Merced Community College District Board of Trustees meeting held March 10, 2015 1. 1. Public Session Call to Order The Board President (Dennis Jordan) called the meeting to order at 5:01 p.m. The meeting was held in the Margaret M. Randolph Board Room on the Merced College Campus in Merced.

2. Hearing of the Public An opportunity was provided for members of the public to address the Board on matters of general district business. Charlie Bennett, Cody Camacho, Claudia Gonzalez, Ayesha Nunes, Lou Ferguson, Dolores Ross, and two other individuals expressed their views regarding Dr. Everett Lovelace. Members Present: Dennis Jordan, Joe Gutierrez, Gary Arzamendi, Cindy Lashbrook, Wayne Hicks, Jean Upton, Leonel Villarreal, Katie Morrill Others Present: Ronald C. Taylor, Mary Gilliland, Chris Vitelli, Patrick Mitchell (MCFA), Charlene Reed (Classified Senate), Kristi Wolf (CSEA), Chuck Hergenraeder (Management Association), Cody Camacho (ASMC), Karen Fritz, Michael Barba, Jagjit Hundal, Joe Allison, Stacey Hicks (Recording Secretary) Trustee Gutierrez led the Pledge of Allegiance. Vice President Gutierrez reported that no action was taken in closed session.

5. Hearing of the Public An opportunity was provided for members of the public to address the Board on matters of general district business. Martin Thompson from the Merced Bicycle Club thanked the Board for the use of the parking facilities they utilize during their workouts. He requested to have the bike rack that is close to the track moved so it is more visible from the track and for it to be permanently installed.

6. Additions and/or Changes to the Agenda None.

7. Granting of Tenure Vice President Vitelli introduced Professor Raul Alcala who is being recommended for tenure tonight. Dr. Gilliland introduced Professors William Baker, Louisa Benhissen, Scott Coahran, Joselle Merritt, Suzzette Norris, Keri Ortiz, Alana Perlin, Wanda Schindler, Laura Strait, and Brandon Tenn who are being recommended for tenure tonight.

Trustee Jordan rejoined the meeting. MSC (Hicks/Arzamendi) to approve Raul Alcala, William Baker, Louisa Benhissen, Scott Coahran, Joselle Merritt, Suzzette Norris, Keri Ortiz, Alana Perlin, Wanda Schindler, Laura Strait, and Brandon Tenn for tenure. The student advisory vote was aye.

A short break was taken so the Board could congratulate the tenured faculty.

8. Presentations a. February Student of the Month

Professor Karen Fritz introduced Professor Michael Barba who nominated the February student of the month, Jagjit Hundal.

Ms. Hundal thanked Professor Barba and her family for their support.

9. Constituent Reports a. From Academic Senate

Dee Sigismond congratulated the faculty who were granted tenure. The discontinuance of the corrections program was approved. Two brown bag lunches will be held to discuss mapping outcomes and distance education.

b. From Faculty Association Patrick Mitchell congratulated the newly tenured faculty and shared his view on the importance of tenure. He shared success stories from Professors Scott Coahran, Kristin Rigg, Caren Col-Hamm, and TAACCCT Director, Autumn Gardia. He also said MCFA is looking forward to negotiations.

c. From Classified Senate Charlene Reed informed the Board of the upcoming Classified Staff Development event on April 9.

d. From CSEA Kristi Wolf said CSEA week is May 17 through the 23 and invited the Board to the events during the week. CSEA will be holding a “Know your contract” class during the classified staff development day. Five job descriptions will be voted on next week. CSEA is sponsoring a table at the State of the College luncheon.

e. From Management Association Chuck Hergenraeder said the last meeting of the Management Association included review of the new CSEA contract. The next meeting is this Thursday where there will be discussion of growth strategies and growth formula. The next Emerging Leaders Institute class will be on March 26.

f. From ASMC Cody Camacho shared some exciting upcoming student activities and fundraisers. ASMC continues to move forward with their sustainability challenge. Discussions have begun regarding open source textbooks and competency based learning.

10. Consideration of Consent Agenda MSC (Hicks/Gutierrez) to approve the consent agenda items as summarized below. The student advisory vote was aye.

11. To the Board for Discussions and/or Action

a. Amending the Conflict of Interest Code to Revise and Update the List of Designated Positions and Disclosure Categories Dr. Taylor explained the purpose for amending the conflict of interest code. Every two years the code must be reviewed for updates. MSC (Hicks/Lashbrook) to adopt Resolution 15-73 authorizing the amending of the Conflict of Interest Code. The student advisory vote was aye.

b. Resolution Honoring Women’s History Month Dr. Taylor brought attention to the resolution in the packet providing the history of honoring women’s history month. MSC (Arzamendi/Hicks) to adopt Resolution 15-74 to honor Women’s History month in March 2015. The student advisory vote was aye.

12. To the Board for Information

a. Quarterly Financial Status Report 2014-15 Fiscal Year; Quarter Ended December 31, 2014 Joe Allison reviewed the information on the Quarterly Financial Status Report for the 2014-15 Fiscal Year; Quarter Ended December 31, 2014.

b. CCCT Board Election for 2015 Dr. Taylor said the Board will need to vote on the slate of nominees at the April meeting. If any Trustee has preferences for nominees, please provide them to Dr. Taylor as soon as possible.

c. Board Policy and Administrative Procedure 3810 – Claims Against the District Dr. Taylor explained this policy was revised by legal counsel and the changes are quite extensive. This will come back at the April meeting for approval.

d. District Openers with MCFA Chapter 770 Dr. Taylor reviewed the list of openers that the District is proposing with MCFA. The Board will be asked to approve this list at the April meeting.

f. Update from Vice President of Instruction

Dr. Gilliland provided an update on enrollment numbers. Conversations to move forward with prison education are happening with the facilities in Chowchilla. The curriculum committee had a technical assistance visit last week which was very helpful and positive. ACCJC gave approval for substantive change in digital arts. The annual report is being prepared and it is on target to be submitted by the deadline.

g. Update from Vice President of Student Services Vice President Vitelli gave information on the two high school visits which have recently occurred. There are more visits coming up and he hopes Trustees can attend them with administration. Registration begins in April for the fall semester. He updated the Board on the activities happening for the student equity initiative.

13. Reports a. From Board Members

Trustee Villarreal sent good thoughts for Trustee Jordan’s son-in-law and expressed his condolences for the loss of Gene Mena, classified employee, at the Los Banos campus.

Trustee Upton congratulated the newly tenured faculty. She reminded everyone of the State of the College luncheon on April 17. She hopes the issue of the bicycle rack at the track can be addressed soon. She enjoyed the visit to Chowchilla High School. Trustee Morrill shared a list of upcoming student events. She thanked the Board for supporting and helping students. Trustee Lashbrook stated the plant sale is March 28. She looks forward to attending some of the upcoming high school visits. She shared a success story of a Merced College alumnus. Trustee Hicks welcomed Trustee Arzamendi back and is glad to see him in good health. He thanked everyone for their help in running an orderly and timely meeting tonight. Trustee Gutierrez congratulated the newly tenured faculty and the student of the month. He thanked everyone for their reports tonight. He sent his thoughts to Gene Mena’s family and to Trustee Jordan’s son-in-law. He also welcomed Trustee Arzamendi back. Trustee Arzamendi said it is good to be back. He congratulated the newly tenured faculty. He is excited about the high school visits and the information about enrollment. He expressed good thoughts for Trustee Jordan’s son-in-law.

Trustee Jordan echoed his fellow trustees’ comments. He continues to be impressed by all the staff of Merced College. He encouraged everyone to continue the good work. He thanked everyone for the thoughts for his son-in-law.

b. Superintendent’s Report Dr. Taylor shared the news of a former trustee, Marian Ciriscioli, passing away in January. He said the memorial service for Gene Mena will be held on Friday, March 20. An account has been established by Dean Latham and if anyone is interested in donating to the fund, please contact her for information. He attended the Phi Theta Kappa induction ceremony this past Saturday. He encouraged everyone to donate to the Alpha Gamma Sigma fundraising effort. The next Excellence in Trusteeship workshop is coming up at Monterey Peninsula College. The MCSBA spring dinner is happening soon and he encouraged trustees to attend.

14. Future Discussion Items from Board Members Trustee Upton would like an update on the bicycle rack issue brought up tonight. Trustee Hicks would like to continue to get updates on the high school visits and to invite Vice President Vitelli to next year’s MCOE conference. Trustee Lashbrook requests an update on hiring processes and diversity of staff.

15. Second Closed Session

President Jordan reported out of the second closed session that the Governing Board voted seven ayes to zero no to not renew the employment of the Dean of Student Services effective July 1, 2015.

16. Adjournment The meeting was adjourned at 10:24 p.m.

Declaring the Week of May 17-23, 2015 as

Classified School Employee Week in the

Merced Community College District

WHEREAS, classified school employees provide valuable services to the schools and students of the Merced Community College District; and

WHEREAS, classified school employees contribute to the establishment and promotion of a positive instructional environment; and

WHEREAS, classified school employees play a vital role in providing for the welfare and safety of Merced Community College District's students; and

WHEREAS, classified school employees employed by the Merced Community College District strive for excellence in all areas relative to the educational community;

THEREFORE BE IT RESOLVED, that the Merced Community College District hereby recognizes and wishes to honor the contribution of the classified school employees to quality education in the state of California and in the Merced Community College District and declares the week of May 17-23, 2015 as Classified School Employee Week in the Merced Community College District.

BOARD POLICY 3810 CLAIMS AGAINST THE DISTRICT Reference: Education Code Sections 72500 & 72502; Government Code Sections 800, 810 et seq, 900 et seq., 910, 946.4, &

53051 Any and all claims for money or damages against the District for money or damages, which are not governed by any other statutes or regulations expressly relating thereto, shall must be presented and acted upon in accordance with Title I, Division 3.6, Part 3, Chapter 1 (commencing with Section 900) and Chapter 2 (commencing with Section 910) of the California Government Code. the following procedures. Compliance with these procedures is a prerequisite to any court action, unless the claim is governed by statutes or regulations which expressly free the claimant from the obligation to comply with this policy and the claims procedures set forth in Government Code Section 900, et seq. Claims must be presented according to this policy as a prerequisite to filing suit against the District. Claims that are not subject to the requirements of this policy include, but are not limited to, the following:

• Claims by public entities: claims by the state or by a state department or agency or by another public entity.

• Claims for fees, wages and allowances: claims for fees, salaries or wages,

mileage, or other expenses and allowances. The designated place for service of claims, lawsuits or other types of legal process upon the District is: Merced Community College District Vice President Administrative Services 3600 M Street Merced, CA 95348

1. Claims for money or damages relating to a cause of action for death or for injury to person, personal property, or growing crops shall be presented to the Board not later than six months after the accrual of the cause of action. (Government Code Sections 905, 911.2)

2. Claims for money or damages as authorized in Government Code Section 905 and not included in paragraph 1 above shall be filed not later than one

3. Claims for money or damages specifically excepted from Government Code Section 905, including but not limited to claims by public employees for fees, salaries, wages, mileage, or other expenses and allowances, shall be filed not later than one year after the accrual of the cause of action. (Government Code Sections 905, 911.2, 935)

Late Claims

Claims under paragraph 1 above that are presented later than six months after the accrual of the cause of action, shall present, along with the claim, an application to file a late claim. Such claim and application to file a late claim must be filed not later than one year after the accrual of the cause of action. If a claim under paragraph 1 is filed later than six months after the accrual of the cause of action and is not accompanied by the application, the Governing Board or the Superintendent/President, or designee, shall, within forty-five (45) days, give written notice that the claim was not filed timely and that it is being returned without further action.

The application shall state the reason for the delay in presenting the claim. The Governing Board, shall grant or deny the application within 45 days after it is presented. By mutual agreement of the claimant and the Superintendent/President, or designee, this 45-day period may be extended by written agreement made before the expiration of such period. If the Governing Board does not take action on the application within 45 days, it shall be deemed to have been denied on the 45th day unless such time period has been extended, in which case it shall be denied on the last day of the period specified in the extension agreement.

If the application to present a late claim is denied, the claimant shall be given notice in substantially the following form:

Delivery and Form of Claim

A claim, any amendment thereto, or an application for leave to present a late claim shall be deemed presented when delivered to the office of the Superintendent/President, or deposited in a post office, sub-post office, substation, or mail chute or other like facility maintained by the U.S. Government, in a sealed envelope properly addressed to the District office with postage paid. (Government Code Sections 915, 915.2)

Notice of Claim Insufficiency

The Superintendent/President or designee shall review all claims for sufficiency of information. The Superintendent/President or designee may, within twenty (20) days of receipt of claim, either personally deliver or mail to claimant a notice stating deficiencies in the claim presented. If such notice is delivered or sent to the claimant, the Governing Board shall not act upon the claim until at least fifteen (15) days after such notice is sent. (Government Code Sections 910.8, 915.4)

Amendments to Claim

Claims may be amended within the time limits specified in Section 1, above, or prior to final action by the Governing Board whichever is later, if the claim, as amended, relates to the same transaction or occurrence which gave rise to the original claim.

Action on Claim

Within forty-five (45) days after the presentation or amendment of a claim, the Governing Board shall take action on the claim. (Government Code Section 912.4) This time limit may be extended by written agreement before the expiration of the 45-day period, or after the expiration of the 45 day period if an action based on the claim has not been commenced and is not yet barred by the period of limitations provided in Section 945.6. (Government Code Section 912.4) The President or designee shall transmit to the claimant a notice of action taken. (Government Code Section 913) If no action is taken within the prescribed time limits, the claim shall be deemed to have been rejected and the claimant notified in accordance with Government Code Section 913. (Government Code Section 945.6)

Retroactivity of this Policy

This policy is intended to apply retroactively to any existing causes of action and/or claims for money and/or damages.

Roster of Public Agencies

The Superintendent/President or designee shall assure that all information regarding the District is filed accurately with the Roster of Public Agencies in the office of the Secretary of State and the County Clerk. Any changes to such information shall be filed within 10 days after the change in facts.

The verified information shall include the full legal name of the District, the mailing address of the Board, and the names and business addresses of each member of the Board, and the name, title, and business address of the Board President, and clerk or secretary of the Board. Pursuant to the CCCT Board Governing Policies, the election of members of the CCCT board of the League will take place between March 10 and April25. This year there are seven (7) seats up for re­election on the board; one of those seven is a vacancy created by a board member that was notre­elected at the district level in November.

Each community college district governing board shall have one vote for each of the seven seats on the CCCT board. Only one vote may be cast for any nominee or write-in candidate. The seven candidates who receive the most votes will serve a three-year term.

The ten trustees who have been nominated for election to the board are listed on the enclosed sheet in the Secretary of State's random drawing order of January 26, 2015. An official ballot for the election is also enclosed in this mailing to each community college district governing board, as well as copies of the statement of candidacy and biographic sketch form of each of the candidates. Candidates' statements and bios will also be available on the League's website (www.ccleague.org).

Please remember that:

1) ballots must he signed by the board secretary and board president or vice-president and also include the name of the district; and

2) ballot return envelopes must have no identifying information or signatures.

Although it is not required, you may want to send your ballots via certified mail as we will not have the ability to confirm receipt. Official ballots must be signed and returned to the CCCT Elections Committee, League office, with a USPS postmarked no later than April25. A self-addressed return envelope is enclosed for your convenience. Faxed ballots will not be accepted. The ballots will be opened and counted by three tellers appointed by the CCCT board president and the results announced at the CCCT Annual Conference, May 1 ~ 3 in Monterey.

Background Information

Pursuant to Education Code Section 15278, the District established the Citizens’ Bond Oversight Committee at a Board of Trustees Meeting held on February 4, 2003, in order to satisfy the accountability requirements of Proposition 39. The Board of Trustees adopted the Citizens’ Oversight Committee Bylaws, setting forth the duties and rights of the Committee, at a meeting held on June 17, 2003.

The purpose of the committee is to “inform the public concerning the expenditure of bond revenues.” The committee is charged with reviewing the expenditure of revenue to ensure the bond revenues are expended in compliance with the purposes of the bond and the requirements of Proposition 39. After a thorough membership campaign, the following members are recommended for approval:

Item: Request to Award Bid for Proposition 39 Project HVAC Bid #2015-03 Presented By: Joanne Schultz For: Information Action X Background Information Proposition 39, the California Clean Energy Jobs Act, passed on November 6, 2012. SB 73 establishes that eleven percent of the funds deposited annually into the Clean Energy Job Creation Fund be allocated to the California Community College Chancellor’s Office to be made available to community college districts for energy efficiency upgrades and clean energy installations. On May 14, 2013, the Board of Trustees was advised about the passage of Proposition 39, the California Clean Energy Jobs Act. Administration worked closely with Merced Irrigation District and Pacific Gas and Electric Representatives to identify potential Proposition 39 projects. Whenever possible, Proposition 39 funding was offset by any allowable utility rebates, which provided additional funding for projects. One of the approved projects was for the replacement of various HVAC units throughout the Merced campus. . As required by Public Contract Code 22000, Administration conducted a competitive bidding for the project, and formal requests for bids were issued and advertised through the Merced Sun Star, and three separate builders’ exchanges. In addition, Administration sent copies of the bid documents to the HVAC bidders on the District’s California Uniform Construction Cost Accounting Act vendor list. Below are details of this project:

Project Cost HVAC BID #2015-03 (33) units. Replace thirty-three units throughout the Merced Campus. Units being replaced are obsolete; original installing company is no longer in operation. New units will offer:

• Improved Reliability • More efficient use of resources and energy • Assist in moving towards standardization in HVAC units • Ensure that students will have adequate cooling

A public bid opening took place on Thursday, March 12, 2015 at 2:00 p.m. There were four bids received, EMCOR was the lowest responsive bidder for the project. The successful bidder of the project must have the project completed by June 20, 2015, as set forth in the Bid Documents. Item: Selection of Independent Audit Firm with Gilbert Associates Presented By: Joanne Schultz For: Information Action X Background Information: Staff engaged in a Request for Proposal (RFP) process for the purpose of selecting an independent audit firm to conduct the annual District and Bond audits and Foundation tax return. The agreement is for a term of three (3) years with the possibility of two (2) additional years, including a cancellation clause upon written notification by either party prior to January 15 each year. RFP’s were sent to eighteen (18) firms which had expressed an interest in providing audit services or were known to have relevant community college auditing experience. Seven (7) audit firms submitted proposals. The proposals were evaluated by staff based on the criteria listed below: • Appropriateness and adequacy of proposed procedures • Reasonableness of time estimates • Appropriateness of assigned staff. The proposal identifies the principal engagement

supervisory and management staff: a. partner, b. Manager/In Charge c. Specialist • Timeliness of expected completion dates • Community College audit experience • Technical and related experience of the firm • Qualifications and experience of staff • Description of the services to be provided • Cost of the work to be performed Upon evaluating each proposal based on the criteria above, four (4) firms were selected for a formal presentation. Each firm was asked to include the following in their presentation: • Experience working with audit committees • Staffing experience with community colleges • Timing of audit process • Audit process philosophy

Based on the criteria from all of the processes, staff recommends engaging Gilbert Associates. Their experience with audit committees, risk based audit approach, and detailed transition plan were areas where they excelled. They will provide an independent audit of the Foundation, District’s books, accounts, financial records and financial statements for accuracy and compliance to all State and Federal statutes; and, an independent performance audit and financial audit on Measures H and J.

Recommendation: It is recommended that the Board of Trustees approve entering into an agreement with Gilbert Associates.

For: Information X Action Background Information Pursuant to Education Code Section 15278, the District established the Citizens’ Bond Oversight Committee at a Board of Trustees Meeting held on February 4, 2003, in order to satisfy the accountability requirements of Proposition 39. The Board of Trustees adopted the Citizens’ Oversight Committee Bylaws, setting forth the duties and rights of the Committee, at a meeting held on June 17, 2003. The Board of Trustees approved the current committee membership at its April 5, 2011 Meeting. The role of the Citizens’ Oversight Committee is to inform the public concerning the District’s expenditure of revenues received from the sale of bonds, authorized by the voters in the county primary election of November 2002. To satisfy one of the requirements of Proposition 39, the Bond Oversight Committee prepares and distributes an annual report. This annual report is for the fiscal year 2013-14 and reflects expenditures through June 30, 2014. Recommended/Requested Action This item is presented as information. Statement of Compliance

This 2013-14 Annual Report is submitted to the Board of Trustees by the Merced Community

College District Proposition 39 Citizens' Bond Oversight Committee.

This Committee advises that, to the best of its knowledge, the Merced Community College

District is in compliance with the requirements in Article XIII, Section 1 (b) (3} of the California

Constitution. In particular, bond revenue has been expended only for the purposes so described

in Measures H and J, as prohibited by Article XIIA, Section 1 (b) (3} (a} of the California

Constitution; no funds were used for any teacher or administrative salaries or other operating

expenses.

• The Governor has proposed $500M to implement an Adult Education Block Grant to increase adult education course offerings. It is expected that funds will be disbursed directly to K12 districts and subsequently allocated to consortium groups by joint approval of the Community College Chancellor and Superintendent of Public Instruction. Future budget years may provide funding directly to community colleges.

• The Governor intends to provide an additional $100M for the Student Success and Support Program (SSSP), plus $100M for Student Equity Plans. At this time, the state has not provided any information regarding the required local match.

Analysis of assessment and program review has identified gaps in the process. There has been a push to increase participation in both. Academic Senate resolved to support the Office of Instruction not offering any sections of courses not current with Title 5 policies, assessment of courses and programs. The result is a push across the college to make

need for the community. On a brighter note, assessment of the Radiologic Technology program at the college highlighted that students with low GPAs (less than 2.75) in the prerequisites were most likely to drop out of the program. As a result of this analysis, they have changed the minimum GPA from 2.35 to 2.75 for new applicants starting in summer 2014. Students on the waitlist for the RT program were given a year to improve their GPA. Results from the last cohort with the lower GPA prerequisite indicate that withdrawals from the program for academic weakness further support the intent of the increase in the prerequisite GPA for admission to the program.

This process has resulted in changes to students curricula, and also the assessment process itself. The registered nursing program reduced the number of courses within the program without reducing content by

!, eliminating redundancy within curriculum. External advisory members and the industry recognized a need for graduates who can think critically. This resulted in a change in the

In addition to the student surveys following the Board of Registered Nursing standards, new rubrics were designed to evaluate effectiveness of student learning using portfolios. At present, Merced College shares SLO assessment results with internal audiences using a variety of methods. CurricUNET has been used to generate reports, and the results from instructional courses and programs were summarized in a newsletter, The SLO Down, produced by the instructional outcomes committee. Course, Program and Institutional SLO

1 assessments have also been reported in a Newsletter from the Academic Senate

l President, the College Newsletter and in the Assessment Review Committee report presented to the College Council and during Convocation. Each area of the College (Instruction, Student Services, Administrative Services), has an oversight committee, with Webpages on the college website, where outcomes reports and discussions by their oversight committees are stored. We have not progressed to the level where we are notifying external audiences about these results, nor considered the audiences, and how

39. cost efficiency of e-transcript delivery; EOPS now offers \"Computing GPA Workshops\" in response to student feedback, and 90% of survey respondents who attended workshops were able to compute a semester GPA; Chemistry aligned al! course SLOs to reflect existing program SLOs. In order to maintain consistency across multiple sections they use common syllabi and a common laboratory report rubric; Foreign languages implemented a

The previous Vice President of Instruction (VPI), Marianne Tortorici, retired on June 30, 2013. An Instructional Dean, Kevin Kistler, was promoted to Interim VPI for the entire 2013-14 fiscal year. The new VPI was hired on July 23, 2014. The previous Vice President of Student Services (VPSS), Anne Newins, also retired on June 30, 2013. The Dean of Student Services, Everett Lovelace, was promoted to Interim VPSS for the entire 2013-14 fiscal year. The new VPSS, Chris Vitelli, was hired on July 7, 2014.

April 2, 2015 TO: Superintendents/Presidents Chief Business Officers Chief Student Services Officers Chief Instructional Officers FROM: Theresa Tena, Vice Chancellor Institutional Effectiveness Division SUBJECT: Requirement and Process for Adopting Institutional Effectiveness (IE) Goals Framework and 2015-16 College IE Goals This memorandum formally notifies colleges/districts of the requirement that each college develop, adopt and post a goals framework as mandated by recently enacted legislation. In addition, this memorandum provides guidance on the process for approving the goals framework, and for adopting and posting the college’s goals. The enacted legislation set ambitious deadlines for implementing this new process, which requires expedited activity at both the local and state levels. In recent weeks, representatives from over 104 colleges attended regional trainings on how to meet these new requirements (materials from these trainings can be found at: (http://extranet.cccco.edu/Divisions/InstitutionalEffectiveness.aspx). Background: Recently enacted legislation established a new system of indicators and goals that is intended to encourage improvement in institutional effectiveness at California community colleges. Pursuant to Education Code section 84754.6, the Board of Governors (BOG) adopted a goals framework at its March 16, 2015 meeting to measure the ongoing condition of a community college’s operational environment (see attached Consultation Digest and BOG Item). This statute also requires that, as a condition of receipt of Student Success and Support Program funds, each college develop, adopt and post a goals framework that addresses, at a minimum, the following four areas: student performance and outcomes, accreditation status, fiscal viability, and programmatic compliance with state and federal guidelines. In addition, it requires that the Chancellor post by June 30, 2015, and before each fiscal year thereafter, the annually developed system wide goals adopted by the BOG, and locally developed and adopted college/district goals. Adopting Framework and Goals: Each college should adopt the framework of indicators approved by the BOG and colleges/districts adopt at least one goal for each of the four areas identified above (see attached “Select Framework of Indicators definitions” document). Colleges/districts may choose to adopt more than one goal for each area; however, in this initial year of implementation, we anticipate that most colleges/districts will adopt only four goals in the following areas:

1) Student performance and outcomes: Course Completion Rate 2) Accreditation status: Accreditation Status 3) Fiscal viability: Fund Balance 4) Compliance with State/Federal guidelines: Overall Audit Opinion

The process that a college uses to adopt the framework and college goals should be locally determined, but colleges are encouraged to ensure that all appropriate constituency groups (e.g. academic senate, classified staff, student senate, etc.) are engaged, consistent with their college’s collegial consultation process.

ISSUE: This item requests approval of a goals framework pursuant to the requirements of Education Code section 84754.6, which was included in the 2014-15 Higher Education Trailer bill. BACKGROUND: The Institutional Effectiveness (IE) Division oversees the development and operation of a comprehensive technical assistance program to further student success at California community colleges. The program aims to identify and scale-up effective practices, provide technical assistance and training, and support colleges facing operational challenges. The program overlays virtually every division of the California Community Colleges Chancellor’s Office—including academic affairs, student services, workforce and economic development, research, and fiscal—and is focused on four primary operational areas: (1) student performance, (2) accreditation, (3) fiscal health, and (4) compliance with state and federal guidelines. In addition to the new division, the state has invested resources to support technical assistance and professional development to be provided through a partnership between a community college district and the Chancellor’s Office. At its November 2014 meeting, the Board of Governors (BOG) awarded the contract to the Santa Clarita Community College District. (Background cont.) RECOMMENDATION: It is recommended the Board of Governors approve the goals framework designed to measure the ongoing condition of a community college’s operational environment.

(Background Cont.) As part of this new program, statute requires the BOG to adopt a goals framework to measure the ongoing condition of a community college’s operational environment focused at a minimum on the four operational areas identified above. To help meet this requirement, the Chancellor’s Office and Santa Clarita Community College District in collaboration with the Statewide Academic Senate created an Institutional Effectiveness Partnership Initiative (IEPI) Advisory Committee, which consists of representatives from more than a dozen statewide organizations. Peer-led resource teams coordinated by Santa Clarita Community College District will use the framework of indicators as one of several measures to assess colleges/districts expressing interest in technical assistance services. The catalyst for this effort has been the Student Success Initiative and its focus on sharing and implementing evidence-based strategies that improve student outcomes and college’s overall effectiveness. The Budget Act of 2014 includes funding for the Chancellor’s Office to implement IEPI. Specifically, statute outlines the following:

• The Chancellor—in coordination with CCC stakeholder groups, fiscal and policy committees of the Legislature, and the Department of Finance—shall develop and the BOG shall adopt a goals framework to measure the ongoing condition of a community college’s operational environment focused at a minimum on the following: Student performance and outcomes Accreditation status Fiscal viability Programmatic compliance with state and federal guidelines

• As a condition of receipt of SSSP funds, each college shall develop, adopt, and post a goals framework that addresses at a minimum the four categories above.

• By June 30, 2015 and before each fiscal year thereafter, the Chancellor shall post both of the following: Annually developed system-wide goals adopted by the BOG Locally developed and adopted college/district goals

• Subject to the availability of funds in the budget, the BOG and Chancellor shall, at a minimum, assess improvement in the four categories and offer assistance.

Analysis The IEPI Advisory Committee met on January 26th, February 5th and March 9th to discuss and recommend a goals framework. The goal in Year One of this effort is to rely upon metrics already collected and reported by colleges and districts. Colleges will develop, adopt, and post by June 30th locally developed and adopted goals using approved metrics.

The attached goals framework is recommended for the 2014-15 fiscal year. It was recognized that these metrics are a starting point and that the list may be revised in the future. The IEPI Advisory Committee will review the list of metrics for the 2015-16 fiscal year and recommend any changes.
