CLCA supports the following legislationthat will provide financial assistance toproperty owners for decreasing outdoorwater consumption through landscapereplacement programs, and will requirelandscaping changes and better watermanagement practices on state-ownedproperties:• AB 585 (Melendez): Allows a tax creditequal to $2,500 or 25% of the amount paidby a qualified taxpayer for installingdrought-friendly landscaping.

• AB 603 (Salas): Allows a credit to ataxpayer participating in a lawnreplacement program in an amount equalto $2/sq. ft. of conventional lawnremoved from the taxpayer’s property.

• AB 606 (Levine): Requires new stateowned lands to reduce waterconsumption through drought tolerantlandscaping and replacement of irrigationtimers and spray sprinklers.

• SB 553 (Wolk): Requires the Departmentof General Services to implement relevantrecommendations made in the modelwater efficient landscape ordinance onspecified state properties in order toreduce water consumption and increasewater efficiency.

CLCA supports this legislation thatprovides a vehicle for possible legislativeaction against the underground economy:• SB 653 (Berryhill): Declares the intent ofthe Legislature to enact legislation thatwould address issues relating to theunderground economy in order to ensurea level playing field for businesses.

• SB 453 (Hill): Extends the sunset date ofthe Contractors State Licensing Boardwhich is responsible for implementationand enforcement of the Contractors StateLicense Law.

• SB 18 (Pan): Recognizes the Tax Recoveryand Criminal Enforcement Task Force for

its excellent public service in combatingthe underground economy in California.

Oppose Unless Amended:CLCA's Position on SB 119SB 119 by Senator Jerry Hill proposes toupdate, restructure, and expand the state'sexcavation safety laws, as well as create acentralized authority to enforce them. TheCLCAwholeheartedly supports safedigging and understands the importance ofcalling a regional notification center prior toconstruction work. However, CLCAmusttake an Oppose Unless Amended positionon SB 119, because under the currentversion of the bill a landscaper would berequired to call a regional notificationcenter prior to mowing a lawn or planting aflower bed. This mandate would not onlybe unnecessary and time consuming; itwould inundate the notification centers andlocators with activities that are not a threatto public safety and distract from theexcavation activities that this law isintended to address.

CLCA has proposed an amendment toSB 119 that would exempt landscapingactivities as described above from therequirements to “call before you dig.”

Diablo Valley College Offers TurfManagement Course this SummerA Turf Management class focusing on drought strategies will be offered at DiabloValley College this summer, taught by Bethallyn Black. A short course designed forlandscape professionals, the lecture/lab class starts June 16 and finishes July 23, andmeets Tuesday and Thursdays from 4:00 to 7:30 p.m.

The material to be covered includes: turf grass ID, installation and maintenance,pests and disease, and drought management and alternatives. Class size will be limitedto 20 students.

In the past, CLCA has hosted a two daylegislative conference inviting about 30 orso member representatives from around thestate to attend. With a one day grass rootstraining to get representatives up to speedon the issues, the second day was alloted tomeeting with legislators to urge support oropposition on impending legislation. Due toeconomic concerns, the legislativecommittee did not have a legislativeconference in 2013 or 2014. This year thestate legislative committee was asked to puton a legislative conference with significantlyless funds.

This year the group attending thelegislative conference was limited to 8members of the legislation committee andCLCA state President Javier Lesaca. Wewere accompanied by CLCA ExecutiveDirector Sandra Giarde, CLCAAssistantExecutive Director Larry Rohlfes,Communications Director John Sassamanand our political consultant with GreenburgTraurig Maria Garcia.

On Tuesday, March 24, the group firstmet briefly at the office of GreenburgTraurig to go over the legislative bills thatwe were to discuss with our localAssemblymember and State Senator thatafternoon. The focus of the group was onthree topics:1. Water Conservation - Four legislativebills dealt with this issue. Two of the billsdealt with tax rebates for convertingexisting landscapes into drought tolerantlandscapes. The last two bills dealt withrequiring government owned properties toabide by the same water restrictions that thepublic is being asked to adhere to. CLCA issupporting all four of these bills.2. Excavation (SB 119) - This bill deals withthe protection of subsurface installations.Although CLCA appreciates the spirit of thebill, CLCA is opposed to the bill unless it isamended. The bill indicates that DigAlert or811 must be called prior to excavation sothat existing utility pipes and lines can belocated and marked off. However, the

definition of “excavation” as per the bill isany penetration of the ground plane. Thiswould include routine maintenanceactivities, such as weeding, aeration,planting flats of annual color, and so on.CLCA is urging that an exemption be madefor most landscape maintenance activities.Early talks with utility companies appear tobe going well, with both sides being willingto establish a happy compromise.3. Underground Economy - CLCA is infavor of legislation that battles theunderground economy because it creates anuneven playing field for those who play bythe rules. CLCA urges that therecommendations contained with the “LittleHoover Commission” report be considered.

Following meetings with each delegate’srespective senator and assemblyperson (ortheir staff members), Maria Garcia, ourlobbyist, arranged for the entire group to beallowed onto the Assembly floor where wemet with Assemblywoman Susan Bonilla.After a little tour around the Assembly sideof the Capitol, we regrouped at Frank Fat’sfor dinner. Assemblywoman Bonilla wasgracious enough to join us for dinner.

The next day, March 25, was a very busyday. The CLCA conference members weredivided into two groups of six.Commencing at 9:00 am until 12:00 noon,each group had scheduled meetings withdifferent legislators every 30 minutes todiscuss the same issues as the previous day.Then we had a two hour lunch breakaccompanied by Cindi Christenson, theRegistrar of Contractors with the CSLB. Wewere able to speak to her over lunch aboutCSLB’s enforcement efforts on theunderground economy. Following lunch wereturned to the Capitol for four moreappointments with legislators.

Many thanks go out to Larry Rohlfesand Maria Garcia for doing the upfrontlegwork needed to coordinate each of themany meetings, meals and lodging for theout of town members. Great job!
