    The procedures to follow if you address the Council are: Council requests that you express your ideas in fiveminutes or less and refrain from any personal attacks or derogatory statements about any City employee, a fellow

    citizen, or anyone else, whether in the audience or not. The Mayor will limit discussion whenever he deems suchan action appropriate to the proper conduct of the meeting. At the conclusion of an open call to the public,individual members of the Council may respond to criticism made by those who have addressed the Council, mayask Staff to review a matter, or may ask that a matter be put on a future agenda. However, members of theCouncil shall not discuss or take legal action on any matters during an open call to the public unless the mattersare properly noticed for discussion and legal action.

    7.0 Public Hearings7.1 The Mayor and City Council shall hear public comment regarding Rezoning case # ZON10-01 and Site

    Plan Review case # SPR10-01: Christian Services Association is requesting approval of a Zone change, ofthe underlying zoning from General Rural (GR) to General Business Zone (CB-2) over the entire 0.7 acreof the property. The applicant is also requesting review and approval of the Site Plan, Landscape andElevations for the proposed XP media building. The proposed developments consist of a two (2) story9,048 SF building. The site is located on the northeast corner of Hathaway Rd and Justin Dr and withinthe City of Maricopa limits; more specifically parcel # 510-19-027 and 510-19-028.

    8.1 Award of Contract. The Mayor and City Council shall discuss and possibly take action on approvinga request by Acting Fire Chief Wade Brannon to award a contract to Arrington Watkins Architects in theamount of $145,000 to be paid from the Grants Fund, Public Safety Administration, Technical Services(220-42300-320). This contract will be funded through Ak-Chin Indian Community State SharedRevenue Funds awarded to the City and is in compliance with the City of Maricopa City PurchasingCode, Sections 3-4-4(E) and 3-4-7, lowest responsive bidder. There is no city match requirement.Discussion and Action.

    8.2

    Resolution 10-10. A Resolution of the Mayor and City Council of the City of Maricopa, Arizona,adopting a Fair Housing policy, making known its commitment to the principle of fair housing, anddescribing actions it shall undertake to affirmatively further fair housing. Discussion and Action.

    8.3 Approval of Agreement. The Mayor and City Council shall discuss and possibly take action onapproving a request by Public Safety Director Patrick Melvin to approve a revision of the RegionalWireless Cooperative Intergovernmental Agreement and exhibits A&B which address asset ownershipand organization in order to maintain fair and equitable treatment to all members and not be a barrierto potential new entrants to the Cooperative and authorize the City Manager to execute all necessarydocuments. Discussion and Action.

    8.4 Grant Acceptance. The Mayor and City Council shall discuss and possibly take action on approving arequest by Grants Manager Mary Witkofski to accept a grant award of $1,290 and $3,238 and designatethe City Manager and Public Safety Director to sign the contracts from the Governors Office of HighwaySafety for Enforcing Underage Drinking Laws through the Office of Juvenile Justice and Delinquency

    Prevention. Discussion and Action.

    8.5 Resolution 10-11. A Resolution of the Mayor and City Council of the City of Maricopa, Arizona,accepting public improvements and maintenance responsibility for the landscaping within the right-of-way of Maricopa-Casa Grande Highway at The Wells. Discussion and Action.

    8.6 Donation of Easement. The Mayor and City Council shall discuss and possibly take action onapproving a request by Development Services Director Brent Billingsley to accept donation of aneasement from the Maricopa Rotary Club for public road purposes including the right to lay, construct,repair and maintain roadway, together with the right of ingress and egress to and from said easementlocated at Plainview Avenue and the Maricopa-Casa Grande Highway. Discussion and Action.

    8.7 Resolution 10-12. A Resolution of the Mayor and City Council of the City of Maricopa, Arizona,allowing the expenditure of Transportation Development Impact Fee funds in the amount of $200,000to fund a traffic signal at the intersection of Porter Road and Smith-Enke Road. Discussion and

    Action.

    8.8 Approval of Expenditure. The Mayor and City Council shall discuss and possibly take action onapproving a request by Transportation Manager Chris Salas and Purchasing Manager Dennis Kirklandon the approval of expenditures exceeding $25,000 pursuant to the City of Maricopa Purchasing Code,Section 3-4-3 (D) and Section 3-4-4 (E). This approval relates to the purchase of traffic signal poles,mast arms and luminaire arms for signals at the intersections of Porter Road and Smith-Enke Road andPorter Road and Adams Way. The expenditures that are anticipated by this approval shall all becompleted under the current fiscal year budget as approved.

    9.1 PSPRS Board. The Mayor and City Council shall discuss and possibly take action on action onappointing one (1) citizen to fill the interim vacancy on the Public Safety Personnel Retirement System(PSPRS) Board. Discussion and Action.

    9.2 P&Z Comm ission. The Mayor and City Council shall discuss and possibly take action on appointingone (1) citizen to fill the interim vacancy on the Planning & Zoning (P&Z) Commission. Discussionand Action.

    9.3 PRL Comm ittee. The Mayor and City Council shall discuss and possibly take action on appointingthree (3) citizens to fill the interim vacancies on the Parks, Recreation and Libraries (PRL) Committee.

    9.4 TAC Committee. The Mayor and City Council shall discuss and possibly take action on opening upthe recruitment to fill one (1) interim vacancy on the Transportation Advisory Committee (TAC).Discussion and Action.

    9.5 Approval of Purchase. The Mayor and City Council shall discuss and possibly take action onapproving a request by Fleet Manager Ray Arrellin to approve the purchase of two (2) solar poweredmessage boards for the Public Works Division in an amount of $33,390 to be paid from the HighwayUsers Revenue Fund, Public Works, Machinery (200-43120-741) based on the Arizona Department ofTransportation contract No. T07590004 with Ver-Mac, and is in compliance with the City of MaricopaPurchasing Code, Section 3-4-14. Discussion and Action.

    9.6 Ordinance 10-02. An Ordinance of the Mayor and City Council of the City of Maricopa, Arizona,zoning certain property described in zoning case ZON10-01 and Site Plan Review case SPR10-01 for

    approximately 0.7 acres generally situated on the northeast corner of Hathaway Road and Justin Drivewithin the City of Maricopa limits; more specifically parcel #510-19-027 and 510-19-028. Discussionand Action.

    9.7 Resolution 10-13. A Resolution of the Mayor and City Council of the City of Maricopa, Arizona,declaring as a public record that certain document filed with the City Clerk and entitled Chapter 19Graffiti amending City Code of the City of Maricopa, Arizona. Discussion and Action.

    9.8 Ordinance 10-03. An Ordinance of the Mayor and City Council of the City of Maricopa, Arizona,adopting Chapter 19 Graffiti by reference as sections 19-1 through 19-41 of the Maricopa City Code andrepealing article 10-2 of the Maricopa City Code and providing for severability and the effective datethereof. Discussion and Action.

    9.9 Resolution 10-14. A Resolution of the Mayor and City Council of the City of Maricopa, Arizona,declaring the City of Maricopa to be a graffiti free zone. Discussion and Action.

    10.0 Executive Session10.1 The Maricopa City Council may go into executive session for purpose of obtaining legal advice from the

    Citys Attorney on any of the above agenda items pursuant to A.R.S. 38-431.03 (A)(3).

    10.2 The Maricopa City Council may go into executive session for purpose of obtaining legal advice from theCitys attorney and to consider its position and instruct representatives regarding negotiations for thepurchase, sale or lease of real property pursuant to A.R.S. 38-431.03 (A)(3) and (A)(7).

    The Maricopa City Council may go into executive session for purpose of discussion or consultation withthe City Attorney to consider its position and instruct its attorney regarding the public bodys positionregarding entering into an agreement with EPS Group, Inc. for a Major Investment Study and thepotential terms thereof, pursuant to A.R.S. 38-431.03(A)(4).
