recommendationsforpoliciesthatencouragesustainabledesignandbuildingconstruction.This

1. INTRODUCTION
MemphisandShelbyCountycontinuetorankamongthehighestenergyusersper
capitaintheUnitedStates.Withenergypricesrisingoverthelongterm,itisimperative
thatthistrendbereversed.Havingtoallocateadisproportionateamountofincometo
coverthecostofenergyconsumptioncanhaveadetrimentalfinancialimpactonour
economicprosperityandtheresourcesofindividualsandfamilieswithinour
community.
OurCityandCountymustalsobevigilantaboutbalancingitsnaturalassetsagainst
environmentalandsustainabilityconcerns.Thisregionhassomeofthebestqualityand
abundantquantityofpotablewaterintheUnitedStates.However,longterm
conservationisimperativetosustainingtheresources.
Ourgovernmentofficialshaverecognizedtheneedforstrongerpoliciestoencourage
sustainablepracticesfortheimprovementofthelifeofthecommunity,aswellasthe
protectionofregionalenvironmentalassets.Thechangesinpolicycanprescribethe
localcodestoenforcesustainablepracticesinthepublicandprivatesectorsofthe
buildingindustry,engagingboththeprofessionalandtheconsumer.
ThetaskoftheGreenBuildingTaskForce(GBTF)andtheConsultingTeamwasto
evaluatetheMemphis&ShelbyCountyExistingBuildingCodesandPermitting
Procedureswiththeaimtoprovidepolicyrecommendations.Theevaluationand
recommendationsanalysis,summedupinthisFinalRecommendationsReport,will
serveasatooltomaximizetheinclusionofavarietyofsustainabledevelopmentparametersthatcoulddirectly(e.g.throughbuildingdesignandoperation)orindirectly
(e.g.throughsitemanagement,landscaping,wateruse,materialselection)impact
energyuse,waterconsumption,andotherenvironmentalconcernsinbuildingand
construction.

OurresearchandanalysisbeganinSeptember2011andwascarriedoutthroughApril
2012.Duringthisperiod,theconsultingteampresentedmonthlyrecommendationsto
theGreenBuildingTaskForceforconsideration.TheGreenBuildingTaskForceinturn
refinedandexpandedthetopicstoachievethefinalrecommendationsreflectedinthis
report.
2. METHODOLOGY
TheConsultingTeamtogetherwiththeGreenBuildingTaskForcecommitteeevaluated
theexistingbuildingcodesandpermittingproceduresunderfourmajormonthlytopics:

x CommercialConstructionNew/Existing(January2012)
x ResidentialConstructionNew/Existing(February2012)
Thegoalofeachtopicalmeetingwastorecommendwaystoremovebarriersthat
inhibitSustainableDevelopmentandtorewardSustainableDesignandConstruction.
Withthisfocusinmind,thetaskforeachtopicwastoidentifytheexistingbarriersastheyrelatetoCodeandProcessandrecommendthepossiblerewardsasmeansof
incentivizingthesustainabledevelopment.Thetotallistofpotentialgreenbuilding
policiesandmeasuresdiscussedincludesapproximately75items.Onekeydirectivewas
toprioritizerecommendationsthathaveaclearandpracticalpathforimplementation.
Accordingly,thegoalwastoselectrecommendationsthatwouldbalancethedesirefor
asignificantgreenbuildingimpactwiththepracticalitiesofimplementation.
3. FINALRECOMMENDATIONS
Basedonthecompiledresearchandteamsexpertise,thefollowingrecommendations
wereproposed:

ThecodeadoptionprocessforIECC2009isalreadywelladvancedandshouldbe
completebymid2012.CodeEnforcementofficialshaveindicatedthattheysupportthe
adoptionprocessandarepreparingtrainingandassociatedactivitiestopreparefor
enforcementofIECC2009.Thiscodecontainsrequirementsforawidevarietyof
energyefficientbuildingstrategiesforbothresidentialandcommercialbuildings
includingwallandroofinsulation,windowsandskylights,lighting,andHVAC

architecturetogeneralcontracting,subcontracting,andmaterialsuppliers(aslongas
localbusinessesareusedfortheseprojects).
Thereareseveralnationalandregionalgreenbuildingprogramsrecognizedbythe
constructionindustryandlocaljurisdictionsthatthelocalcodeenforcementcanadopt:
theU.S.GreenBuildingCouncilsLeadershipinEnergyandEnvironmentalDesign(LEED),
EnterpriseGreenCommunitiesCriteria,GreenGlobe,EnergyStar,EcoBUILDandothers.
Theseprogramsprovideastrongframeworkforsustainabledevelopmentinresidential
andcommercialapplications,aswellasneighborhoodrevitalization.Eachprogramhas
someimplicationontheoverallcostofconstruction.However,thesevarybyanumber
offactors:localclimate,localeconomy,levelsofengagementandgreencertification,siteconditions,etc.
Accordingtothe2009analysisIncrementalCost,MeasurableSavings:EnterpriseGreen
CommunitiesCriteria,theaveragecostofmeetingtheGreenCommunitiesCriteria
increasestheconstructioncostby2.1%(seehttp://www.seattle.gov/dpd/cms/groups/
pan/@pan/@sustainableblding/documents/web_informational/dpdp018267.pdfp.4).
The2003reporttoCaliforniasSustainableBuildingTaskForce,TheCostsandFinancialBenefitsofGreenBuildings,showsarangeofbuildingcostincreaseforLEEDcertified
buildingsrangingfrom0.6%forLevel1basiccertificationto6.5%forLevel4Platinum
certification(seehttp://www.usgbc.org/Docs/News/News477.pdfp.15).
TheU.S.GreenBuildingCouncilsLEEDratingsystemhasthebenefitofnationwide
recognitionandisknownforincorporatingabroadrangeofenvironmentalissues(i.e.
waterconservation,wastereduction,indoorairquality,energyefficiency,etc.).However,pursuingactualLEEDcertification,asopposedtousingLEEDasaguidecan
addsoftcost(designanddocumentationfees,LEEDapplicationfees)totheoverall
projectcost.Accordingtothe2003LEEDCostAnalysisbyNorthbridgeEnvironmental

ManagementConsultants,thesoftcostisestimatedtovaryfrom1%to5%ofthetotal
constructioncost(seehttp://www.cleanaircoolplanet.org/for_communities/LEED_links/
AnalyzingtheCostofLEED.pdfp.4).
Besidesapplyinggreenpracticestonewconstruction,itisrecommendedbyGBTFthat
theexistingMemphisandShelbyCountygovernmentbuildingsreceivegreenretrofits,
suchasenergyefficientmechanicalandelectricalsystems,waterefficientplumbing
fixtures,environmentalfriendlyfinishesandfurnishings,upgradesofbuildingenvelope,
increasingofnaturaldaylighting,etc.Thiswoulddemonstratethatlocalgovernmentis
consciousoftheneedforconservationofenergy,waterandothernaturalresourcesas
wellasaproperwastemanagement.Retrofittingofexistingbuildingswouldalsohelpthepublicunderstandthatsustainabilitycanbeachievedinavarietyofways.Thegreen
retrofitpolicywouldpromotethedevelopmentoflocalexpertiseinauditing,
accompaniedbypublicawarenesscampaignstomaximizetheeducationalbenefitsof
theinvestments.
Recommendation2
ResidentialExpandtheEcoBUILDprogramwithabroadersetofgreenmeasures,
andadoptatimelineforconvertingitfromavoluntaryprogramtoamandatory
program.
Forresidentialbuildings,theGBTFrecommendsbuildingonthesuccessofMLGWs
EcoBUILDprogramtoadvancegreenbuildinginMemphisandShelbyCounty.The
researchshows,thatthemostsuccessfulregionalgreenbuildingprogramshavebegun
withlocalutilitybasedgreenincentiveprogramssimilartoEcoBUILD(e.g.AustinEnergy
GreenBuildingofAustin,TXorTheColoradoGreenBuildingGuildofBoulder,CO).
EcoBUILDisasuccessfullocalprogramwithaclearimplementationpaththathas
engageddozensoflocalhomebuildersandhascertifiedhundredsoflocalhomessince
itsinitiationin2004.ThestatisticsshowthatEcoBUILDhousesare30%moreenergy
efficientthanthosebuilttoexistingIECC2003standards(seehttp://www.mlgw.com/

residential/ecobuildresidential).TheprogramisfinanciallysupportedbyMLGWandits
implementationlessensthestressonthelocalCodeEnforcementdivision.
WhileEcoBUILDisfocusedlargelyonenergyefficiencymeasures,itincludesafewgreen
itemssuchasuseofrecycledmaterialsforroofdecking,trimboardorinsulation,useof
interiorfinishessuchaspaintsandstainswithlowvolatileorganiccompounds(VOC),
anduseofnativeoradaptedplantstoreducelandscapewatering.TheGBTFproposes
addingthefollowingitems,subjecttoapprovalbyMLGW:
x RequiringWaterSenselabelofapplicableplumbingfixtures
x RequiringEnergyStarAppliances,suchaswasher,refrigerator,etc.
x
Requiringuseofirrigationcontrolsforwaterconservation
MLGWevaluatesandupgradestheEcoBUILDprogrameachtimenewcodesare
adoptedorchangesareappropriateduetonewtechnologyandotherfactors.The
GreenBuildingTaskForcerecommendscontinuingthistrendinthefuturetokeepthe
EcoBUILDprogramcurrentandontheleadingedgeofenergyconservationand
sustainability.
TheGBTFrecommendstransitioningEcoBUILDfromavoluntarytoamandatoryprogramovertime.Thestatisticsindicate,thatwhiletheaverageincreaseof
constructioncostassociatedwithbuildingtoEcoBUILDstandardsrangefrom1.5%to
3%,theaverageannualenergysavingsequalto30%(seehttp://www.mlgw.com/
residential/ecobuildresidential).Ittakestimeforthemarketplacetobecomefamiliar
withthecriteriaofagreenbuildingprogram.Byprovidingatimeframewithinwhichthe
requirementwillbecomeactivegivesthelocalbuildingindustrysubstantialincentiveto

WelearnedfromEcoBUILDprogramstaffthatdevelopingacommercialprogramisvery
complicatedgiventheneedtotestenergyefficiencymeasuresforanacceptable
paybackperiodinthewidediversityofcommercialbuildingtypes.Also,performance
verificationofenergymeasuresismuchmorecomplicatedforcommercialbuildings
giventhevariedtypesandsizesofHVACsystemsusedincommercialbuildings.In
addition,adopting2009IECCwillbegintoimprovetheefficiencyofShelbyCounty
commercialbuildings.
Wherefeasible,theGBTFproposesselectingmeasuresfromtheInternationalGreen
ConstructionCode(IgCC)inordertobuildfamiliaritywiththisnationalcodeinthelocal
marketplace.NotethatIgCCappliestocommercialbuildingsonly.Recommendedno
costmeasuresfromtheIgCCinclude:

departments.NashvilleusesAccelaKivasoftwareandFranklinismigratingfroman
inhousesystemtoIDTPlans.KnoxvilleusesPermitsPlusandknoxplans/project
doxtotrackallreviews.Inonespecificcity,anydepartmentissuingapermitorsigning
offonapermitcandosointhesystem;thisincludestheirHealthDepartment,Public
Works,Assessor,Historic,andWaterServices.Thesystemalsogeneratespublichearing
notices,letters,andcouncillegislationasanaddedbenefit.Atrackingsystemisonewaytostreamlineandclarifythereviewprocesssodevelopersanddesignersknow
wheretheirdocumentsareinthereviewprocess.Thiscouldmakedoingbusinessin
MemphisandShelbyCountyeasier.
4 CONCLUSION
TheGreenBuildingTaskForcetogetherwiththeConsultingTeamwouldliketothank
theMemphisandShelbyCountyGovernmentleadersfortheopportunitytobepartofthisactionplanforgreenbuildinginMemphisandShelbyCounty.Werecognizedthe
needforadvancingourregioninsustainablebuildingpracticesandwehopethatthe
