The following is intended to ratify, reaffirm, and introduce specific guidelines regarding certain requests or violations with respect to the Weston Hills Declarations of Covenants, Conditions, and Restrictions so Weston Hills will continue to be a beautiful well-kept Community for years to come. All lawns, landscaping, and sprinkler systems and any property, structures, improvements and appurtenances shall be maintained by the Owner of each home and shall be well maintained and kept in first class, good, safe, clean, neat and attractive condition consistent with the general appearance of Weston Hills Neighborhood by the Owner of each home. Any work performed requiring ARB approval prior to obtaining that approval may result in a fine to the Home Owner.

AC Window Units

Window air conditioner units are not permitted either in a window or wall mounted. Allowable trim

No owner or tenant of a dwelling shall install awnings or other decorative exterior trim, except small exterior decorations such as address plates, name plates without prior approval of the ARB.

Animals/Pets

Animals raised, bred or kept for commercial purposes are prohibited.

Domestic pets are permitted: a) A maximum of 4 dogs or cats are permitted per residence. b) All pets are not permitted to roam free. c) All pets are to be confined to the residence or lot or on a leash. d) The individual walking a pet is responsible for picking up any waste created by the pet. e) All pet owners are responsible for their pet's activities. f) Pets shall not be "tied out" on the exterior of home or common areas and left unattended g) Dangerous breeds, as determined by the State of Florida, or aggressive animals are

prohibited and the Association can require such animals to be removed from the

community.

Architectural Review Approval Policy:

Except as provided below, when an Architectural Review application is submitted and approved, the approval shall be valid for ninety (90) days and the work shall be completed within ninety (90) days. If not completed within ninety (90) days, owner must apply for an extension of time to complete.

If an application for exterior change is submitted in response to a second deed restriction enforcement letter or a notice of fine hearing letter, approval shall be valid for a period of 30 days and work shall be completed within that time, or be subject to the issue being forwarded to the Fining/Hearing Committee without further opportunity to correct.

If a homeowner has done work that is not approved, the Association may require such work be removed or modified in order to meet Association standards.

Artificial Vegetation

Artificial grass, plants, or other artificial vegetation are not permitted on any residential lot. Barbecues and outdoor cooking appliances

Are permitted when used in the back of the home.

Outdoor cooking is not permitted in the front of the home

Outdoor cooking on the Community’s common areas is prohibited unless used in

conjunction with a Board of Directors-sponsored community event.

Bushes

Bushes are classified as a woody plant that is smaller than a tree and has many branches growing up from the lower part of the main stem at ground level.

Bushes are not to exceed a maximum height of six (6) feet in height.

Bushes are not to obstruct any sidewalk, pathway, driveway, front windows, doors, and must not hinder line of sight of any vehicular traffic.

Clotheslines

Portable clothes lines are permitted with in the rear patio areas.

Stored out of sight when not in use. Commercial Activity

Conducting commercial or business activity that would generate traffic to and from the community or parking on the private streets prohibited

A personal office may be kept for the personal use of the owner as long as the office is not being used for the meeting of clients and customers.

Daycares are not permitted. Commercial Vehicles

Overnight parking of a commercial vehicle that has a gross weight over one (1) ton with or without commercial business names, advertisement, or logos permanently located on the vehicle are prohibited.

Any vehicle with advertising must be covered or kept in the garage (out of sight from the street)

Service vehicles are permitted during normal business hours only

Commercial vehicles are not permitted in the Community overnight

Commercial trailers are not permitted in the Community overnight Contractors and other hired outside service providers

Exterior work is not to commence prior to 7 AM and is to be finished by 6 PM 7 days a week. (Including weekdays and weekends)

Community property, road ways, sidewalks, and neighboring properties adjacent to the work being performed are to be cleaned and debris free at all times.

Gate access for these service providers are the responsibility of the homeowner. See policy on gate access.

Doors

Front entry, side entry and garage door replacements must have ARB approval and must coincide with the colors specified in Exterior Colors Selection listed below.

Garage doors must be white

Front entry screen doors are permitted and must be of either bronze or white framed. Driveway

Driveway modifications must have ARB approval

Must be kept clean of stains and mold and weeds

No more than a twenty (20) square foot area of the total driveway surface shall be stained, contain mold or mildew, or discoloration at any time. This amount will be used as a guideline only for the issuance of a violation letter to the homeowner and shall not affect, modify or change anything written in the Declaration of Covenants, Conditions and Restrictions.

Not be used for storage

Rugs or mats may be used to prevent oil stains from vehicles on a temporary basis only.

Rugs or mats are to be placed completely under the vehicle

Rugs and mats used must be removed and stored out of sight while driveway is vacant

Driveway Finishes

Driveway finishes may be stained a solid color without ARB approval as long as it is also an approved color (see exterior painting).

Painting or staining of driveway must include driveway, sidewalk in front of the driveway and apron. Must be painted with a non-slip paint (See approved color list). Existing painted driveways that have been approved shall not be required to meet these provisions so long as the current color is maintained. If the homeowner changes the color, the above standards will need to be met.

Pavers, stamped concrete or designer finishes must have ARB approval. Specifications must accompany ARB Request for approval.

Easement (see 7/17 amendments also)

The section of grass between the curb and the sidewalk Planting of trees, shrubs, bushes and hedges are not permitted due to safety issues, and

utility locations.

Only low ground cover type plants are permitted. ARB Approval required. Material and plant specifications must accompany ARB Request.

No edging of any sort is permitted in easement between street and sidewalk.

Only shredded pine or pine straw is permitted to be used as mulch in easement area (between street and sidewalk), as established by the St. Johns River Water Management District standards, and must be installed in such a manner so as not to create a drop-off from the sidewalk or driveway to the easement area. (amended 5/15/14)

ARB Approval required. Material and plant specifications must accompany ARB Request. Exterior Lighting

Security lights are permitted and shall be of a single lamp holder type mounted to the metal soffit under the eave or rake of the roof with a maximum two (2) lamps per holder and a total of four (4) locations per home.

Maximum wattage per fixture is one hundred and fifty (150) watts.

Lamps shall not be aimed so as to illuminate adjacent neighbor's homes.

The ARB may request removal or adjustment of any lighting that creates a nuisance such as spill over to adjacent properties.

Exterior Mechanical Equipment

Installation of exterior mechanical equipment including but not limited to HVAC, propane tanks, pool heaters, pool filters, water softeners installed on the side of the home must be placed on a solid base such as concrete or other similar surfaces.

o Maximum height of the equipment above ground shall be four (4) feet, not including vent pipes, controls' or disconnects.

Equipment must be set back a minimum of three (3) feet from the rear of the house line and ten (10) feet from the front of the house line •

Equipment must be concealed from view with the installation of hedge like plants similar to existing landscaping design or by other means such as a fence.

Exterior Painting (see 7/17 amendments also)

All exterior paint must be an approved color

ARB approval is not necessary if painting an approved color

Approved original paint scheme book is color maintained by the ARB, Management Company, and the Board of Directors as well as a display posted at the clubhouse facility.

Homes can only be three (3) colors. Wall color, trim color, and front door color. All trim must be white

New colors can be submitted. A 3 x 5 color draw down (paint sample) and ARB request must be submitted to the ARB once it is approved it is then submitted to the Board of Directors for approval. The ARB or Board of Directors may require a six (6) foot paint sample be placed on the side of the home to assist in their approval.

Exterior paint must be maintained in like new condition. A house with peeling, faded, and cracked paint blocklines showing or otherwise poor condition of paint or stucco must be painted.

Paint finish for exterior painting may be satin, flat or eggshell. Gloss or semi-gloss is not permitted.

Exterior Color Selection Formulas All paint samples are available for viewing at the clubhouse. Samples are based from Valspar Ultra Premium Exterior Flat gallon size formulas. Samples can be obtained from Lowe's and matched to other paint manufacturers if needed. All fences require ARB Approval.

A plot layout of the properties perimeter indicating the fence location, size, color, and type must accompany the ARB form for approval.

Fences may be constructed from wood, PVC, Aluminum, or wrought iron and shall not exceed a six (6) feet height measured from the ground to the top of the fence.

PVC fences must be white.

Aluminum fences may be white, bronze or black

Wood fences may be stained as long as it is an approved color. Clear sealers are permitted. Approved color samples are available at the clubhouse.

All fences must be maintained in like new condition.

Fences must not exceed a ten (10) feet set back from the front of house.

Gates must be constructed of the same material as the fence.

Gates must remain closed at all times and have a latch to keep them secure. Fence Colors

All other colors must be submitted to the ARB Approval. A color sample must accompany the ARB request.

Flags

American Flags, all US Armed Services flags including MIA, POW, and sports related flags are permitted. Size of US Flags and/or US Armed Services flags cannot exceed 4.5 feet x 6 feet. Size of sports flags cannot exceed three (3) feet by five (5) feet. Such flags do not require ARB approval. Any other flags require ARB approval.

Flags must be removable.

Flags must be flown on a pole in an outward fashion from the home. Flags mounted flush onto the home are prohibited.

Flags must be directly attached to the home to the left or to the right of the front door or garage door.

American flags must be flown in compliance to the Freedom to Display Act of 2005 and the Federal Flag code, 36 U.S.C. Sections 171-178 as amended.

Flags flown at night must be illuminated.

There shall be a maximum of two (2) flags per pole. Flag Poles

Flag poles are permitted and must be approved by the ARB. All specifications must accompany the ARB request.

Flag poles are to be retractable and lowered in severe weather.

Flag poles must be aluminum or stainless steel and anchored with a sleeve embedded in concrete

Flag poles are not to exceed three (3) inches in diameter or eighteen (18) feet in height Gardens

Vegetable or herbal type gardens are permitted however, they must be in the rear of the home. Must be within a fenced in area or must not be visible from the street or common areas.

Garages

Each home shall have an attached garage.

No garage shall be enclosed permanently or converted to another use without the substitution of another attached garage of the same kind or matching materials so as to conform architecturally to the construction of the dwelling unit.

All garages must have overhead garage doors, which shall be maintained in a useful condition and shall be closed when not in use.

Carports are not permitted. Gutters and Downspouts

Gutters and downspouts are permitted with ARB Approval. Size, color and material specifications must accompany the ARB request for approval.

Gutters and downspouts are to be constructed of White vinyl or aluminum.

Downspouts must have standard splash blocks of a natural earth tone to prevent erosion. Hedges

Hedge type plants adjacent to a properties perimeter or structures must be kept trimmed and manicured on a regular basis and must not exceed a maximum height of six (6) feet.

All hedge type plant installations must have ARB approval. Hedge specifications including a plot layout indicating plant location on the property must accompany the ARB Request.

Hedges are not to obstruct usage or line of sight of driveways, sidewalks and vehicular traffic.

The ARB may request hedges to be trimmed lower for safe usage of sidewalks or to eliminate restricted line of sight for vehicular traffic.

Holiday Lighting and Decorations

Installation of Holiday lighting and decorations does not require ARB Approval.

Installation of Holiday lighting and decorations for Christmas Holidays is after Thanksgiving and must be removed by January 10th

Installation of lights and decorations for other Holidays are for a 20 day period only 10 days prior and 10 days after.

The ARB may require the removal of any lights or decorations that create a nuisance. Hose Reels

Mounted hose reels or portable reels are permitted to be mounted /placed on the side of the home. They shall be mounted no greater than three (3) feet from the ground surface.

Must be shielded by shrubs or of other means so it is not visible from the street. Irrigation

Installations of irrigation systems do not require ARB Approval.

Owners are encouraged to inspect and maintain their own irrigation systems regularly to avoid waste of water, and overwatering.

Irrigation may cause staining or mold growth on homes, sidewalks, driveways, and fences or other items that may become unsightly. It is the home owner's responsibility to treat and remove any such staining or mold on a regular basis.

Watering must be in compliance with the St. Johns Water Management District’s restriction guidelines. Watering days are governed by address

o Daylight savings time (2nd Sunday in March until the 1st Sunday in November) o Odd numbered addresses water on Wednesdays and Saturdays. o Even numbered addresses water on Thursday and Sundays.

o Eastern Standard Time (1st Sunday in November until the 2nd Sunday in March) o Odd number addresses water on Saturday o Even number addresses water on Sunday

Watering is most effective before 10 am or after 4 pm.

Irrigation of new landscape or lawns is allowed at any time of the day on any day for the initial 30 days and every other day for the next 30 days for a total of one 60 day period provided that the irrigation is limited to the minimum amount for establishment.

Irrigation systems can be operated anytime for maintenance or repairs but are not to exceed 10 minutes per hour per zone.

Irrigation using a hand held hose equipped with a spray nozzle that can be adjusted so water only flows only as needed is allowed anytime.

Adjust sprinklers so as little water as possible lands on sidewalks, driveways, and streets. Landscape

Landscape shall be maintained per the Declaration of Covenants, Conditions and Restrictions at all times

The installation of additional landscape beds other than the original landscaping must have ARB approval. A plot plan of the property indicating the landscape beds being added or removed must accompany the ARB Request.

Landscape beds must be properly maintained. Free of weeds, also with the proper ground cover which can be mulch or stone. Bare dirt is not permitted.

The addition or the removal of landscape beds must not alter the flow of water drainage on or off the property.

The replacement of bedding plants in approved landscape beds does not need ARB approval.

Replacement of original landscape does not require ARB Approval.

Use of stones or rocks in landscape beds is permitted, but is limited to pea gravel, river rock and egg rock and shall be either white or natural earth tones. All existing stones or rocks may remain and be maintained. However, if the homeowner replaces existing rock/stones with another type of stone or rock, they must be replaced with one of the approved types of stones or rock.

Synthetic mulch must be of natural earth tones or white.

Landscaping can be lined with concrete curbing, decorative wall stone or bricks as long as they are of earth natural tones or white. Black rubber or synthetic curbing is also permitted.

Annual plants in existing landscape or plant beds (plants living for a single year or season) may be planted without ARB approval.

Potted plants are allowed for decorative usage except when placed on the grass or on the lower section of driveways, or sidewalks.

No edging or curbing is permitted in easements

Water features are permitted with ARB approval. The ARB has the authority to restrict placement of such features if being installed in the front of the property. Water features must be tied down or able to be removed in the event of adverse weather such as tornados or hurricanes.

Lawn

Yards shall be maintained per the Declaration of Covenants, Conditions and Restrictions at all times

Lawn types permitted are St. Augustine or Zoysia.

Re-sodding with an approved grass type does not need ARB Approval.

Only two types of grass are permitted. Lawns are not permitted to be a blend of grass types.

Lawns must be properly maintained which includes regular mowing, trimmed and edged on a weekly or twice a week depending on growth

A regular maintenance schedule for weeds, fertilizer, and insect control by a professional or by the homeowner is required.

No more than ten feel by ten feet (10'xl0'=100 square feet) of the total yard (grass) that is visible from the street shall be dead, dying, or in a distressed condition at any time. This amount will be used as a guideline only for issuance of a violation letter to the homeowner and shall not effect, modify or change anything in the Declaration of Covenants, Conditions and Restrictions.

Over seeding of lawn with rye grass or any other type of grass other than St. Augustine or Zoysia is prohibited.

Grass longer than eight (8) inches will be considered as a violation.

Grass clippings must be removed from sidewalks, driveways and streets after each mowing.

Dirt, trash, and debris resulting from all operations of lawn and landscape care shall be removed and all areas left in a clean condition

Suggested Lawn care for St. Augustine: a) Ideal grass length is recommended between two (2) to four (4) inches in length. b) Mowing grass shorter than recommended is more prone to weeds, insects and burning. c) Annual chinch bug and grub treatments by a professional service or by the homeowner are required.

Parking

Park in driveways only.

Parking in grass in prohibited.

Night time parking on the street between the hours of 11 pm and 6 am is prohibited.

Parking against the flow of traffic is prohibited.

Parking near an intersection or in any manner that would restrict normal traffic flow is prohibited.

Boats, campers, motor homes, buses, and any other type of recreational vehicles are prohibited overnight.

Storage of vehicles other than in the garage is prohibited.

All vehicles must have proper license and registration.

All vehicles must be in working order. A vehicle that cannot operate on its own power shall not remain in the Community for more than twelve (12) hours except in the garage of a home.

Working on or repairing of vehicles other than in a garage is prohibited.

Violations will be the responsibility of the vehicle owner and the home owner. Towing, if Necessary, will be at the owner's expense.

Patios or Decks

Revisions to patios must have ARB Approval. Lot layout indicating patio location and material specifications must accompany the ARB request for approval.

Patios and decks are only permitted at the rear of the home. Roofs

Roofs shall be maintained per the Declaration of Covenants, Conditions and Restrictions at all times.

Roof modifications or alterations must have ARB approval. Specifications must accompany the ARB Request for approval.

Entire replacement of roofing materials must have ARB approval. Specifications must accompany the ARB Request for approval.

Homeowners are required to maintain the condition of roofs from peeling, fading, cracked, missing, or otherwise poor condition must be repaired.

Replacement of missing shingles is permitted without ARB Approval as long as they are of the same weight, size, color and design type as the existing materials.

Shingles are to be asphalt or fiberglass, three (3) tab, or Architectural type shingles.

Shingle colors are to be Identical to original shingle color.

Replacement of roofing materials shall meet all building code requirements and have proper permitting

No clay tile or metal roofs permitted.

Roofs must be cleaned in the event of mold or mildew buildup.

No more than one third (1/3) of the total roof shall be covered with mildew at any time. This amount will be used as a guideline only for issuance of a violation letter to the homeowner and shall not affect, modify or change anything written in the Declarations of Covenants, Conditions and Restrictions.

Roof coatings are prohibited.

If roll roofing material is required to be used in any of the roof valleys, the color of the roll roofing shall be consistent with the style and color of the shingles.

Satellite Dishes or Antennas

Satellite Dishes and Antenna installations must adhere to guidelines issued by the Federal Communications Commission on Over the Air Reception Devices (FCC Rule 47 CF.R. Section 1.4000 as amended and the listed guidelines below).

Location of Satellite dishes or antennae must have a ten (10) feet set back from the front or rear of house.

No more than one (1) Satellite Dish is permitted and must not exceed 18 inches in diameter.

No more than one (1) antenna is permitted and must not exceed an overall height of five (5) feet above the peak of the roof. Overall size not to exceed twenty four (24) inches by sixty (60) inches.

Mast aerial or tower antennas are prohibited

All cables and wires must be concealed. Cables or wires must be installed so they are from the antennae or satellite dish down into the attic space and then distributed to the interior rooms. Cables are not permitted to be installed on the outside of the home from room to room.

Screen Enclosures

Screen enclosures for pool or patio or front entry areas must have ARB Approval. Plot plan of property indicating the location of the enclosure and material specifications must accompany the ARB Request.

Front Entry screen enclosures must be white or bronze framing.

Retractable garage door screens are permitted and must be painted the same color as the exterior wall color or white.

No metal or any other material except charcoal colored screening shall be permitted for any screen enclosure for pool or patio.

Sheds or storage buildings

All sheds/storage buildings must be approved by the ARB.

ARB Request must include size, shape, location, and material specifications included with ARB Request.

Storage buildings/sheds must not exceed over all height of ten (10) feet one hundred twenty (120) square feet.

Construction shall be of block or wood frame constructions and must be anchored to the ground to meet hurricane requirements.

Exterior siding shall be made of wood, stucco, or cementous product and painted to coincide with the color scheme of the main home.

Roof shall be shingled the same color and style as the main house.

Only one (1) outbuilding shall be approved per residential lot.

No metal or vinyl products shall be approved as outbuildings or storage sheds.

Must be concealed within a fenced in area.

Placing the outbuilding on a slab shall be optional if the homeowner desires and included in the ARB Request if desired.

Shutters

Reusable/Removable type Hurricane Shutters are permitted and must be approved by the ARB. Material specifications including mounting specifications must accompany the ARB Request.

Mounting hardware is not allowed to be visible when not in use.

Hurricane shutters are to be installed seventy two (72) hours prior to the hurricane event and must be removed and stored within seventy two (72) hours after the threat has passed.

Hurricane shutters are not permitted to be in place for the entire hurricane season

Hurricane shutters are not permitted for security

Decorative shutters are permitted on the front windows of the house only

Decorative shutters are to be constructed of vinyl, wood or aluminum and must be white.

Decorative shutters do not need ARB Approval. Sidewalks/Walkways

All walkways and pathways including the sidewalks in the front of each home is the responsibility of each home owner to keep clean of mold, mildew and stains.

No more than one third (1/3) of the total sidewalk, pathway or walkway shall be covered with mildew at any time. This amount will be used as a guideline only for issuance of a violation letter to the homeowner and shall not affect, modify or change anything in writing in the Declaration of Covenants, Conditions and Restrictions.

Walkways or pathways extending from the back of the home can be made from concrete, stone, shale, or pavers. Stone, shale or pavers must be of natural earth tones. These walkways/pathways must have ARB Approval. A plot layout indicating the location of the walkway/pathway including material usage specifications must accompany the ARB Request.

Walkways, pathways, or sidewalks damaged due to construction, renovations, modifications, maintenance or repairs to a lot are the responsibility of the homeowner to repair or replace.

Concrete porches at the front entry and sidewalks leading to the front entry also must be an approved color when visible to the street

Signage

Commercial signs are not permitted on any lot or common areas.

Real Estate or Rental signs are permitted providing that they are not larger than twenty four (24) inches by thirty six (36) inches and not to exceed forty eight (48) inches in height. Mounted in the ground by a four (4) by four (4) post, wire or metal legs.

Only one (1) sign permitted per home.

May be placed no closer than fifteen (15) feet from the curb.

Security Alarm signage is permitted but not to exceed twelve (12) Inches by twelve (12) inches. Security Alarm sign age must be placed in the landscape bed area.

Garage Sale signage is permitted only in the front of the home for that day only. Yard sales are only permitted twice a year on predetermine designated dates chosen by the BOD.

All other sign age is prohibited.

Signage is not permitted in any common area, including the boulevard, front entry to the community, mailboxes, and clubhouse facility.

Solar Panels

Solar Panels are permitted and must have ARB Approval. Solar Panel specifications and mounting information including location must accompany the ARB Request.

Solar Panels are only permitted on the back half of the roof area and must not exceed one quarter of the total square footage of the roof.

Solar panels and on roof piping must be black or bronze in color. Below roof piping must be painted the same color as the exterior wall.

Any equipment placed on ground level must adhere to the mechanical equipment specifications listed in this document.

Ground mounted solar panels are not permitted. Spas/Hot tubs

Spas and Hot Tubs are permitted and have not less than a ten (10) foot set back from any property line.

Spas and Hot tubs are only permitted within enclosed screen enclosures or fenced in areas. Sports/Play Equipment

Outdoor play sets, swing sets, basketball goal, soccer goals, trampolines, and other recreation equipment are permitted but must be located at the rear of the home within a fenced in area not visible from the street.

Outdoor play sets, swing sets, basketball goal, soccer goals, trampolines, and other recreation equipment are prohibited on any common area.

Basketball goals in the driveway are prohibited.

Tree house or platforms of a like kind or nature shall not be constructed on any part of any lot.

Storage

Stored items must not be visible from the street

Items stored at the side of the home, driveway or front entry are prohibited

General storage areas or workshops are prohibited in the rear or sides of the home

Storage of laundry, mops or similar articles shall not be hung or exposed so as to be visible from outside the residence or lot.

Swimming Pools

In ground swimming pools are permitted and must have ARB Approval. Pool construction specifications must accompany ARB Request.

Above ground swimming pools are prohibited.

In ground swimming pools must be enclosed in a screened enclosure.

No pool or enclosure may extend beyond the width of the house or infringe on any rear easement.

Exposed concrete walls created in constructing a pool must be screened from view by the installation of hedge like plants similar to existing landscape and design.

Pools shall be adequately maintained and chlorinated.

Trash/Debris

All debris, miscellaneous wood and other similar items cannot be stored or left on the property.

Items need to be discarded and placed curbside for normally scheduled trash pickups as required by the waste removal company.

Trash collection and disposal procedures established by the Association and the Waste Management Company shall be observed

All household trash must be stored in sanitary containers with lids

No outside burning of trash, garbage or other waste is permitted

Garbage containers may be stored outside as long as they are not visible from the street

No supplies or other similar articles shall be stored or placed outside of the house or parcel in plain view of the street

Trash cans can be placed curbside the night before a scheduled pickup but must be removed and stored out of sight by the end of the trash pickup day

It is the responsibility of each owner to prevent the development of any unclean, unsightly or unkept conditions on any lot which tend to substantially decrease the beauty of the community as a whole or specific area.

Trees

Trees situated on any lot between set back lines and the property lines having a diameter of eight (8) inches measured four (4) feet from the ground level or more may not be removed without prior ARB approval. A plot plan indicating the location of trees to be removed must accompany the ARB Request.

Trees less than eight (8) inches measured four (4) feet from ground level do not need ARB Approval for removal.

Tree removal approval is based on the following criteria: a) Trees and bushes of any type are not permitted in the easement areas due to safety and

utility locations. b) the location of the tree restricts the construction of utility lines or drainage facilities. c) the location of the tree restricts access to the property d) the location of the tree restricts use of the property consistent with all other county, state

codes, statutes, ordinances, resolutions, and site location modifications are not feasible or reasonable which a variance would otherwise have to be granted.

e) the tree constitutes a potential hazard to life or property that cannot be mitigated without the removal of the tree.

f) the tree is dying or dead so that it's restoration to sound condition is not practical, or it has a disease which can be expected to be transmitted to other trees and endanger their health.

g) the tree would increase light and air circulation for the purpose of improving poor health conditions of a group of trees or preventing disease of a group of trees, the selective removal of up to twenty five (25) percent of the group may be permitted.

Trees need to be pruned or trimmed on a regular basis so as not to restrict sidewalk, driveways, or vehicular traffic line of sight.

Anyone violating the provisions above will be required to replace such trees with trees of a like kind, size and condition within thirty (30) days after demand by the ARB. If the owner fails to comply with the ARB the ARB shall cause suitable replacement to be planted and the cost thereof shall be a lien against the property owner.

Trees are classified as a woody plant with secondary branches extending from a single trunk above ground level.

When a tree is removed, the tree stump shall be ground out. (prevents termites) Windows

Replacement of existing windows must be white vinyl or aluminum.

It is the responsibility of the home owner to obtain any permitting required and must meet Hurricane Specifications.

Window replacements must be approved by the ARB. Window specifications must accompany the ARB Request for approval.

Window Treatments

Windows visible from the street must have proper window treatments. Newspaper, aluminum foil, sheets, linens or other non-standard window treatments are prohibited.

Broken or window treatments that are in poor condition are to be repaired or replaced.

Window tinting is permitted if it is non-reflective gray or charcoal in color. An ARB request is not needed.

Window treatments in a single window must be of matching color on the front of the house. Yard Waste

All yard debris, including, but not limited to, lawn clippings, leaves, weeds, etc. must be picked up and placed in trash cans or properly bundled. Yard debris to be stored where not visible from the street prior to 5:00 p.m. the night before scheduled pickup. Yard debris to be placed on the drive or in the easement area (between street and sidewalk) for pickup. No debris to be put in the street.
