy known as systematic investing.

To systematically invest, you simply put the same amount of money into the same investments at regular intervals. To illustrate, you could put $100, $500, $1000 or more into investment X on the first of every month. To make it even easier on yourself, you could automatically transfer those dollars from your bank account directly into the investment you’ve chosen.

In all likelihood, your contribution will buy a different amount of shares of Investment X each month. For example, if Investment X sells for $100 per share in January, a $500 investment will buy five shares. In February, if the price has fallen to $50 per share, your $500 will buy 10 shares.

In other words, when you systematically invest, you’ll automatically buy more shares when the price is lower and fewer shares when the price is higher – and that’s a great way to cope with market volatility. But systematic investing also offers some other advantages, including the following:

• Efficient share building – The more shares you own of an investment, the bigger your cumulative gains whenever the price of that investment rises. Consequently, increasing your shares should be a prime objective – and systematic investing is one way of building your share ownership.

• Investment discipline – Most people realize the value of investing for their retirement and other long-term goals, but they often put it off each month and find other things to do with the money – and by then, there’s often nothing left to invest. But setting up a bank authorization to invest systematically each month, you’ll “pay yourself first.”

• Lower cost of investing – Through systematic investing, your cost per share likely will be lower than if you made sporadic lump sum investments. And by lowering the cost of investing, you will, in effect have the potential to boost your returns.

While systematic investing is typically a good way to fight the effects of volatility, it can’t guarantee a profit or protect against loss. And keep in mind that you need the financial where withal to keep investing through up and down markets.

But if you have that ability, consider systematic investing. It may not be glitzy or glamorous, but it may work for you.

We would like to thank those Builder and Associate member companies that quickly responded to our call-to-action to assist BIAW in identifying member companies willing to sign on to a lawsuit being prepared by our state association to challenge recently-adopted changes to the state energy code.

Thankfully, we had a strong response and those members have been referred to BIAW. The pending lawsuit will argue that the state is pre-empted by federal law when it comes to setting standards for certain “covered products” (HVAC equipment, some plumbing equip) that are more stringent than federal standards. There is currently a challenge being brought in federal court in New Mexico that alleges many of the same claims against the City of Albuquerque’s code, and the plaintiffs

there were successful in stopping the code from going into effect. Our state association is on solid legal ground and is getting ready to file the complaint in the next week or so. The newly adopted changes to the state energy code will have huge implications for our industry, our members and the consumer.

Initiative 1082: The Time is Right for a Competitive Optionin Workers’ Compensation16

Our Costs Are Too High• Despite a 52% decrease in on the job injuries since 1990,

workers’ compensation taxes have increased more than 53% over the past ten years.

• Even though claims have decreased, the Department of Labor & Industries’ administrative costs increased 82% from 1999 – 2009 (28% in just the last year).

• A recent report from the State Auditor says workers’ comp taxes will need to be increased 33% next year to keep the system solvent.

Our System Doesn’t Work• In Washington, the average injured worker with a time-

loss claim misses 270 days of work—more than twice the national average. Oregon’s average time loss rate is about 70 days.

• WA has the highest pension rate in the nation. Pension rates have increased more than 300% since 1996.

• More than 50% of injured workers are likely to receive a lifetime pension from Washington if they’ve been off work more than two years.

• Between 2007-08 Washington pensioned 3,600 injured workers, while Oregon pensioned just 24. So, for every 1 person who received a pension in Oregon, Washington handed out 150.

• A recent report from the State Auditor says our state’s Accident Fund faces a 74.4% chance of insolvency within two years. Within five years, the chance is 90%.

Washington Is Out of Step With the Rest of the Nation• Washington is one of only four states with a government

monopoly that forbids private competition for industrial insurance coverage.

• While workers’ comp taxes are falling around the country, Washington is one of only a handful of states that increased workers’ comp taxes this year. Oregon has not increased rates in 20 years—and employers there are actually enjoying rate decreases in 2010.

• Washington has the second-highest cost per employee in the nation for workers’ compensation. We provide the third most generous benefit package in the nation. There is no such thing as a high-benefit/low-cost system.

Employers Need More ChoicesFive years ago, the West Virginia legislature passed a bill to transition their government-run workers’ compensation system into a competitive market. In the one year since the privatization of WV’s workers’ comp system was fully complete, the result has been:

• The number of claims filed has decreased from 40,000 to 29,000

• Claim protests have fallen 68 percent

• The overall appeals process has been streamlined, resulting in claims disputes being resolved in a shorter period of time

• Claimants have received better claims management by claims adjusters having fewer claims to manage, and

West Virginia’s open market for workers’ comp has also resulted in:

• Overall premiums have dropped over 30%, or more than $150 million

• 198 different workers’ compensation insurance companies have filed rates and forms, and 154 of those have active workers’ comp policies in the voluntary market

• More than 90% of all claims are ruled upon within 30 days.

If the goal of workers’ compensation is to assist injured workers in the best way possible while maintaining a competitive business environment, shouldn’t we look at examples where both are apparently taking place?

The U.S. Environmental Protection Agency recently announced release of an amendment to the Lead: Renovation, Repair and Painting rule that removes the opt-out provision for pre-1978 homes without pregnant women or children under age six in residence.

The amendment also instructs contractors to provide a copy of the records required under the rule to be shared with home owners within 30 days of completing the remodeling work. The amendment goes into force 60 days from its publication in the Federal Register on Thursday, May 6th. Thus, it will be effective on July 6, 2010.

Nevertheless, all provisions of the Lead: Renovation, Repair and Painting rule went into effect on April 22, which requires remodelers and other contractors disturbing painted surfaces in pre-1978 homes attend the required training and submit firm certification. The rule also dictates lead-safe work practices, pre-renovation consumer education, and record keeping practices.

The amendment to the rule goes into effect on July 6, 2010 and

• Removes the opt-out provision. Under the current rule, owner-occupied pre-1978 housing units (i.e., not inclusive of rental properties) where no pregnant women nor children under age six, nor a property qualifying as a “child occupied facility” (such as a day care facility) could sign a waiver. The remodelers must keep a record of the waiver for three years, which waives the implementation of the work practices dictated by the rule. The new amendment to the regulation that goes into effect in July revokes the opt-out completely. All work in pre-1978 must then follow all work practices dictated by the regulation as of the effective date on July 6. See the final amendment as published in the Federal Register.

• Requires remodelers to share rule compliance records with customers. Remodelers will have to share a copy of the compliance records required for remodelers under the regulation (such as the checklist of followed practices) with home owners within 30 days of completion of the work. See the final amendment as published in the Federal Register.

The EPA has also given advanced notice of additional plans to change the lead rule as a direct result of a voluntary legal settlement with several environmental groups that challenged the original regulation. Specifically, rule makings will be conducted to:

• Require abatement-style dust wipe testing and share results with home occupants and owners. This rule change will apply to certain remodeling activities and require the contractor to achieve the EPA’s strict numerical limits for lead dust levels on window sills, window troughs, and floors. The EPA’s numerical lead dust standards are the same as those dictated to lead-based paint abatement firms for achieving “clearance” under EPA’s abatement rules. Depending on the outcome of this upcoming amendment, remodelers and other contractors may

also be subject to additional regulatory restrictions at the state and local level triggered by the knowledge of disturbing lead-based paint. After this proposal is published, it will be out for a 60 day comment period with the goal of completing and finalizing this rule change in July 2011. • Apply the lead rule to public and commercial buildings. The EPA plans to amend the rule to expand its scope over both public and commercial buildings. NAHB will follow this development but expects the proposal to come out after the clearance testing amendment. See the proposed rule amendment as published in the Federal Register.

Rule EnforcementEPA Assistant Administrator Owens visited the NAHB Remodelers Board of Trustees recently to answer questions about the lead paint regulation which took effect on April 22. He explained that the EPA will not take enforcement action against firms that in good faith submitted firm certification paperwork before April 22 but have not received official approval yet from EPA. A copy of the letter is available for download. However, the EPA will still be taking enforcement actions against parties that fail to follow work practices in pre-1978 homes. In Washington State, it is our understanding that the Department of Commerce will be assuming enforcement and administration of the rule beginning July 1, 2010 and has been ramping up staff to facilitate enforcement.

Future ActionsNAHB is closely following the continuing actions of the EPA to amend the rule and will be commenting and asking members to submit comments on proposed rule changes.

The Rebuilding Together program’s mission is to preserve and revitalize houses and communities, assuring that low-income homeowners, from the elderly and disabled to families with

children, live in warmth, safety, and independence. In partnership with local communities, Rebuilding Together’s goal is to make a sustainable impact. They make this impact through providing necessary repairs free of charge to existing homeowners. These necessary repairs often include home modifications, roofing, plumbing, and electrical repairs and/or improvements. Each year, locally, a number of projects are identified and needs assessed in preparation for achieving the most impact with the resources and help available.

On May 15, NCHBA members helped to complete a project that the Association chose to undertake. Through their efforts, a very appreciative homeowner received some much-needed repairs to her home. The scope of the repairs was:

• Reinforcing and Stabilizing a Deck Serving as the Main Entry to the Home.• Tearing Down and Removing a Dilapidated Wood Fence• Replacing Fence with Metal Chain Link • Metal Roof Repair• Minor Electrical Repair

Thankfully, the weather held out long enough to complete the needed repairs! As always, this opportunity to give back to the community was enjoyable and meaningful, and we would like to sincerely thank these valued members, NCHBA staff and family members for giving of their time, labor and expertise:
