INTRODUCTION

Dear Residents of Mayfair:

The attached Architectural Guidelines (the "Guidelines") are presented to assist all residents in maintaining high standards of design and compatibility. They do not modify any requirements set forth in the Declaration of Covenants, Conditions, and Restrictions (the "Covenants), and it should be noted that the language of the Covenants takes precedence.

The over-all goal of these Guidelines and recommendations is to keep our community an attractive and desirable place in which to live, and it is hoped their use will provide each resident with a practical means of accomplishing this.

When planning exterior alterations, please consult the attached Guidelines and pertinent sections of the Covenants to determine possible requirements. PLANS FOR ALL EXTERIOR ADDITIONS AND MODIFICATIONS TO A HOMEOWNERS PROPERTY MUST BE SUBMITTED TO THE ARCHITECTURAL CONTROL COMMITTEE (THE "ACC" OR THE "COMMITTEE") OF THE MAYFAIR HOMEOWNERS ASSOCIATION, INC. (THE "MHA" OR THE "ASSOCIATION") ON THE ATTACHED APPLICATION FORM AND MUST BE ACCOMPANIED BY DETAILED PLANS AND SPECIFICATIONS To set such a process in motion, please contact a member of The Architectural Control Committee (the "ACC" or the "Committee') of The Mayfair Homeowners Association, Inc. (the "MHA" or the "Association') or send your application to the address on the application.

When planning any digging or planting, please call Miss Utility at 1-800-257-7777. Allow forty-eight (48) hours for a response. Articles IV, V and VI of the Covenants covers the Architectural Control Committee, Architectural Control, Maintenance Obligations and Use Restrictions. Such Use restrictions can be found on pages 15 - 21 of the Covenants. These Guidelines may be changed from time to time, and any suggestions you have would be welcomed by the Committee.

IMPORTANT INFORMATION

1. The Covenants are a set of legal documents which are part of your deed of ownership and "run with the land" (i.e., transfer to future owners). This binding contract assures minimum standards for land use, architectural design and property maintenance. The Covenants provide for your membership in The Mayfair Homeowners Association as well as the operation of the MHA, the Mayfair Architectural Control Committee, and the architectural review process.

2. If you proceed with an alteration or professional or in-home industry before obtaining written approval, you do so at your own risk and your property would be in violation of the Covenants. You would then face the cost of removing or modifying the alteration to comply with the Committee's decision should your application not meet requirements. In considering the application, the Committee will not be influenced for or against the application if work is commenced prior to approval. However, for the reasons stated above, residents are strongly urged not to undertake construction in advance.

3. If you have a complaint about a proposed, approved or unapproved alteration or a neighbor's property, please contact an ACC member and contact, in writing, First American Management, Inc., MHA's management company at "The Architectural Control Committee of Mayfair c/o First American Management, Inc. 9160 Red Branch Road, Suite #E6, Columbia, MD 21045." 4. Once the application has been approved, work must commence within six (6) months and all work must be finished within a reasonable time period not to exceed one (1) year or such other time period as established by the ACC, or the approval is voided and must be re-submitted. In addition, if work does not progress following the established time period, the project could be considered abandoned and the MHA will take appropriate measures to clean up the property in accordance with the Covenants.

REVIEW CRITERIA

The Committee evaluates all submissions on the individual merits of the application. Besides evaluation of the particular design proposal, this includes consideration of the characteristics of the housing type and the individual site, since it may be an acceptable design of an exterior in one instance may not be for another.

Design decisions made by the Committee in reviewing applications are not based on personal opinion or taste. Judgments of acceptable design are based on the following criteria which represent in more specific terms the general standards of the Covenants.

RELATION TO NATURAL ENVIRONMENT. Fencing, in particular, can have damaging effects on the feeling of open space. Other facts such as removal of trees, disruption of the natural topography and changes in rate or direction of storm water run-off also adversely affect the natural environment.

CONFORMANCE WITH COVENANTS. All applications are reviewed to confirm that the project is in conformance with the Covenants.

VALIDITY OF CONCEPT. The basic idea must be sound and appropriate to its surroundings.

DESIGN COMPATIBILITY. The proposed improvement must be compatible with the architectural characteristics, of the applicant's house, adjacent houses, and the neighborhood setting. Compatibility is defined as similarity in architectural style, quality of workmanship, similar use of materials, color and construction details.

LOCATION AND IMPACT ON NEIGHBORS. The proposed alteration should relate favorably to the landscape, the existing structure and the neighborhood.

The primary concerns are access, view, sunlight, ventilation and drainage. For example, fences may obstruct views, breezes or access to neighboring property; decks or sheds may cast unwanted shadows on adjacent property or infringe on a neighbor's privacy. Therefore, it is required that the applicant discuss the proposal with all contiguous neighbors prior to making an application and obtain the acknowledgment of all such contiguous neighbors of the proposed project. It may be appropriate in some cases to submit neighbors' comments along with the application.

SCALE. The size (all three dimensions) of the proposed alteration should relate well to adjacent structures and their surroundings. For example, a large addition to a small house may be inappropriate.

COLOR. Color may be used to soften or intensify visual impact. Parts of the addition that are similar to the existing house such as roofs and trim should be matching in color.

MATERIALS. Continuity is established by use of the same or compatible materials as were used in the original house. The options may be limited somewhat by the design and materials of the original house. For instance, horizontal wood siding on the original house should be reflected in an addition. On the other hand, an addition with wood siding may be compatible with a brick house.

WORKMANSHIP. Workmanship is another standard which is applied to all exterior alterations. The quality of work should be equal to or better than that of the surrounding area. Poor practices, besides causing the owner problems, can be visually objectionable to others. Poor workmanship can also create safety hazards. The Association assumes no responsibility for the safety of new construction by virtue of design or workmanship.

APPLICATION PROCEDURES

1. The Committee will meet as needed. An application will be expedited through the review process by the Committee, provided (1) the application indicates that the proposed change will strictly conform to the Covenants and to the appropriate guidelines enumerated below and (2) the applicant expressly agrees to make the alterations in strict conformance with the guidelines.

2. Submit an application fully completed to the address noted thereon. When plans are required, they must be submitted with the application.

3. Each application will be assigned a log number, which corresponds to your lot number.

4. Rental unit residents must submit their applications through the property owner. The property owner must sign the application.

5. Prior to the meeting, one or more members of the Committee will make an on-site visit, if warranted.

6. Formal written response usually follows within fifteen (15) days after the meeting unless the Committee requests additional information, to be reviewed at the next meeting.

7. If an applicant disagrees with the decision, he has the right of review. This must be made to the MHA Board of Directors, within thirty (30) days of the date of the formal notice of the disapproval.

NOTES:

1. Any approval by the ACC shall not be construed to permit any alteration to land or buildings in accordance with these plans that would violate any of the Covenants or any of the provisions of the Building Code and Zoning regulations of Baltimore County, to which the above property is subject. Further, any approval by the ACC shall not be construed as a waiver or modification of any Covenants. I understand that I am solely responsible for obtaining any and all necessary permits or licenses required by Baltimore County and/or the State of Maryland. I further agree to hold harmless the Association and its Committee from any claims or actions arising by reason of violation of the Baltimore County Codes and/or State law.

2. The Building Ordinance of the Baltimore County Building Department (Building Permits) requires that you file plans with the Building Inspector at his office in the local Municipal Building. If the Baltimore County authorities make any changes to the plans as approved by the ACC, the applicant is responsible for notifying the ACC of the changes, prior to construction, for approval of the changes by the ACC.

3. I understand and agree that no work on this request shall commence until written approval of the Committee has been received by me.

4. I agree to provide a copy of all appropriate permits and licenses before commencing the alterations.

5. I understand that any changes to the alterations as approved need to be approved by the ACC before commencing with such changes.

Any disapproval or qualified approval by the ACC will be accompanied by a written statement of grounds upon which the action was taken.

If you disagree with the decision of the ACC, an appeal may be made to the Board of Directors according to the Covenants. Any such appeal should be made in writing within thirty (30) days of the date of the ACC's letter stating its decision.

This application may be photo-copied and saved for multiple alterations.

Show location of item on the property by a sketch or by a copy of your plot plan given to you by the builder/contractor. ANTENNAS

Generally, refer to the Covenants, including but not limited to, Article VI, Sections 1.13, 1.19 and 1.2.3

AIR CONDITIONING UNITS

Window air conditioning units are not permitted.

ATTIC VENTILATORS

An application is not required for a roof mounted ventilator which does not protrude more than twelve (12) inches above the roof surface, does not extend above the roof line, is located in an area not visible from the street, and is painted to match the color of the roof.

All other ventilators require an application which must include the following information:

1. A description of the proposed ventilator, indicating size, color and style.

2. A diagram, sketch or picture of the material to which it will be attached, showing its exact proposed location and anticipated projection.

AWNINGS AND SUN TRELLISES

See Exterior Building Alterations.

BASKETBALL BACKBOARDS

All basketball poles and hoops shall be submitted for approval. No backboards or hoops may be affixed to houses

CHIMNEYS AND METAL FLUES

An application is required for chimneys and metal flues and it must include the following:

1. A site plan showing the location of the proposed chimney and its relationship to property lines and adjacent structures.

2. Detailed drawings showing exterior elevations and dimensions of the chimney.

3. A description of the chimney and proposed exterior construction materials. This should include the color and type of siding enclosing the chimney, trim color, and relationship to the existing structure.

CLOTHESLINES

Clotheslines of a permanent nature are prohibited. Temporary or retractable ones, while not encouraged by the ACC, are permitted without requiring application as long as they are removed when not in use and are located in the rear of the house within the boundaries of the physical structure.

DECKS

1. Written approval for all decks will be required.

2 Applications should include the following information:

a. Drawings showing the size and style of the deck.

b. Site plan showing the relationship of the deck to the house and lot.

c. A list of materials to be used.

d. Color of the deck. (NOTE: If the color of the deck does not match the color of the siding, color samples for the deck and a description of the house colors must be submitted with the application.) Natural wood or pressure treated wood need not include a sample.

3. Decks must be constructed with pressure treated or rot-resistant (cedar, redwood) lumber.

4. Approvals of decks will be judged solely on individual merits which include, but are not limited to, the location, size, conformity with design of the house, relationship to neighboring dwellings and proposed use.

5. The Baltimore County Building code should be observed in all its aspects, including the obtaining of a building permit, to avoid possible problems.

6. It is suggested that plans be submitted for approval to the Committee prior to applying for the Baltimore County Permit.

UNDER DECK STORAGE

If the under-deck area is to be used for storage, visual impact to the surrounding area must be considered. Special screening or landscaping may be required. Homeowners must submit pictures or drawings that show how the storage area will be arranged to present a neat, uncluttered appearance.

STORM DOORS

The committee will only approve storm doors that are of the full view type or six panal ,full view glass. The storm door must match the color of the existing front door or house trim.

All applications should include descriptions of material, color and style.

DOG RUNS AND DOG HOUSES

1. Written approval will be required for all dog runs and dog houses.

2. Dog runs and dog houses must be located behind the house (as close to the house as possible), and preferably attached to the house. To ensure the privacy of adjacent neighbors, dog runs and dog houses should not be located near property line.

3. The size of dog runs/houses should be proportionate to the size of the resident's house and lot.

4. If other fencing exists on the property, fencing for dogs should be the same type.

5. All dogs not enclosed in a secure (i.e., gated, locked and of sufficient height to prevent over-leaping or escape) fenced yard shall be restrained by a strong, secure leash or chain at all times.

6. Pet owners shall immediately remove and properly dispose of their pets feces in a sanitary fashion whenever their pet defecates on any area not within the boundaries of the pet owners lot.

EXTERIOR DECORATIVE OBJECTS. LIGHTING. GRILLS

1. Written approval will be required for all exterior decorative objects such as bird baths, pink flamingos, wagon wheels, sculptures, fountains, pools, free-standing poles of all types, vertical flag poles, and items attached to approved structures.

2. Written approval will be required for all exterior lights or fixtures or shutters not included with original structures.

3. Written approval will be required for all permanently placed grills, such as masonry or metal pits.

4. Portable BBQ's must be stored in the rear of the house.

5. Seasonal lighting and decorations do not require approval; however, they should not be operative prior to thirty (30) days before the season and should be removed within thirty (30) days after the season.

EXTERIOR BUILDING ALTERATIONS

1. Written approval is required for all exterior alterations to the dwelling or property. Building alterations include, but are not limited to, storm windows, porches, or other additions to the home.

2. The original architectural character or theme of any unit should remain the same. Once the character is established, whether it is traditional, contemporary, etc., no portion should be changed or added to, which would conflict with or change that character.

3. Information required on all applications must include:

a. Site plan showing the location of the proposed structure, distances from neighboring dwellings, property lines, and other identifiable landmarks.

b. Detailed drawings and plans including exterior elevations, foundation plans, changes in grade, and the relationship of the proposed structure to the existing dwelling and other buildings.

c. Specification for exterior materials including type of siding on dwelling and proposed structure, color of existing dwelling and trim, color samples of proposed structures and trim, and exterior lighting arrangements.

TOOL/STORAGE SHEDS

Shed designs should be consistent with the architecture of the neighborhood and may only be used by residents of the lots. A request for approval of a shed must include plans and specifications and a plat that shows the location of the shed. All sheds must meet Baltimore County building codes and lot line restrictions.

Drawings and plans should include all exterior changes that will be made in conjunction with the shed; for example, lighting or landscaping. These items must be consistent with the appropriate sections in these guidelines. The ARB may require additional landscaping or fencing to screen sheds based on their proximity to neighbors.

Size: Sheds cannot be larger than 10 feet wide by 10 feet long by 6 feet high.

Materials: Sheds must be 2x4 and plywood construction. Siding must match house siding. Roof shingles must match house roof shingles.

Paint: Trim must be painted to match house trim.

FENCES

1. Written approval is required for all fencing.

2. Metal fencing will not be considered for approval.

3. As a general rule, the type of fencing, if approved, will be guided by existing fencing in the area.

4. Fences should adjoin the property line. No fences are permitted in front yards. Fences should begin at the back corners of the house.

5. All applications must include the following information:

a. Fence style and material. Fences that have one finished side must be built with the finished side out (posts on the inside).

b. Color of fence and house.

c. Dimensions, including height. No fence under 48 inches or over six (6) feet high will be approved.

d. Site plan, which shows the relationship of the fence to adjacent houses, open spaces, and property lines, including dimensions.

GUTTERS AND DOWNSPOUTS

An application is not required for replacement of gutters and downspouts or the addition of gutters and downspouts which are painted the same color as existing downspouts . All other gutters and downspouts require an application.

HOME INDUSTRY

Generally, refer to Covenants, including but not limited to, Article VI, Section 6.1.15 (single family use), Section 6.8 (day care).

MAINTENANCE AND WOODPILES

1. The Covenants provide that each owner shall keep his lot and all improvements thereon in good order and repair, including but not limited to seeding, watering, mowing, the pruning and cutting of all trees and shrubbery and the painting or other appropriate external care of all buildings and improvements. This should be done in a manner and with such frequency as is consistent with good property management.

2. Owners who fail to maintain their properties will have fifteen (15) days from the date of the notice of such a violation to remedy the situation. After that time, the Association may have the appropriate maintenance performed, and all costs associated with this action will be assessed against the owner.

3. All planting areas should be properly maintained at all times. At the end of the growing season, all dead plants should be removed.

4. Woodpiles must be maintained at the rear of the house.

5. Construction materials will be allowed on the rear of the property during the period of actual construction and shall be removed promptly upon completion of the project. No permanent storage of construction material is allowed.

6. Snow removal. As a courtesy to neighbors, and as required by Baltimore County law, residents must clean the sidewalks adjacent to their property.

7. Lawn maintenance equipment must be properly stored when not in use, and may not be left out in the open.

OTHER ALTERATIONS

Exterior alterations not addressed in these Guidelines will be considered on a case-by-case basis and should be applied for in the same manner as those which are addressed.

PATIOS AND WALKWAYS

An application is required for all new or expanded patios or walkways as well as for those existing patios or walkways where a material change is proposed. An application is not required to replace an existing patio or walkway with one of identical material.

PLANTING AND LANDSCAPING

1. Applications will not be required for plantings that do not and will not exceed three (3) feet in height. However, written approval will be required for screen planting (row or cluster style) and property line plantings.

2. These applications should include a description of the types and sizes of trees or shrubs to be planted and a site plan showing the relationship of plantings to the house and adjacent dwellings.

3. Remember to call Miss Utility at 1-800-257-777 before doing any planting or digging.

SIGNS

No signs are permitted except for small security signs and certain real estate and construction signs and are subject to the following criteria in addition to any criteria included in the covenants:

1. For Sale or For Rent signs do not require applications provided the following guidelines are met:

a. Signs should be no larger than four (4) square feet.

b. Signs should be erected on posts of sufficient strength to avoid bending or warping.

c. Signs should stand no more than four (4) feet above the ground.

d. No more than one (1) sign should be erected on any given property.

e. Signs should be maintained in good condition.

f. Realtors are permitted to use their logos, trademarks, and color schemes.

2. Off-Site Direction Signs (Open House)

a. Off-site signs are permitted only at the entrance to cul-de-sacs; only one sign is allowed at that intersection.

b. They shall remain standing only during the hours of the open house.

RESIDENTIAL VEGETABLE GARDEN PLOTS

Applications are not required if the size of the plot is limited to twenty-five (25) square feet or less. Plots must be located behind rear line of houses.

SOLAR COLLECTORS

An application is required for all solar collectors and will be reviewed on a case-by-case basis.

STORAGE OF VEHICLES

Generally, refer to Covenants, including but not limited to, Article VI Sections 1.3 and 1.23.

SWING SETS AND PLAY EQUIPMENT

1. Generally, swing sets and play equipment should be located within extended sidelines of the house and in the rear.

2. Approval is required for all permanent play equipment, including permanent sand boxes. (Play equipment not affected by this rule are those items which can be easily relocated or moved indoors overnight.)

3. Maximum size is not limited, but the overall size of the play equipment should be proportionate to the site (i.e., not seem in any way to dominate the site or stand as a Primary feature of the lot).

4. Swing sets must be constructed of materials similar to those specified for decks. No metal swing sets will be approved.

PRIVATE POOL/HOT TUBS

Private pools are generally discouraged because there are very few locations in residential areas where they can be placed without affecting adjacent properties. Pools require fencing which is proportionately too large for the lot in size and area enclosed. Noise and lighting problems are also a consideration.

An application is not required in the case of portable children's wading pools not more than 6' in diameter. A complete application should be filed for all other pools/hot tubs. The Committee will not approve above-ground pools, which are prohibited.

Applications should include:

1. A site plan showing location and dimensions of the pool or hot tub, other related equipment, fences, etc., in relation to the applicant's house, property lines, and adjacent dwellings.

2. Detailed drawings and plans of the pool, deck area, lighting arrangements. walkways, fences, etc., and pertinent information concerning water supply system, drainage and water disposal system.
