CONSTRUCTION LAW COMMITTEE
Green Building and sustainability is a rapidly evolving area of practice affect-ing all professionals in the building industry--increasingly in Louisiana, and increasingly including attorneys. This presentation will help construction attor-neys understand the principles and processes behind Green Building practices, and will provide an understanding as to how these “Green” practices can affect the legal and contractual arrangements on a construction project. Participants will gain an understanding on Green rating systems and how these systems can be used in contracts, the common pitfalls involved with Green Building, and the best practices to avoid those pitfalls. The session will also cover the new opportunities opening up to attorneys with the growth of Green Building and will discuss the issue of attorneys and LEED accreditation.

Deconstructing The Reptile: Defending “The Reptile” Strategy In Insurance Litigation
INSURANCE LAW COMMITTEE
“The Reptile” approach to litigation has been gaining ground in courtrooms across the country, and is increasingly being employed by policyholder counsel to persuade juries to give big dollar awards and bad faith damages against the insurance industry. Doug Green, a seasoned jury and litigation consultant, will deconstruct this strategy and offer insightful advice on how to address it, from witness preparation to closing argument.

2016 BENCH BAR CONFERENCEBourbon with the Bench & Bar
Thursday, March 10, 2016Bourbon is America’s whiskey, having been declared by the U.S. Congress as America’s Native Spirit in 1964. From sweet aromatic bourbons to spicy, woodsy bourbons, attendees experienced a range of flavors and aromas to delight their senses. There’s no better place to sip bourbon than at the Grand Hotel, where generations of bourbon aficionados have sipped America’s whiskey. A special thanks to Les Alexander, AEA Group, for sponsoring Bourbon with the Bench & Bar.

I’ve been a member of the YLS since 2006, and it has been a rewarding and enriching experience. We are proud that the YLS is one of the most active young lawyer groups in Louisiana. All of the YLS programming is designed to further the New Orleans Bar Association’s commitment to professional development and service to the local community.
The YLS coordinates a diverse range of programs throughout the year, including seminars and bar conference events. YLS members have the opportunity to participate in the Procrastinators’ Program CLE presentation For Young Lawyers, By Young Lawyers and the Big Easy Bootcamp, a great way to get experience as a CLE presenter.
In addition to continuing legal education program-ming, the YLS is also dedicated to organizing community legal fairs, speakers for naturalization ceremonies, programs directed toward local school children, and service projects for the betterment of the greater New Orleans area.
The YLS also puts on four fundraising events every year in support of legal aid services. The Bar & Grille
The YLS prides itself on giving back to the community and having a great time while doing. It is a fantastic way to meet other young lawyers, network with experienced lawyers and judges, and engage in valuable community service in the New Orleans area.
I encourage everyone to give back to the New Orleans legal community. For young lawyers, there is no better organization than the YLS. Join us! We meet the first Tuesday of every month at 12:00 p.m. at the New Orleans Bar Association offices, located at 650 Poydras Street, Suite 1505. Getting involved is as easy as showing up. For more information on joining the YLS, please call (504) 525-7453 or e-mail me ([email protected]) or Liz Daino ([email protected]).

I n the case of McClanahan v. McClanahan, 14-0670 (La. 5th Cir. 3/25/15), 169 So. 3d 587, the Fifth
Circuit Court of Appeal ruled that the Trial Court did not err when finding that the husband had sufficient income to pay both child and periodic spousal support as ordered by the Trial Court.
In this particular case, the husband appar-ently had many complicated transactions among and between his various companies and himself. In addition, the husband had produced and/or provided inadequate documentation of his income.
The Court of Appeal noted that the husband’s alleged salary of $60,000 per year was inconsistent with his standard of living, and that the Trial Court had the right to consider evidence of the husband’s standard of living when his claimed income was in-consistent with his lifestyle.
There are many times when we face opposing parties who either do not produce documents, “take cash under the table,” or in some other manner enjoy a standard of living far removed from their claimed salary.
If you face such an obstacle, use the McClanahan case in support of the court’s right to render a more subjective opinion as to the individual’s income and, thus, his/her obligation to pay child support or spousal support.
