RATIONALEThe subject property falls within TRCA’s approved master plan for acquisition for the Rouge River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. Through the review of subdivision 19T-05003 for a proposed residential development of this site, TRCA staff established the limits of the open space lands (i.e. Block 12 on the draft M-Plan) which is comprised of Oak Ridges Moraine lands. The subject open space land is also adjacent to other TRCA parcels.

TAXES AND MAINTENANCEBased on preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2013 taxation year. The Town of Richmond Hill has agreed to manage the property.

AND FURTHER THAT the authorized TRCA officials be directed to take the necessary action to finalize the transactions including obtaining needed approvals and signing and execution of documents.

CARRIEDBACKGROUNDResolution #A94/10 at Authority Meeting #5/10, held on June 25, 2010, approved the Greenlands Acquisition Project for 2011-2015.

In 2004 a signed petition to complete a comprehensive analysis into the on-going erosion at the rear of the properties spanning nos. 30 – 48 Royal Rouge Trail was submitted to TRCA by the residents of the area. In response, TRCA retained the services of Terraprobe Limited to complete the investigation and to provide TRCA with a detailed assessment of the site, including the forecast long-term stable slope crest (LTSSC) and an estimation of the potential risk to the existing properties located within the affected area.

The findings of the initial assessment determined that the primary contributing factor to the erosion is groundwater seepage, and that there was significant risk of loss of valuable tableland. It was recommended at that time that remedial action be undertaken to address the on-going erosion and to provide long-term protection to the existing structures at risk within the study area.

In 2009 TRCA initiated a Class Environmental Assessment (Class EA) in accordance with the Conservation Ontario Class Environmental Assessment for Remedial Flood and Erosion Control Projects process, to develop a comprehensive solution to address the problem.

The preferred solution(s) as determined through the Class EA process involves slope trimming, regrading and aggressive planting of the oversteepened slope at the rear of the properties from nos. 30– 40 Royal Rouge Trail, and the construction of a large retaining structure adjacent to, and at the rear of the properties from nos. 42 – 48 Royal Rouge Trail.

The formal Project Plan, generated through the Class EA process was submitted to the Ministry of the Environment in September 2011, and was approved through the 30-day public review period in October 2011. Pending receipt of remaining approvals, and the completion of all landowner agreements, staff anticipate commencing implementation of the proposed works in the summer of 2012.

Through the completion of the proposed erosion control measures, the private properties at 30 - 44 Royal Rouge Trail will be impacted. These properties front onto the north side of Royal Rouge Trail between Sheppard Avenue East and Glen Rouge Park, northwest of Kingston Road. The subject properties to be transferred to TRCA consists of seven parcels described as Parcels ‘A’ to ‘G’ inclusive and are strips of land that run, more or less, northward from the north end of the new top of the slope down into the Glen Rouge ravine. The lands to be retained by the owners include the remaining southerly land with houses and other improvements.

The TRCA funding policy for works carried out on private lands, stipulates that benefiting landowners are required to contribute to the cost of the project, either financially, or through the transfer of lands. Resolution #A159/09 adopted at Authority Meeting #7/09 on September 25, 2009 sets out this funding policy.

If the landowners wish to retain ownership of their lands, the landowners have the option to pay to TRCA a financial contribution and provide a permanent easement and restrictive covenant over the parcel of land. The financial contribution differs for both the easterly and westerly components because the easterly component includes a less costly slope trimming, regrading and aggressive planting of the oversteepened slope while the westerly component includes the construction of a large retaining structure. It is estimated that the financial contribution in the easterly section involving 30 to 40 Royal Rouge Trail will be about $8,500 per property, while the financial contribution in the westerly section involving 42 and 44 Royal Rouge Trail will be about $25,000 per property.

Negotiations are being completed with the seven homeowners. Two of the seven homeowners, being the landowners of Parcel A at 30 Royal Rouge Trail and Parcel B at 32 Royal Rouge Trail have indicated that they wish to consider a financial contribution in lieu of a land transfer.

RATIONALEThe subject properties are required for the construction of the Royal Rogue Trail Erosion Control Project.

TAXES AND MAINTENANCEThose Parcels ‘A’ to ‘G’ inclusive which are acquired will be turned over to the City of Toronto under the terms of the existing management agreement.

FINANCIAL DETAILSFunds for the costs related to this purchase are available in the Royal Rouge Trail Erosion Control Project, a project included in the 2012 capital program approved by the City of Toronto.

Since TRCA does not presently own any adjoining property and the abutting residential lots to the east (i.e. within subdivision 19T-06V04) will effectively isolate Blocks 178 and 179, the City of Vaughan has agreed to allow TRCA temporary access over the neighbouring City-owned valleyland to the north until alternate access is achieved through the valley buffer Block to the immediate west, which is proposed to be conveyed to TRCA as part of the approval of the adjacent residential subdivision.

Attached is a plan showing the location of the subject lands.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT Toronto and Region Conservation Authority (TRCA) enter into an easement agreement with George Johnson for the purpose of constructing, and permitting the public use of a trail system, said land being Part of Lot 5, Concession 7, Township of Uxbridge, Regional Municipality of Durham;

THAT the term of the easement agreement be for five (5) years with automatic extensions until terminated and in no event will the initial term and any renewals or extensions thereof, exceed in aggregate twenty-one (21) years, less a day;

THAT TRCA pay an annual fee to George Johnson of $6,000.00, with such fee increasing by 4% annually beginning August 1, 2013;

THAT TRCA erect barriers on both sides of Chalk Lake Road (where the proposed trail is to cross) to help ensure trail users to slow down before crossing at Chalk Lake Road;

THAT TRCA be responsible for signing the trail to ensure trail users understand the trail rules including the need to stay on the trail and not to trespass off the trail;

THAT the agreement be on terms and conditions satisfactory to TRCA staff and solicitors;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining needed approvals and signing and execution of documentation.

CARRIEDBACKGROUNDDiscussion began with George Johnson regarding possible trail alignments across Mr. Johnson's property following TRCA's purchase of the neighbouring Skyloft property. Negotiations included Township of Uxbridge staff, Durham Conservation Association, Uxbridge Naturally and Green Durham members (who have agreed to pay 50% of the annual rental fee). The trail easement agreement will facilitate an improved realignment of the Oak Ridges Trail with the intent of reducing on road segments of the trail for user safety and enhanced natural experience. Once it was determined that George Johnson was receptive to the concept of the easement, the Oak Ridges Trail Association was consulted and their organization also participated to determine the preferred easement alignment.

The Oak Ridges Trail Association cannot hold easements on land, so TRCA will enter into the easement agreement. The terms of the easement agreement will be for five (5) years with automatic extensions. In no event will the initial term and any renewals or extensions thereof, exceed in aggregate twenty-one (21) years, less a day. George Johnson or TRCA can terminate the easement agreement at anytime by providing six (6) months prior written notice to the other party.

The Johnson property will provide a strategic trail connection/linkage between TRCA's Skloft property, Oak Ridge Moraine Land Trust's Purvis property and TRCA's Dagmar properties. In May 2011,TRCA approved an Easement Agreement involving another neighbouring landowner within the Township of Uxbridge (Lakeridge Farms Limited) which was also for the purpose of constructing and permitting the public use of the trail system. All partners agree these types of arrangements help to improve the overall trail user experience, community connections and safety.

RATIONALEThe trail easement agreement with George Johnson has been fully supported by the Township of Uxbridge and was developed in consultation with the community and the Oak Ridges Trail Association for non-motorized recreation activities such as walking, hiking, bicycling, snowshoeing, cross country skiing and on leash dog walking. The easement also provides a safer trail route, which takes it off road from the existing alignment. In addition, the new route over the easement will provide the user with a highly valued natural experience.

A plan illustrating the property location and the trail is attached.

FINANCIAL DETAILSIt is anticipated that Mr. Johnson will initially plow and regularly mow/maintain the trail on subject easement, resulting in minimal operating costs to TRCA for this work and management. Green Durham has agreed to pay 50% of the annual rental fee. Funding is available in TRCA's Durham Watershed Trails Capital Account 109-06.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT the contract for Albion Hills Conservation Area Visitor Services Centre Construction Project be awarded to Frontier Group of Companies. at a total cost not to exceed $312,500.00, plus HST, it being the lowest bid meeting Toronto and Region Conservation Authority (TRCA) specifications;

THAT award of the contract be subject to terms and conditions satisfactory to TRCA staff and solicitors, including but not limited to determination of the final contract cost not to exceed the approved amount;

THAT should staff be unable to achieve an acceptable contract with the above-mentioned contractor, staff be authorized to enter into and conclude contract negotiations with other contractors that submitted tenders, beginning with the next lowest bidder meeting TRCA specifications;

AND FURTHER THAT authorized staff be directed to take the action necessary to implement the contract including obtaining any approvals and the signing and execution of documents.

CARRIEDBACKGROUNDCurrently, Albion Hills Conservation Area and Campground has two registration intake locations for customers visiting its facilities. Day use clients are processed at the front gate and overnight campers are processed at the campground registration office. This system relies heavily on customer understanding and honesty. For example, when overnight camping customers enter the park, TRCA staff cannot ensure the customer will then proceed to the campground office for registration. The group camping program also experiences significant fee collection challenges for the same reason. As a result, registration, collection of camper/client fees, access to the park and overall customer service are impacted negatively by an inefficient system. In order to improve customer service, capture potential loss of revenue and to exceed customer expectations, it is the intention of TRCA to streamline its services by combining various administrative functions and relocating them to one centralized site at the main entrance of the park.

In addition, staff has monitored and evaluated on an annual basis the condition of both the gatehouse and campground office buildings. While the existing gatehouse is structurally sound, it does not meet the needs of a registration administration office in terms of available space, safety, security, storage, administration and staff washroom facilities. In contrast, the campground office requires immediate attention due to its overall disrepair. The campground office is declining at a rapid rate due to age, moisture related issues, pest infiltration and overall weather related damage. In order to meet health and safety standards, exceed customer expectations, safeguard internal equipment and streamline registration services to one location, staff propose the demolition of the existing campground registration office and the construction of a new front entrance gatehouse.

Over the last few months staff worked closely with Paul Didur Architect Inc. to prepare and refine detailed design and construction drawings required to move forward with the tendering and building permit process. The new gatehouse will combine all registration functions currently being performed at separate locations throughout the park. The new front entrance gatehouse will provide the following specific primary functions:

site for primary day use and overnight registration fee collection;

main park administration office;

centralized customer information kiosk;

small retail camp store.

In order to accomplish this goal, TRCA plans to demolish the existing campground office and gatehouse and construct a new four season, approximately 900 square foot, building which will consist of the following features:

staff washroom with holding tank;

staff office;

storage area;

entrance to accommodate walk-in customers;

retail space;

parking lot extension and improvements.

Based on the evaluation criteria and recommendations from Paul Didur Architect Inc., staff concluded that the tender submitted by Frontier Group of Companies Inc. meets all requirements set out in the tender documents and is the lowest bid received. B.L.T. Construction Services Inc. was disqualified due to failure to provide the required mandatory bid bond documentation.

Staff is confident that Frontier Group of Companies Inc. will conduct the required tasks in a timely and cost effective manner. CARRIEDBACKGROUNDIn support of its vision for The Living City, TRCA is committed to providing equal access to its facilities to all community members. TRCA advocates for community health and well-being, as well as promotes and encourages environmental stewardship and guardianship within local communities.

The TRCA Accessibility Standards for Customer Service Policy stems from the Accessibility for Ontario's with Disabilities Act, 2005 (AODA), Regulation 429/07, which was passed in order to implement and enforce mandatory accessibility standards. The Policy outlines TRCA's responsibility to ensure that its services, employment opportunities and current workplace environment are accessible to persons with disabilities.

The Admittance Policy addresses user participation of TRCA programs and services including but not limited to persons with disabilities, financially challenged individuals and groups, children and Active Transportation users (defined by the Public Health Agency of Canada as walking, jogging, running, cycling, in-line skating, skateboarding, wheelchairing and snowshoeing). Additionally, TRCA provides opportunities for free access to public facilities through a wide range of programs, including but not limited to:

Doors Open events at Lake St. George Field Centre, Claremont Field Centre, Black

Creek Pioneer Village and the Kortright Centre for Conservation: hosted annually to provide local community access to these facilities.MAP (Museum Access Pass): offered at Black Creek Pioneer Village (BCPV). This

program is available free of charge at all 99 Toronto public libraries. It allows a Museum Access Pass to be taken out on loan using a library card for access to venues like BCPV. Cultural Access Pass: provides free admission to all public use facilities for new Canadian

citizens, and up to four of their children, for one year from date if Citizenship. Research Library Access: access to the BCPV Research Library for the public can be

obtained by making an appointment with BCPV staff. Caledon Canada Day: hosted annually at Albion Hills Conservation Area, this celebration

provides free admission, live entertainment, children’s activities and more to over 10,000 local community members.Kids Free program: provides free general admission for children aged 15 and under at all

conservation areas. BCPV kids free program provides free general admission for children aged 15 and under Monday through Friday during the months of July and August.

RATIONALEDespite the aforementioned TRCA offerings, staff continue to receive numerous inquiries from the public and school/organized groups requesting increased access. In response to these requests, in order to recognize different sectors of the community, and to align TRCA policies with its municipal partners, the TRCA Admittance Policy was developed. The Policy promotes the full participation of users in educational, cultural and recreational programs and services and addresses needs of community members, including but not limited to persons with disabilities, financially challenged individuals and groups, children and Active Transportation users.

DETAILS OF WORK TO BE DONETRCA will undertake an evaluation of the TRCA Admittance Policy within one year after it is

fully implemented to assess its effectiveness and to identify amendments if required. Any proposed substantive amendments will be submitted to the Authority for consideration and approval.Amend the Fee Schedule for Public Facilities and Programming to reflect the changes

outlined in the TRCA Admittance Policy and Operational Procedures.

FINANCIAL DETAILSActive Transportation Users:Financial implications of the elimination of general admission fees for Active Transportation users at TRCA conservation areas will be minimal due to the fact that currently many local residents access TRCA facilities through Active Transportation modes at no charge. The vast majority of visitors arrive by vehicle as the main mode of transportation due to the remote location of TRCA's facilities, minimizing any financial impact.

BCPV Kids Free Program:A marketing analysis determined that free child general admission to BCPV, Monday through Friday, during the months of July and August, is forecasted to increase attendance by 1,600 visits. Revenue generated by the projected increase in attendance, including secondary sales, is forecasted to offset the projected loss in revenue from child general admissions.

Affordable Admittance to Persons with Disabilities and Financially Challenged Individuals and Families:As a minimum, staff will ensure that all financial assistance provided to persons and groups with disabilities and financially challenged individuals and groups covers the base operating costs directly associated with the delivery of program/facility. RES.#B92/12 - BLACK CREEK HISTORIC BREWERYStatus Report. Summary report for Black Creek Historic Brewery.

IT IS RECOMMENDED THAT the report dated June 18, 2012, on the third year of the Black Creek Historic Brewery at Black Creek Pioneer Village (BCPV) be received.

CARRIEDBACKGROUNDAt Executive Committee Meeting #10/08, held on December 12, 2008, Resolution #B168/08 was approved, in part, as follows:

THAT a contract with Trafalgar Ales and Meads to establish and operate a pioneer brewery and museum at Black Creek Pioneer Village be approved, at a cost not to exceed $92,000 annually, plus applicable taxes and reasonable inflationary adjustments;...

AND FURTHER THAT staff report back after one season of operation of the Pioneer Brewery and Beer Museum.

2011 marked the third year of operation for the Black Creek Historic Brewery (BCHB) at BCPV. The brewery continues to impress visitors at BCPV as measured by the consistent excellent feedback on comment cards. A brewery sample tour was a new initiative that was also very well received. Guests were able to sample three different brews while interacting with a brewery interpreter regarding the differences in each.

Some key highlights for the brewery in 2011 included: brewing the 1-mile beer on-site;

a 3/4 page article in the Toronto Star about the brewery ;

successful launch of the Black Creek Stout in November 2011, the brewery's third listing

in the LCBO.

The brewery had a positive effect on both Black Creek Pioneer Village’s paid admission and as an added option for corporate clients. The brewery also received an increased media presence both locally and nationally.

Special Events: On-site and Outreach In 2011, the brewery was integrated as a feature to all special events at Black Creek Pioneer Village. For each event, a specialty brew was created and marketed as part of the event. Some of the specialty brews included:

Canada Day – Maple Beer;

Halloween – Pumpkin Beer;

Christmas – Winter Warmer Beer.

Off site, the brewery participated in three special events including the Toronto Wine and Cheese Show, Paddle the Don and the Charles Sauriol Environmental Dinner.

LCBO Sales BCPV launched its first beer in the LCBO in November 2010, the Black Creek Porter Ale. Based on the initial success of the Porter, the LCBO agreed to list two more beers: the Black Creek Pale Ale and the Black Creek Stout. In the first full year of sales, Pioneer Breweries Limited sold 6,517 cases through the LCBO, which represents a 1% share of the microbrewery market. The LCBO has been so impressed with the sales of the beer that they have accepted three new listings for 2012.

The Brewery and Local Food ConnectionThe brewery and restaurant continue to be popular destinations for both visitors and staff. The restaurant continues to promote local, sustainable meals and pairs the Black Creek beers as well as beers from other micro-breweries to menu items. The restaurant will continue to work hand-in-hand with the brewery by creating specials that are either paired with or, in some cases, made with the beer.

Sustainable Practices: The 1-Mile Beer In November 2011, Black Creek Historic Brewery received the distinction of being the only brewery in North America to brew a 1-mile beer. Using barley and hops grown on-site, a 70-litre batch of beer was brewed without electricity. This project helped highlight the sustainability of Black Creek beer as an agricultural product.

The Brewery in 2012/2013 There are a number of very exciting tourism initiatives that have already started or are in the planning stages for 2012 and 2013, including:

launch of a partnership with Ontario Craft Brewery Tours;

a submission, in partnership with Tourism Toronto, Ontario Culinary Tourism

Association and Ontario Craft Brewery Tours, to include Black Creek Historic Brewery (with two other local micro-breweries) in the Canadian Tourism Signatures Experience Collection program, which will market packages to international travelers;acceptance of three new specialty beers into the LCBO, bringing the total listings to six;

procurement of a new refrigerator to meet increased demand for on-site growler sales.

The new tourism initiatives coupled with the LCBO program will continue to help drive the growth of the brewery in 2012. In addition to the aforementioned revenue derived directly from the Brewery program, BCPV realized a 60% increase in general admission revenues from $19,000 in 2010 to $30,585 in 2011 that can be directly attributed to brewery visits. Also, additional revenue of $6,500 was generated through corporate client programming that included the Brewery as part of the package.
